Please be advised that the hourly compensation rate for court-appointed attorneys will be increased from $50.00 to $60.00 effective January 1, 2017. Also effective January 1, 2017, the hourly compensation rate for attorneys appointed by the Court in capital homicide cases will be $90.00 for the first chair and $60.00 for the second chair. Probable Cause—Mistaken Identification.

The Court determined, based upon the totality of circumstances, that a statement from an alleged eyewitness to a crime was sufficient to establish probable cause to arrest the defendant. Additionally, the Court determined that the police were not required to provide the defendant with Miranda warnings, as the defendant was a witness, and no longer a suspect of a crime, at the time that his statements were made to police.

steinBerg, J., November 15, 2016. The defendant, Juan Carlos Martinez, is charged with Hindering Apprehension or Prosecution.1 It is alleged that the defendant provided false infor-mation to investigators in an effort to lead them astray in identify-ing the triggerman behind a shooting in South Whitehall Township.

On August 5, 2016, counsel for the defendant filed a “Motion to Suppress Statements Pursuant to Pa. R.Crim.P. 581.” It is al-leged that the defendant was unlawfully arrested, and that his statements to police were taken without the benefit of Miranda warnings. A hearing on that motion was held on October 10, 2016, during which Officer Joel Wischner and Detective Jerome Cra-mer of the South Whitehall Police Department testified.2

BACkgROUND

On December 11, 2015, Joshua Flores was shot in the leg in the 3200 block of kingston Place, in South Whitehall Township.

Police responded to that location, confirmed that Mr. Flores had been shot, and attempted to determine the circumstances behind the shooting. Their initial investigation at the scene of the shooting led them to speak with Christopher Miller, who told Officer Wisch-ner that “his cousin was shot [at] his residence ... and that the suspects were in the Weis parking lot.” 3

While Officer Wischner remained in the neighborhood of the shooting, he observed the defendant, and a second person later identified as Shanna Crowthers, walking back towards the residence. He approached them and asked if they knew “what happened.” Both of them played dumb, and while Officer Wischner was speaking with them, Mr. Miller came out of the residence “yelling, that’s ... the one that did it.”4 He pointed the finger at the defendant.

The defendant was placed in handcuffs, patted down, and placed in Officer Wischner’s patrol car. During that process, the defendant told Officer Wischner that “he knew what happened, but he didn’t want to get into it right now.”5 He was taken to the South Whitehall Police Department and placed in a cell.

Detective Cramer took over the investigation and spoke with the defendant in an interview room. By the time they discussed the shooting, Detective Cramer’s investigation revealed that the defendant was a witness, not the trigger person. For that reason, he did not advise the defendant of his Miranda rights before dis-cussing the shooting.

The defendant told Detective Cramer that he should be look-ing for a “black male of Jamaican descent” who went by the name of “Jamal,” and drove a Chevy Cobalt.6 The individual arrested for the shooting does not remotely fit that description. Following the discussion with Detective Cramer, the defendant was released from custody and provided a ride home.7

DISCUSSION

a. Probable Cause to Arrest

The defendant contends that Officer Wischner did not have probable cause to arrest him because his arrest was predicated on a mistaken identification by an eyewitness. It is also alleged that Mr. Miller was “insufficiently reliable” because the evidence at the suppression hearing failed to adequately explain his basis for iden-tifying the defendant.

It is axiomatic that the police must possess probable cause to effectuate a warrantless arrest. Commonwealth v. Thompson, 604 Pa. 198, 203, 985 A.2d 928, 931 (2009); Commonwealth v. Dozier, 99 A.3d 106, 112 (Pa. Super. 2014) (citing Commonwealth v. Saab, 269 Pa. Superior Ct. 206, 409 A.2d 437 (1979)) (collecting cases) (police had probable cause to arrest defendant, whom the victim did not previously know, based upon very detailed description and arrest one-half hour after offense and three and one-half blocks from attack). Likewise, the Fourth Amendment is not violated by an arrest based on probable cause even though the wrong person is arrested. Hill v. California, 401 U.S. 797, 802 (1971) (“When the police have probable cause to arrest one party, and when they reasonably mistake a second party for the first party, then the arrest of the second party is a valid arrest.”); Commonwealth v. Wright, 867 A.2d 1265, 1268 (Pa. Super. 2005) (where wrong individual was mistakenly arrested, his subsequent convictions were upheld because officers had probable cause to arrest proper individual, and the mistaken arrest was reasonable and understandable under the circumstances of the case); see also, State v. green, 723 A.2d 1012, 1015 (N.J. Super. Ct. App. Div. 1999) (collecting cases).

