I. Introduction

A. Project background

1. Objectives of the Project

The Urban Environment and Climate Change Adaptation Project funded by ADB will construct and upgrade the urban environmental infrastructures, stormwater and wastewater management, and flood control in order to minimize environmental pollution, improve urban environment and climate change adaption for the two coastal cities, namely Dong Hoi (Quang Binh Province) and Hoi An (Quang Nam Province). The objective of the project is to increase people's accessibility to climate change adapting infrastructure. The project was approved by ADB Board on 27 November 2015. The loan agreement, project agreement, and grant agreement were signed on 25 March 2017 and became effective on 17 July 2017.

2. Basic information of Dong Hoi Project

- Project title: Urban Environment and Climate Change Adaptation Project - Dong Hoi City.

- Funding source: Asian Development Bank (ADB).

- Executing agency (EA): People's Committee of Quang Binh province.

- Project Owner/Implementing Agency (IA): People's Committee of Quang Binh province.

- Total investment: 38,800,000 USD (of which 31,739,000 USD of ADB loan and co-

financing by ADB and 7,070,000 USD counterpart funds of the Government of Vietnam).

- Overall project duration: 2017 - 2022.

- Location of the project: Dong Hoi city, Quang Binh province.

3. Components and main packages of the Project

Component 1: Improvement of wastewater management for the city center.

This component focuses on the construction of wastewater system for the center city in Dong Hoi

city, which includes wastewater drainage system, tertiary sewer system, and 01 lift pumping

station. This component includes package DH/W1.

Component 2: Development of climate change resilient infrastructure for Bao Ninh

Peninsula.

This component focuses on the construction of a new Vertical Road No. 3 with 36m in width from

Km0 to Km2,919 and 03 Horizontal roads connecting the new route with the old one (Vo Nguyen

Giap street); construction of rainwater drainage system D1500 and wastewater drainage route;

construction of 03 pumping stations for levelling and 01 pumping station for transferring

wastewater; construction of 02 regulating lakes; construction of medium voltage lines, transformer

stations, and attached control electrical cabinets. This component is divided into four (4) packages

DH/W3, DH/W4, DH/W5, DH/W8.

Particularly, package DH/G1 provides equipment and materials for all pumping stations under the

two above-mentioned components.

Component 3: Management of flood and other infrastructure.

In this component, the implementation of flood management measures and construction of other

infrastructure to cope with climate change adaptation will eliminate economic, social and

environmental damage due to floods, riverbank/ coastal erosion. The component 3 is divided into

two (2) packages DH/W7, DH/C1.

Component 4: Site clearance and Resettlement.

The main features of this component include: carry out the graves and architectural objects

relocation to create ground for the construction process and resettlement process for the local

people soon stabilize their life as well as develop the local economy.

Component 5: Project Management and Capacity Building.

This project will improve the capacity of project management, implementation and operation

agencies and raise community awareness of climate change. This component includes three (03)

packages:

- Package DH/PISC1: Project implementation support and capacity development.

- Package DH/PISC2: Independent Auditing Consultant.

- Package DH/PISC3: External Resettlement Monitoring

B. Project Implementation Progress

By June 2021, most of the project’s packages have been in construction process. The Project implementation progress is summarized in table 1 as follows:

- Utility trench No. 4, casting manhole components for rainwater drainage and wastewater drainage, box culvert 2x2m

- Installation of sewer pipes D1500 from T61-T65, construction of ditches - Installation of sewer pipes D1500 from manholes T57-T61, P72-P73, construction of

ditches connecting regulating lake No. 1 and No. 2, construction of the regulating lake No. 1.

• DH/W1: - The contractor continues to implement the construction of drainage routes in Bac Ly, Nam

Ly and Phu Hai wards ▪ In Bac Ly ward: Route No.17A, 17B, 14B, 14C, 14 (Pile 14.6 to Pile 14.13), 12, 12A,

15, 16, 04, 2A, 2B, 2C, 2 with an estimated length of 1,588m ▪ In Nam Ly ward: Construction of the routes No. 15, 15A, 07, 09, 10, 16, 1, 11, 12, 21,

23, 31, 38, 38B, 21A, 01, 01B, 01A, 02 with a total length of about 2,400m ▪ In Phu Hai ward: Construction of a pressurized wastewater collection system,

installation of sewer pipe HDPE D160, PN10 with a total length of about 2,200m, pumping station No. 04.

