C. PressureControl Equipment:

A 9" 3000 psi WPdouble gatehydraulicBOP with pipe rams and blindrams will be installed on the 8-

5/8" casinghead. The BOP stack will be tested prior to drilling below surface casing. The ram

preventerswillbe tested to 70% ofthe working pressure of the casinghead.The annularwillbe tested

to 50% ofits working pressure. Operationalchecks will be madedailyor on trips. A BOP schematic

is shownon attached Exhibit"AN

The BOP system will be consistent with API RP 53. Pressure tests will be conductedbefore drilling

out from under allcasingstringswhich are set and cemented in place. Blowout preventer controls will

be installedprior to drillingthe surfacecasing plug and will remain in use until the well is completed or

abandoned. Preventerswillbe inspectedand operatedat least daily to ensure good mechanicalworking

order. This inspectionwillbe recorded on the dailydrillingreport. Preventers will be pressure tested

before drilling casingcement plugs. The accumulator system will meet IADC guidelines concerning

pump capacities, storagecapacity,and reservoirvolume. Closingunit fluid volume will be sufficient

to pre-charge the systemto operating pressure plus 50% excess. One set of controls willbe in the

doghouse on the rig floor andone setwillbe remote on the drillingpad.

Surface - Cement will be circulated to the surface. Casing will be cemented withapproximately200 cu. ft of API Class'G' cement.

Production - Casing will be cementedwith approximately 300 cu, ft of API Class 'G'cement. Theactualcementvolumewill be basedupon holedepth and gauge,

and will be determined fromlogs.

Additional additives will be used to retard the cement, accelerate the cement, control lost circulation,

or controlfluid loss. All cementingwill be donein accordancewith API cementingpractices.

E. Mud Program and Circulating Medium:

Fresh water circulatedthrough the reserve pit willbe used for drillingthe 12-1/4" surfacehole to 400'.

An air or air/mist system will be used for drillingfrombelow surfacepipe at 400' to TD.

The mod system will be visually monitored.

A truck-mounted air drillingrig maybe used to drillthe surface hole to 400' and to pre-set the surface

casing beforemovinga drillingrig on location to drill the rest of the hole to TD.

Sufficient mud materialswill be stored at the wellsite to maintain mud requirements and to control

minor well controlor lost circulation

1. Existing Roads: SeeMap A and MapB.

a. Location of proposed well in relation to town or other reference point: Location isapproximately5.8 miles northwestof Orangeville,Utah.

b. Proposed route to location: (See Map "A" for marked access).

c. Location and description of roads in the area:(See Map "A" andMap "B").

d. Plans for improvement and/or maintenanceof existingroads: The existing roads will bemaintained in the sameorbetter conditionasexistedprior to the commencementof operations.

2. Planned Access Roads:

a. The existing and proposed roads will be crowned, ditched or dipped from the existing Countyroad to the location prior to use for movingthe drillingrig onto the site. The maximumdisturbed width will not exceed 30' with an eighteen foot running surface. Dust will becontrolledbythe use ofwater or an approveddust retardant, as directedby the Area Manager.All roads, including access to drillingwater, will be maintained in as good or better conditionthan existing condition.

b. Maximum grades: Maximum grade will be less than 10%.

c. Turnouts: None planned.

d. Location: Access to the location uses an existingroad up to the location. New road that willbe constructed for access off of the existing road is flagged. (See Map B).

e. Drainage: The road surfacewill be centercrownedwith ditcheson each sideof road. Slopeswill have a maximumslopeof 3:1.

f. Therewillbeno culvertsplacedin the ditchwaysduringthe drillingphase ofoperations. Furtherevaluation will be made for the additionsof culvertsif the road is to have long-term use.

g. Surfacematerials(source): Surfacematerialswill most likely not be required to be transportedto the accessroad or drillpadforconstruction purposes. However, if gravel is required,the dirtcontractorwillbe responsiblefor locatingand permittingof any necessary construction material.

O O7. Methods of Handling Waste Disposal:

The reserve pit will be lined.

Produced waste water will be confinedto a lined pit for a period not to exceed90-days after initialproduction.

Trashwillbe confinedin a covered containerand hauled to an approved landfill. Burning of waste oroilis not approved,and spoil materialwill be kept on site for recontouring.

No bore holes will be used for disposal ofwaste materials.Human waste will be containedand willbe disposed of at an approved sanitarylandfill.

8. Ancillarv Facilities:

Not applicable for drillingoperationsin this area.

9. Wellsite Lavout:

A plat showingaccess to the well-pad and the location of the reserve pit are attached.

