0. SUMMARY

Environmental, Health and Safety Control and Protection: Environmental, Health and

Safety inspections continued being regularly carried out in weekly basis to monitor impacts due

to works and the implementation of mitigation measures. Specific monthly reports, which are

submitted to EPMU, and a quarterly report, which is submitted to the Client and to ADB, were

prepared for all packages concerning the supervision and control of the above mentioned

issues, as regular reporting procedure established by the PSC, increasing the duties specified

in our Contract in order to improve the monitoring and control processes. Also, short weekly

check lists are prepared after each inspection on site in order to maintain the information

constantly updated.

The general main problems and impacts on site along the entire Project in this second quarter

2014 have been very similar to the previous periods, and may be summarized as below:

Cleanliness, healthy conditions

Up to the date, six packages including packages A1, A2, A3, A6, A7 and A8 have been

completed and come into operation and exploitation. All the main construction works of

these packages have been finished and there are some miscellaneous works under

construction such as fencing, slope protection with grass/concrete. During the site

inspection, it’s noted that the construction sites are keep in cleanliness and tidiness

condition, in general; however, at some locations of package A4 and A5 we still

detected the dirtiness status due to lack of housekeeping activity of the Contractor such

as worker’s camps, CBPs or at fueling areas.

Noise & Air Pollution

The dustiness status was noted at some locations of package A4 during carrying out

construction works or transporting material. The Engineer has requested the Contractor

to mobilize the water trucks/wagons to water the surface of transportation roads and at

affected areas in order to minimize the spread of dust. The compliance of the

Contractor with this instruction was recorded during the site inspections.

Soil pollution and erosive processes. Hazardous substances management






The status of soil being eroded into cropland or polluted by oil was noted in package

A2, A3, A4 and A5. For the agricultural land which was impacted by erosion, almost all

the land owners have been compensated for damage assets, including restoration cost.

In package A2, the Contractor has prepared the money and made a schedule to

compensate impacted households from July 14th till August 04, 2014.

At the present, for the completed packages, the slope protection work with grass or

concrete is being promptly implemented in order to prevent erosion happening.

Package A1 has finished grassing work; package A2 has reached about 80%; package

A3 has reached 95%; sodding work of package A6 has been completed; package A7

achieved 91% and it’s already finished in package A8.

Bad management in fueling was noted during inspections package A4 and A5 such as

at Km 105+280 and Km 135+000. The Engineer has requested the Contractor to

comply with fuel control regulations; however, the improvement is inadequate.

Rivers protection, water quality

The serious problem was detected in package A1 from 2011 when the Contractor

carried out the construction work at sections Km 7+660 (Xuan Phuong Bridge) and Km

10+695 (Tan Loi Bridge). Because there was no riverside protection measure applied

during carrying out construction work so the riversides in these areas in downstream

have been seriously undermined and collapsed. Despite the strong penalty of the

Engineer (VND ten billion has been retained), restoration work is being carrying out

very slow at Km 7+660 and there is no action at Km 10+695.

At other locations, in general, the water quality is not seriously impacted. At Km

145+000, the cement laden water from CBP was leaked into small existing drainage;

however, the Contractor has solved this problem already.

Safety conditions

At the sections where is under construction, the lack of PPE status is usually detected.

It is partly unawareness of the worker because of lack the training of the Contractors

and also the Contractor didn’t provide them with enough PPE. The Engineer has many

times requested the Contractor to provide the workers with enough PPE at work as well






as implement training for newcomer to ensure the safety onsite; however, the

improvement is unremarkable.

Traffic Protection and Maintenance

It’s noted that almost all the underpass box culverts of package A7 and A7 have not

been completed while the highway has been exploited. This leaded the status of using

the highway for travel by rudimentary vehicles or motorbike, even livestock… of local

people. This is very dangerous. The Engineer has checked and requested the

Contractor to accelerate the progress of frontage roads construction work then

immediately finish the fencing work to ensure the traffic safety.






1. INTRODUCTION. FRAMEWORK OF THE REPORT

1.1 FRAMEWORK OF THE REPORT

Within the framework of the Environmental Control Plans proposed by the contractors and the

duties of the Consultant (PSC) in this matter contained in the Consulting Services Contract, the

environmental team of national specialists (NS) in charge of inspecting the environmental

conditions of the works for the new highway, have done weekly inspections along the sites and

surroundings of all the Packages which nowadays are all with construction activities, checking

the environmental measures applied by the constructors and detecting any impacts that could

be generated by the building works during the period of reference of this quarterly report, that

means, April, May and June 2014.

