Ellen Freedman is founder and President of Freedman Consulting, which assists Delaware and Lehigh Valley law firms with mergers, partner compensation issues, strategic planning, management of projects in such areas as technology, financial management, time and billing, facilities, human resources, and providing computer training ad hoc or in a classroom setting.

Ellen holds the designation of Certified Legal Manager through the Association of Legal Administrators (ALA), the credentialing body for the CLM degree. She was one of the first 20 in the nation to have achieved this designation. (Currently less than 200 in the nation have earned the degree.) She holds a Certification in Computer Programming from Maxwell Institute, a Certification in Web Site Design from Temple University, and a B.A. from Temple University, where she also did two years of graduate studies in Criminology.

EASTERN AND MIDDLE DISTRICT ADMISSIONS CEREMONIES ON THE SAME DAY: JUNE 15, 2016

The Federal Courts Committee is sponsoring a joint admissions ceremony for area lawyers who wish to be sworn in to the United States District Courts for the Eastern and Middle Districts of Pennsylvania.

This first-time event will take place at the centrally located Allentown, Pennsylvania federal courthouse. Hon. Joseph Leeson will preside over the Eastern District admissions, while Hon. Malachy Mannion will preside over the Middle District admissions. Other judicial officers from the ‘Northern tier’ will attend as their schedules permit. Anyone interested can be sworn in to either bar, or both, at the same time, by simply filling out the customary bar application and paying the admission fee.

The ceremony will commence at 3:30pm on June 15 at the courthouse. After the ceremony, you are invited to join the bench and bar at the Lehigh Valley Iron Pigs game at Coca-Cola Park in Allentown.

For those from the Montgomery County/greater Philadelphia area, bus service from will be available from Plymouth Meeting to the courthouse, then to the ballpark, then back home to Plymouth Meeting. In his petition under the Post Conviction Relief Act, defendant failed to establish ineffective assistance of counsel related to his decision to enter a guilty plea because the record, along with the testimony of trial counsel, established that defendant knowingly, voluntarily and intelligently entered the plea.

Ford, J., October 8, 2015. Before the court is a pro se petition filed by defendant, Hasan Collier, Jr., under Pennsylvania’s Post Conviction Relief Act (PCRA), 42 Pa. C.S. §§9541-9546, as well as an amended PCRA petition. In these petitions, defendant claims he was denied effective assistance of counsel by Attorney Eric K. Dowdle, his trial counsel, and that this ineffectiveness caused him to enter his guilty pleas in an unknowing and involuntary manner. Defendant’s claims lack merit. Accordingly, I enter an order deny-ing and dismissing the petitions.

At the guilty plea hearing conducted on November 20, 2014, defendant and the Commonwealth entered a plea bargain that was accepted by the court. Under the plea bargain, defendant agreed to enter a guilty plea to Count 1 of the criminal information, at-tempted homicide causing bodily injury, 18 Pa. C.S. §§2501(a), 901, and Count 5, carrying a firearm without a license, 18 Pa. C.S. §6106(a)(1). It was further agreed that the sentences could not exceed the standard ranges of the sentencing guidelines. In turn, the Commonwealth agreed to withdraw all of the remaining counts. The parties left it to the court to determine whether the sentenc-es would run consecutively or concurrently. The charges stemmed from an incident on May 29, 2014, in which the defendant shot

the victim, David Sanchez, in his chest and right arm. The victim suffered non-life-threatening injuries.

On January 15, 2015, I sentenced defendant on Count 1 to state confinement for a period of not less than eight years to not more than sixteen years. On Count 5, I sentenced defendant to state confinement for not less than two years to not more than four years. The sentences imposed on both counts fell within the stan-dard range of the sentencing guidelines. (The standard range on Count 1 was 78 to 96 months and the standard range on Count 5 was 12 to 24 months.) I ordered that these sentences run con-secutively so that defendant’s aggregate sentence was state confine-ment for not less than ten years to not more than twenty years. The sentences conformed to the plea bargain negotiated by the parties.

On January 22, 2015, defendant filed a post-sentence motion which I denied by order filed on January 27, 2015. Defendant did not file a direct appeal.

Defendant timely filed a pro se PCRA petition on July 14, 2015. Because this was defendant’s first PCRA petition, I ap-pointed Attorney Robert Long to represent defendant and I or-dered Attorney Long to file an amended PCRA petition.

On September 2, 2015, defendant, through his court-appointed counsel, filed an amended PCRA petition. The claims raised in the amended petition mirrored the claims raised by defendant in his pro se PCRA petition. I conducted a hearing on the PCRA petition and amended PCRA petition on September 16, 2015.

In his PCRA petitions, defendant claims that his guilty pleas were not entered in a knowing, voluntary and intelligent manner due to the ineffectiveness of his trial counsel, Attorney Dowdle. Defendant first asserts that Attorney Dowdle “was ineffective for explaining the plea in such a manner as to make the [defendant] believe he would receive a minimum sentence of no more than 78 months to 96 months at most.” Additionally, defendant contends that Attorney Dowdle “was ineffective for talking the defendant into pleading guilty rather than considering possible defenses or preparing for trial.”

In order to establish eligibility for PCRA relief, defendant must prove by a preponderance of the evidence that the conviction or sentence resulted from “[i]neffective assistance of counsel which, in the circumstances of the particular case, so undermined the truth-determining process that no reliable adjudication of guilt or innocence could have taken place.” 42 Pa. C.S. §9543(a)(2)(ii).

