I. GENERAL INFORMATION OF THE PROJECT

Impact and Outcome: The project’s impact for Bac Giang, Mong Cai and Sa Pa Towns is aligned

with the Government’s Socio-Economic Development Strategy (2011-2020), i.e. economic, socio-

cultural and environmental development in the three towns of Bac Giang, Mong Cai and Sa Pa

improved, contributing to making Viet Nam a modern-oriented, industrial country by 2020. The

project outcome will be improved urban services in Bac Giang, Mong Cai cities and Sapa town.

Outputs: Outputs of the project are: (i) strategic local economic development plans (SLEDPs) and

Sa Pa Green City Action Plan (GCAP) developed; (ii) priority urban infrastructure investments

implemented; (iii) institutional capacities for managing public investments strengthened; and (iv)

community awareness on project activities and environmental sustainability improved.

The project includes: (i) five subprojects in Bac Giang, namely BG1: Tran Quang Khai Road;

BG2: North Eastern Ring Road; BG3: Wastewater Collection and Pond Improvements; BG4:

Stormwater Improvements; BG5: Wastewater Treatment Plant Extension; (ii) three subprojects in

Mong Cai, namely such as MC1: Construction of Wastewater Treatment and Stormwater drainage

system – East; MC2: Construction of Wastewater Treatment and Stormwater drainage system –

West; MC3: River Bank Protection; (iii) three subprojects in Sa Pa, namely such as SP1:

Wastewater and Drainage; SP2: Road 1 – Route 152; SP3: Town Center Enhancement.

Environmental Monitoring Report: Environmental Monitoring for the first 6 months of 2019 is

prepared by the Project Implementation Support Consultant (PISC) for the PMUs. This report

addresses the following issues:

i) Project Implementation Progress

II. IMPLEMENTATION PROGRESS1

2.1. Overview

As of June 30, 2019, the value of work completed in the project is estimated at about 39.32% of

the total workload of the whole project. In particular, the rate of completion of the Bac Giang

Subproject is about 22.18%, the Mong Cai Subproject is about 55.71% and the Sa pa Subproject

is about 18.57% compared to the overall progress.

The proportion of the value of workload and actual progress has been achieved for each work item

of the project as follows: (i) Construction and installation of equipment accounts for 80.81% and

the actual progress of this item has been completed at about 26.50%; (ii) Compensation and

clearance works accounted for 5.30% and the actual progress of this item was about 99%; (iii)

PISC consultancy service accounts for 1.46% and actual progress of this item is about 54.83%;

(iv) independent consultant on resettlement accounts for 0.23% and actual progress of this item

being completed at 40%; (v) The Green Sa pa Green Action Plan Consultancy accounts for 1.14%

and the actual progress of this project was 0%; (vi) Other types of consultancy services, project

management and other expenses (using state budget) account for 11.05% and the actual progress

of this item was about 60.16%.

2.2. Overall project implementation progress:

Overall assessment of the progress of the project to date: most of the items of the project basically

meet the requirements of the proposed plan. However, bidding and especially the selection of

contractors is slower than planned so there is a potential risk that affects the overall progress of

the project. Detailed design of the packages has basically been completed. On the other hand, in

the process of construction, there have been some problems that require design changes. These

are: (i) package BG2: additional 1.2km of road surface that needs rehabilitation to ensure

consistency in road infrastructure (ii) Package BG3: the embankment of Banh Keo Lake has been

built up which requires design changes; (iii) package SP2: Additional viaduct at Km7+500 to

Km7+800 to pass over the creeping area in these section; (iv) Packages MC1 and MC2 need to

add SCADA, package MC3 needs to upgrade the existing park upstream of the Eastern

embankment to remain consistent with the new park downstream, and to convert one old

warehouse into parkland to join the 2 parks, in order to maximize the performance and

sustainability of the project.

Construction work in the field to date: (i) In Bac Giang, there are 4 packages BG1, BG2 and BG3,

BG4 under construction with the completed workload of about 25,32%, 88,20%, 26,15% and 13,7

% respectively; (ii) In Mong Cai, 3 packages of MC1, MC2 and MC3 are under construction with

the completed workload of about 53,4%, 66% and 42,00 %, respectively. (iii) In Lao Cai: SP1,

SP2 and SP3 are under construction with a completed workload of about 7,10%, 33,50%, 35,00%

respectively.

2.3. Construction activities:

Construction work in the field to date: (i) In Bac Giang, there are 4 packages BG1, BG2, BG3 and

BG4 under construction with the completed workload of about 25,32%, 88,20%, 26,15% and 13,7

respectively.

III. ENVIRONMENTAL MANAGEMENT AND MONITORING FRAMEWORK

3.1. Institutional arrangements for monitoring and implementation of the

EMP

The responsibilities of the Parties for Environmental Monitoring are shown in Figure 1 below.

3.2. Stakeholders’ role and responsibilities in implementing EMP

The responsibilities of the Parties for EMP and Environmental Monitoring are shown in Table 2

below.

PPC

Overall responsibility for the successful implementation of the EMP, and liaison

with the Lao Cai PMU, Mong Cai PMU in the submission of comprehensive

environmental safeguard reports to ADB. EA will set up a Project Steering

Committee (PSC) to support the implementation of the EMP.

