INSTRUCTION TO THE TENDERERS

1) SCOPE OF WORK :

a) Supply of materials specified in Schedule "A" appended hereto the full quantity as per order to be placed.

b) The requirement of material indicated in Schedule “A” has to be supplied in full on

the basis of ordered quantities. Although we may rely on single reputed manufacturer for supply of the quantity indicated, in order to ensure timely receipt of material, it is likely to split and ordered to more than one supplier. .

c) The material is to be delivered against the requirement of Superintending Engineer, O & M Kalyan Circle II, MSEDCo Ltd, Kalyan at our Major Stores Netivali, Kalyan.

d) The quantities required by us are approximate and the total quantity may vary +/- 5%.

e) The supplier will have to supply the material indicated in Schedule “A” at the rate given in the schedule.”A” as per requirement from the S.E. O & M Kalyan Circle II, MSEDCo Ltd, Kalyan .

2) PRICES :

a) The Tenderers should quote only single price/rate for the quantity offered by them. The offers with prices quoted on slab basis and or with any conditional discount on any account shall not be accepted

b) The Prices should be quoted on free delivery basis at our Major Stores Kalyan and inclusive of packing forwarding, freight and transit insurance but excluding Excise Duty, Sales Tax, Octroi etc. The price should be on firm quotation basis. In case the Prices are quoted including; the present rate and amount of Excise Duty, Sales Tax, Octroi etc.. should be mentioned separately.

3) SALES TAX (IF ANY)/VAT:

i) This MSEDCo Ltd is registered under the Sales Tax Act of the Maharashtra State, so also under the Central Sales Tax Act 1956.

ii) Declaration on Form "E"/"C" will be issued whenever and wherever applicable.iii) The Tenderer should give his Sales Tax Registration No. and mention Tax

applicable as below to his offer in Schedule "A".a) Sales Tax /VAT % with "E" Form. Orb) Central Sales Tax % with "C" Form.

4) DISCLOSING THE NAME OF THE MANUFACTURER : Whenever material is described by name of the particular make being offered on re-sale basis, the Tenderer shall specifically disclose the name of the original supplier or the manufacturer. The Firm shall not be allowed to supply the material offered from any other manufacturer than the quoted make unless prior permission in writing is so obtained from this office.

i) The Tenderer shall quote his lowest reasonable rate in the enclosed Schedule "A" only and not on his letterhead.

ii) The Tenderer shall quote his rate per unit specified in Schedule "A" in figures as well as in words. Any variation in the rates etc. will not be allowed on any ground such as mistake, misunderstanding etc. after the Tender has been submitted.The Tendered rate must include in general.a) All charges for container and packing.b) All charges to effect free delivery at our Stores.

iii) Suppliers printed Terms and Conditions will not be considered as forming part of the offer.

iv) In case of difference between the rates in figures and words, the tender is liable to be rejected.

6) AMBIGUITY IN QUOTATION :

Tenderers are requested to make a note that in case of ambiguous Terms in respect of free delivery at our Stores, Excise Duty, Sales Tax or if the blanks are not filled in or answered, the offer shall be liable for rejection.

7) FILLING IN OF QUESTIONAIRE :

Tenderers are requested to ensure that the comments against each and every item/clause of Annexure/Questionnaire shall be clearly filled in and answered. Any item/ clause shall not be left blank or unanswered. If any item/clause is not applicable, the words "NOT APPLICABLE' shall be written against it.

8) ADDITIONS/ALTERATIONS PROHIBITED :

Tenderers shall not make any additions, alterations or the changes in the tender form and in the conditions of Tender and supply, including the description and specification of material mentioned. They should quote rate for the material described in the enclosed schedule "A"

9) SIGNING OF THE TENDER DOCUMENTS: The offers must be submitted in the tender documents only and be clearly and legibly filled in with all Schedule and must be either in ink or typewritten. The offer along with all documents such as tender details, tender form, conditions of tender, supply, questionnaires, drawing and test certificates etc… should be duly signed on each page and corrections, if any, should be duly initiated. There should be no overwriting. The over writing should be avoided and any correction shall be duly initiated. Tenders not signed as above shall be liable to be rejected.

10) SUBMISSION/SUPERSCRIBING OF THE TENDER DOCUMENTS. IMPORTANT

The bidder shall submit his offer detailed below.a) Copy of receipt regarding payment of E.M.D. amounting to Rs. 5000/--b) Valid Income Tax clearance Certificate.c) Valid Sale Tax/VAT Registration Certificate.d) Previous experience of supplying similar items, if any.

The tenderers are requested to enclose their offers in an envelope of proper size, duly sealed. This envelope containing the complete offer shall be super scribed indicating the address, tender No., due time and date of submission and details as follows, before posting and delivering the same.

details.

i) Telegraphic offers or offers received in the form of Telex Message shall not be entertained and considered under any circumstances.

ii) Tender documents received after the due date and time of the submission may not be accepted.

iii) The Tender received in person or by post, after the due date and time of submission shall not be opened and no correspondence will be entertained. The Board shall not be responsible for any cause arising out of such delay.

iv) In case the date of opening happens to be Holiday, the Tender shall be opened on the next working day at the same time as far as possible.

v) The MSEDCo Ltd, reserves right to reject any or all offers without assigning any reason thereof.