In order to be entitled to relief on a claim of ineffective assistance of counsel, the PCRA petitioner must plead and prove by a preponderance of the evidence that (1) the under-lying claim has arguable merit; (2) counsel whose effectiveness is at issue did not have a reasonable basis for his action or inaction; and (3) the PCRA petitioner suffered prejudice as a result of counsel’s action or inaction.

Commonwealth v. Steele, 599 Pa. 341, 360, 961 A.2d 786, 796 (2008). A defendant’s failure to meet any prong of this test defeats his claim. Commonwealth v. Wright, 599 Pa. 270, 321, 961 A.2d 119, 149 (2008) (citation omitted). Finally, counsel is presumed to be effective and the defendant must prove otherwise. Common-wealth v. Rivers, 567 Pa. 239, 246, 786 A.2d 923, 927 (2001).

Helpful in deciding the present case is this Superior Court statement:

A criminal defendant has the right to effective counsel during a plea process as well as during a trial. Hill v. Lockhart, 474 U.S. 52, 106 S.Ct. 366, 88 L.Ed.2d 203 (1985). Allegations of ineffectiveness in connection with the entry of a guilty plea will serve as a basis for relief only if the ineffectiveness caused the defendant to enter an involuntary or unknowing plea. Commonwealth v. Allen, 557 Pa. 135, 732 A.2d 582 (1999). Where the defendant enters his plea on the advice of counsel, ‘the voluntariness of the plea depends on whether counsel’s advice “was within the range of competence demanded of attorneys in criminal cases.” ’ Hill, 474 U.S. at 56, 106 S.Ct. 366, 88 L.Ed.2d 203 (quoting McMann v. Richardson, 397 U.S. 759, 771, 90 S.Ct. 1441, 25 L.Ed.2d 763 (1970)); See also Tollett v. Henderson, 411 U.S. 258, 267, 93 S.Ct. 1602, 36 L.Ed.2d 235 (1973) (holding that a defendant who pleads guilty upon the advice of counsel ‘may only attack the volun-

tary and intelligent character of the guilty plea by showing that the advice he received from counsel was not within the standards set forth in McMann.’).

Defendant testified at the September 16, 2015 PCRA hearing. He stated that Attorney Dowdle never considered taking his case to trial. He explained that Attorney Dowdle waived defendant’s preliminary hearing and immediately began to negotiate a plea bargain with the Commonwealth. Defendant also stated that At-torney Dowdle disregarded defenses raised by the defendant. Specifically, defendant said he told Attorney Dowdle that he was under the influence at the time he committed the crimes. Defen-dant testified that Attorney Dowdle told him that he would not receive a minimum sentence of more than 78 to 96 months under the plea bargain.

Attorney Dowdle testified at the PCRA hearing. He explained that defendant never asserted his innocence. In fact, defendant confessed to the crimes during a videotaped custodial interrogation by police. Defendant told the police the location of the gun he used to shoot the victim and police were able to locate that weap-on. Attorney Dowdle explained that he obtained discovery from the Commonwealth and reviewed the discovery with defendant. He testified that there were no suppression issues and that he discussed possible defenses with defendant. He informed defen-dant that voluntary intoxication was not a defense to the crimes charged. Attorney Dowdle explained that taking this case to trial was never seriously discussed as an option and that he entered into plea negotiations with the Commonwealth as defendant’s best chance to limit the time he would serve in state prison. Attorney Dowdle explained the plea bargain and the sentencing guidelines to defendant and reviewed the pre-sentence investigation report with him prior to the guilty plea hearing. He testified that he never told defendant he would receive a minimum sentence of no more than 78 months to 96 months. Attorney Dowdle testified that he informed defendant of his maximum exposure under the plea bargain and explained to him that the court had the discretion to

As to the claim that Attorney Dowdle told defendant he would receive a minimum sentence of no more than 78 months to 96 months, the court accepts the testimony of Attorney Dowdle as reasonable and accurate and rejects the testimony of defendant as unlikely and incredible.

Defendant’s claim is undercut by the record developed at the guilty plea and sentencing hearings. At the plea hearing, both the district attorney and the court explained to defendant the terms of the plea bargain. N.T., 11/20/14, pp. 2-3, 6-8. At one point, there was this exchange:

THE COURT: [T]he worst that you are facing—I want you to understand the worst. Whether you get the worst or not I don’t know, but the worst that you are facing on the attempted homicide is a sentence of not less than 96 months to not more than 20 years. ... On your firearms charge, the worst sentence you’re facing there is 24 months to 7 years.

... Do you understand all those things?

DEFENDANT: Yes.

N.T., 11/20/14, pp. 7-8. The district attorney and the court again explained the terms of the plea bargain at the beginning of defen-dant’s sentencing. N.T., 1/15/15, pp. 2-3. At no point during the sentencing did defendant state his disagreement with the plea bargain. At the close of the hearing, the court asked defendant if he understood the sentences that were imposed and defendant answered in the affirmative. N.T., 1/15/15, p. 20.

The court also believes Attorney Dowdle’s testimony that he discussed the option of trial and possible trial defenses with defen-dant. This issue was addressed at the guilty plea hearing. Attorney Dowdle stated on the record that he discussed the possibility of trial with defendant and that he explained to defendant that vol-untary intoxication was not a defense. Defendant agreed with Attorney Dowdle’s statement on the record. N.T., 11/20/14, pp. 18-19.

In sum, defendant failed to meet his burden of demonstrating ineffectiveness on the part of Attorney Dowdle. Additionally, the record from the guilty plea and sentencing hearings demonstrates that defendant knowingly, voluntarily and intelligently entered his guilty pleas. For these reasons, defendant’s pro se PCRA petition and amended PCRA must be denied.