CPC Monitoring the daily implementation of the project including the implementation

of the EMP and reporting to EA.

PPMU

- Ensure that EMP regulations are strictly implemented during different phases of the

project (design / pre-construction, construction and operation) to mitigate

environmental impacts to acceptable levels. Monitor implementation of the EMP

(mitigation and monitoring measures) with the support of the PSC and PCC;

- Ensure that the implementation of the project complies with the principles and

requirements of ADB's Environmental Policy and Safeguard Policy (SPS 2009).);

- Throughout the implementation of the project, commit and maintain a full-time

team of the PPMU consisting of Environmental and Safeguard Officers (ESOs) to

oversee the implementation of the EMP;

- Ensure that environmental protection measures and mitigation measures in the

EMP are incorporated into the detailed design;

- Secure all necessary environmental permits from DONRE prior to awarding

construction contracts;

- Ensure that the Contractor's Environmental Management Plan (CEMP) and

Environmental Management Plan is included in the bid and the contract for the

construction works;

- Establish a mechanism for addressing environmental grievance, as described in the

IEE, to receive and facilitate the settlement of concerns, complaints and grievances

of affected people in terms of the project's environmental performance;

- With the support of the PCC, prepare the semi-annual Environmental Monitoring

Report for submission to ADB;

- Based on monitoring results of the EMP, identify environmental remedial actions

and prepare corrective action plans if necessary to submit to ADB.

LISC/PISC

- update the EMP to meet the final detail design of subprojects;

- Supervising CEMP preparation of Contractors. Review, clarify and monitor the

implementation of CEMP;

- Provide technical advices and support to PMU / SO to implement EMP; Design

supervision and coordination of PMU-SO's and EO's capacity building and training

programs;

- Implement environmental monitoring in accordance with the environmental

monitoring plan developed in the updated EMP, and implement other plans

approved by ADB and the PMU. Conduct laboratory experiments (EMC) for the

monitoring program specified in this EMP; Prepare monitoring reports for

submission to IA / EA Quarterly;

- Participate in the preparation of monthly and quarterly progress reports for the

subproject (to be submitted to Bac Giang PMU and ADB), and prepare a semi-

annual safeguard policy report (submitted to the EA and ADB);

- Review of possible sites where pollution may occur.

Contractors

- Develop CEMP and submit to Bac Giang PMU (through PISC) for approval before

commencing construction.

- Ensure implementation of the CEMP during construction phase; and

- Prepare and submit a monthly progress report including a report on CEMP

implementation and environmental issues at the construction site.

Detailed Design

Consultant

- Incorporate environmental protection and mitigation measures identified in the

EMP in the design phase of the project; The detailed design stage provides all

necessary information for the PPC to facilitate CEMPs (EMP Management Plans,

Waste Management Plans, Noise and Dust Management, etc.) as described in uIEE

/ EMP.

- During the detailed design phase, inform PCC and LISC of any changes in the

layout or design of the project and provide all necessary information to the PCC to

facilitate any changes, any additional environmental assessment prior to project

development required by the EMP (or additional environmental assessment in the

event of a combined change will result in adverse environmental impacts that do

not fall within the scope of IEE preparation during loan processing, etc.)

- In the detailed design stage, provide all necessary information to the PPMU and the

SC and the PSC to facilitate the approval of the DONRE before awarding the

construction contract.

DONRE

- Reviewing and approving environmental assessment reports as required by the

Government.

- Monitor the environmental performance of the project as DoNRE’s function in

accordance with the state management requirements in the field of environment.

Construction

Supervision Consultant

(CSC)

- Continuous supervision of the contractor. Gather information to monitor contract

performance of the EMP and CEMPs

- Assessment of environmental impacts caused by construction works and

equipment.

- Carry out day-to-day monitoring to ensure that environmental management plans

and CEMPs are properly implemented by contractors.

- Guide workers on the implementation of EMP and CEMPs, health and safety

- Record and answer to the PPMU on occupational accidents, illnesses and incidents

- As part of the regular progress report to the PPMU, preparation of EMP contract

status reports, health and safety.

- Mobilize a national environmental expert to ensure proper implementation of the

above tasks.

- Recruit qualified environmental staff to ensure compliance with environmental and

legal obligations and contractual obligations.

Local Community

- Conducting community supervision of construction activities of the contractor.

- Based on the Grievance Redress Mechanism, promptly notify local authorities and

the PPMU of non-compliance with environmental management measures.

Environmental Reporting System:

In accordance with the approved uEMP, monthly monitoring reports on uEMP compliance as well

as semi-annual environmental monitoring reports must be prepared by relevant stakeholders. The

detail status of current reporting is described below.

charge of monitoring of Environmental Safety and Labor Safety for each package in all subproject.

PISC: There is one firm for PISC to help 3 PMUs during project implementation. Each subproject

has 01 part-time staff with a national environmental consultant that has continually been providing

support on environmental and safe issues through site inspections for implementation of the

environmental and safety compliance at site.

3.3. Grievance Redress Mechanism GRM (Revised and updated)

In all Subprojects, the GRM has been introduced to stakeholders and local communities in the

process of public consultation with verbal and visual presentations of the subproject components.