Complete the construction of utility trench on the vertical road No. 4, continue the construction and installation of the surface water drainage system, the wastewater drainage route, the ditch system for the construction of the embankment of the regulating lake No. 1.

Construction of the rainwater drainage system, wastewater drainage system, utility trench system on the vertical road No. 1, No. 2, No. 3 and the power system on the vertical road No. 2

• DH/W8:

Construction of aggregate subbase, aggregate base, utility trench, rainwater drainage system, wastewater drainage system at the chainage Km0+330,51÷Km0+557,76, and Km0+759,34 ÷ Km1+387,33.

II. Institutional Setup and Responsibilities for EMP Implementation and Supervision

A. Institutional setup for Environmental management

The Institutional Relations for Environmental Management has been determined since the EMP reporting and shown in Table 2.

- Actively interact with local people and take actions to avoid disturbance during the construction process.

The contractor’s EMP was approved. The contractor assigned an environmental officer to perform this task (list of personnel is presented in table 3).

The contractor is always willing to listening to local people’s opinions or complaints on the environment during the construction of the workers’ camp.

Environmental monitoring unit

- The contract signs a contract with this unit to monitor environmental components and identify emission sources during the construction process of the Project.

Environmental Reporting System

In accordance with the approved EMP, monthly monitoring reports on EMP compliance as well as semi-annual environmental monitoring reports must be prepared by relevant stakeholders. The detail status of current reporting is described in Table 4.

B. Incorporation of Environmental Requirements into Project Contractual Arrangements As required by ADB, the original EMP must be updated based on the detail design of each project

package and the updated EMPs should be incorporated in the biding documents instead of the

original EMP. The contractors are responsible for preparing their own CEMP that will include a

COVID 19 risks management plan. The succeeding table showing the schedule of updating uEMP,

preparing CEMP and COVID 19 risks management plan.

During this reporting period, all of packages are developing Covid-19 prevention plans to submit to the PMU for approval. Besides, during the construction process, the contractors also seriously take measures to prevent Covid-19 epidemic including wearing masks when working, washing hands with hand sanitizer, checking the temperature daily for workers, keeping a safe distance on the construction site as recommended by the Government, the Ministry of Health and local authorities. Contractors should post the Covid-19 prevention posters at the workers’ camp and construction sites. PISC1 supervises the contractors' compliance with Covid-19 prevention measures and promptly reports any non-compliance cases to PMU. PISC1 Consultant and PMU also strictly implement the local Covid-19 prevention recommendations such as providing hand sanitizer, checking temperature daily for the staff, officers, and guests to the office, wearing facemasks and arranging staff to work from home…. As of the end of this reporting period, there have been no cases of COVID-19 infection in the project units.

III. Compliance with the environmental covenants of the project The status of compliance with Environmental Covenants of the Project is presented in the table

below.

Implementing Agencies to ensure that the preparation, design, construction, implementation, operation and decommissioning of the Project and all Project facilities comply with: (a) all applicable laws and regulations of the Borrower relating to environment, health and safety; (b) the Environmental Safeguards; and;

(c) all measures and requirements set forth in the IEEs, the EMPs, and any corrective or preventative actions set forth (i) in a Safeguards Monitoring Report or (ii) which are subsequently agreed between ADB and each Project Executing Agency (on behalf of itself and the Borrower)

a. The EIA of the project was approved by Quang Binh PPC in Decision No. 2131/QD-UBND dated June 28, 2018. The contractor is required to comply with all applicable labor laws and core labor standards during construction. b.

The preparation and approval of uEMP is in compliance with the requirements. The EIA report of the project was approved according to Decision No. 1231/QD-UBND dated June 28, 2018; uEMPs of package DH/W4 and DH/W5 were prepared and approved in September 2018; uEMPs of package DH/W3 and DH/W8 were approved in January 2019; uEMP of package DH/W1 was approved in March 2019. The uEMPs have been included in the bidding documents and the contract with the contractors. Contractors prepare the Environmental Management Plan and submit it to the the PISC1 consultant and the PMU for approval prior to the commencement of construction. c. The Monthly Safeguard Monitoring Reports of contractors are submitted to the PISC1 consultant. The consultant prepares a Quarterly Safeguard Monitoring Reports for the PMU and assists the PMU in preparing the Semi-annual Safeguard Monitoring Reports to submit to ADB. Corrective actions at the request of the PISC1 consultant, PMU or ADB have been implemented.

