VILLAGE OF ROCHESTER 2017-69 May 22, 2017 PUBLIC WORKS COMMITTEE 7:00 p.m. Chris Johnson called the meeting to order at 7:00 p.m. with Nick Ahlers, Gary Beck Jr., Chris Bennett, Ed Chart, and Doug Webb present. Vince Klemko was absent.

Also present: Village Trustees Gary Beck and Russ Kumbier; Christopher Birkett, Public Works Manager; Betty Novy, Clerk-Treasurer; and John Tierney, Village Engineer. Period for Public Comment: No citizens registered for public comment. Beck Jr. moved, 2nd by Bennett to approve the minutes from the April 24, 2017 meeting. Motion carried. Information Items: Review long-term road plan for the village and provide direction. Birkett provided a brief overview of the road plan noting that in 2010 the village developed a long term road replacement plan based on the inventory of roads under its jurisdiction, the age of those roads, and their PASER scores. The PASER rating system was explained as a uniform state wide tool used to score roads based on the condition of the pavement. A new road is rated 10, with ratings decreasing incrementally down to 1 for roads so badly deteriorated that they need complete reconstruction. A color coded map was reviewed that showed all roads under village jurisdiction and their associated PASER ratings. The road replacement plan groups roads in five year blocks based on when they will need resurfacing. The costs to perform the work associated with each grouping is incorporated into the village’s capital improvement plan which pays debt back based on the life expectancy of the work performed or the asset it is associated with. Debt issues which accommodate each five year road improvement group are scheduled for a 20 year payment term – the average life expectancy of the roads. Birkett noted roads age differently based on different factors- intensity of use, drainage, base, soils, etc., and stressed the importance of chip-sealing, edge patching, and crack-filling in extending the life of the roads. Some roads may last as long as 30 years, but others can start deteriorating badly as soon as 8 – 10 years. Each planned grouping of roads is reviewed and re-evaluated each five years based on actual conditions. This plan was developed so that the village can stay within the guidelines of state levy limits, but still be responsible in terms of keeping up with road maintenance. It also allows the village to keep the tax rate stable. Birkett reported the village is currently in its second five year group. N. River Road, from Main Street north towards the Village limits, and Fox Grove Drive were completed last year. The rest of the five year grouping involves resurfacing Mather through Clark Streets, Springwood Lane, E. Spring St., Water St., E. Fox St. and Ela Avenue based on available funds. The condition of several roads that seem to be deteriorating prematurely were discussed, including Oak Knoll Road and S. State Street. Birkett noted Oak Knoll is scheduled for reconstruction in 2026. The importance of talking to property owners about ditching before projects begin was discussed so that they understand how important drainage is to the life expectancy of roads. Committee members agreed that a project encompassing the remainder of roads in this five year grouping should be put together this Fall for early bidding in 2018. Action Items: Review and discuss Snowplowing contract specifications. Committee members reviewed and discussed current snowplowing contract specifications. Consensus of the Committee was to recommend approving the snowplowing contract specifications to put out to bid with three changes to the existing contract: that the annual retainer be increased to $35,000 (from $25,000); that the section on Mobilization Fees be removed; and that the

