REGULAR COUNCIL MEETING OF THE FARMVILLE TOWN COUNCILHELD ON JUNE 14, 2017

Mayor Whitus called to order the regular meeting of the Farmville Town Council held on

Wednesday, June 14, 2017 at 7:00 p.m., in the Council Chamber of the Town Hall, located at

116 North Main Street, Farmville, Virginia.

Present at the meeting were Mayor D.E. Whitus, presiding and Council members D.E.

Dwyer, D. L. Hunter, S.B. Thompson, T.M. Pairet, A.D. Reid, and G.C. Cole.

Council member J.J. Davis was absent.

Staff present was Town Manager, Gerald Spates; Town Attorney, Gary Elder; Chief of

Police, Andy Ellington; Town Treasurer, Carol Anne Seal; Director of Public Works, Robin

Atkins; Town Planner, Cindy Morris; Town Clerk, Lisa Hricko; Communications Specialist,

Kate Eggleston and Administrative Assistant, Jackie Vaughan.

Mayor Whitus welcomed guests and asked for a moment of silence for the Washington

D.C. shooting victims and the two officers that were instrumental in saving lives. Rev. Michael

Kendall led the invocation and Mr. Reid led the Pledge of Allegiance.

PUBLIC COMMENT PERIOD

Mr. Greg Tsigaridas, representing Stars Under the Stars Film Series, addressed Council,

providing an update on this year Film Series. He stated that 2017 marks the 20 th season for the

outdoor Film Series. The mission of the Series is to show classic movies, 25 years or older, free

to the public and under the stars at the Crute Stage. Mr. Tsigaridas expressed appreciation to the

community, the sponsors and the Town for their support of the Series over the past 20 years.

REQUEST APPROVAL OF THE CONSENT AGENDA

On motion by Mr. Hunter, seconded by Mrs. Thompson and with all Council members

voting “aye”, the consent agenda was approved as submitted. The consent agenda includes the

draft minutes of the May 3, 2017 regular work session meeting, the May 10, 2017 reconvened

work session and the draft minutes of the regular May 10, 2017 Council meeting.

REQUEST APPROVAL OF THE TREASURER’S REPORT

On motion by Mr. Hunter, seconded by Mr. Cole and with all Council members voting

“aye”, the motion to approve the Treasurer’s Report as presented was approved.

with Council members Dwyer, Hunter, Thompson, Pairet, Reid and Cole voting “aye”, the

motion to authorize the Town Treasurer to pay the bills as submitted was approved.

REQUEST ON BEHALF OF MR. RICHARD BRATCHER TO PURCHASE PARCEL NO.

0023A07(16)00-37

On motion by Mr. Pairet, seconded by Mrs. Thompson and with a recorded vote with

Council members Cole, Reid, Pairet, Thompson, Hunter and Dwyer voting “aye”, the motion to

accept the recommendation of the Infrastructure Committee and grant the request on behalf of

Mr. Richard Bratcher to purchase parcel number 0023A07(16)00-0037 for $10,500, was

approved. It is the Town’s policy that all fees associated with the transaction are to be paid by

the requester and that the Town Attorney is to review all documentation of the transaction.

BACKGROUND:

Mr. Richard Bratcher, property owner of 900 4th Avenue, Ext., requested to purchase a lot

owned by the Town of Farmville, located on Third Avenue that adjourns his property. The parcel

is undeveloped and is not on an open street. In order to build on the lot, the street would need to

be paved. Mr. Bratcher advised, at the present time he plans to leave the property as a natural

habitat and has no plans to build on the lot.

Council had referred this matter to the Infrastructure Committee. The Committee

discussed the request and recommended Town Council move forward with the public hearing.

The hearing was held this evening and there were no comments.

REQUEST TO ABANDON A PORTION OF BARROW STREET BETWEEN FOURTH

AVENUE, EXT. AND THE UNOPENED PORTION OF THIRD AVENUE

On motion by Mr. Pairet, seconded by Mr. Cole and with all Council members voting

“aye”, the motion to accept the recommendation of the Infrastructure Committee and continue

the request on behalf of Mr. and Mrs. Bratcher and Mr. and Mrs. Kiewiet de Jonge for the

abandonment of a portion of Barrow Street between Fourth Avenue, Ext. and the unopened

portion of Third Avenue was approved.