IV. Environmental impacts mitigation measures implemented in the reporting period

A. The compliance status with environmental requirements during the ADB Mission

During the review in December 2020, ADB identified a number of environmental issues that should be resolved. PMU and PISC1 consultant have requested contractors to implement these measures and have been recognized by ADB during the monitoring period in May 2021. Besides, some assessments of the ADB mission team in May 2021 have also been taken into consideration and adjusted by PMU and PISC. The detailed measures are presented in the following Table.

B. Monitoring of the EMP Compliance by PISC1

PISC1 daily supervises the contractors' compliance with EPM on site as well as the monthly environmental reports. In terms of the environmental and labor safety issues that fail to meet the requirements, PISC1 will issue the official letter to request for resolution. In this reporting period, PISC1 has issued official letter No. RHDHV/PICS1/210630.1 dated June 30, 2021 requesting the contractor of package DH/W1, DH/W3 to take measures to ensure traffic safety. The letter is attached in Appendix 1 of the report.

The contractors frequently report the status of compliance with EMP and environmental impacts mitigation measures to the PMU in monthly, quarterly, and semi-annual environmental reports.

In the context of social distancing due to the COVID-19 epidemic, technical staffs, environmental experts of CSC/PISC1, and PMU staff carry out site supervision in compliance with regulations of the local government.

From January to June 2021, Quang Binh province applies the Government's CT15 directive, so the contractors still work on the construction site and implement epidemic prevention measures as required by the local government. The PMU has mobilized the environmental expert of PISC1 consultant, who is living in Dong Hoi city, to supervise the implementation of environmental impact mitigation measures at the sites of the packages DH/W1, DH/W3 DH/W4, DH/W5, DH/W8. The environmental specialist of PISC1 was mobilized for a total of about 1 month to do site supervision during this reporting period. Specifically, the environmental specialist carried out site supervision 4 days in March from 23th to 26th, 5 intermittent days in April from 1st to 7th, 5 intermittent days in May, on 6th , 17th – 18th and 24th - 25th, and 3 intermittent days in June, on 4th, 21th and 30th .

Besides, because PISC1 Consultants does not have a position of safety engineer, monitoring activities on occupational safety, traffic safety, COVID-19 prevention, etc. are further supported by the site inspectors of PISC1. These site inspectors still work normally when Quang Binh province applies Directive 15 in the first 6 months of 2021. The officer who is in charge of the environmental and social safety policies of the PMU also performs supervision as usual. Both the staff of the PMU and PISC1 Consultant comply with the requirements of epidemic prevention in accordance with the requirements of the locality.

The contractor's COVID prevention measures are outlined in Table 8 below..

V. Environmental impact monitoring

A. Monitoring plan and responsibilities

PISC1 Consultant take responsibilities for environmental monitoring. The environmental monitoring program is implemented quarterly. The environmental parameters include air quality, surface water quality, noise and vibration. The three air quality monitoring parameters include: Noise, Dust, CO, SO2, NO2, and surface water quality monitoring parameters include: pH, Suspended Solids, BOD5, COD, Ammonium, Chloride, Iron, Lead, Total grease. During this reporting period, environmental monitoring activities have been carried out in March and June 2021.

Sampling locations for environmental quality monitoring of the packages are determined in uEMP, air quality is monitored at 15 locations of the packages DH/W1, DH/W3, DH/W4, DH/W5

The results of ambient air quality monitoring in this reporting period show that all parameters are within the permissible limits of the standards according to QCVN 05:2013/BTNMT, except for noise at locations K3. , K12, K13, K14, K15 in the monitoring period in March 2021 and the

location at K11, K13, K14 in the monitoring period in June 2021 are higher than the permissible limits. The reason for this issue is the participation of many other means of transport at the time of monitoring.

Comparing the monitoring results in March and June 2021 with the background environmental monitoring results sampled and analyzed during the preparation phase of the EIA report in May 2018 (The background environment results are included in Appendix 3 of the report), it shows that the monitoring parameters fluctuate as follows:

- TPS: The results at the sampling locations in March 2021 and June 2021 are higher than the background environment results in May 2018. However, all values of the TPS parameters are below the permissible limits.