They also directed that the Public Works Manager contact potential bidders and ask if there is a better way to bid out the contract (e.g. a flat seasonal cost). If so, an option to bid that way should be included and the contract put out to bid as soon as possible. Review and possibly select Chip sealing contractor. Proposals to chip seal Old Orchard Way, Hunters Glen, Royal Hill Road, Royal Hill Court, and N. River Road south of Hwy 36 with boiler slag were reviewed as follows: Fahrner Asphalt Sealers: $55,263; Scott Construction, Inc.: $38,897. Ahlers moved, 2nd by Beck Jr. to recommend awarding the 2017 chip sealing work to Scott Construction for $38,897, with additional direction to get a proposal to add Ridge Line Road, Vergon Drive, Fox View Drive, and Abbey Lane to the program and report those costs for consideration at the June meeting. Votes were: Ahlers: Aye; Beck Jr.: Aye; Chart: Aye; Johnson: Aye; Kumbier: Aye; Webb: Aye: Bennett: Naye. Motion passed. Discuss and possible action for purchase of Public Works truck replacement. Chart presented a quote from Lynch Truck Center, Rochester, WI, for a painted (yellow) 2017 CHEVY Silverado 3500HD 2WD with a MONROE brand 9-foot dump body with folding sides and mini strobe light mount for $38,991. It was noted that purchasing a KNAPHEIDE brand dump body shortens the delivery time by four to six weeks. Birkett reported on soliciting a quote comparative to the painted FORD F-350 that was available through the state contract for approximately $36,538 from Miller Motors, Burlington, WI. They chose not to submit a proposal. The painting costs of $3,300 included in the CHEVY quote were discussed as well as how painting the truck a high visibility color will delay its delivery by four to six weeks. Committee members noted several other municipalities have white fleet trucks and determined that the visibility of a white truck could be improved through the use of high visibility tape, logos, and the addition of strobe corner lights. Ahlers moved, 2nd by Beck Jr. to recommend authorizing the purchase of a white Chevy Silverado 3500 truck with a 9’ KNAPHEIDE brand dump body with pull down sides with the addition of corner strobe lights and reflective tape for a price up to $36,500 from Lynch Truck Center. VILLAGE OF ROCHESTER SEWER UTILITY RESOLUTION #2017-7

ACTIONS SET FORTH BY THE VILLAGE OF ROCHESTER SEWER UTILITY BOARD RELATING TO SPECIFIC CMAR SECTIONS: RESOLVED, the Village of Rochester Board of Trustees will continue to work towards identifying and remediating clear-water infiltration sources in Village of Rochester sewer system in order to reduce utility costs for treatment. Utility rates will continue to be reviewed and adjusted twice annually to reflect actual sewage treatment costs. Adopted, approved and recorded this 26th day of June, 2017.

5. Financial Management General Comments

The Village of Rochester Sewer Utility participated in a cooperative project with the WesternRacine County Sewerage District in 2016 whereby 36 leaking sewer laterals were replaced andsanitary sewer mains were lined. The Village utiity paid $260,111 in capital funds towards thesecosts but is already seeing significant reductions in its treatment costs. Overall, the project was asuccess!

Village of Rochester Park Shelter Sub Committee

Meeting called to order by committee chairman. Steve Fladwood at 7:00PM.

Roll was taken, Fladwood, Monsen, Chart were present, Chris Johnson and Nick Ahlers was absent. DPW

Manager Birkett was also present.

Period for public comment: No citizens registered for public comment.

Minutes were approved Monsen moved, Chart seconded.

The committee reviewed and discussed the Engineers plan that Chart had obtained. The plan did not

have the 14' patio area on the plan. Committee discussed and decided to add the 14' to the 3' drip

apron. The width of the concrete patio area will be 30' .

The committee discussed Orientation for the structure, it was decided to have it run parallel with the

basketball court and that the patio extends to the West. The committee also recommended that electric

be stubbed out for future electrification if the board decides to pursue that option. Water was also

discussed but can be added at a later time without impacting construction.

The committee recommended the above actions to the DPW Committee to move forward with the

process. Monsen moved, Chart seconded, motion approved.

The committee will meet again after the results of the Village board meeting are known.

Monsen moved to adjourn Chart 2"d Meeting adjourned at7:25 PM. Motion carried.

of five months, or within 30 days of acquiring ownership of a licensable dog, at the office of the Village Treasurer.

b. A person who is temporarily keeping a dog is not required to license the dog in

the Village if the dog is licensed in the municipality where it usually resides. c. A person who is fostering a dog is not required to license the dog if the dog is

kept in the Village for no longer than 30 days, provided that the dog has a certificate of veterinary inspection.

d. A person who is granted a Kennel License pursuant to subsection L.2. shall

provide Rabies Certificates and apply for Kennel Tags annually. The Kennel Owner is responsible for ensuring that dogs kept or harbored at the kennel have current rabies certificates and for affixing kennel tags to the collars of all dogs age five months or older.