BACKGROUND: Mr. Pairet, Chairman of the Infrastructure Committee informed Council

that Mr. Spates spoke with Mr. Bratcher today and presented the Infrastructure Committee’s

recommendation. Mr. Pairet stated he is asking for a continuation in order for the Bratchers and

Kiewiet de Jonges to discuss and explore their options. Mr. Pairet stated the Infrastructure

Committee would meet prior to the July Council meeting and present their recommendation to

Council.

The public hearing was held this evening and there were no comments, Mayor Whitus

questioned by continuing the request would an additional public hearing need to be held and the

Town Attorney indicated no.

REQUEST ADOPTION OF ORDINANCE NO. 182 - TO EXTEND THE REBATES ON

NEW RESIDENTIAL AND COMMERCIAL WATER AND/OR SEWER CONNECTIONS

WITHIN THE CORPORATE LIMITS OF THE TOWN OF FARMVILLE

On motion by Mr. Pairet, seconded by Mr. Reid and with a recorded vote with Council

members Cole, Reid, Pairet, Thompson, Hunter and Dwyer voting “aye”, the motion to accept

the recommendation of the Finance and Ordinance Committee and adopt ordinance No. 182,

extending the rebates on new residential and commercial water and/or sewer connections within

the corporate limits of the Town of Farmville, the ordinance is to be reviewed prior to its

expiration on June 30, 2018, was approved.

ORDINANCE NO. 182 CONTINUES THE REBATE ESTABLISHED BY ORDINANCE NO. 178 FOR RESIDENTIAL CONNECTIONS WITHIN THE CORPORATE LIMITS OF THE TOWN OF FARMVILLE TO THE TOWN WATER/SEWER SYSTEM IN THE AMOUNT OF $ 2,000 PER TAP FOR THOSE WATER AND/OR SEWER TAPS PURCHASED BETWEEN JULY 1, 2017 AND JUNE 30, 2018 UPON SUBMISSION OF APPROPRIATE DOCUMENTATION TO THE TOWN THAT THE HOOK UP HAS BEEN COMPLETED WITHIN SIX (6) MONTHS OF JUNE 30, 2018. ORDINANCE NO. 182 ALSO PROVIDES FOR A DISCOUNTED RATE FOR WATER AND/OR SEWER CONNECTIONS FOR BUSINESS AND COMMERCIAL PROJECTS WITHIN THE CORPORATE LIMITS OF THE TOWN OF FARMVILLE. CURRENTLY, COMMERCIAL WATER OR SEWER CONNECTION COSTS $4,500, PLUS LABOR, MATERIALS AND EQUIPMENT TO MAKE TAP. WHEREAS, the Farmville Town Council seeks to protect the health, safety and welfare of the citizens of the Town of Farmville; and

WHEREAS, access to water and proper management of waste are essential to the protection of health, safety and welfare; and

WHEREAS, the Town of Farmville wants to assist those citizens who would like to connect to the Town’s water and sewer system.

NOW THEREFORE BE IT ORDAINED by the Farmville Town Council this 14 th day of June, 2017, that any citizen who purchases a water and/or sewer tap for residential use in the Town of Farmville between July 1, 2017 and June 30, 2018, shall receive a rebate in the amount of $2,000 per tap upon written proof of a building permit to construct a residence and issuance of a Certificate of Occupancy for new construction, and/or upon written proof that an existing residence is hooked up to the Town water/sewer system no later than December 30, 2018; and

BE IT FURTHER ORDAINED that for any business or commercial development or similar project in the Town of Farmville, if the water and/or sewer tap is purchased between July 1, 2017 and June 30, 2018 and all construction is complete by December 30, 2018, the Town shall issue a rebate in whatever amount is appropriate to reduce the cost of each water and/or sewer connection to be the equivalent of $2,000 per tap, plus labor, materials and equipment to make tap.BACKGROUND: Ordinance #178 provides a discount on new residential and commercial

water and/or sewer connections within the corporate limits of the Town of Farmville. The

ordinance expires on June 30, 2017. At the May Council meeting, noting the community’s

economic growth, the Finance and Ordinance Committee recommended Council authorize

advertisement for a public hearing on continuing the rebates. The public hearing was held this

evening.

CONTINUED - REQUEST ADOPTION OF ORDINANCE NO. 184, PERMITTING

OPENING BURNING WITHIN THE CORPORATE UNDER SPECIFIC REGULATIONS

AND REQUIREMENTS

On motion by Mr. Cole, seconded by Mrs. Thompson and with all Council members

voting “aye”, the motion to delay action on the adoption of Ordinance No. 184, until further

discussion by Council was approved. Members expressed health safety concerns for those with

compromised breathing.

