Department Convention Summary

The Department Convention was held May 2-3 at the Holiday Inn Express and American Legion Post 29 in Elkins. During the business meeting on May 3, Richard Roger Ware was installed as Department Commandant. During the WV MODD Pack Growl on May 2, PDC Mike McLain was installed as WV Pack Leader. The following National Officers were in attendance: National Vice Commandant Mid East Division - Mike McLain; Asst National Vice Commandant Mideast Division - Bruce Rakfeldt, PNVC Mideast Division - Bud Raines, Mid East Division Adjutant - Roger Ware, Mideast Division Chaplain - Lee Taylor, Mideast Division Good Will Ambassador - Guy Hall, MODD MEDVCD - Craig Reeling, PDC Dept of Virginia & Past VA Pack Leader - Wayne Sarapata. Division Marine of the Year

Section 300 (h) of the National Administrative Procedures outlines the criteria for selection of the National Marine of the Year. Using these provisions NVC Mike McLain has appointed the following Mideast Division members to form a committee to select a 2014 Mideast Division Marine of the Year. The Chairman is Bud Raines, Department of Maryland who is the 2013 Mideast Division Marine of the Year and members Roger Ware Department of West Virginia and Fred Wise Department of Delaware. The guidelines in Section 300 (h) (2) of the above reference must be followed for each nomination. Please insert “Division” in lieu of “National“, as appropriate. Any regular member from the Mideast Division can be nominated and the Mideast Division MOY will be presented at the 2014 Mideast Division Conference, June 28, 2014 in Martinsburg, WV. The Mideast Division has created an inter-active guide to choosing your MOY with the Mideast Division Marine of the Year Nomination Package for Jarheads and can be downloaded from the division website at www.mclmideastdiv.org. This is an excellent guide to helping you submit your Division MOY nomination. Each letter of nomination must be mailed to the above chairman, registered return receipt, post marked not later than May 15, 2014. The above provisions are for 2014 Marine of the Year selection only.

Membership Applications

Effective 1 April 2013, all applications to join the MCL must be submitted on a Membership Application form dated 2013 or later. These forms have the date printed in the lower left portion of the application. If any applications are submitted without using the 2013 or later date they will be returned to the Detachment Paymaster who submitted them. National HQ will not accept any applications unless they have the 2013 or later date.. In addition, the original signed copy of the Membership Application must be submitted along with the dues transmittal. A copy of the application may be kept on file at the Detachment level if deemed necessary. The new Membership Application form includes a place for Service Number or Social Security number (for those who did not receive a separate Service Number). One or the other must be included to allow an applicant to become a Regular Member, so that the applicant could be positively identified if there were ever a reason to request the DD-214 from the Marine Corps custodian of Official Military Personnel Files. If the applicant chooses not to include either their Service Number or Social Security Number, they will be accepted as an

“Associate Member” only. Paymasters make sure you have all new applications filled on the 2013 or later Membership Applications forms and that all members who desire to be Regular members fill out either their Service Number or Social Security Number otherwise National will join them as “Associate Members.”

Good Standing and Delinquent Members

A member shall be considered in good standing in the MCL except when:a. Required dues are not paid, and transmitted, on or before membership expiration date as shown on

the member’s card. b. A member is indebted or in arrears to the member’s Detachment, Department, or to National Headquarters. c. Under suspension as punishment upon the adjudication of guilt as is provided in Chapter Nine, Section 910 of the Administrative Procedures.

A member shall be identified as delinquent whenever the member’s dues are not paid and transmitted on or before membership expiration date as shown on member’s card. a. Such member shall be retained in the delinquent status for a maximum one year, during which time the member may erase this status by making payment of all dues in arrears and all dues current and provided that the member is not indebted to the detachment, department or National Headquarters. b. Should the affected member remain in the delinquent status in excess of one year, such member shall be dropped from all membership rolls. c. No delinquent member may be transferred.

Once a member’s status is delinquent, he is no longer in good standing and therefore can not: a. Hold an elected or appointed officer position b. Is not considered a delegate from either a detachment or Member -at-Large c. Can not have name placed into consideration for elected position. d. Not entitled to wear any MCL clothing or uniform e. Can not attend MCL meeting as a member f. Can not cast a vote

WV Business License

Detachments require a WV business license. Effective 2010 all license renewals were issued a permanent license. All non-profit corporations have no fee for their business licenses. If your business license expires June 2014 and you have not renewed it, contact the WV State Tax Department at 1-800-982-8297 and a renewal form will be mailed to your detachment so you can receive a Permanent Business Certificate. Ensure you have this permanent business license with you anytime you conduct a raffle or a fund raiser. Suggest making a copy of it and covering in a plastic frame, and keep your original in your detachment files.