- NO2: The results at 14/15 sampling locations in June 2021 are lower than the background environmental results in May 2022, while the results in March 2021 had 9/15 locations which are lower than the background environmental results, but all locations are within the permissible limits.

Noise: Most of the monitoring results in March and June 2021 are lower than the background environment in May 2018 because most of the results in May 2018 are above the permissible limits. During the monitoring period in March 2021, the results of noise at 5 locations K3, K12, K13, K14, K15 and 3 locations K11, K13, K14 in the monitoring period in June 2021 were higher than the permissibe limits of QCVN 26:2010/BTNMT. Many means of transport at the intersections at the monitoring time is considered to be the primary reason for the noise problem at these monitoring locations. Mitigation measures of contractors have been mentioned above.

The results show that all monitoring parameters are within the permissible limits of QCVN 08-MT: 2015/BTNMT – National technical regulation on surface water quality.

Comparing the surface water monitoring results in March and June 2021 with the background environmental results during the preparation phase of the EIA report in May 2018 shows that the pH, TSS, BOD5, COD are higher, but all of the parameters are below the permissible limits.

In terms of the ammonium, iron, and lead, the monitoring results in March and June also show that they are all higher than the background environmental results, except that the Total grease remains unchanged in all three monitoring times.

VI. Public consultation, grievance redress mechanism

A. Public consultation and information disclosure The EIA of the Project, the environmental protection plan of DH/W1, DH/W3, DH/W4, DH/W5,

DH/W8 have been published in Bao Ninh commune. Besides, the contractor also provided an

information board about the project including name, package, design consultant, supervision

consultant, construction contractor, and location.

In this reporting period, the DH/PISC1 supervision consultant only conducted the public

consultations in the form of direct interviews with a few households surrounding the construction

site of DH/W1, DH/W3, DH/W4, DH/W5, DH/W8. The results of the interview are as follows:

- All participants were well-aware of the construction and supported the construction. Local

people living around the construction site in Phu Hai ward, Bac Ly junction, Nguyen Thi

Dinh street, Truong Chinh, Nhat Le, Ly Thuong Kiet, Huu Nghi, Hoang Xuan Han street

confirmed that they had not been affected by the construction activities and there had been

no labor accidents or environmental incidents since the commencement of construction of

the packages.

- The list of the interviewees is added in Appendix 4 of the report

B. Grievance redress mechanism Before the construction of DH/W1, DH/W3, DH/W4, DH/W5, DH/W8, the grievance redress

mechanism (GRM) has been established and operated since 2019 in order to address community

concerns and assist the project to maximize environmental and social benefits.

The GRM has been disclosed to APs through the meetings, public consultations with

representatives of the PMU, PISC1, contractors, and local authority & AHs.

When the construction of the packages starts, the contractor will publish information board at the

gate of the construction area or close to the construction area including information about the

project name, package, design consultant, supervision consultant, construction contractor,

location, so that the AHs can know and contact if any complaints occur.

PMU has been setting up a system to monitor and record complaints. This system includes:

- Tracking forms and procedures for grievance redress.

- Processes for informing stakeholders about the status of a case;

- Procedures to retrieve data for reporting purposes, including the periodic reports to the

ADB.

Additionally, the procedure available under the Civil Law and the Land Law No. 45/2013/QH13;

Law on Complaints No. 02/2011/QH13; and Decree No. 47/2014/ND-CP

In the public consultations, the GRM was discussed and all AHs agreed with the proposed GRM.

By the reporting period, the PMU found out that

VII. Capacity building activities The implementation of capacity building activities for the Project is essential and should be

integrated in the project construction process.

In July 2020, with the assistance of the PISC1 Consultant, PMU organized the training on ADB environmental safeguard policy for contractors of package DH/W3, DH/W4, DH/W8 and PMU staff. Contractors were provided with basic information about the environmental management system, environmental compliance requirements according to ADB policies, as well as experience in implementing mitigation measures at the construction site. In addition, the consultant also guided the contractor on how to prepare monthly environmental reports.

Plan of capacity building training on environmental safeguards for the remaining contractors DH/W1, DH/W8… was submitted by PISC1 and approved by PMU in June 2021. However, due to the complicated developments of the Covid-19 epidemic and the State's regulations on the Covid-19 prevention (limiting mass gatherings), training sessions on environmental capacity building have not been carried out in this reporting period.