Formal disclosure in local languages of subproject information to affected persons and

stakeholders was undertaken during the preparation of the IEE to constitute the onset of

information disclosure and stakeholders involvement during project implementation. At the very

least, the summary of the IEE was translated into Vietnamese language and distributed to all

affected people. As part of a stakeholder communication strategy established for the IEE, regular

communication with stakeholders is required throughout the implementation of the subproject.

In accordance with ADB's Governmental Communications Policy (2012), the IEE has been

available on PPC website, Provincial People's Committee offices, DoNRE offices, and at project

sites. Similarly, all project reports with specific references to the EMP Implementation of EA / IA

/ PSC has been available simultaneously in office and on site. In addition, the IEE would also be

available on the ADB website. After the commencement of the subprojects, all environmental

reports and EMP reports by the EA / IA Project are available on the ADB website.

A clearly defined grievance redress mechanism has been set up to deal with APs' complaints and

grievances related to environmental issues, land acquisition, resettlement and compensation, in a

timely and satisfactory way. All affected people (APs) are fully aware of their rights, and detailed

procedures for filing a complaint, and appeals process. This has been announced and disseminated

through an effective publicity campaign. The grievance redress mechanism and complaint

procedure would also be explained in a project information booklet (PIB) that would be distributed

to all APs.

APs have the right to complain about any aspect of the affected environment, land acquisition and

resettlement requirements such as noise, pollution, benefits, rates and payments, and procedures

for resettlement and income restoration program. Appeals can be made verbally or in writing. In

the case of verbal complaints, the grievance committee will be responsible for recording minutes

in all meetings with the APs.

A Grievance Board with members experienced in handling environmental and social issues were

organized in the communes, designated for those tasks by the local leadership. Commune officials

have made all efforts to resolve complaints and issues at the commune level through appropriate

community consultation. All meetings have been handled by the Grievance Board and copies

would be provided to APs. A copy of the minute of the meeting and the action taken would be

provided to the PPC, IA, PSC, and ADB on request.

The procedure for settling complaints is presented below. The procedures described below were

applied to both social and environmental issues and in accordance with the legal process for

settling disputes in Vietnam.

Phase 1: First-time APs' complaints will be submitted verbally or in writing to the village head or

cluster leader. Complaints will be discussed with the APs and the Grievance Board or their

members. Because initial environmental issues are likely to be related to construction activities,

the contractor and the PMU should be notified immediately. The Grievance Board shall be settled

within 15 days of receiving the complaint. All meetings will be recorded and a copy of the meeting

minutes will be provided to the affected people.

Phase 2: Without mediation, or response within 15 days of filing the complaint, APs may refer

the matter to the District Grievance Board (DGC). The DGC is required to respond within 15 days

of receiving the AP's appeal.

Phase 3: If the AP is dissatisfied with the decision of the DGC, or if no response is received, APs

may appeal to the Provincial Grievance Committee (PGC). The PGC will review and make a

decision on the appeal within 30 days of receiving the complaint.

Phase 4: If the AP remains dissatisfied with the decision of the PGC or if no response is received

within the prescribed time limit, the AP can eventually take their case to the provincial court. The

court will resolve the complaint in writing and submit a copy to the appropriate authorities

including the PPC, DGC / PGC and APs. However, if the AP remains dissatisfied with the decision

of the Court, the case may be referred to the provincial court. However, if the decision of the

provincial court remains unsatisfactory for the affected person, the AP may file the complaint with

a higher court.

The PPC will be responsible for examining complaints and grievance procedures and resolutions.

PPC supervisors must have expertise and experience in social and environmental issues related to

infrastructure development. PPC may recommend further measures to resolve unresolved

complaints. The environmental consultant will provide necessary training to improve the grievance

procedure and develop capacity building programs for members of the grievance committee when

requested.

In case APs are unable to express in writing or verbally, they are encouraged to seek the help of

local groups, NGOs, family, village head or neighborhood leaders to record their complaints, and

to obtain documentation, surveys or property valuations, to ensure that when disputes occur, the

accuracy of the information provided allows all parties to be treated fairly. Throughout the

grievance process, the responsible Grievance Board will ensure that the affected people are

provided with copies of the grievance, decision or resolution.

If the dispute resolution efforts based on the grievance procedures remain unresolved or

unsatisfactory, the APs have the right to discuss their concerns or issues directly with the ADB

Office in the South-East Asia through ADB resident mission in Vietnam (VRM). If affected people

remain dissatisfied with the VRM feedback, they may contact the ADB Assistance Office directly.

ADB's accountability mechanism/ framework provides a forum where people affected by ADB-

funded projects can talk and find solutions to their problems and report non-compliance with

ADB's policies and procedures. It includes two separate but complementary functions: problem

solving and compliance review. Complaints must be made in writing and sent to the receiving

Grievance Redress mechanism: The PISC consultant has assisted the PMUs to set up a GRM

which has been approved by ADB on 26 May 2018.

The grievances redress mechanism has been incorporated into the Contractor's Environmental

Management Plans and has been disseminated to the CPCs of the project communes and the heads

of the villages. Contractors and Construction Supervisors have been trained in this content by the

PISC in each subproject such as:

• In Bac Giang, Bac Giang People's Committee issued the decision on the establishment of

the Complaints Board and the GRM process of the Project in accordance with the Decision

No. 1810 / QD-UBND dated 12/7/2018 and the Decision No. 1811 / QĐ-UBND dated

12/7/2018 of People's Committee of Bac Giang city. A grievance mechanism was

announced by the PMU at meetings with local authorities and affected people in July 2018.