Corporation Annual Report

Every detachment that is incorporated must file an Annual Report for Corporations. The cost is $25 and is payable to the WV Secretary of State’s office. This must be completed before June 30 of each year. This should be done as soon as you have your elections and officers installed. If you have not received your renewal form, contact the WV Secretary of State 1-877-826-2954 or 1-866-767-8683 and have one sent to your detachment. Companies that do not file their annual reports on time are at risk of being administratively dissolved or revoked and will be assessed a mandatory late fee of $25 (twenty-five dollars) for non-profit organizations as required

by West Virginia Code. If you have any officer changes after your corporate renewal is filed, then you must file an application to change officers, a cost of $15.00.

Make Annual Verification of Paid Life Members

Paymaster John Hancock sends a reminder to all detachments to verify their Paid Life Members (PLM) listed on the membership roster dated 6/30/14 from National. Upon receipt is the best time to do this so it’s not forgotten. These are due at National before Dec. 31. If a detachment does not certify its PLM roster is true and accurate before the deadline, it will not receive its annual residual interest for its life members. Take the original copy of the roster and verify the PLM members. The Commandant and Paymaster must sign a statement on the original that they certify and annotate that the life member list is audited and is true and accurate and that there are no changes. This must also be dated. Make a copy after signing and then forward the original to Dept Paymaster John Hancock. He will send this to the National Adjutant/Paymaster. You must send this signed roster to Paymaster Hancock with enough lead time for him to send it to National and arrive there by Dec. 31. Ref: National Bylaws Sections 645 and 646.

Report of Officer Installation (ROI)

Every Detachment is required annually to hold elections and for the proper installation of officers. The Marine Corps League Report of Officer Installation (ROI) must be completed and signed by the Installing Officer. The Detachment Adjutant must ensure it is completed and all required information filled in those areas as listed. This includes: Detachment Name, Detachment number and Department. The Detachment EIN, Detachment Incorporation ID Number and Date must be listed on the form. The date of elections, date and place of installation, Installing Officer and Title and signature are to be filled in also. The Detachment Meeting day and date of each meeting, time, place, street address, city, state and zip code are required. Next every elected and appointed officer name, phone number, address and zip are requested. The total renewal dues must be filled in so National can mail the dues notices to all paying members.The last item on the ROI is who is submitting the form, title, signature and date. This form after ensuring it is filled out properly is then submitted to the Department Adjutant. Once National HQ receives the ROI, it compiles all the information listed on the form and with every Quarterly Membership roster, an administrative page is included for reference and this ensures your detachment information is on file at National. Adjutants at the Detachment and Department level must ensure the ROI is filled out properly.

Paymaster Duties

(1) Serve as the detachment’s treasurer and in that capacity shall be directly responsible to the Detachment’s Board of Trustees. Will be responsible for paying authorized bills and will assure the legitimacy of payment requests and Board of Trustees approvals, prior to releasing funds. Will have a right to question expenditures if necessary. Will ensure that new bank signature cards are completed on new Commandant and Paymaster after Officer installation each year.

(2) Cause to be kept all proper and necessary books for the recording of all the financial business of the Detachment, including a correct record of all membership accounts.

(3) Receive all monies, keeping a record of their sources and purposes and shall deposit said monies, in an approved and federally insured account, including, but not limited to, a checking account. All monies deposited shall be in the name of the Marine Corps League Detachment only.

(4) Provide such assistance to the Audit Committee to ensure the annual audit of the Detachment finances is completed prior to the annual installation of officers. Monthly audits can be conducted and be combined to satisfy the audit required. Otherwise, this report along with a copy of the monthly minutes of the meetings must be forwarded to the Department Commandant no later than 10 days after the installation of officers.

(5) Will audit the Quarterly Member Listing of 30 June each year from National Headquarters and make corrections, additions or other adjustments and certify it to be correct as annotated and ensure that the Detachment Commandant and he sign it and forward through the Department to National Headquarters before 30 December annually.

(6) Complete and file the annual IRS Form 990-N after the fiscal year ending 30 June and ensure National Headquarters and the Department Paymaster receives a true and complete copy of the IRS confirmation reply.

(7) Submit membership National per capita and Department per capita dues, application fees and life member fees to the Department Paymaster ensuring that these arrive before the end of the month of the member’s renewal date.