It has frequently been explained:

Probable cause to arrest exists when the facts and cir-cumstances within the police officer’s knowledge and of which the officer has reasonably trustworthy information are suffi-cient in themselves to warrant a person of reasonable caution in the belief that an offense has been committed by the person to be arrested. ... Probable cause justifying a warrant-less arrest is determined by the ‘totality of the circumstances.’

... Furthermore, ‘probable cause does not involve certainties, but rather “the factual and practical considerations of every-day life on which reasonable and prudent [persons] act.” ’ ...

Commonwealth v. Williams, 941 A.2d 14, 27 (Pa. Super. 2008) (internal citations omitted); see also, In Interest of O.A., 552 Pa. 666, 676, 717 A.2d 490, 495 (1998); Commonwealth v. Johnson, 467 Pa. 146, 153, 354 A.2d 886, 889 (1976); Commonwealth v. griffin, 310 Pa. Superior Ct. 39, 46, 456 A.2d 171, 174 (1983).

In Commonwealth v. Evans, 305 Pa. Superior Ct. 450, 451 A.2d 734 (1982), in which the same probable cause standard was articulated, it was alleged that the police lacked probable cause to arrest the defendant, and that his subsequent confession should be suppressed as fruit of the illegal arrest. The court, in concluding otherwise, noted that it is well-settled that “[t]here is a substantial basis for crediting the information of an eyewitness.” Id. at 457, 451 A.2d at 737. See also, Commonwealth v. Walker, 348 Pa. Su-perior Ct. 207, 216, 501 A.2d 1143, 1148 (1985). Furthermore, even though an arresting officer may not have direct, personal knowledge of the relevant facts and circumstances, probable cause may rest solely on information supplied by another person, pro-vided there is a substantial basis for crediting that information. Commonwealth v. Stokes, 480 Pa. 38, 44, 389 A.2d 74, 76-77 (1978) (The uncorroborated confession of an accomplice, the statement of a victim identifying the perpetrator of a crime, and an eyewitness whose identity is known, all fall within the category of information sufficient to establish probable cause.); see also, Commonwealth v. Bells, 373 Pa. Superior Ct. 57, 540 A.2d 297 (1988) (information provided by victim, who gave a detailed physical description of her attacker and the unusual knife he possessed, established probable cause to arrest); Commonwealth v. george, 878 A.2d 881, 884-85 (Pa. Super. 2005). It has also been held repeatedly throughout the federal courts that a statement from an alleged victim is ordinar-ily sufficient to establish probable cause. Acosta v. Ames Dept. Store, Inc., 386 F.3d 5, 10 (1st Cir. 2004); Lee v. Sandberg, 136 F.3d 94, 103 (2d Cir. 1997); Sharrar v. Felsing, 128 F.3d 810, 818 (3d Cir. 1997); United States v. Harness, 453 F.3d 752, 754 (6th Cir. 2006); Reynolds v. Jamison, 488 F.3d 756, 765 (7th Cir. 2007); Clay v. Conlee, 815 F.2d 1164, 1168 (8th Cir. 1987); Easton v. City of Boulder, Colo., 776 F.2d 1441 (10th Cir. 1985).

Although Mr. Miller was not the victim, he certainly had a connection to the events that unfolded outside his residence. His cousin was the victim, and he believed the suspects were at a Weis Market located nearby. When Mr. Miller identified the defendant, he was upset and intoxicated, but had no hesitation in identifying the defendant.

The defense would require an extensive investigation prior to a finding of probable cause and discount eyewitnesses whose credibility might be affected by their alcohol consumption. Law enforcement has never been required to make such wide-reaching assessments at the initiation of an arrest. The arresting officer is “neither required nor allowed to sit as prosecutor, judge or jury. [His] function is to apprehend those suspected of wrongdoing, and not to finally determine guilt through a weighing of the evi-dence.” Panetta v. Crowley, 460 F.3d 388, 396 (2d Cir. 2006) (quoting krause v. Bennett, 887 F.2d 362, 372 (2d Cir. 1989)); see also, Curley v. Village of Suffern, 268 F.3d 65, 70 (2d Cir. 2001) (“[O]nce a police officer has a reasonable basis for believing there is probable cause, he is not required to explore and eliminate every theoretically plausible claim of innocence before making an arrest.”); State v. griffin, 570 P.2d 1067, 1069 (1977) (victim’s advanced age and contradictory stories about how crime occurred did not result in finding that arresting officer lacked reasonable, trustworthy information to establish probable cause where basic information was not contradictory).