In addition, the Grievance Mechanism was posted by the BG1, BG2 contractors at the site

management office, along with a form to file complaints in June 2018 and in April 2019

for BG3, BG4 contractors.

• In Mong Cai, the preliminary GRM as outlined in the uEMP was announced by the PMU

at meetings with local authorities and affected people in the first quarter of 2018. After the

final draft of the Grievance Mechanism, the contractors have posted it at the site

management office with attached form to file complaint in June 2018.

• In Lao Cai, the preliminary GRM as outlined in the uEMP and then it was integrated into

approved CEMP and disclosed and introduced by PMU/PISC to local authorities

(commune, village head) and affected people in July 2018.

As of this reporting period (from Jan to June 2019), no complaints from people or local authorities

about environmental safeguard issue in Sapa, Bac Giang and Mong Cai has been filed. However,

there are three complaints about the compensation and resettlement in all subprojects:

Móng Cái subproject: Mr Lam Van Gai has petitioned to LFDC on the compensation rate for the

land that his family has reclaimed. Upto June 2019, this complain has been resolved and his family

has accepted the compensation and allowance

TDA Sa Pa: In the semi-annual report of 2018 there was 1 complain in package SP1 (Mr

NguyenAnh Tuan, Gian Tra hamlet, Sa Pa commune), to date, this complain has been resolved

and his family has accepted the compensation and allowance.

TDA Bắc Giang: In the report of 2018’s 2nd half, there was 1 complain in package BG1 (verbally)

of 22 HHs in Doi Chet area, Huong quarter, Tho Xuong ward on the method to determine the

origin of the land in their area. On 22/6/2019, Bac giang CPC has issued written response on the

petition of Mr Le Kim Lai and other citizens in the quarter, in which the CPC determined that the

acquired land was cemetary, therefore was not entitled to compensation. Local authorities have

sent the response to the AHs. This issue will be further reported in upcoming report if there is new

development (See details on the Semi-annual Report of Resettlement Monitoring for first 6 months

in 2019)

3.4. Updated EMPs, Incorporation of EMP requirements into the

Construction Contracts and preparation of the Contractor's Environmental

Management Plan (CEMP)

The updated EMPs were included in the bidding documents for civil works during the

procurement phase. Bidders are required to consider the requirements of the EMPs when

submitting their bids.

• In Bac Giang: an uEMP (first updated) has been prepared for 4 packages (BG1, BG2,

BG3, BG4) and approved by ADB in May 2017; The first draft of the uEMP for package

BG5 has been submitted to ADB on 12/12/2018 and final version was approved by ADB

at the beginning of March 2019. Besides, package BG2 has proposed to upgrade 1.5 km

of the existing road extended from the Northeast Ring Road to the junction with road 295B

to Ha Bac Nitrogenous Fertilizer Plant, so uEMP (first updated) of the packages BG1,

BG2, BG3 and BG4 were also updated for the second time to submit to ADB in February

2019, this final revision was submitted to ADB in the second half of March 2019.

• In Mong Cai: uEMP (for MC1, MC2, MC3 packages) is included into item 6 chapter VII,

Section 2 of the bidding documents and into the Works contracts.

• In Sa Pa: uEMP has been prepared for all packages (SP02, SP03, SP01) and approved by

ADB in May 2017 and October, 2017 and Febuary 2018 respectively. For the SP 02

“Upgrading of Provincial Route 152 (Section from Sa Pa Town to Ban Den Cross-road),

due to changes of technical design (construct viaducts instead of road), the uEMP of this

component has been updated again in March,, 2019 which have been reviewed by project

owner before submit to ADB for approval. In May, 2019, the uEMP of SP1 have been

finalized and awaiting for No Objection Letter from ADB.

Construction contractors have prepared CEMPs to submit to CSCs and PMUs for approval since

April 2018, such as:

• In Bac Giang: April and May 2018 for BG2 and BG1 packages; in Jan 2019 for BG3

package and in April 2019 for BG4 package.

• In Mong Cai: in April and May 2018 for MC1 and MC2 packages; and MC3 package in

January 2019.

• In Sa Pa: in April and July 2018 for SP2 and SP3 packages and the CEMP of SP01 was

prepared by constructors and revised by PISC in December 2018 and then approved by

PMU Lao Cai in December,2018.

The environmental and safety monitoring tasks included in the contract with the Construction

Supervision Consultant (CSC) require CSCs to regularly monitor environmental compliance and

safety at construction sites.

- Bắc Giang: for packages BG1 and BG2 on 5/4/2018 and 25/6/2018; for package BG3

- Móng Cái: for packages: MC1 and MC2 on 29 and 30/3/2018, and MC3 on 05/11/2018.

the change in wastewater treatment technology and the addition of the existing wastewater

treatment plant (package BG5), Bac Giang PMU (with supported by PISC) has submitted these

changes and supplements on EIA report for Bac Giang subproject to Bac Giang DONRE and has

been approved by the Decision No. 1990 / QD-UBND dated December 21, 2018 by Bac Giang

Provincial People's Committee.