The location and access road will be clearedof trees prior to any construction. Stumpswill bescatteredor buried in an area designated by the BLM. Any stumpleft in place will be cut so that thestumpheight does not exceed12inches. All slashless than four inches in diameterwillbe chippedorscattered outside the cleared area and must be within24 inchesof the groundat all points. All materialfour inchesin diameteror greater will be removedfrom Federal land, unless otherwisedirected. Allof the above will take place prior to placement of drillingfacilities.

Topsoil and vegetationwillbe strippedtogether to a depth of 6 to 8 inches and stockpiled by wind-rowon the northeastedge of the location. No topsoil stripping will be allowedwhen soilsare moisturesaturatedto a depth of 3 inches, or frozenbelow the stripping depth.

Thereservepit will be fencedon three sidesprior to drilling activityand closed off on the fourth sideafterdrillingis finished.Fencing willbe four strandsof barbedwire or 48-inch woven wirewith onestrand of barbed wire abovethe woven wire. All cornerswill be bracedwith a wooden H-type brace.The fence construction will be on cut or undisturbed ground and the fence will be maintained in alivestock tight condition.

10. Plans for Restoration of Surface:

The San Rafael Resource Area Manager will be notified at least 24-hours prior to commencingreclamation work.

Immediatelyupon completionof drilling,the locationandsurroundingarea will be cleared of all debris,materials,trash, and junknot required for production.

that they willbe subjectto prosecutionfor knowinglydisturbinghistoric or archaeologicalsites,or for

collectingartifactsor fossils. The Operatorwill iramediatelybring to the attentionof the SanRafaelResource Area Manager any and all antiquitiesor other objects of historic or scientificinterestincluding,but not limited to, historic or prehistoric ruins, artifacts, or fossilsdiscovered as a result ofoperationsunder this permit. The operatorwill immediatelysuspend all activities in the area of theobject and will leave such discoveries intactuntil told to proceed by the Area Manager. Notice toproceedwill be based upon evaluationof the culturalsignificanceof the object.Evaluationwill be by

a qualifiedprofessional selectedby the Area Manager from a Federal Agency insofar as practical.

When not practical, the Operator willfollowthe mitigationrequirementsset fbrth by the Area Manager

concerning protection, preservation,or dispositionof any sites or material discovered. Within five

working days the Area Manager willinform the Operatoras to:

whethermaterialsappear eligiblefor the NationalRegister of Historic Places;

the mitigation measure(s)the Operatorwill likelyhave toundertakebeforethe sitecan be used (assumingin situpreservationis not necessary);and,

a time frame for the Area Managerto completean expeditedreview under 36 CFR 800.11 to contbrm, through the StateHistoricPreservation Officer,that the findings of theAreaManagerare correct and that mitigation is appropriate.

If the Operatorwishes, at anytime, to relocate activities to avoid the expense of mitigationand/or the

delays associated with this process, the Area Managerwill assume responsibilityfor whatever

recordationand stabilizationof the exposedmaterialsmay be required. Otherwise,in those situationswhere the Area Manager determines that mitigation, data recovery and/or salvageexcavationsare

necessary,the Operatorwill bear the cost. The AreaManager will provide technicaland procedural

guidelines for the conduct ofmitigation.Uponverificationfrom the Areamanager that the required

mitigationhas beencompleted,the Operatorwill thenbe allowed to resume construction.

A. DRILLINGPROGRAM

1. The proposed 3M BOP system is adequate. Installation,testing and operationof the system shall be in conformance with Onshore Oil and Gas Order No. 2.

2. The applicationdid not indicate whethera rotating head would be used. Aswith all air drillingoperations,use of a rotatinghead is mandatory. This and other airdrillingrequirements are found in Onshore Oil and Gas Order No. 2, part 111,E,1"Special DrillingOperations."

3. Due to the potential for fresh water, the Emery Sandstone must be isolated.Cement behind the production casing must be circulatedback to surface.

4. Any fluid bearing zones or lost circulation zones encountered while drillingwillbe isolated behind casing and cement.

5. If a gas meter run is constructed,it willbe located on lease within 500 feet ofthe wellhead. The gas flowlinewillbe buried from the wellhead to the meter and willbe buried downstream of the meter until it leaves the pad. Meter runs willbe housedand/or fenced. The gas meter shall be calibratedprior to first sales and shall becalibratedquarterly thereafter. Allgas production and measurement shallcomplywiththe provisions of 43 CFR § 3162.7-3, Onshore Oil and Gas Order No. 5, and AmericanGas Association (AGA)Report No.