(8) Serve as a member of Detachment Membership Retention Team (MRT) and keep track of all paid and unpaid members in the detachment on a monthly basis and report on membership status at each meeting. The National Membership quarterly roster will be used to track all paid and unpaid members on a monthly basis.

(9) Will submit a dues transmittal form monthly for those members paying their dues in that month ensuring that the proper amount is paid.

Adjutant Duties

Shall be the recording secretary of the Detachment meetings and affairs. Support the detachment officers through correspondence, documentation, written communication, media releases and other staff assistance as may be directed by the Detachment Commandant. In addition the Detachment Adjutant shall:

(1) Keep and transcribe complete and accurate record of the business meetings at all board meetings, detachment meetings for a permanent record for a period not to exceed three (3) years.

(2) Assist the Detachment Commandant in preparing agendas for all business meetings and information for detachment special projects.

(3) Prepare the Detachment Quarterly Report and Detachment Annual Report for presentation during any scheduled Department Quarterly meetings or convention.

(4) Ensure the annual Report of Officer Installation is completed with renewal dues amount and is signed by the Installing Officer and forwarded through the Department. He will also ensure a listing of the new officers are given to the Detachment Web Sgt for the Locator page.

(5) After annual officer installations are completed, the Adjutant will complete and file the Corporation Annual Report prior to July 1 for the Detachment each year and mail to the WV Secretary of State, Business and Licensing Division.

(6) If Officers are installed after 1 July the Adjutant will complete and file a Application to Appoint or change Officers, and/or Office Addresses with the WV Secretary of State and mail a copy to the Department Adjutant

(7) The Adjutant will complete and file the WV State Tax department Business Registration Certificate for the detachment. This Certificate is free for non-profit corporations, is permanent and will be indicated on the Detachment certificate. Your detachment must have a physical address vice a PO Box to receive the certificate. You can have it mailed to a PO Box. You must have this certificate at your location while conducting all activities.

(8) The Adjutant will prepare new bank signature cards after annual installation of Officers that includes the Detachment Commandant and Detachment Paymaster. A motion must be made during a membership meeting and approved by vote to change bank signature cards and this must be recorded in the Detachment Minutes.

(9) The Adjutant will maintain desktop procedures and all Detachment turn-over files, copies of the National and Department Bylaws and Administrative Procedures, Detachment Bylaws, Detachment minutes and resolutions and Marine Corps League Guidebook for Detachment officers.

(10) Maintain and publish a Detachment Directory which shall contain: (a) Listing of detachment officers and general membership (b) Past Detachment Commandants (c) Past Detachment Marine of the Year

Department Quarterly Meeting September 13, 2014 in Parkersburg, WV

The Quarterly meeting will be held Saturday, September 13, 2014 at 10 a.m. at the American Legion Post 15 in Parkersburg, WV. Department Staff Officers meeting at 0930. All detachments are expected to have a representative attend this meeting and give a report of their respective detachment activities for period May 2014 - Sep 2014. This report should include total number of members, PLM and total unpaid, or deceased members; what you are doing on membership and retention or contacting any unpaid members. Have you completed your PLM audit, did you file your 990N E-file, is your detachment locator page current; whether you conduct bylaws/leadership training, have a Marine for Life program and have appointed a Detachment Veterans Service Representative, or support for OEF members who return from deployment; and have brief summary of significant events and what goals you have. Please limit your report to 5 minutes, make 10 copies and give a copy to the Dept Adj. A MODD Pack Growl will immediately follow the meeting. The uniform code for attending Dept Quarterly meetings is black trousers, red polo shirt, and MCL cover. MCL Uniforms will be required for the Dept Convention.

The WV Pack is selling these pins for $5 each to generate funds to help support the 2014 National Convention in Charleston, WV. You do not have to be a member of the MODD to purchase one of these pins. These pins will be sold at various meetings and events in the Department and Mideast. This is the official Military Order of the Devil Dogs 75th Anniversary patch which will be sold during the 2014 National Convention in the WV ship’s store and will be on T-shirts. Kennel Artist Jack Severn designed it for use by our Pack and Department.

Only PDD’s can actually attend the Supreme Growl but all PUPs and DDs can get a Passport stamp and a MODD 75th anniversary dog tag. You actually have to be physically present to get one of these dog tags. Be sure to have your detachment list you on their National Convention delegate list as you are required to check in with the MCL and get your credentials before registering at the Dog House. There will be long lines at both check in areas so I highly recommend that you check in on Sunday, August 3, 2014 at both places.