Besides, package BG2 has proposed to upgrade 1.5 km of the existing road extended from the

Northeast Ring Road to the junction with road 295B to Ha Bac Nitrogenous Fertilizer Plant, so

uEMP (first updated) of the packages BG1, BG2, BG3 and BG4 were also updated for the second

time to submit to ADB in February 2019, this final revision was submitted to ADB in the second

half of March 2019 Bac Giang PMU (with supported by PISC) has submitted these changes and

supplements on EIA report to Bac Giang DONRE for approval in April 2019, however, there isn't

still the decision to approval for this report by Bac Giang PPC until now. It is expecting to

approval this report in August 2019.

4.3.2. Licensing for Stone Quarries, Construction Materials Mines and

Disposal Sites

a. In Móng Cái

The permits required for the quarries, mines of the MC1 and MC2 subprojects under the Mong

Cai subproject are largely collected by the PPMU during the project preparation phase. The status

of licenses for mining, mines and disposal sites can be summarized as follows:

- Sources of construction materials: The supplier is Tri Duc Construction Investment and

Development JSC, located at Hoa Binh Boulevard - Upper Trung - Ninh Duong Ward -

Mong Cai. This company supplies sand and stone for two packages MC1 and MC2 and they

have full legal documentation for this supply. Information on sand and stone supply units

was verified by the CSC in Official Letter No. 05.17 / TVGS-GMS2 sent to the PMU on 18

November 2017. Fresh concrete for MC3 is supplied by Quang Thao Construction JS

Company (address: Zone 7 km2, Hai Yen ward, Mong Cai city, Quang Ninh). The whole

soil from excavation is re-used for leveling.

- Source of filling material: Demand for backfill for both sub-projects is 66,700 m3 and the

readily available sources (from the hills located in the area of West Ka Long WWTP and a

small part from the construction of drainage lines) is 17,700 m3 respectively. Currently, the

subproject is still using readily available resources. For additional resources, during the

project preparation phase, the selected field is within Hong garden, Hamlet 5, Quang Nghia

commune, Mong Cai city (about 25 km from the center of the city). However, the licensing

of soil mining in the Mong Cai area is difficult due to licensing procedures and due to

adjustments in the provincial planning. The PMU and its contractors are working to

accelerate the licensing process and take into account land use plans at licensed mines

outside Mong Cai to avoid delays. Up to now (Q4/2018), there still is a shortage of filling

material for WWTP of MC1 (the contractor is still applying for environmental license for

the current mine, but there are other viable alternatives). Project owner and CSC have issued

warnings for contractor.

- Disposal sites: Construction spoil includes soil dredged from the construction site of the

Eastern WTP and a part of the spoil is dredged from the drainage ditch (approx. 500-600

m3, mainly sandy soil and sediment), which will be temporarily transported to Ngoc Ha

Construction Joint Stock Company’s disposal site (a sub-project subcontractor) in Hai Hoa

ward (about 8 km from Mong Cai center). At present, most of the construction spoil is fertile

soil (in Eastern WTP) that can be recycled for farming. The whole soil from excavation is

re-used to level in MC3 concstruction site.

b. In Bắc Giang

The licenses required for the quarries, mines of the BG1, BG2 subprojects in the Bac Giang

subproject are largely collected by the PPMU during the detailed design phase. Licensing status

for mining and disposal sites can be found in the uEMPs.

Sources of construction materials:

The construction materials such as cement, iron, steel, bentonite, stone ... from suppliers in Bac

Giang province and surrounding areas to serve two packages (BG1, BG2) which have been

submitted by the contractor and approved by CSC, PPMU before and during construction.

Source of filling material:

- Package BG1: The contractor has proposed the supply of source of filling material and has

been approved by CSC and PPMU from the soil mine in Deo Rung hill of Bao Loc 1 village,

Bao Son commune, Luc Nam district, Bac Giang province.

- Package BG2: The contractor has proposed the supply source of filling material and has been

approved by CSC and PPMU from 2 soil mines including (i) soil mine in Nui hill – Nam Le

village – Xuong Lam commune – Lang Giang district – Bac Giang province and soil mine in

Minh Son commune - Huu Lung district - Lang Son province. The supply source of stone for

construction is the stone mine Vo Noi village - Ho Dung commune - Huu Lung district - Lang

Son province.

Disposal sites: Particularly for spoils of specific packages as follow

- Package BG1: The contractor has signed a contract with Bac Giang Urban Public Works Joint

Stock Company to collect, transport and dispose of excavated soil in Song Mai commune,

Bac Giang city, to make use of vacant land in the project area. There is a need to level instead

of transport to the Da Mai landfill site 6km away from the project area.

- Package BG2: The contractor has signed a contract with Hoan Chinh Construction Materials

and Trading Company Limited to collect, transport and dispose of waste in Dong Bong, Nam

Ngan Village, Quang Chau Commune, Viet Yen District, Bac Giang Province to fill subsided

areas (eg, lagoons, riversides).

- Package BG3: the contractor has been approved the disposal site for dredged material of

ponds. The disposal of dredged material area is approved that is Da Mai landfill, in

accordance with the approved uEMP, it is far from about 6km to the project area.

During construction and transportation phases, the use of quarries, mines, and environmental

protection will be regularly monitored at the disposal sites and on major transport routes.

c. In Sapa

Fill mines: Road fill is taken from the excavated volume, the remaining will be excavated from

(I) Mine 1: Km5 + 700 on the left of the village road of Lao village, Lao Chai commune, (ii) Mine

2: Km11+100 on the left side of the village road of Su Pan.