11) DISREGARD OF TENDER CONDITIONS:

The MSEDCo Ltd, reserves the right to reject any tender, which does not confirm to any of the conditions or instructions etc. in respect of the tender.

i) The Tenderer should note that no correspondence shall be entertained or considered after the due date.

ii) To judge the capacity and capability of the Tenderer or his manufacturer, the Tenderer shall furnish a list of orders executed by him or by his Manufacturers for the last 3 years indicating the name of the Purchaser, material ordered, quantity ordered, value, the delivery quoted, the delivery executed, performance certificate from the user and the deviation or slippage in delivery. Details of pending orders and quantities outstanding against orders of these offices and others should be indicated separately. The Tenderer should have completed orders amounting Rs 20 Lakhs during last year.

12) ACCEPTANCE OF TENDER:

The MSEDCo Ltd, does not bind itself to accept the lowest offer or disclose any reason for rejection of any Tender or part of Tender. It is also not binding on the MSEDCo Ltd, to disclose any analysis, report on Tender or samples. The MSEDCo Ltd, shall reserve right to order out/procure any quantity in excess to the extent of 50% or any less quantity of the quantities TENDER NO. SE/ KC- II /TECH/08-09/T 8offered by the Tenderers. The quantity specified would be for dispatched to destination at our Kalyan Stores, as per requirement.

13) SUBMISSION OF SAMPLES:

Sample is to be prepared strictly as per the specification and drawing which will be given to Tenderer by this office along with the intimation letter .The drawing attached with this Tender documents are only illustrative drawing and are meant for Tender purpose only. The authorized representative of MSEDCo Ltd. will approve this sample and supply shall be strictly according to this sample only. The subsequent supply will be checked as per approved sample by our Dy. Ex. Engineer (Stores) [The Consignee]

14) EARNEST MONEY DEPOSIT :

Tenderers should pay 1% of the Tender value i.e. Rs 5000/- towards the Earnest Money unless the firm is exempted on account of statutory directives. Earnest Money shall be paid in the office of the Superintending Engineer, Maharashtra State Electricity Distribution Co Ltd, O & M Kalyan CIRCLE II, KALYAN, 3rd floor "Tejshree" Jahangir Maidan, Karnik Road, Kalyan- 421 301 Or by Demand Draft drawn on the Scheduled Bank in Kalyan in favour of MSEDCo Ltd, A reference to the Tender number should be given in case the E.M.D. is paid in Cash or by DD before the due date of the Tender and the relevant deposit amount and receipt No. should be mentioned in the Tender. Interest shall not be paid by MSEDCo Ltd, on this deposit. Earnest Money Deposit shall be forfeited in the following cases.

a) In case the Tenderer withdraws tender/offer during the validity period, or differ from any terms and conditions of tender.

15) EARNEST MONEY OF UNSUCCESSFUL TENDERER :

Earnest Money Deposit shall be returned to the unsuccessful Tenderers, after the Tender has been decided, and on submission of application & original Receipt of E.M.D. paid; to the Superintending Engineer, O & M KALYAN CIRCLE II, KALYAN. "Tejshree" Jahangir Maidan, J.M Road, Kalyan-(West) 421 301.

16) OFFER OF S.S.I. UNITS :

Offers of the S.S.I. Units shall be considered in accordance with the State Government's G.R.No. BKS/1088/(2512)/Industries-6, dated 2/1/1992 and prevailing rules of the MSEDCo Ltd, from time to time.

17) DELIVERY: The Tenderer is requested to quote deliveries FOR destination only. The tenderer should quote clear delivery time schedule in the Column No (2). Of schedule A. Offers with qualified delivery schedule which directly or indirectly affects the conditions of the tender and supply of material given in Schedule-A shall be liable for rejection. The tenderer should strictly adhere to the delivery period as the time being essence of the contract. The delivery will be deemed to have been completed on the date of receipt of material at Stores, unless the material so delivered is rejected by the MSDCo Ltd.

TENDER NO. SE/ KC- II /TECH/08-09/T 818) LIQUIDATED DAMAGES :

PENALTY FOR LATE DELIVERY : In case the material is not delivered in time, the supplier shall be liable to pay penalty, at the prescribed rate i.e. at half percent of the price per week subject to a maximum of 10% reckoned on the contract value of such incomplete supply of material including the portion supplied which could not be brought in to commission

due to any part thereof not having delivered in time. Non-availability of raw material or its procurement or any related problem will not be considered as a reason for late delivery or as a Force Majeure.

RISK PURCHASE :

Failure to effect the supply of material, MSDCo Ltd, will procure the material from market at the rate prevailing and in accordance with Indian Contract Act. The additional cost so, required to procure the material shall be recovered from the suppliers, on whom the orders has been placed and who have to be delivered the material within stipulated period.

