1 Senate File 130 – Governor’s Deappropriations for Current Fiscal Year

The legislature’s first major action was to cut the budgets from the current fiscal year after revenue estimates showed a much lower amount of revenue coming in. This legislation resulted in harmful cuts to major services to the total of $117 mil-lion, while no tax credits, tax cuts, nor was the Governor’s office affected.

2 HF 542 – Qualifying for Second Year

Unemployment

IFL Position was NO. Passed Senate 29-

21. Bill was signed into law by the

Governor.

This bill increased the amount an employee must earn to eight times (8x) the

weekly benefit to be covered for a second year of unemployment, a drastic in-

crease from the previous $250.

3 SF 166 – K-12 School Funding

IFL Position was NO. Passed Senate 28-

21, 1 Absent or not voting. Bill was

signed into law by the Governor.

This bill set the K-12 growth rate for supplemental school aid and categorical

growth at 1.1%. The IFL Position was no less than 4%, because schools have been

underfunded or not funded at all for many years now.

4 HF 203 - Davis-Bacon Road Swap/

Bypass Made in America Rules

IFL Position was NO. Passed the Senate

26-21, 3 Absent or not voting. Bill was

signed by the Governor.

This legislation allows local governments to bypass Federal made in America laws

that required US Steel and manufacturing to be used if Federal funds are used on a

project, and also allows these local governments to bypass Davis-Bacon prevailing

wage requirements, resulting in lower wages in rural areas.

HF 291/SF213 – Severe Limits on Public

Sector Collective Bargaining

(For Vote on Final Passage, see #59)

This legislation removed all mandatory subjects of bargaining for non-public safety

public employees except base wages, and those wages could only be negotiated at

3% or the cost of living whichever is lower. In addition to stripping all rights to

negotiate over terms and conditions of employment, this legislation removed the

ability of a public employee to have dues deducted from their paychecks, and re-

quires recertification elections before every contract vote, where the union must

receive a majority of bargaining unit members, not of those voting, to remain in

existence. Contracts are limited to a maximum of five years, and this legislation

substantially changes the considerations an arbitrator may take into an account

for making a ruling. This legislation also strikes PERB’s power to interpret Chapter

20 of the Iowa Code, allows an incoming Governor to reject a contract or arbitra-

tor’s ruling, and requires public employers to offer health insurance, but does not

speak to its cost or quality. One amendment that was adopted did allow release

time, seniority, and grievance procedures to be considered permissive subjects of

bargaining.

This amendment was offered by the Republican floor manager of the bill and improved it

slightly. This amendment restored proper cause termination. It also added DOT motor

vehicle enforcement peace officers to the public safety class and made release time, senior-

ity and grievance procedures permissive subjects of bargaining. This amendment reduced

the level needed for a bargaining unit to be considered public safety employees to 30% of

bargaining unit members. It also authorized the United States Department of Transporta-

tion Director and United States Department of Labor to restore bargaining rights if needed

to avoid the loss of federal funds. While this amendment did improve the bill, however

very slightly, some Senators voted NO because it did not improve the bill enough.

The Legislature passed new restrictive laws that would make it much hard-

er to vote in many ways. Voters are now required to show ID, and outlaws

same day registration that has been in place for years. If a person does not

have a valid picture ID, the state can furnish one, which is hard to justify in

tough budget times when other services are being cut. In addition, this

legislation shortened the timeline for requesting an absentee ballot by 11

days. This bill also requires signature verification, which is especially prob-

lematic for voters that are disabled or seniors. The IFL opposed these

measures because we believe we should be making it easier, not harder

for people to vote, and this legislation is a solution in search of a problem.

61 HF 295 - Banning Local Government

Laws Including Minimum Wage

Ordinances

IFL Position was NO. Bill passed 29-21.

HF 295 was a far reaching bill that limited the ability of local governments to

set employment standards such as wage levels and leave standards. In partic-

ular, several Iowa counties voted to raise the minimum wage level in their

jurisdictions, with some having taken effect or were about to take effect short-

ly after the passage of this legislation. This bill lowered the minimum wage for

an estimated 85,000 workers living in those counties.

HF 518 – Workers Compensation

Overhaul

(For Vote on Final Passage, see #74.)