B. SI)RFACE USE PLAN

A. General Stipylations

1. The operator (permitee) shallconstruct,operate and maintainthe facilities,improvement and structures withinthis APD in strictconformitywith the surface use planwhich was made a part ofthe approved APD. Any relocation, additionalconstructionoruse that is not in accordwiththe APD shall not be initiated withoutprior written approvalofthe authorizedofficer. A copyof the completeAPD including allconditionsof approvalNoncompliance with the above shall be grounds for an immediate suspension of activitiesif it constitutesa threat to public health and safetyor the environment.

B. Road Stipulations

1. No constructionor routine maintenanceactivitiesshall be performed during periodswhen the soil is too wet to adequatelysupportconstruction equipment. Ifsuch equipmentcreates ruts in excess of 6 - 12 inches deep, the soil shall be deemed too wet toadequately support constructionequipment.

2. When upgrading or maintainingexistingroads, the permittee shall utilize Class IIIroadstandards. No upgrading beyond the existingdisturbed area is authorizedunder thispermit. Ifdetermined necessary bythe authorized officerthe permittee shall upgrade theroad to meet the standards for Class Ill roads. This request shall be made if damage isdetermined to be occurring to the resource due to poor drainage or other inherentproblems withthe currentdesign of the road.

2a. The permittee shall utilize (Class III)road standards in the upgrading, use andmaintenanceof the new roads authorizedunder this permit. No upgrading beyond theexisting disturbed area is authorizedunder this permit. Ifdetermined necessary by theauthorized officerthe permittee shallupgrade the road to meet the standards for Class IIor Class IIIroads. This request shall be made if it is determined due to poor drainage orother inhetent problems with the currentdesign of the road, damage to the public lands isoccurringincidental to such road use.

3. The permittee shall be responsible for constructionand maintenanceof the roadutilizingClass III(Resource) Road Standards as described in BLM Manual Section 9113and the Moab District Road Standards for the term of the permit includingbut not limitedto grading, graveling, snow removal, ditch cleaning,or other constructionand maintenancerequirements as directed by the authorizedofficer.

4. The companyshall provide a competent on-site inspector during constructionof theroad and drillpad site to ensure compliance with all stipulations. The inspector shall bedesignated at the pre-drillconference,and shall be given an approvedcopy ofallmaps,permits and stipulationsprior to the start of construction. The BLMshallalso designate arepresentative for the project at the pre-drillconference.

5. Allsuitabletopsoilmaterial removedin conjunctionwith clearing and strippingshall beconserved in stockpileswithinthe pad. Topsoil shall be 2 - 6 inches, to be determined onsite by the BLMauthorizedofficer. Topsoil shall be strippedand salvaged during theconstructionof all new roads and pâds. Ifareas are to be left disturbed for a period

excess of one (1) year, topsoilstockpilesshall be seeded with a mixtureprescribed by theauthorizedofficer.

C. Construetion Stipulations

1. Topsoil from the access roads shallbe wind rowed along the uphillside of the road.When the wellis plugged and the road rehabilitated,this soil shallthenbe usedas a topcoatingfor the seedbed.

2. Any cultural and/or paleontological resource (historicor prehistoric site or object)discovered by the permittee, or any person workingon his behalf, on public or Federalland shall be immediately reported to the authorized officer. The permittee shall suspendThe permittees shall be responsible for the cost of evaluationandany decision as toproper mitigationmeasures shall be made by the San Rafael Resource Area Managerafterconsultingwiththe permittee.

3. Allfacilitieson site for six months or longer shall be painted a flat non-refelectivecolormatching the standard environmentalcolorsas determined by the Rocky Mountain FiveState Interagency Committee. Facilities required to be painted to complywith OSHArequirements are exempt.

D. Site Preparation

1. The entire roadbed and drillsite shouldbe obliteratedand brought back to approximateoriginalcontour. Drainage control shallbe reestablishedas necessary.

2. Allareas impacted by road construction shallbe recontoured to blend in with theexisting topography. AIIberms shall be removed. In recontouring the disturbed areas,care shouldbe taken to not disturb additionalvegetation.

3. Erosion controlstructures such as water bars, diversion channels, and terraces shall beconstructedto divert water and reduce soilerosionon the disturbed area. Water barsshallbe spaced on road grades greater than 4 percent (i.e., 4 to 8 percent grade on 200-foot intervals and greater than 8 percent on 100-foot intervals.) In addition,water barsshouldbe installed at all alignmentchanges (curves),significantgrade changes,and asdetermined by a qualified engineer. Water bars shouldbe sloped with the grade and cutto a minimum 12-inch depth below the surface. The grade of the water bar shouldbe 2percent greater thatn the grade of the road.

