Section 11 Exemption Order

TemporAry reducTion in The flow of wATer in The SouTh eSk river

I, JEREMY ROCKLIFF, Minister for Primary Industries and Water, acting pursuant to section 11 of the Water Management Act 1999, herby exempt Hydro Tasmania from the requirement to not, in the construction or operation of any works, reduce the flow of water in the South Esk River below 0.42 cumecs between 18 April 2016 and 30 May 2016.

This exemption is subject to the following conditions:

(i) Hydro Tasmania may only reduce the flow of water into Cataract Gorge below 0.42 cumecs for the purposes of constructing, removing and refurbishing the bypass system associated with the replacement of dewatering valves in Trevallyn Dam; and

(ii) Hydro Tasmania may only reduce the flow of water into Cataract Gorge below 0.42 cumecs on up to a total of ten days between 18 April 2016 and 30 May 2016 (inclusive); and

(iii) Hydro Tasmania may not reduce the flow of water into Cataract Gorge below 0.42 cumecs on any public holiday whilst the exemption is in force; and

(iv) Hydro Tasmania is to make every effort to not reduce the flow of water into Cataract Gorge below 0.42 cumecs per second on weekend days whilst the exemption is in force; and

(v) Hydro Tasmania is to make every effort to minimise the duration of any reduction in the flow of water into Cataract Gorge below 0.42 cumecs; and

(vi) Hydro Tasmania is to notify the Secretary of the Department of Primary Industries, Parks, Water and Environment, a minimum of 24 hours in advance, of any reduction in the flow of water into Cataract Gorge below 0.42 cumecs; and

(vii) following any period during which the flow of water into Cataract Gorge is reduced below 0.42 cumecs, Hydro Tasmania is to notify the Secretary of the Department of Primary Industries, Parks, Water and Environment as soon as practicable after the flow of water is restored above 0.42 cumecs.

The purpose of this Order is to exempt Hydro Tasmania from a requirement of its special water licence to not, in the construction and operation of any works, reduce the flow of water in the South Esk River below 0.42 cumecs, subject to a range of conditions as specified in this Order. The exemption is necessary to enable Hydro Tasmania to undertake essential works on Trevallyn Dam, which will require the flow of water into Cataract Gorge to be stopped for brief periods

I, Peter Carl Gutwein, Treasurer, for the purposes of section 10A of the Government Business Enterprises Act 1995, give notice of the transfer of the assets listed in Schedule 1 of this notice by Tasmanian Networks Pty Ltd ACN 167 357 299 to Tasmanian Railway Pty Ltd ACN 139 383 761, subject to the terms, conditions and limitations contained in this notice.1 Definitions‘Asset’ has the meaning given to that term in the Government Business Enterprises Act 1995.‘Transfer day’ means the date referred to in clause 2 of this notice.‘State’ means the State of Tasmania, being the owner of Tasmanian Networks and Tasmanian Railway.2 Transfer dayThe assets are transferred on 15 May 2016.3 Consideration

(a) For the purposes of section 1(3) of schedule 1A of the Government Business Enterprises Act 1995, the assets are transferred by Tasmanian Networks to Tasmanian Railway for nil consideration.

(b) For the avoidance of doubt, the transfer under this transfer notice must be recorded in the financial accounts as follows:(i) in the case of Tasmanian Railway, as a contribution by the State; and

GENERAL PURPORT OR EFFECT OF THE ABOVEMENTIONED STATUTORY RULES

(1) Proclamation under section 2 of the Local Government Amendment (Code of Conduct) Act 2015This proclamation fixes 13 April 2016 as the day on which the Local Government Amendment (Code of Conduct) Act 2015 commences.

(2) Local Government (Model Code of Conduct) Order 2016

This order sets out the model code of conduct relating to the conduct of councillors.

(3) Local Government (General) Amendment Regulations 2016These regulations amend the Local Government (General) Regulations 2015 consequentially on the making of the Local Government Amendment (Code of Conduct) Act 2015 and the Local Government (Model Code of Conduct) Order 2016 made under that Act.

(4) Registration to Work with Vulnerable People Amendment (Regulated Activities) Regulations 2016These regulations amend the Registration to Work with Vulnerable People Regulations 2014 by –

(a) prescribing certain child-related activities and services to be regulated activities for the purposes of the Registration to Work with Vulnerable People Act 2013; and

(b) prescribing certain other matters for the purposes of that Act.