19) CONDITIONS OF SUPPLY :

i) QUALITY OF SUPPLY :

The Material offered should be strictly as per specification, for material mentioned in Schedule "A" and as per drawing which will be given to Tenderer by this office along with the intimation letter, strictly in accordance with it and as per the approved standards/samples. Bulk supplies will commence only after approval of the first sample. Supplier will keep this office informed of the progress of manufacture of the material, from time to time.

ii) VALIDITY OF THE TENDER :

The offer of this Tender, shall be open for acceptance by the MSEDCo.Ltd for a period of 90 (Ninety) days from the date of opening of the Tender and the Tenderer shall be bound to supply the materials mentioned in Schedule ” A” at the same rate on acceptance by the MSEDCo Ltd, during validity period of the contract.

iii) SECURITY DEPOSIT :

The Supplier should pay Security Deposit at the rate of 10% of the value of the original order would be placed on them. Security Deposit is payable by (a) Banker's Cheque (b) Cash (c) Demand Draft (d) Pay order, in favour of Maharashtra State Electricity DISTRIBUTION CO Ltd

iv) PAYMENT OF BILLS :The Suppliers will be paid 90% payment of the price along with Excise Duty, Sales Tax / VAT etc. of the consignment by A/c Payee Cheque only, after the supply of material and the of submission of bills to this office. The release of payment also subject to supply of material as per our specification, in good condition and verification thereof and on receipt of S.R. Note from the Stores. Remaining 10% of the payment will be made after the expiry of the guarantee period. However if the payment is delayed for any reason the Tenderer cannot claim interest/damage etc.


V) INSURANCE: In all cases insurance shall be done by supplier with Government Insurance fund or with other insurance authorities subject to or approval for all risks.

VI ) GUARANTEE :Material should be guaranteed for workmanship and quality for a period of 18 months from the date of supply for 12 months from the date of commissioning whichever is earlier. In case subsequently during usage of material or prior to that if any defect in the material is noticed by MSEDCo Ltd, the good quality material shall be supplied, free of cost and earlier material shall be taken back by the supplier.

vii) CONSIGNEE:

The Consignee will be the Dy. Executive Engineer, (Stores) Major Stores at Kalyan.

viii) MSDCo Ltd’s TERMS & CONDITIONS

It is presumed that the Tenderer is fully aware of the Board's General Conditions of Contract for the supply of plant, equipment and material particularly in respect of Earnest Money Deposit, Security Deposits, Terms of payment, penalty for the late delivery, etc. and other important terms, any ignorance of these conditions will not exempt the Tenderer from his liability to abide by the same. The Board will also take no responsibility for any accident to contractor or his workers/staff/ officers or damage to his tools /plants /machinery etc., while carrying out MSEDCo Ltd, works and no compensation / damages etc. shall be paid by the MSEDCo Ltd,. Tenderer shall be bound by MSEDCo Ltd’s, standard Terms& Conditions to the extent, the same are not alters/ varied/amended/ modified/added /deleted here in.

20) OCTROI:

The Octroi exemption certificate will be issued by our stores officers Major Stores, Netivli, Kalyan. The supplier should collect this certificate before the date of delivery of material.

21) AGREEMENTS:

Whenever agreements are to be executed, the supplier shall be execute the same in the form and manner as required by the Board on the required stamp papers at his cost.

22) WEIGHMENT

The material shall be weighed and weighment charges shall be born by the Tenderer only. The weighment slips and challans shall be submitted with the bills

23) DISPUTE: In case of any dispute or differences arising regarding any matter, the decision will be given by the Chief Engineer, Zone office, Kalyan and his decision will be final and binding on the Tenderer.

24) LEGAL JURISDICTION.This Tender, subsequent order and related matter is subjected to legal jurisdiction of Kalyan Court only.

General specifications for Hot Dip Galvanised fabrications.

Scope: The scope of this tender includes fabrication, hot dip galvanized and supply of articles required for HT / LT line as per drawings enclosed. The drawings enclosed are only illustrative and are for tendering purpose. The detailed drawings will be along with detailed drawing.

General: The Channel / angle sections to be used for fabricating the cross arms etc. are detailed in the drawing. The clamps should be shaped invariably by not bending only. There should not be sharp edges. Generally the fabrication is to be made out of M.S. channel of 75x40x6mm and 100x50x6mmHowever, if desired by Company and other size of Angle, Flat, Channel fabrication will have to supplied by the tenderer at the rate for Angle, Flat, Channel quoted by him on Kg.(weight) basis.

Galvanising: All fabrication shall be hot dip galvanized in strict accordance with ISS 4759. before galvanizing all the surfaces should be thoroughly degreased, rust should be removed either sand blasting or applying an effective rust remover.The mass of zinc coating over the surface shall not be less than 610 gm/m2. Uniform thickness of coating all over the surface should be ensured.

Acceptance Test: i ) Visual inspection. ii ) Dimensional check.

iii ) Weight check.

Type test: Galvanizing tests as detailed above.