The results were already included in the environmental, health and safety weekly inspection

reports (EHSWIR) and the corresponding monthly reports for each package (EHSMR). The

Weekly Reports have been included in the corresponding Monthly Reports. So, it’s considered

not necessary or useful to include again that information in this document.

As the environmental team, therefore under its responsibility, is also in charge of monitoring

the healthy and safety conditions in site, specialists in site offices also have made weekly

inspections in all packages. Their results have been being included in the mentioned monthly

reports, as nowadays all these issues have been joined in only one report. Therefore these

issues are also included in this quarterly report.

So, this document is defined as Environmental, Health and Safety Monitoring Quarterly Report

(hereinafter called EHSQR). It will be submitted to the Client, Vietnam Expressway Corporation

(VEC), through the Expressway Project Management Unit (EPMU) and following the Terms of

Reference (ToR) of the Consultant’s Contract, also to Asian Development Bank (ADB).

1.2 DESCRIPTION OF THE PROJECT. DIVISION IN PACKAGES

Noi Bai - Lao Cai (NB-LC) Highway is a part of Kunming - Hai Phong Transport Corridor, which

has been studied with a total length of 865 Km passing Yunnan province of China and Lao Cai,

Yen Bai, Phu Tho, Vinh Phuc, Ha Noi, Bac Ninh, Hai Duong, Quang Ninh and Hai Phong

provinces of Vietnam.

Vietnam Expressway Corporation, which is a state owner company, is the proposer of this

project. Its executing agency is the Ministry of Transport (MOT), and it’s being financed by

Asian Development Bank (ADB) and the Government of Vietnam.

According to original design, NB - LC Highway has a total length of about 262.4 km, passing

through 72 communes and 18 districts of provinces and cities as Ha Noi, Vinh Phuc, Phu Tho,

Yen Bai and Lao Cai.

The construction of project is divided into two phases, in which the first phase will construct

244 km with 4 lanes from Ha Noi to Yen Bai and 2 lanes from Yen Bai to Lao Cai. The second

phase will be the widen section of the former with 6 lanes from Ha Noi to Yen Bai and 4 lanes

from Yen Bai to Lao Cai (Chinese border, 262 km).

Construction of the whole project, first phase, is divided into 8 packages including A1, A2, A3,

A4, A5, A6, A7 and A8. All of them have already begun their construction activities. The length,

location and the status of works in each package at the end of the period are described in the

following paragraphs and tables.

- Package A1 is about 26.630 km of length with start point at station Km 0+070 and

finishes at station Km 26+700. Package A1 goes through the Soc Son district of

Hanoi City and Vinh Phuc province.

- Package A2 is about 22.120 km of length and goes through the Vinh Phuc province

and a little of Phu Tho province. Package A2 has start point at station Km 26+700

and finishes at station Km 48+820. It must cross over Lo River, with a long bridge.

- Package A3 is about 32.240 km of length with start point at station Km48+360 and

ending point at station Km 80+00. Package A3 goes through the Phu Tho province.

The most significant structure is the bridge to cross over Red River.

- Package A4 has start point at Km 80+000 in Cam Khe district, Phu Tho province

and ending point at Km109+750 in Tran Yen district, Yen Bai province. Its total

length is 29.750 km.

- Package A5 has start point at Km109+750 in Tran Yen district, Yen Bai province

and ending point at Km150+900 in Van Yen district, Yen Bai province. Its total

length is 41.150 km.






- Package A6 lengthens from start point Km150+900 of Van Yen district, Yen Bai

province to Km190+420 in Van Ban district, Lao Cai province. Its total length is

39.520 km. Almost alignment goes through high mountains in Yen Bai and Lao Cai

province and crosses over natural streams by 18 bridges. This section also

includes 1 tunnel under range of mountain at Km186+500.

- Package A7 lengthens from start point Km190+420 in Van Ban district to Km

218+040 in Bao Thang district, Lao Cai province. Almost alignment also goes

through high mountains and 18 bridges are needed. Its total length is 27,620 m.

Khe Sang bridge with a length of 287m is the biggest one.

- Package A8 begins at station Km 218+040 in Bao Thang district and finishes at Km

244+155 in Bao Thang district, Lao Cai province. Its total length is 26,115 m. Suoi

Trat bridge with a length of 374.8 m is the biggest one.

Currently, 2 packages, Package A1 and Package A8, were already opened to traffic, although

some works are still pending. Also, it’s foreseen that on April 1st 2014, Package A7 will be

open to public use. Finally, on April 6th, a forth stretch will be open, Package A2 and first part of

A3 until interchange IC8 to connect with national road.