Although the identification of the defendant was in error, within a few hours he was released from custody. The determina-tion of probable cause does not turn on that error, but on the in-formation in Officer Wischner’s possession at the moment the defendant was taken into custody. Officer Wischner was the only officer present at a shooting scene, where five to ten mostly in-toxicated people were present, and the defendant was identified by one of the individuals. Furthermore, the defendant, after deny-ing any knowledge of the events, admitted knowledge as he was about to be placed in the patrol car. Finally, no other person came forward exculpating the defendant. Based upon the totality of the circumstances, Officer Wischner had probable cause to arrest the defendant.

The Bar Association of Lehigh County has started the Annual Ask for the Lehigh County Lawyer’s Charitable Fund Grant. This year’s theme is “School Programs in Need” and we are asking all organizations applying to keep that in mind as they complete their request.

We are proud to remind all lawyers that the Bar Association of Lehigh County has conducted an Assistance Program to benefit area 501c3 organizations to provide much needed assistance to our surrounding communities for many years. This program has raised over $200,000 throughout that time and distributed these funds to many deserving area organizations.

This year to assist these organizations, we are asking each lawyer to give generously to help support those in our local community. Remember, these contributions stay in the Greater Lehigh Valley area.

The Program is administered through the Lehigh Valley Community Foundation and all gifts are tax deductible to the fullest extent of the law. The Foundation will acknowledge all gifts for tax purposes.

We will recognize all those nonprofit organizations receiving funds as part of our Law Day celebration in May.

Past years’ contributions went to the Crime Victims Council of the Lehigh Valley, Dream Come True, The Lehigh Valley Zoo, Community Bike Works, The Victory House, Angel 34, Miracle League of the Lehigh Valley and many more.

All Members, Family Members & Members Staff, are invited to take part in this demonstration and training. Hands-Only CPR is CPR without mouth-to-mouth breaths. It is recommended for use by people who see a teen or adult suddenly collapse in an “out-of-hospital” setting (such as at home, at work or in a park). According to the American Heart Association, about 90 percent of people who suffer out-of hospital cardiac arrests die. CPR, especially if performed immediately, can double or triple a cardiac arrest victim’s chance of survival.

b. Statement Made to Detective Cramer

Detective Cramer interviewed the defendant, but only after the defendant was no longer a suspect in the shooting. As a result, Detective Cramer did not believe Miranda warnings were neces-sary.

It is well established that Miranda warnings are only required in a custodial interrogation. Commonwealth v. Housman, 604 Pa. 596, 625, 986 A.2d 822, 839 (2009). Custodial interrogation has been defined as “questioning initiated by law enforcement officers after a person has been taken into custody or otherwise deprived of his [or her] freedom of action in any significant way.” Common-wealth v. Mannion, 725 A.2d 196, 200 (Pa. Super. 1999); see also, Commonwealth v. garvin, 50 A.3d 694, 698 (Pa. Super. 2012); Commonwealth v. gonzalez, 979 A.2d 879, 887-88 (Pa. Super. 2009) (quoting Miranda v. Arizona, 384 U.S. 436, 444 (1996)). The United States Supreme Court has stated, “the ultimate inquiry is ... whether there [was] a ‘formal arrest or restraint on freedom of movement’ of the degree associated with a formal arrest.” Com-monwealth v. Boczkowski, 577 Pa. 421, 447, 846 A.2d 75, 90 (2004) (quoting Stansbury v. California, 511 U.S. 318, 322 (1994)).