BACKGROUND: The Farmville Volunteer Fire Department has requested Town Council

consider allowing open burning within corporate limits of the Town of Farmville for the burning

of brush and garden material and the clearing of construction sites. Both would require a permit,

fee and approval of the burn site by the Town’s Fire Marshal and the Chief of the Farmville

Volunteer Fire Department. At the May 10, 2017 Council meeting, Council authorized

advertisement of a public hearing on the proposed ordinance. The public hearing was held this

evening and no one addresses Council.

VACANCY ON THE LOCAL BUILDING OFFICIAL BOARD

On motion by Mr. Cole, seconded by Mr. Pairet and with a recorded vote with Council

members Dwyer, Hunter, Thompson, Reid, Pairet and Cole voting “aye”, the motion to accept

the recommendation of the Personnel Committee and appoint Mr. Brian Vincent to the Farmville

Local Building Official Board, was approved.

BACKGROUND: The vacancy is to fill the unexpired term of Mr. Southard Brumfield, who

was appointed to the Board of Zoning Appeals and is no longer eligible to serve on the Local

Building Official Board. Mr. Vincent’s term on the Local Building Official Board expires on

May 31, 2018 and he will be eligible for reappointment for a four (4) year term.

VACANCY OF TOWN REPRESENTATIVE ON THE CENTRAL VIRGINIA REGIONAL

LIBRARY BOARD

On motion by Mr. Reid, seconded by Mr. Hunter and with a recorded vote with Council

members Cole, Reid, Pairet, Dwyer, Hunter and Thompson voting “aye”, the motion to accept

the recommendation of the Personnel Committee and appoint Ms. Mary Jane Cook as

Farmville’s representative on the Central Virginia Library Board, was approved. Mrs. Cook’s

term will begin July 1, 2017 and run through June 30, 2021.

BACKGROUND: Mr. Lowell Frye, Farmville’s representative on the Centra; Virginia

Library Board will be stepping down on June 30, 2017, after serving for two (2) four years terms.

Representatives serve a four (4) year term, with a maximum of two (2) terms. At the May

Council meeting, Town Council referred reviewing the Volunteer Applications to the Personnel

Committee for their recommendation to Council.

APPOINTMENT OF MEMBER TO THE FARMVILLE INDUSTRIAL DEVELOPMENT

AUTHORITY

On motion by Mr. Pairet, seconded by Mrs. Thompson and with a recorded vote with

Council members Dwyer, Hunter, Thompson, Pairet, Reid and Cole voting “aye”, the motion to

accept the recommendation of the Personnel Committee and request that the Circuit Court of

Prince Edward County appoint Teresa Stewart to the Farmville Industrial Development

Authority was approved. Ms. Stewart is to fill the unexpired term of Elizabeth Ragland, a term

ending on February 28, 2018.

BACKGROUND: Mr. Spates stated Elizabeth Ragland had resigned from the Authority due

to health reasons and Ms. Stewart has expressed an interest in serving. The Personnel

Committee had reviewed the Community Volunteer Applications and supported the appointment

of Teresa Stewart to the Farmville Industrial Development Authority.

REQUEST APPOINTMENTS TO THE FARMVILLE PLANNING COMMISSION

On motion by Mr. Reid, seconded by Mr. Cole and with a recorded vote with Council

members Dwyer, Hunter, Thompson, Pairet, Reid, and Cole voting “aye”, the motion to accept

the recommendation of the Personnel Committee and appoint the following individuals to the

Farmville Planning Commission were approved.

Sherry Honeycutt – Ward A, term ending on June 30, 2018

Abigail O’Connor – At-large, term ending on June 30, 2021

John Miller – Ward B, term ending June 30, 2018

Chuck Ross – At-large, term ending June 30, 2018

L.D. Phaup – term ending June 30, 2018

Jerry Davenport – Ward E, term ending June 30, 2021

Cameron Patterson – Ward C, term ending June 30, 2021

Patrick Crute – Ward D, term ending June 30, 2021

BACKGROUND: The Personnel Committee met on May 25, 2017 to review and discuss the

Citizen Volunteer applications received to fill the vacancies on the Town’s Boards, Commission

and Authority. Mr. Spates stated it has been Council’s desire that the Planning Commission

membership mirror that of Town Council with equal Ward representation. He stated that all

members are eligible for reappointment when their current terms expire.