E. Seedþeci Preparation

1. An adequate seedbed should be prepared for all sites to be seeded. Areas to berevegetated should be chiselledor disked to a depth of at least 12 inches.

2. Ripping of fillmaterialsshould be completedby a bulldozer equippedwith singleor atwin set ofrippershanks. Ripping shouldbe done on 4-foot centers to a depth of 13inches and shall followfinal grading andprecede seedbed material application. Rippingshall be completedat a speed which maximizes ripper shank actionand promotes soilmaterialdisruption to the specifieddepth. Rippingshould be repeated untilthe compactedarea is loose and

3. Seedbed preparation should be considered to be completewhen the soil surface iscompletelyroughened and the numberof rocks on the site is sufficientto cause the site tomatch the surroundingarea.

F. Fertilization

1. Commercial fertilizerwitha formula of 18-16-8 shallbe appliedat a rate of 200 poundsper acre to the site.

2. Fertilizer shall be appliednot more than 48 hours prior to seeding and cultivatedintothe upper 3 inches of soil.

3. Fertilizer shall be broadcast over the soil using hand-operted "cyclone-type"seeders orrotarybroadcast equipmentattached to constructionor revegetation machineryasappropriateto slope. AIIequipmentshall be equippedwith a metering device. Fertilizerapplicationshall take place prior to the final seedbed preparation treatment. Fertilizerbroadcasting operationsshall not be conducted when wind velocities would interfere witheven distributionof the material.

G. Mulchinq

1. Mulchingshall be conducted as directed by the authorizedofficer.

2. The type of mulch shall meet the following requirements:

Wood cellulose fiber shall be natural or cooked,shalldisperse readily in water, andshall be nontoxic. The homogenous slurryor mixture shall be capable of applicationwith power spray equipment. A coloreddye that is noninjurious to plant growth may beused when specified. Wood cellulosefiber shallbe packaged in new, labeledcontainers. A minimumapplicationof 1500 pounds per acre shall be applied. Asuitabletackifier shall be appliedwith the mulch at a rate of 60 to 80 pounds per acre.

An alternative methodof mulching on smallsites would be the applicationof straw orhay mulchat a rate of 2000 pounds per acre. Hay or straw shall be certifiedweedfree. Followingthe applicationof strawor hay, crimping shall occur to ensureretention.

H. Regeedinq

1. All disturbed areas shall be seeded with the seed mixturerequired by the AuthorizedOfficer. The seed mixture(s) shall be planted in the fallof the yera (Sept.- Nov.), in theamounts specifiedin pounds of pure live seed (PLS)/acre. There shall be no primary orsecondary noxious weed seed in the seed mixture. Seed shall be tested and the viabilitytesting of seed shall be done in accordance withState law(s) and within 12 monthsprior topurchase. Commercial seed shall be either certifiedor registered seed. The seed mixturecontainershall be tagged in accordance with State law(s) and available for inspection bythe authorizedofficer.

2. Seed shall be planted using a drillequipped with depth regulator to ensure properdepth of plantingwhere drillingis possible. The seed mixture shall be evenly

uniformlyplanted over the disturbed area. Smaller/heavier seeds have a tendency to dropto the bottom of the drill and area planted first. The holder shall take appropriatemeasures to ensure this does not occur. Where drillingis not possible, seed shall bebroadcast and the area shall be raked or chained to cover the seed. Woody species withseeds that are too large for the dillshall be broadcast. When broadcasting the seed, thepounds per acre bited below are to be increase by 50 percent. Reseeding may berequired if a satisfactory stand is not established to the surface rights owner'sspecifications. Evaluation ofthe seeding's successshall not be made before completionof the second growing season after the vegetation becomes established. The AuthorizedOfficer is to be notifieda minimumof seven (7) days prior to seeding of the project.

3. The disturbed areas for the drillsite and road must be seeded with the followingseedmixture immediately afterthe topsoilis replaced:

I. Hvdroloav Sticulations

1. Reserve pits and disposal ponds shall be constructed to prevent comminglingwith bothground and surface water. Enough freeboard shall be maintained in disposal ponds tocontain precipitation from a 50 year 24 hour event without overflow.

2. Applicant shall provide estimates based on best availabledata for produced waterquantities and chemicalquality to be expected from each well. Once drilled, one-timechemicalanalysis (to include ion balance and TDS) willbe provided to BLMPrice Office.Additionally,the potentiometric surface of water in the Ferron and the Navajo (for injectionwells)shall be recordedand providedto BLMPrice. Any additionalwater ofnot (such aslevels inthe unconfinedsurface alluvium)shall be recorded and informationprovided toBLMPrice.