Sand mine: Sand Mine No.1 (Bao Nhai Sand Mine): Located at the beginning of the route at Km

5 + 00 TL153 on the right side of Bac Ngam - Bac Ha, Bao Tan 2 village, Bao Nhai commune,

Bac Ha district. The mine has been licensed and under the management of mining cooperative Anh

Tu. Quality: coarse sand with little gravel, good quality sand and in stable, favorable conditions

for transportation.

Construction sand mine 2 (Bến Đền sand mine): Located at the beginning of the route at Km

26 + 600 Highway 4E, about 0.5 km left in Gia Phu commune, Bao Thang district. The mine has

been licensed and is under the management of production and trading company Gia Phu Building

Materials. Quality: coarse sand with little gravel, good quality sand and in stable, favorable

conditions for transportation.

Construction sand mine 3 (Cốc San sand mine): Located at the beginning of the route at km

133 + 300 QL4D about 1.3 km turn left of the route, following the Road to Canh San hydropower

scheme in Luong Do village, Coc San commune, Bat Xat district. The mine is licensed and under

the management and operation of the Commune People's Committee. Quality: coarse sand with

little gravel, good quality sand and and in stable, favorable conditions for transportation.

The quarry at Trung Chai field is located at the end of the route, on the left of the road Km 99 +

500 QL4D, belonging to the group 12 Sa Pa town, Sa Pa district. The quarry has been licensed and

under the management and harvest of Kim Tuyen One Member Limited Company. Quality: This

is sedimentary rock, medium intensity, gray color, blue gray, block structure. Road to the mine is

convenient, from the mine to the beginning of the route is about 5km. Current production is about

1000m3 / day.

Other materials: timber collected in Sa Pa center, Iron and steel in Thai Nguyen, concrete in the

center of Lao Cai city, Plastic in Hai Phong.

Disposal sites

Design consultants, investors and local authorities have agreed on the selection of reasonable

disposal sites. These sites are planned by Sapa DPC for disposal sites. These are the existing sites

of district. The detailed as follows:

(i) Site 1: at Km1+00 – Km1+250 on the right of Provincial Road 152, Sapa town, Sapa district.

(ii) Site 2: at Km11+400 – Km11+600 on the right of Provincial Road 152, Su Pan commune,

Sapa district.

(iii) Site 3: Km14+500 – Km14+700 on the right of Thanh Kim- Bản Phùng route, Ban Ho

commune.

4.4. Results of environmental compliance monitoring

4.4.1. Status of EMP implementation

The inspection methodology involved reviewing project document and CSC reports, field

observations of the work areas and relevant site supplemented with photographic documentation

and formal and informal interviews with workers, residents, stakeholders and affected persons

(APs).

The site inspections for EMP compliance are conducted daily by CSCs, joint meetings among

CSCs and Contractors shall be organized whenever the environmental and safety issues are

4.4.2. Findings during the site inspections

In the first half of 2019, site inspections were conducted by the PISC environmental specialists to

validate and monitor the implementation of EMP for construction packages in Bac Giang, Mong

Cai and Sa Pa. The site visits were conducted together with the PPMUs, the CSCs and the relevant

contractors in the three provinces. The site-visits suggested that the construction works in three

provinces are mostly minor that did not generate significant adverse environmental impacts. There

are some minor environmental and safety issues that the contractors have not complied with to

follow approved EMPs, as indicated in Table below.

4.5. Environmental Quality Monitoring 3

4.5.1. In Móng Cái subproject

Environmental Quality in construction phase

Monitoring of environmental quality has been carried out in all construction packages in 3

subprojects. A total of 6 construction packages have been monitored for environmental quality (BG

has 2 packages, MC has 3 packages and SP has 1 package). The following results:

On February 22 – 25 and May 09 – 12, 2019, PISC consultant conducted environmental monitoring

during the construction phase for 3 packages MC1, MC2 and MC3.

The purpose of this environmental monitoring sampling program is to monitor the air quality,

noise, vibration and surface water quality during construction of 3 packages as the basis for

assessment of the impact of construction activities on the East, West of Ka Long and Ka Long river

(MC3). Analysis results show

Air quality, Noise, Vibration in MC1, MC2 and MC3

Results showed that concentration of pollutants is less than or equal to the permitted levels

specified in related QCVN. However, noise levels in the measurement exceed the WHO noise

guideline.

Surface Water quality

The results show that most of the indicators are within the allowable limits of QCVN 08-MT: 2015

/ BTNMT-B2- “National Technical Regulation on surface water quality - B2- Waterborne traffic

and other purposes with low quality water requirements”. Particularly nitrite content at all sampling

points are slightly over the limit.

Results of environmental quality monitoring in Mong Cai subproject are shown in Appendix 2

4.5.2. In Bắc Giang subproject

Quarterly, on March 25th and June 25th, 2019, the environmental monitoring is conducted by PISC

on the construction period for 3 packages of BG1, BG24 and BG3.