TOWN MANAGER’S ANNUAL PERFORMANCE EVALUATION

On motion by Mrs. Thompson, seconded by Mr. Cole and with all Council members

voting “aye”, the motion to continue the Town Manager’s annual performance evaluation until

the reconvened Council meeting was approved.

ADOPT THE 2017-2018 TOWN BUDGET

Mayor Whitus stated this matter would be continued. The Code of Virginia requires

seven days between the public hearing and when Council may adopt the budget.

BACKGROUND: The Finance and Ordinance Committee has finalized their

recommendations on the 2017-2018 Town budget and the public hearing was held this evening.

REQUEST ON BEHALF OF CASANDRA HARRIS TO HAVE A BLOCK PARTY ON

SERPELL STREET

On motion by Mr. Hunter, seconded by Mr. Reid and with all Council members voting

“aye”, the motion approve the request by Cassandra Harris to hold a block party on Serpell Street

on July 1, 2017 from 2:00 p.m. until 9:00 pm was approved. The rain date will be July 8, 2017.

BACKGROUND: Mr. Spates stated this is an annual neighborhood event and he sees no

issue with approving the request.

ADOPT RESOLUTION TO THE VIRGINIA DEPARTMENT OF TRANSPORTATION

On motion by Mr. Pairet, seconded by Mrs. Thompson and with Council members

Hunter, Dwyer, Pairet, Thompson, Reid and Cole voting “aye”, the motion to adopt a resolution

pledging full faith and credit to Virginia Department of Transportation for the installation of and

maintenance of utilities owned or maintained by the Town of Farmville to be located with the

Town limits of Farmville, Prince Edward County or Farmville, Cumberland County, was

approved.

BACKGROUND: The Town is currently doing a project for the Virginia Department of

Transportation, in which they require the Town to adopt a resolution pledging full faith and

credit. The resolution saves the Town from having to post a bond when working with or for the

Virginia Department of Transportation on projects. The resolution is to be valid from June 7,

2017 to March 31, 2021.

REQUEST FOR APPROVAL OF AND CONCURRENCE IN ISSUANCE OF TAX-

EXEMPT BONDS ON BEHALF OF CENTRA HEALTH AND AFFILIATES

On motion by Mr. Hunter, seconded by Mr. Reid and with a recorded vote with Council

members Cole, Reid, Pairet, Thompson, Hunter and Dwyer voting “aye”, the motion to adopt the

resolution concurring with the Lynchburg Inducement Resolution and approve the issuance of

the Bonds by the Lynchburg Authority with respect to the portion of the Centra Southside

project, was approved.

BACKGROUND: Centra requested that the Lynchburg EDA issue tax-exempt bonds to

finance the Farmville-Related Projects and to finance and refinance other projects. Mayor

Whitus stated the resolution does not financially obligate the Town.

On motion by Mr. Hunter, seconded by Mr. Reid and with a recorded vote with Council

members Cole, Reid, Pairet, Thompson, Hunter and Dwyer voting “aye”, the motion to refund

Ankur Brahmbhatt $2,456.32 on their 2017 Quality Inn business license provided their 2017

Personal Property tax is paid, was approved.

BACKGROUND: Quality Inn changed ownership on April 28, 2017 and Mr. Ankur

Brahmbhatt has requested a refund for the overpayment of the business license.

REQUEST APPOINTMENT TO THE LOCAL BUILDING OFFICIAL BOARD

On motion by Mr. Dwyer, seconded by Mrs. Thompson and with a recorded vote with

Council members Hunter, Dwyer, Pairet, Thompson, Reid and Cole voting “aye”, the motion to

reappoint Mr. Lynn Ayers and Mr. Robert Winthrop to the Farmville Local Building Official

Board, was approved. Mr. Ayers three-year term will run through June 1, 2020 and Mr.

Winthrop’s four-year term will run through June 1, 2021.

BACKGROUND: Mr. Lynn Ayers and Mr. Robert Winthrop terms on the Local Building

Official Board expired on May 31, 2017. Both have agreed to continue to serve on the Board.

REQUEST HOLIDAY HOURS

On motion by Mr. Reid, seconded by Mr. Hunter and with a recorded vote with Council

members Cole, Reid, Pairet, Thompson, Hunter and Dwyer voting “aye”, the motion to follow

the State and grant Monday, July 3, 2017 as a holiday was approved. Town Offices will be

closed on Monday, July 3, 2017 and Tuesday, July 4, 2017 for the 4th of July holiday.