“The standard for determining whether an encounter with police is deemed ‘custodial’ ... is an objective one based on a total-ity of the circumstances with due consideration given to the reason-able impression conveyed to the person interrogated.” Common-wealth v. Johnson, 615 Pa. 354, 374, 42 A.3d 1017, 1028 (2012); Commonwealth v. Busch, 713 A.2d 97, 99 (Pa. Super. 1998). It was explained in further detail in Stansbury, “that the initial deter-mination of custody depends on the objective circumstances of the interrogation, not on the subjective views harbored by either the interrogating officers or the person being questioned.” Stansbury v. California, 511 U.S. 318, 322-23 (1994). In Commonwealth v. Baker, 24 A.3d 1006 (Pa. Super. 2011) the following factors were identified to determine under the totality of the circumstances whether a detention has become so coercive to constitute the functional equivalent of an arrest:

[T]he basis for the detention; its length; its location; whether the suspect was transported against his or her will,

how far, and why; whether restraints were used; whether the law enforcement officer showed, threatened, or used force; and the investigative methods employed to confirm or dispel suspicions.

Id. at 1019-20 (citing Commonwealth v. Mannion, 725 A.2d 196, 200 (Pa. Super. 1999)). See also, Commonwealth v. Williams, 941 A.2d 14, 31 (Pa. Super. 2008); Commonwealth v.Watkins, 750 A.2d 308, 313 (Pa. Super. 2000).

Finally, in Howe v. Fields, 132 S. Ct. 1181, 1189 (2012), it was similarly explained:

As used in our Miranda case law, ‘custody’ is a term of art that specifies circumstances that are thought generally to present a serious danger or coercion. In determining wheth-er a person is in custody in this sense, the initial step is to ascertain whether, in light of the objective circumstances of the interrogation a reasonable person [would] have felt he or she was not at liberty to terminate the interrogation and leave. And in order to determine how a suspect would have gauge[d] his freedom of movement, courts must examine all of the circumstances surrounding the interrogation. Relevant factors include the location of the questioning, its duration, state-ments made during the interview, the presence or absence of physical restraints during the questioning, and the release of the interviewee at the end of questioning.

Id. (internal quotations and citations omitted).

In Commonwealth v. Horner, 497 Pa. 565, 442 A.2d 682 (1982), it was explained that the police are not required to provide Miranda warnings to a witness even when that witness is trans-ported to the police station in a locked police van. See also, Com-monwealth v. O’Shea, 456 Pa. 288, 291, 318 A.2d 713, 714 (1974) (“Although Miranda warnings are not required before interviewing all possible witnesses to the crime, they are required ‘wherever an individual is questioned while in custody [o]r while the object of an investigation of which he is the focus.’ ”).

The circumstances in this case are somewhat different, but nonetheless, Miranda warnings were not required because the

defendant was a witness. He was initially a suspect and in custody when he was placed in a cell at the South Whitehall Police Depart-ment. However, when Detective Cramer interviewed him, the objective circumstances demonstrate that the cloud of custody had disappeared. Detective Cramer told him that he was a suspect, but basically a witness.8 He explained that he did not provide the defendant with Miranda warnings because he was no longer con-sidered a suspect.9 The defendant was not handcuffed, and upon learning that he was not a suspect, he was cooperative. He was told he was free to leave,10 but remained, and provided Detective Cra-mer with a description and information about the shooter. In retrospect, it may have been better for the defendant to remain silent. However, poor judgment is not the litmus test for deciding if Miranda warnings are mandated.

Finally, the defendant was released and provided a ride home after the interview.11 The facts and circumstances demonstrate that the defendant was not subject to a custodial interrogation requir-ing Miranda warnings.

For all the foregoing reasons, the Motion to Suppress is de-nied.

ORDER

AND NOW, this 15th day of November, 2016, upon consid-eration of the “Motion to Suppress Statements Pursuant to Pa.R.Crim.P. 581,” a suppression hearing held on October 10, 2016, and consideration of the memorandum of law filed by coun-sel;

IT IS HEREBY ORDERED that the Motion to Suppress Statements is DENIED.

You may be able to petition the Court to set aside the sale if the bid price was grossly inadequate compared to the value of your prop-erty. 7. The sale will go through only if the buyer pays the Sheriff the full amount due in the sale. To find out if this has happened you may call (610) 782-3175. 8. If the amount due from the buyer is not paid to the Sheriff, you will remain the owner of the property as if the sale never hap-pened. 9. You have a right to remain in the property until the full amount due is paid to the Sheriff and the Sheriff gives a deed to the buyer. At that time, the buyer may bring legal proceedings to evict you. 10. You may be entitled to a share of the money, which was paid for your house.
