    REPORT

    On November 14 15, 2012 the VIII International Conference Entrepreneur and Consumer Steps Towards Each Other was held in Moscow. The Conference was conducted within the framework of the Consumer Education and Protection Initiative (CEPI) program under the support of the Asia-Pacific Economic Cooperation (APEC) and the World Federation of Direct Selling Associations (WFDSA). The Conference organizers were the Russian Direct Selling Association (RDSA) and the International Confederation of Consumer Societies (CONFOP).

    More than 75 representatives of business circles, representatives of executive state power bodies, entrepreneurs as well as representatives of the Federal Service for Supervision of Consumer Rights Protection and Human Welfare (Rospotrebnadzor) and consumer organizations from Belgorod, Veliky Novgorod, Volgodonsk, Vologda, Voronezh, Yekaterinburg, Kazan, Kaluga, Kostroma, Lipetsk, Magnitogorsk, Moscow, Omsk, Penza, Perm, Rostov-on-Don, Ryazan, Saint-Petersburg, Saratov, Smolensk, Tver, Tula, Khabarovsk, Cherepovets took part in the Conference. Journalists representing 5 newspapers, magazines and news agencies participated in the Conference as well.

    The conference was devoted to the discussion of the following problems: Problems of small business taxation. Problems of consumer rights judicial protection on the consumer market. Problems of the consumer educational level. Problems of self-regulation on the consumer market. Problems of consumer rights protection in the direct selling industry. Development of anti-pyramid legislation.

    In her opening remarks Tamara Shokareva, President of the Russian Direct Selling Association, reported that the VIII International Conference Entrepreneur and Consumer Steps Towards Each Other was conducted within the framework of the Consumer Education and Protection Initiative (CEPI) program under the support of the World Federation of Direct Selling Associations (WFDSA). She pointed out that the program was ultimately aimed at a creation of such socio-economic environment under which the small business is permitted to develop dynamically through the implementation of additional consumer rights protection measures.

    Dmitry Yanin, Chairman of the International Confederation of Consumer Societies, in his welcome speech pointed out that the Conference was an optimal format for a dialogue between consumer organizations, governmental bodies and business circles that implemented self-regulation in their everyday activities. In his speech Dmitry Yanin referred to activities of the Russian Direct Selling Association as a positive example of implementation of self-regulation principles on the consumer market.

    Also in the course of his speech he dwelled upon problems of the improvement of the consumer rights protection legislation.

    Sergey Shtogrin, First Deputy Chairman of the RF State Duma Budget and Tax Committee, informed the Conference participants of the legislative acts that were considered and adopted by the RF State Duma in the area of tax legislation.

    In the course of his presentation Mr. Shtogrin reported that at the moment the RF State Duma was considering amendments to the RF Tax Code that specified the amount of tax on income of natural persons when tax payers used social and pecuniary exemptions and that determined incomes that were exempted from income tax payment.

    REPORT

    In his presentation Mr. Shtogrin laid a special emphasis on the draft law On Entering Amendments to Separate Russian Federation Legislative Acts on Issues of Mandatory Pension Insurance that was submitted by the RF Government and that proposed to introduce in 2015 a 3-time growth of social contributions to the RF Pension Fund for individual entrepreneurs that did not use any employees. He stressed the fact that the above amendments would stultify the work of a great number of individual entrepreneurs that had low income or that just started their entrepreneurial activities and especially for those ones that were engaged in their activates with the purpose of earning additional income to their primary salary, pension, child care allowance, etc.

    Sergey Shtogrin told the Conference participants that he had submitted an amendment in compliance with which individual entrepreneurs that used a simplified taxation system and did not have any employees should pay social contributions for mandatory pension insurance in the amount that did not exceed 6% of their income but that should not be less that the level of their social contributions established for 2012.

    The presentation of Andrey Artemyev, Head of Municipal Budget Institution Yekaterinburg Municipal Consumer Protection Center and President of the All-Russia Consumer Protection League, addressed some peculiarities and problems of utilization by courts of Resolution of the RF Supreme Court No. 17 of June 28, 2012.

    He said that it was necessary to create in Russia a state concept of consumer rights protection that would determine the legislation development as well as the procedures for supervisory bodies in this area.

    In his presentation Mikhail Emelyanov, First Deputy Chair of the RF State Duma Committee on Economic Policy, Innovative Development and Entrepreneurship, marked that when one was speaking about the legislation in the consumer rights protection area it was necessary to find a balance between interests of entrepreneurs and interests of consumers.

    He informed the Conference participants of draft bills related to consumer rights protection that were under consideration at the RF State Duma at the moment.

    Mr. Emelyanov proposed to arrange at the RF State Duma hearings devoted to the consumer rights protection problem. He said that Conference participants could elaborate draft amendments to the legislation and proposed to consider those amendments at Duma hearings.

    Oleg Prusakov, Department Head of the Federal Service for Supervision of Consumer Rights Protection and Human Welfare (Rospotrebnadzor), dwelled upon legal aspects of Rospotrebnadzors participation in the judicial protection of consumer rights.

    In his presentation Oleg Prusakov spoke in detail about provisions of Resolution of the RF Supreme Court No. 17 of June 28, 2012 that clarified a number of controversial issues of law enforcement practices.

    Also he indicated some statistical information on Rospotrebnadzors participation in judicial protection of consumer rights in 2011.

    Tamuna Gabilaia, Executive Director of the World Federation of Direct Selling Associations, made a presentation on the development of the global direct selling industry in 2011.

    The presentation of Petr Shelisch, Chairman of the RF Consumer Union, was devoted to the judicial protection of consumer rights.

    REPORTIn his speech Mr. Shelisch marked the fact that at the moment it was necessary to improve the quality of the legislation, to arrange a state supervision of execution of the legislation in the consumer rights protection area. He said that it was necessary to improve the quality of judicial protection of consumer rights and especially court decisions in consumer rights protection area.

In his speech Valery Petropavlovsky advised the Conference participants of the main provisions of the EU Directive on Unfair Business Practices and proposed to try to adapt it to Russian environment.

    The key topics of discussions within the frame of the Round Table were: Problemsofconsumerrightsprotectioninthedirectsellingindustry. Problemofunethicalbusinesspracticesofanumberofdirectsellingcompaniesthatarenot members of RDSA. Developmentofanti-pyramidlegislation. ProblemsofconsumereducationoftheRussianpopulation. Problemsofself-regulationontheconsumermarket.

    On November 15, 2012 within the frame of the VIII International Conference Entrepreneur and Consumer Steps Towards Each Other the Conference participants visited the industrial and warehouse complex of ACCORD POST located in Klimovsk town (Moscow region).

    The participants were acquainted with technologies of processing of postal correspondence on personalized communication with clients. The data control center, the industrial facilities, the warehouse and the call-center were demonstrated to the Conference participants.

    The participants were deeply impressed by the tour of the ACCORD POST facilities. The visit confirmed the fact that RDSA member companies placed much emphasis on the quality of customer services and implemented modern and innovative technologies provided by associated members of the Russian Direct Selling Association.

    The program Customer Education and Protection Initiative CEPI was elaborated in 1998 and was officially approved at the Meeting of the Ministers of Small Business of APEC member states held in 1999 in Christ Church, New Zealand. The APEC CEPI program is a result of the partnership of private structures and public organizations of the APEC member states, as well as representatives of business and entrepreneurship circles of these countries.