The PISC1 consultant proposes the expected training plan in the near future as follows:

- Training on environmental safety policy for contractors of package DH/W1, DH/W8.

- The training period: 01 day in October 2021 or November 2021, the specific training time will be agreed with the PMU after the COVID19 epidemic is basically under control.

- The training content will introduce ADB safeguard policy, the contractor's compliance with the EMP, mitigation measures at the site, supervision process of the contractor's environmental safety staff, and reporting the environmental compliance. Specific training program and training materials will be submitted to the PMU for consideration and approval.

- Environmental Expert of PISC1 Consultant is responsible for conducting the training. In case the expert cannot conduct offline training in Dong Hoi, an online training plan will be developed and submitted.

There are several issues that contractors have not carried out since the beginning of the contract, including:

The prolonged and complicated development of the Covid-19 epidemic is considered the primary reason that has affected the contractors’ performance. PISC1 Consultant have requested the contractors to remind and disseminate safety measures at every weekly meeting, so far there have not been any labor safety incidents occurring in all packages. Waste oil and grease are currently being collected by contractors into boxes and stored at the camp to find a collection and treatment unit. Besides, the contractors are preparing the Covid-19 prevention plan to submit to PMU for approval, and the contractor still applies epidemic prevention measures during the construction process. Specific details of each issue and implementation responsibilities are shown in Table 13 below.

IX. Conclusions and recommendations

A. Overall Progress of Implementation of Environmental Management Measures The environmental management system of the project has been established and operated rather

effectively. All environmental requirements from both ADB and the Government have been

implemented.

During the reporting period, the stakeholders namely the Project Management Unit, PISC1 Consultant, the construction supervisor, and the Contractor, have sufficiently performed the required tasks in compliance with the environmental safety policy. Specifically:

PISC1 consultant taking responsibilities for construction supervision and capacity building conducts monitoring of EMP compliance activities of contractors at the construction site, requests immediate corrective actions for unsatisfactory issues. Periodic monitoring in the first 6 months of 2021 has been carried out by PISC1 as planned. Monitoring results of environmental components are updated in this reporting period. The PISC1 consultant will continue to carry out the monitoring in the last 6 months of 2021 as planned. Monitoring results will be updated in the next reporting period. The PISC1 consultant prepares the environmental safety monitoring report for the first 6 months of 2021 for the PMU to consider and approve. The PISC1 consultant complies with the requirements of COVID-19 prevention according to local regulations, and simultaneously, monitors and reminds contractors about this work. During the site monitoring process, the PISC1 consultant also consulted the people around the construction site about the impacts of construction activities, so far, in the current reporting period, there have been no complaints from the local people.

Contractors of packages DH/W1, DH/W3, DH/W4, DH/W5, DH/W8 have taken corrective actions as required from the previous ADB review; complied with COVID-19 prevention measures including the preparation of a COVID19 prevention plan in order to carry out construction under new normal conditions. The contractors are preparing the Covid-19 prevention plan to submit to PMU for approval. During construction, the contractors not only relatively effectively implement the environmental mitigation measures, but also maintain and comply with the report preparation.

The PMU conducts site inspections, discusses and reminds contractors to improve the implementation of environmental measures. The PMU has reviewed the Environmental Safety Monitoring Report for the first 6 months of 2021 prepared by the PISC1 consultant and submitted it to ADB for consideration and comments. The PMU also regularly supervises the opinions of people around the construction site of the packages in order to propose timely measures.

B. Proposed actions The remaining environmental issues of the Project during this reporting period are clearly

presented in section B, part VIII. Relevant agencies are required to mobilize resources to urgently

resolve these issues.

In the context of complicated developments of the Covid-19, the contractor is required to

sufficiently comply with the Covid-19 preventive measures during the construction process to

ensure the workers’ health and safety.

The environmental monitoring program should be carried out as planned in the next reporting period. According to the construction progress and the current status of Covid-19, PISC1 Consultant and the sampling unit should arrange a reasonable sampling plan to ensure the safety and comply with the requirements of the Government.

When the Covid-19 epidemic is under control, training courses on labor safety, environmental sanitation and HIV should be promptly implemented.