The purpose of this environmental monitoring is the assessment of quality of air, noise, vibration

and surface water during BG1, BG2 and BG3 packages construction which is the basis for the

evaluation of impact on surrounding air, surface water quality during construction of Tran Quang

Khai road (BG1), North East Ring Road (BG2), Upgrading ponds (BG3). Analysis results show

that:

Environmental quality monitoring results in package BG1:

Air Quality, Noise, Vibration:

The results show that concentrations of pollutants in ambient air samples are all lower than the

maximum allowable levels under QCVN 05:2013/ BTNMT - National Technical Standard on

Ambient Air Quality; noise are all lower than the maximum allowable levels under QCVN

26:2010/BTNMT - National Technical Standard on noise (normal areas: from 6 am-9 pm).Surface

Water Quality:

- The concentration of all pollutants in Thuong River at project area (BG-SW0.1, BG-SW0.2

adn BG-SW0.3 measurement points) are within the specified threshold in QCVN 08: 2015-

B1 / BTNMT - National Technical Standard on Surface Water Quality, column B1 on this

period. In fact, construction activities In package BG1 discharge no wastewater to the Thuong

River. However, the results of baseline environmental survey at the above positions, the

ammonium content exceeds the allowed limit. This suggests that the quality of the Thuong

River is affected by many industrial enterprises located on both sides of the river, especially

the Ha Bac Fertilizer and Chemicals Plant, one of the largest producers of fertilizer in

Vietnam - often discharges at least 10,000 m3 of wastewater per day.

- Surface water quality in surrounding small pond/lagoon (BG-SW0.4, BG-SW0.5

measurement points): The results show that most of the contaminants in surface water in

small surrounding ponds / lagoons all meet the standard in QCVN 08: 2015-B1 / BTNMT:

National technical regulation on surface water quality - column B1, except to some

parameters that exceeded the standard at the measurement point BG-SW0.4 such as: DO

(exceeded 2.5 times), BOD (exceeded 1.6 times), COD (exceeded 1.5 times) and at the

measurement point BG-SW0.5 is DO (exceeded 1.9 times), BOD (exceeded 1.13 times),

COD (exceeded 1.03 times) in the dry season. Based on the observation, there is no activity

of discharging waste water from the construction sites, this is a small pond/ lagoon with

activities to breed ducks and poultry, so there is a currently potential risk of organic pollution

on the small pond / lagoon.

Results of environmental monitoring in package BG2:

Air Quality, Noise, Vibration: On March 25th, 2019, the environmental air, noise, vibration

monitoring is conducted for BG2 package. The results show that concentrations of pollutants in

ambient air samples are all lower than the maximum allowable levels under QCVN 05:2013/

BTNMT - National Technical Standard on Ambient Air Quality; noise are almost lower than the

maximum allowable levels under QCVN 26:2010/BTNMT - National Technical Standard on noise

(normal areas: from 6 am-9 pm), except for BG-A0.3 sampling point (exceeded 1.01 times) because

of there is high density of vehicles at the juntion of current NH.1A road.

For Packages BG3 (upgrading ponds):

Air Quality, Noise, Vibration: The results show that the concentration of pollutants in ambient

air samples is lower than the maximum allowed under QCVN 05: 2013 / BTNMT: National

Technical Regulation on ambient air quality. In general, the quality of the air environment,

vibration, noise is quite good while the construction of BG3 package.

Results of environmental quality monitoring in Bac Giang subproject are shown in Appendix 1.

4.5.3. In Sapa subproject

According to the terms of reference approved by ADB, three packages in Sapa have to carry out

baseline monitoring and quarterly monitoring, 3 of which have been carried out.

Periodic environmental monitoring has been carried out on quaterly basic which in accordance

with Government regulations and requirements in the project's environmental management plan.

As of July 2019, a total of 12 quarterly monitoring times were held at 03 bidding packages. The

latest environmental monitoring of 3 packages in Sapa were in 28 June, 2019.The sample as

followed: SP02: 6 air samples; 3 surface water samples and 2 soil samples; SP02: 10 air samples

and 4 soil samples; SP01: 3 air samples; 2 surface water samples and 2 soil samples

Soil environment: The content of heavy metals in the soil environment of the project is within

the allowable limits according to QCVN 03-MT: 2015 / BTNMT: National technical regulation

on permissible limits of some metals heavy in the soil (Agricultural land), does not affect

cultivation and production activities.

For package SP02

Ambient Air: Measurement and analysis parameters in the project are up to standards, the

concentration of pollutants is not higher than that of QCVN 05: 2013 / BTNMT: National

Technical Regulation on ambient air quality (average 1 hour); Therefore, the construction and

installation work in the project does not pollute the surrounding air environment.

In this package, there are 3 construction contractors. In July, there are not many construction

activities, only some locations are leveling and casting concrete structures. The main sources

of air pollution in this time are mainly transportation of materials on the road and ground

leveling and construction.

Surface water: The concentration of the parameters is compared against QCVN 08-MT: 2015

/ BTNMT: National Technical Regulation on surface water quality, showing that the surface

water is not polluted, ensuring the life of aquatic plants as well as other human activities.

Soil: The project activities do not pollute the soil. The concentration of indicators is within the

limits of regulation QCVN 03-MT: 2015 / BTNMT: National technical regulation on limits of

some heavy metals in soil (agricultural land).

