The Court has implemented a new procedure for scheduling settlement conferences. Court Administration has provided the following information:

All cases scheduled for a civil jury trial will be scheduled for a settlement conference. Three settlement masters have been appointed by the Court: Honorable Robert A. Freedberg,1 Honorable Emil A. Giordano,2 and Honorable Leonard N. Zito.3

Settlement conferences will proceed as follows:1. Judge Koury will assign a settlement master.2. The settlement master’s assistant will contact counsel to

schedule the date and time of the settlement conference. An Order will be filed and e-mailed to counsel by Court Administration confirming the settlement conference.

3. The Order scheduling the settlement conference will set deadlines and procedures for submission of the settlement conference memorandum and supporting exhibits.

4. Counsel are not permitted to request a specific settlement master.

5. Only the President Judge has the authority to excuse attendance of the adjuster or trial counsel from the settlement conference. If a request is being made by the adjuster to be excused from attending the settlement conference, trial counsel must prepare and submit to the President Judge a Motion for Excusal of Attendance. This can be submitted to Court Administration by e-mail and does not need to be presented in person.

Preliminary Objections—Punitive Damages—Recklessness—Comparative Negligence.

Plaintiff filed a complaint alleging that Defendant negligently and recklessly collided with Plaintiff ’s motor vehicle while speeding and running a red light. Defendant filed pre-liminary objections seeking to strike Plaintiff ’s allegations of recklessness and his implied claim for punitive damages as impertinent. The court determined that such allegations were not impertinent because Plaintiff ’s allegations of recklessness were not included to support a claim for punitive damages. Rather, Plaintiff included such allegations in order to preclude Defendant from arguing that Plaintiff was comparatively negligent. The court determined that, because Plaintiff did not seek punitive damages, Defendant was not prejudiced by Plaintiff ’s allegations of recklessness. Thus, the court overruled Defendant’s objection.

OPINION

This matter is before the court on “Defendant’s Preliminary Objec-tions to Recklessness in Plaintiffs’ Complaint” (“POs”), filed on February 12, 2018. On February 28, 2018, Plaintiffs filed a Response to Defendant’s POs. Briefs have been filed, and the matter was submitted to the court at Argument Court on March 20, 2018, for disposition on the parties’ briefs.

On January 16, 2018, Plaintiffs filed a Complaint that alleges the following facts. On January 19, 2016, Plaintiff Monica Weiss-Nolen (“Plain-tiff ”) was driving north on Greenwood Avenue in Palmer Township, Northampton County. (Compl. ¶4.) At the same time, Defendant was driv-ing east on William Penn Highway, was speeding, and ran a red light, colliding with Plaintiff ’s car. (Id. ¶¶4, 6.) Plaintiffs characterize Defendant’s actions as reckless. (Id.) As a result of the crash, Plaintiff suffered injuries to her back, neck, knees, and shoulders. (Id. ¶7.) In Count I, Plaintiff seeks compensatory damages for negligence. In Count II, Plaintiff ’s husband seeks compensatory damages for loss of consortium. In her POs, Defendant moves to strike “reckless” and related terms from Plaintiffs’ Complaint, arguing that the Complaint fails to set forth factual averments to support a conclusion that her conduct was reckless.

Pennsylvania Rule of Civil Procedure 1028(a)(2) allows for any party to file a preliminary objection on the ground of “inclusion of ... im-pertinent matter[.]” Pa. R.C.P. No. 1028(a)(2). “To be ... impertinent, the

allegations must be immaterial ... to the proof of the cause of action.” Com-mon Cause/Pennsylvania v. Commonwealth, 710 A.2d 108, 115 (Pa. Commw. 1998). Only where an allegation is wholly irrelevant to the action in every way and cannot influence the result will it be deemed to be imper-tinent. Jefferies v. Hoffman, 417 Pa. 1, 3, 207 A.2d 774, 775 (1965). “Fur-thermore, the right of a court to strike impertinent matter should be spar-ingly exercised and only when a party can affirmatively show prejudice.” Commonwealth, Department of Environmental Resources v. Hartford Ac-cident and Indemnity Company, 40 Pa. Commonwealth Ct. 133, 138, 396 A.2d 885, 888 (1979).

In this case, Defendant argues that “reckless” and related terms are impertinent to Plaintiffs’ claims because the facts pleaded do not support a conclusion that Defendant acted recklessly such that punitive damages can be awarded. In response, Plaintiffs argue that they have not claimed punitive damages and have only alleged “recklessness” in their Complaint to “pre-clude defendant from raising comparative negligence in this action,” citing Krivijanski v. Union Railroad Company, 357 Pa. Super. 196, 515 A.2d 933 (1986). (Pls.’ Br. 4.) In Krivijanski, the Pennsylvania Superior Court held “that when willful or wanton misconduct is involved, comparative negli-gence should not be applied.” Id. at 203, 515 A.2d at 936.

Given that Plaintiffs are not seeking punitive damages, given Plain-tiffs’ stated reason for pleading “reckless” and related terms, and given the Superior Court’s holding in Krivijanski, the allegations in question may influence the result in this case. Furthermore, since Plaintiffs have not claimed punitive damages, the court cannot conclude that Defendant will be prejudiced by the allegations. Accordingly, Defendant’s preliminary objections will be overruled.

WHEREFORE, the court enters the following:

ORDER

AND NOW, this 28th day of March, 2018, “Defendant’s Preliminary Objections to Recklessness in Plaintiffs’ Complaint,” filed on February 12, 2018, are hereby OVERRULED. Defendant shall file an answer to Plaintiffs’ Complaint within twenty (20) days.