2. Fees. The fees for licenses shall be determined by the Village Board and set forth in the

Fee Schedule, and shall provide for a lesser license fee for altered dogs and for a late fee for licenses applied for after January 31st, or on or before the age of five months, or within 30 days of acquiring a licensable dog,

L. Limitation on Dogs and Cats; Kennel Licenses.

1. Except as set forth in subsection 3, the maximum number of adult cats and/or dogs five months of age or older allowed per residential dwelling unit or other premises in the Village is limited to four, but no more than three of those animals may be dogs over five months of age. Anyone wishing to keep more than the allowed number of dogs or cats must obtain a kennel license pursuant to subsection 2.

a. The limitation on the number of dogs set forth herein applies to dogs that are

owned, fostered and/or boarded. It does not apply to the temporary keeping of dogs, provided that such dogs are temporarily kept for no longer than two weeks. In the event of the temporary keeping of dogs or cats for persons who are deployed, a Special Exception Permit may be applied for and granted by the Village Board.

b. A dog or cat breeder who engages in the sale of 25 or more dogs and/or cats per

year, regardless of the age of the animal, that the person has bred and raised, unless all of the dogs and/or cats are from no more than three litters, must obtain a Kennel License. Such an operation is considered a commercial business.

c. Any person who sells, distributes, or trades, or offers for sale, distribution or

trade, 25 or more dogs or cats in a year that the person has not bred and raised, regardless of the age of the animal, must obtain a Kennel License. Such an operation is considered a commercial business.

2. Kennel License. No person shall keep, own, or operate a kennel within the corporate

limits of the Village of Rochester without first obtaining a kennel license to do so from the Village Board. "Kennel" means any residential dwelling unit or other premises wherein or whereon four or more dogs or cats are kept for any purpose as set forth in subsection 1, except as set forth in subsection 3.

a. No kennel license shall be issued for any land that is less than three acres in

area unless such kennel exists and is licensed on the date of the adoption of this Chapter.

P. Restriction on Number of Livestock and Other Non-Domestic Animals.

1. Except as provided in subsection 2, no person shall place, allow or consent to the placement on his or her property any livestock or other non-domestic animals on a parcel of land less than five acres in area.

2. Exceptions. The restriction set forth in subsection 1 shall not apply to:

a. Agriculturally zoned parcels of real estate which are equal to or greater than five

acres. b. A property owner who has obtained a Special Exception Permit pursuant to

subsection Q of this section. c. Parcels of real estate which are contiguous to other parcels owned by the same

individual or members of the owner’s immediate family, such as parents, children or siblings, which in aggregate are equal to or greater than five acres in area.

d. Legal Nonconforming Use. The lawful nonconforming use of a parcel of real

estate existing at the time of the adoption of this Code may be continued, although the use does not conform with the provisions of this section; however:

(1) Only that portion of the land in actual use may be so continued and the

nonconforming use may not be extended to additional lands; and (2) The nonconforming use must be in compliance with any terms and

conditions of a zoning ordinance affecting the property. (3) Discontinuance of nonconforming use. If a nonconforming use is

discontinued or terminated for a period of twelve months, any future use of the structure or land shall conform to the provisions of this section.

(4) Current File. A current file of all nonconforming uses and structures shall

be maintained by the Village Clerk to the extent it is reasonably practical to do so listing the following: property location, use of the structure or land and date the use became nonconforming.

Q. Special Exception Permit. Notwithstanding any provision contained in this chapter to the contrary,

in the event that a person wishes to raise and/or maintain any animal or fowl as otherwise contrary to subsection N of this section, or a property owner seeks to place, allow or consent to the placement of livestock or other non-domestic animals within 300 feet of a dwelling unit as otherwise contrary to subsection O of this section, or place such animals on property containing less than five acres contrary to subsection P of this section, said person or property owner shall apply for a Special Exception Permit, which shall require the approval of the Village Board. Special Exception Permits may be granted by the Village Board for the presence of more than the number of dogs or cats allowed in a residence set forth in subsection L only under the following circumstances: for the combination of households when the occupants already own animals (for the life of the animals); for the temporary keeping of dogs and/or cats during a deployment (for the term of the deployment); and for the addition of a service dog to a household.

1. Application. Not less than twenty days prior to the next regularly scheduled meeting of

the Public Works Committee, the applicant shall pay a fee in an amount set by the Village Board and set forth on the fee schedule, and shall file with the Village Clerk an application setting forth the following:

a. The parcel of real estate that is the subject of the request.