For package SP03:

Air: Measurement and analysis parameters in the project area before the construction are up

to standards, the concentration of pollutants not exceeding the level specified in QCVN 05:

2013 / BTNMT: Technical regulations National Quality of surrounding air quality (average 1

hour);

Soil: Unpolluted soil. The concentration of indicators is within the regulation of QCVN 03-

MT: 2015 / BTNMT: National technical regulation on limits of some heavy metals in soil

VI. CONCLUSION AND RECOMMENDATIONS

Conclusions:

i) The project has mostly complied with the requirements of ADB and the Government

of Vietnam in the management and monitoring of the environment.

ii) Regarding the Environmental Management Plan. Overall, the subprojects have

complied with the requirements of the approved EMP and CEMP fairly well. Necessary

documentation and arrangement for EMP monitoring work have been completed in all

subprojects.

iii) Environmental Surveys as required by the project have been undertaken.

iv) Nonetheless, some contractors have not fully complied with EMP requirements as

shown in section “Remarks on Non-compliance”. This issue must be improved by

contractors and CSCs in the coming time.

Recommendations:

i) For contractors: complete missing / unrealized environmental protection measures /

structures as mentioned in the report; continue the implementation of environmental

and safety measures in construction sites; remind workers to strictly observe labor

safety regulations.

ii) For CSCs: promptly assign personnel to supervise occupational safety and

environmental aspects; maintain the promised reporting programme; Support PISC

during environmental monitoring.

iii) For PPMUs: urge contractors, CSC, PISC to perform tasks according to assigned tasks

and schedule, ensure environmental compliance during construction process.

APPENDIX 1: MONITORING RESULTS IN BAC GIANG

Quarterly, on March 25th and June 25th, 2019, the environmental monitoring is conducted by PISC on the construction period for 3 packages of

BG1, BG2 and BG3.

The purpose of this environmental monitoring is the assessment of quality of air, noise, vibration and surface water during BG1, BG2 and BG3

packages construction which is the basis for the evaluation of impact on surrounding air, surface water quality during construction of Tran Quang

Khai road (BG1), North East Ring Road (BG2), Upgrading ponds (BG3).

1. Environmental quality monitoring results in package BG1

b. Surface Water Quality

The results show that:

- The concentration of all pollutants in Thuong River at project area (BG-SW0.1, BG-SW0.2 adn BG-SW0.3 measurement points) are within

the specified threshold in QCVN 08: 2015-B1 / BTNMT - National Technical Standard on Surface Water Quality, column B1 on this period.

In fact, construction activities In package BG1 discharge no wastewater to the Thuong River. However, the results of baseline environmental

survey at the above positions, the ammonium content exceeds the allowed limit. This suggests that the quality of the Thuong River is affected

by many industrial enterprises located on both sides of the river, especially the Ha Bac Fertilizer and Chemicals Plant, one of the largest

producers of fertilizer in Vietnam - often discharges at least 10,000 m3 of wastewater per day.

- Surface water quality in surrounding small pond/lagoon (BG-SW0.4, BG-SW0.5 measurement points): The results show that most of the

contaminants in surface water in small surrounding ponds / lagoons all meet the standard in QCVN 08: 2015-B1 / BTNMT: National technical

regulation on surface water quality - column B1, except to some parameters that exceeded the standard at the measurement point BG-SW0.4

such as: DO (exceeded 2.5 times), BOD (exceeded 1.6 times), COD (exceeded 1.5 times) and at the measurement point BG-SW0.5 is DO

(exceeded 1.9 times), BOD (exceeded 1.13 times), COD (exceeded 1.03 times) in the dry season. Based on the observation, there is no activity

of discharging waste water from the construction sites, this is a small pond/ lagoon with activities to breed ducks and poultry, so there is a

currently potential risk of organic pollution on the small pond / lagoon.

2. Results of environmental monitoring in package BG2

On March 25th, 2019, the environmental air, noise, vibration monitoring is conducted for BG2 package on the construction period. The main

construction items of package BG2 were completed in April 2019 (except for about 100 meters of road at the gate of Methadone-Treatment Center,

which is pending for permission of the Ministry of Public Security), so it was not conducted the air quality monitoring for package BG2 in June

APPENDIX 3: MONITORING RESULTS IN SAPA

In Sapa, as of the end of June, 2019, 03 construction packages namely SP1, SP 02 and SP03 are under construction. Below is the results of

Surface Water Quality of the area is detailed in the table above, the concentration of the parameter was compared against QCVN 08-MT: 2015 /

BTNMT: National Technical Standards for surface water quality, which reveals that: Surface water is not contaminated, ensuring conditions for

aquatic plants growth as well as other human activities. 1.3.Soil quality monitoring

The result shows that, the soil quality indicators do not exceed the allowace limitted of the National standard. This mean the project activities do

cause contaminated for soil in the project area. The details of soil quality is shown in table below:

Based on the results of the analysis, the indicators showed that the soil was not contaminated. Some indicators exceed the baseline result but not

exceed the allowance limited of National standard. The concentration of indicators is in the regulation of QCVN 03-MT: 2015 / BTNMT:

National technical regulation on limits of some heavy metals in soil (agricultural land).

Comment:

The above result show that the soils in the sample are not polluted. Concentrations of the indicators are under the allowance limitted of National

standard named QCVN 03-MT: 2015 / BTNMT: National technical regulations on the allowable limits of some heavy metals in the soil

(Agricultural land, forestry land). The project activities does not pollute the soil environment.