The environmental monitoring program is carried out in compliance with regulations of Vietnam

Government and ADB safeguard policy in order to control environmental impacts and to

ensure that the environment in the surroundings of the project area is well preserved. The VEC

proponent should perform environmental protection measures stated in the EIA report as well

as requirements written in the approval decision made by MONRE. In accordance with article

23 of the Environmental Protection Law and article 15 of Decree 80/2006/ND-CP, MONRE will

organize, direct, and monitor the environmental protection measures performed by VEC as

stated in the EIA report approved.

At present, this environmental monitoring program is being undertaken by Environmental

specialists of Getinsa hired by Vietnam Expressway Corporation. EPMU, the Project Manager,

with the Consultant’s support, monitors the environmental protection measures applied by the

contractors during the development of their works, incompliance with the environmental control

and protection plans proposed by contractors and already approved by the PSC. Consultant

reports to EPMU-VEC as the main involved authority in the project.

In addition to that, during the monitoring process, the environmental specialists and contractors

will try to find out and mitigate unanticipated environmental impacts arising from the project

construction process.

3. CARRIED OUT TASKS DURING THE PERIOD

During the period of reference for this quarterly report, the environmental tasks carried out by the specialists in their site offices and for each

package were the following (see table below).

In some cases, weather conditions difficulted so much the movement along the alignment, therefore may be any week it was not possible the

access to site. In other cases, the progress and distribution of the works in the packages, have conditioned especialists to carry out punctual

inspections instead of general ones.

As Annex 2.3 there are included the results of the noise and vibration levels monitored during

the period of this quarterly report.

4.4.1 Package A1

All the construction work of package A1 has been finished by January 2014.

4.4.2 Package A2

The main construction work of package A2 has been finished, and there is no noise or

vibration impacting on the sensitive areas. Up to now, the Contractor is still carrying out the

compensation the local people for the damages which were due to vibration during

implementing construction work.






4.4.3 Package A3

The main works of remaining section of package A3 in this peiod are asphalt concrete

pavement; road marking, fencing and landscaping. These works didn’t cause the vibration that

affects the sensitive areas and the noise didn’t excess the standard.

4.4.4 Package A4

By monitoring onsite, it’s noted that the noise arising from construction work didn’t exceed the

standard.

4.4.5 Package A5

Up to now, the Contractor has completed planting anti-flare and landscaping trees in median.

Twenty kilometers of embankment slopes has been planted with grass to protect slopes from

erosion. Remaining slope is being prepared in order to carry out sodding work.

The Contractor has already planted the anti-flare and landscaping tree in median. It’s about

40% of slope protected with grass and the Contractor is finishing the remaining slope to carry

out the sodding work.

4.15.4 Package A4

The Contractor is preparing to plant the anti-glare trees in median in compliance with the

requirements of the Project‘s Technical Specification.

4.15.5 Package A5

Up to now, the Contractor has grassed about 80% of the slopes and the Contractor is trying to

finish the remaining slope on schedule to complete the sodding work.

The Contractor already finshed the sodding work and anti-flare trees in the median of package

The Contractor has already submitted Restoration plant for Unauthorized disposals at

Km190+420; Km208+890; Km209+800 and Km195+350- Km195+500 on March 28th 2014.

Engineer reviewed and proposed to VEC and ADB to checking and approval. So now the

contractor was waiting opinion of ADB mission and will carry out according to ADB mission

mentions.

Till the present, the Contractor has grassed about 70% of the slopes and all the surfaces that

are prepared for second stage and the Contractor is trying to finish the remaining slope on

schedule to complete the sodding work.

Up to the date, the Contractor has grassed about 70% of the slopes and the surface that is

prepared for second stage and the Contractor is carrying out the remaining work.

4.16 ACCIDENTS DUE TO THE LACK OF SAFETY MEASURES. RESPONSIBLES

During this period, the second quarter in 2014, by the site inspection, Consultant did not notice

about any serious accident happened due to lack of safety measures. Also, Consultant did not

receive any report regarding significant accidents in any package.

However, the Consultant has often required the Contractors to comply with the Methods

Statement as well as the project’s Safety Plan and to improve the management and control of

safety issues to ensure the project’s safety during construction process and prevent

unfortunate accidents in the future.

6. GRIEVANCE INTAKES. PUBLIC CONSULTATION

As Annex 1 we include a summary table with references about complaints which were

expressed by local people affected by the construction works, to the environmental or social

impact specialists.

It’s supposed that these are not the only existing complaints, but the only ones received or

collected by Consultant.

On the other hand, after being implemented in some packages the system to collect

complaints by the contractors, the Consultant has not received any information from

contractors.

As the road now acts like a dam and the current irrigation system is lower than the affected rice field, the land owner can no longer grow rice in the area and prefers that his land is acquired by the Project. The area is also affected by erosion of the road embankment slope