3. Applicant shall submit(to BLMPrice) specific and comprehensiveplans for the disposalofproduced

4. Allhydrologic modificationsshall be made in accordance withthe "State of UtahNonpoint Source Management Plan for HydrologicModifications - March 1995", unlessotherwiseauthorizedby BLM.

This reportwillbe filed directly with MMS.

Sundry Notices- There willbe no deviation from the proposed drillingand/orworkoverprogramwithout prior approval. "Sundry Notices and Reports on Wells" (Form 3160-5) willbe filed forapprovalfor allchanges of plans and otheroperationsin accordancewith43 CFR § 3162.3-2.Safe drillingand operatingpractices must be observed.

DrillinqSuspensions- Operations authorizedby this permit shall not be suspended for morethan30 days withoutprior approvalof the Moab BLMOffice. AIIconditionsof thisapprovalshall be applicableduring any operations conducted with a replacement rig.

Undesirable Events- Spills, blowouts, fires, leaks, accidents, or any other unusual occurrencesshall be immediately reported to the BLMin accordancewithrequirements of NTL-3A.

Cultural Resources- Ifculturalresources are discovered during construction,work that mightdisturb the resources is to stop, and the BLMis to be notified.

First Production- Should the vyellbe successfullycompletedfor production, the Moab BLMOffice willbe notifiedwhen the wellis placed in producing status. Such notificationniay bemade by phone, but must be followed by a sundrynoticeor letter not later than five (5)business days followingthe date on which the wellis placed into production.

A first production conferencewillbe scheduledas soon as the productivityof the wellisapparent. This conference should be coordinatedthroughthe local BLMField Office. Thelocal BLMField Office shall be notified prior to the first sale.

Well Completion Report- Whether the well is completed as a dry hole or as a producer, "WellCompletion and Recompletion Report and Log"(Form 3160-4) willbe submittedto the MoabBLMOffice not later than thirty(30) days aftercompletionof the well or after completionofoperationsbeing performed, in accordancewith 43 CFR § 3162.4-1. Two copies of all logs,core descriptions, core analyses, well test data, geologic summaries,sampledescription, andallother surveys er data obtainedand compiledduring the drilling,workover, and/orcompletionoperations,willbe filed withForm3160-4. When requested, samples (cuttingsand/or samples) willbe submittedto the Moab BLM

O OVenting/Flarinqof Gas- Gas produced from this well may not be vented/flared beyond aninitial,authorizedtest period of 30 days or 50 MMcf,whicheverfirst occurs, without the prior,writtenapprovalof the BLM. Should gas be vented or flared without approvalbeyond theauthorizedtest period, the wellmay be ordered shut-inuntilthe gas can be captured orapprovalto continuethe venting/flaringas uneconomicis granted. In suchcase,compensationto the lessor shall be requiredfor that portion of the gas that is vented/flaredwithout approvaland which is determined to have been avoidablylost.

Produced Water- Produced waste water may be confinedto an unlinedpit for a period not toexceed 90 days after initialproduction. During the 90 day period, an applicationfor approvalof a permanent disposal methodand location, alongwiththe required water analysis,willbesubmittedto the Moab BLMOffice for approvalpursuant to Onshore Oil and Gas Order No. 7.

Off-Lease Measurement, Storage, Commingling-Prior approvalmust be obtained from theMoab BLMOffice for off-leasemeasurement, off-leasestorage and/or commingling(eitherdown-hole or at the surface).

Pluqqinq and Abandonment- Ifthe well is completedas a dry hole, plugging instructions mustbe obtainedfrom the Moab BLMOfficeprior to initiatingplugging operations.

A "Subsequent Report of Abandonment" (Form 3160-5) willbe filed withthe Moab BLMOfficewithin thirty(30) days followingcompletionof the well for abandonment. This report willindicate where plugs were placed and the currentstatus of surface restoration. Uponcompletionof approvedplugging, a regulation marker willbe erected in accordancewith 43CFR § 3162.6. XTO Energy Inc. acquired wells from Chevron/Texaco on August 1, 2004. Chevron/Texaco failed to file a

Notice of Intent to surface comminglethese wells and XTO Energy Inc. was unaware until recently that

nothing had been filed. We are including with this applicationfor surace commingle a list of the wells

in Emery County and a spreadsheet showing production figures for these wells. Each well has its own

meter then runs through a central deliverj point where allocations are made.