This legislative session saw the largest overhaul of the worker’s compensation

system in perhaps Iowa’s history of the program. While the initial bill was particu-

larly egregious, the final product was not much better. This bill automatically pre-

sumes that an accident caused on the job by a person who tests positive for drugs

or alcohol, of any limit, is the workers’ fault. Keep in mind that many drug tests

have look back periods weeks or months. This bill drastically changes the way that

shoulder injuries are treated, whereas once such an injury could be considered a

body of the whole injury, a shoulder injury is now treated the same as a scheduled

member injury whether or not there is a career ending injury or an office worker

falls in the parking lot. This bill also reduced the amount of interest that is paid on

claims by insurance companies, making it easier for justice for workers to be de-

layed. This bill also aimed to make representation of workers by attorneys harder,

and further this bill prohibits collecting workers’ compensation and unemploy-

ment at the same time, even though there are scenarios in which that is appropri-

ate.

This bill set the K-12 growth rate for supplemental school aid and categorical

Bypass Made in America Rules

This legislation allows local governments to bypass Federal made in America laws

that required US Steel and manufacturing to be used if Federal funds are used on

a project, and also allows these local governments to bypass Davis-Bacon prevail-

ing wage requirements, resulting in lower wages in rural areas.

HF 291/SF213 – Severe Limits on Public

Sector Collective Bargaining

This legislation removed all mandatory subjects of bargaining for non-public safety

public employees except base wages, and those wages could only be negotiated

at 3% or the cost of living whichever is lower. In addition to stripping all rights to

negotiate over terms and conditions of employment, this legislation removed the

ability of a public employee to have dues deducted from their paychecks, and re-

quires recertification elections before every contract vote, where the union must

receive a majority of bargaining unit members, not of those voting, to remain in

existence. Contracts are limited to a maximum of five years, and this legislation

substantially changes the considerations an arbitrator may take into an account

for making a ruling. This legislation also strikes PERB’s power to interpret Chapter

20 of the Iowa Code, allows an incoming Governor to reject a contract or arbitra-

tor’s ruling, and requires public employers to offer health insurance, but does not

speak to its cost or quality. One amendment that was adopted did allow release

time, seniority, and grievance procedures to be considered permissive subjects of

bargaining.

The Legislature passed new restrictive laws that would make it much harder to vote in many ways. Voters are now required to show ID, and outlaws same day registration that has been in place for years. If a person does not have a valid pic-ture ID, the state can furnish one, which is hard to justify in tough budget times when other services are being cut. In addition, this legislation shortened the time-line for requesting an absentee ballot by 11 days. This bill also requires signature verification, which is especially problematic for voters that are disabled or seniors. The IFL opposed these measures because we believe we should be making it easi-er, not harder for people to vote, and this legislation is a solution in search of a problem.

87 HF 295 - Banning Local Government

Laws Including Minimum Wage

HF 295 was a far-reaching bill that limited the ability of local governments to set employment standards such as wage levels and leave standards. In particular, several Iowa counties voted to raise the minimum wage level in their jurisdictions, with some having taken effect or were about to take effect shortly after the pas-sage of this legislation. This bill lowered the minimum wage for an estimated 85,000 workers living in those counties.

HF 518 – Workers Compensation

Overhaul

(For Final Passage of HF 518, see #91)

This legislative session saw the largest overhaul of the worker’s compensation

system in perhaps Iowa’s history of the program. While the initial bill was particu-

larly egregious, the final product was not much better. This bill automatically pre-

sumes that an accident caused on the job by a person who tests positive for drugs

or alcohol, of any limit, is the workers’ fault. Keep in mind that many drug tests

have look back periods weeks or months. This bill drastically changes the way that

shoulder injuries are treated, whereas once such an injury could be considered a

body of the whole injury, a shoulder injury is now treated the same as a scheduled

member injury whether there is a career ending injury or an office worker falls in

the parking lot. This bill also reduced the amount of interest that is paid on claims

by insurance companies, making it easier for justice for workers to be delayed.

This bill also aimed to make representation of workers by attorneys harder, and

further this bill prohibits collecting workers’ compensation and unemployment at

compensation, with representatives from labor and from management.

89 Amendments to Collective Bargaining Bill: H 1211 to H 1176 by Carlson

This amendment struck the provisions on shoulder injuries and made a shoulder injury a scheduled injury for 400 weeks. This amendment struck provisions which end compensation at age 67. This limited the payments for an employee with a permanent partial disability who returns to work but allows the payments to be reviewed if employment ends. In addition, this amendment establishes a new vo-cational rehab program for persons with shoulder injuries to give them training at the closest community college, or another program if employee will not be able to return to work. The Department of Workforce Development determines if the employee cannot return to work. This requires the employer to pay up to $15,000 in costs and allows the employer to receive status reports. Makes the interest pay-ments start from the time of injury and sets the rate at 2%, plus the prime and makes the effective date July 2017. While this amendment improved the bill, much, much more could have been done and many voted NO for that reason.