BACKGROUND: Mr. Spates requested Council to grant Monday, July 3, 2017 as a holiday

for Town employees.

STANDING COMMITTEE REPORTS

Public Safety, Chairman Hunter – nothing to report

Town Property/Building Committee, Chairman Thompson – nothing to report

Infrastructure Committee, Chairman Pairet – Mr. Pairet stated the Committee will meet

and make a recommendation on the request to abandon a town street right of way at the next

Council meeting.

Personnel Committee, Chairman Reid – Mr. Reid reported that the Committee will be

meeting next week to discuss the Town Manager’s annual performance evaluation.

Parks and Recreation, Chairman Cole – Mr. Cole reported the Town has received over

500 recreational assessment surveys. The Committee will be meeting next week to look over the

surveys and continue the discussion in the master plan study.

MISCELLANEOUS ITEMS

The 100-Yard Sale will be held on Saturday, July 1, 2017.

Mr. Spates presented Council with copies of Farmville’s historic district map. He stated,

currently there are no projects that will interfere with the historic district, unless there is a

historic structure within the project.

Members received copies of the proposed street paving map, which included the cost of

milling and paving the street. Mr. Spates stated there have been minor adjustments to the

original plan.

Mr. Spates shared with Council a traffic study recently completed on Perry Drive by the

Farmville Police Department. During the four-day period, the study showed that the

majority of vehicles using Perry Drive obeyed the speed limit. The speed limit on Perry

Drive is 25 mph and the average speed of a vehicle traveling on Perry Drive was 28 mph.

Mr. Spates stated another traffic study would be done when the Longwood University

students return.

Mr. Spates presented Council with the final sketch of the new Welcome to Farmville

sign. He stated adjustments were made to the original design, which created a price

reduction.

Mr. Spates asked Council to refer the cost to open and close graves at Westview

Cemetery to the Finance and Ordinance Committee. Mr. Spates stated the Town’s fees

are low compared to other localities. He also expressed concerns about the scheduling of

public works employees on the opening and closing of graves.

Mayor Whitus spoke of Longwood University Real Estate Foundation’s plans of

renovation Frazier and Curry dorms. The project will cost an estimated $60 million dollars and

collection. Town Attorney, Gary Elder stated that the Town had used every means available and

applicable to the law with no success of collecting the monies. Mr. Spates added the

uncollectable delinquent accounts include water/sewer accounts, business personal property and

parking tickets and ranging from 2003 through 2011. Council expressed concern that the write-

off totals $63,000 and dated back to 2003. Mrs. Seal stated delinquent accounts had not been

written off since 2005 and in the future uncollectable delinquent accounts would be submitted to

Council for write-off annually.

CLOSED SESSION – PERSONNEL, LEGAL CONSULTATION FOR PROBABLE

LITIGATION AND LAND DISPOSITION

On motion by Mr. Cole, seconded by Mr. Hunter and with all Council members voting

“aye”, Council went into closed session under Section 2.2-3711.A.1 of the Code of Virginia, for

discussion personnel matters involving the Town Treasurer; Section 2.2-3711.A.7 of the Code

of Virginia for the briefing by staff members and legal counsel pertaining to probable litigation,

where such consultation or briefing in open meeting would adversely affect the negotiating or

litigating posture of the Town of Farmville; and Section 2.2-3711.A.3 of the Code of Virginia,

for discussion or consideration of the disposition of publicly held real property, where discussion

in an open meeting would adversely affect the bargaining position or negotiating strategy of the

public body

Mayor Whitus called for a five (5) minute recess. Council reconvened in closed session.On motion by Mr. Hunter, seconded by Mr. Pairet Council retuned to the regular order of

business.

CERTIFICATION OF CLOSED MEETING

WHEREAS, the Farmville Town Council has convened a closed meeting on this date pursuant to an affirmative recorded vote and in accordance with the provisions of The Virginia Freedom of Information Act; and

WHEREAS, Section 2.2-3712 of the Code of Virginia requires a certification by the Farmville Town Council that such closed meeting was conducted in conformity with Virginia law;

NOW, THEREFORE, BE IT RESOLVED that the Farmville Town Council hereby certifies that, to the best of each member’s knowledge, only public business matters lawfully exempted from open meeting requirements by Virginia law were discussed in the closed meeting to which this certification resolution applies, and only such public business matters as were identified in the motion convening the closed meeting were heard, discussed or considered by the Farmville Town Council.
