In Equity, to the Honr. the Chancellors: Yourorator William Sherard sheweth that he contracted with William Crawfordfor a small tract of land, containing 100 acres, adj. land of RobertSimpson, Miles J. Hardy, Arch. Mauldin Senr. and Junr. That the saidWilliam Crawford had long resided and represented himself the trueowner. That having paid him the consideration price on the 26 March1842, and took possession, in the latter part of 1844 one JacksonMcCurry intruded himself and took possession. Your orator informthat said Jackson McCurry has recently married with one Sarah White,the widow of John White, through whom they claim to have an interest onthe land, rests on the following statement. That William Crawfordpurchased the land in the year 1820 from David Gillespie, beingembarrassed circumstances, was promise aid from his brother-in-lawJohn White, and he became surety for the price, except a portion paidby the mother in law of William Crawford and received a title in hisoWn name, and was in possession until sold to your orator. Some timeafter he took possession one Purcell in the Court of Common Pleas,a recovery being had, and that David Gillespie procured a second deedto be executed to John White. That William Crawford paid the con­sideration price to either Gillespie or wnite. When John Whitedeparted this life intestate leaving his widow and two chn. Alexanderwnite and Rosanna White each minors, the former being about 11 yrs. andthe other about nine yrs. Nathan McCallister was admnor. on the est.of John White. Who collected the entire sum due from the advancesmade in his lifetime. During the twenty years Crawford lived on theland on rent was paid to White of Gillespie. Said White held titleas security. Filed 6 May 1845. Testimony. Robert Simpson statesthat William Crawford had a family of five sons and three dtrs. allof age except two and living in his family except two, who lived inthe neighborhood. Nathan McAlister sworn that he admnor on the est.of John White bein~ a brother of the widow, the present Mrs. McCurry:About the year 1833 Sarah and John White were married. In the year1836 John White died intestate. (Part of Alex. White, will in notes.)No date, Wife Elizabeth White to have one third during her life timeor widowhood. After all debts are paid the remainder to be dividedamong my five youngest chn. John, Nancy, Catorena, Martha. Sons Johnand James Wnite to have the other two thirds of the land bv sale ordivision. J
