JOURNEYS OF DISTINCTION – BOOKING CONDITIONS 2006/71.YOUR CONTRACTWhen you book your journey/holiday, the terms set out below form thebasis of the contract between Venice Simplon-Orient-Express Limited(“the Company”) and you and your party.The contract is concluded onlywhen the Company confirms your booking.The person who makes thebooking is responsible on behalf of everyone included in the booking.

2.YOUR TICKET’S CONDITIONSPassengers and their luggage are carried on services subject to the Company’s current Conditions of Carriage of Passengers and their Luggage.

Carriage by rail, air, river, road or sea services operated by other carrier(s)is subject to the terms and conditions of the carrier with which youtravel, including the Conditions of Carriage of Passengers and theirLuggage of the carrier or carriers. Conditions of Carriage are subject tointernational conventions and agreements as well as to any applicablelaw. Any ticket issued for or used on such other transport shall be issuedby the Company as agent only for the carrier(s) concerned.

Tickets are issued by the Company:

– for travel on the Eastern & Oriental Express as agent for Eastern & Oriental Express Limited.

– for travel on the Road To Mandalay as agent for Myanmar Hotels and Cruises Ltd.

– for travel on Afloat in France boats on behalf of European Cruising Ltd.

– for travel on The Royal Scotsman on behalf of Great Scottish & Western Railway Company.

Copies of all Conditions of Carriage applicable to your journey/holidayare available for inspection at:

1) the Company’s Reservation Office 2) through the travel agentwhere you book 3) on www.orient-express.com.You will be requiredto indicate your acceptance of such conditions before booking yourjourney/holiday.

3. HOW TO BOOKOur tour consultants will be pleased to discuss your requirements andmake a provisional reservation for you.To confirm, please complete thebooking form and send it to our office with a 15% deposit (for GrandTour of Great Britain,VSOE Istanbul,The Royal Scotsman and Afloat inFrance bookings, a 25% deposit is required). Full payment is requiredfor all bookings made within 56 days of departure. Completion of thebooking form requires that you accept the Booking Terms & Conditionsas set out in this brochure. Alternatively, you may take the completedform to your travel agent

On receipt of the booking form and deposit/full payment, we will confirm your reservation in writing to the address you supply. If youhave made your reservation through a travel agent, all correspondencewill be sent to him/her. Any money paid by you to a travel agent inrespect of a booking with the Company and held by the agent is heldon behalf of the company.

NOTE THAT HOTELS AND FLIGHTS CANNOT BE BOOKEDUNTIL A BOOKING FORM AND DEPOSIT IS RECEIVED.

The final balance is due 56 days prior to departure. Failure to remit atthis time may subject your reservation to cancellation by the Company,and fees as set out in Booking Condition 4 will be charged.

Payments received for holidays commencing in the UKthat include an air element are financially protected byour Civil Aviation Authority licence (No 3141) and bond.

All other holidays are protected by a specialaccount set up by our bankers and held in trust on your behalf.

4. IF YOU CHANGE OR CANCEL YOUR BOOKINGThe company will do its best to make any changes that you mayrequest after your confirmation has been issued.

If an amendment or cancellation by you or any member of your partyis necessary, this must be confirmed in writing and a fee is payable byyou to the Company, on the following scale

Notification of a cancellation to a confirmed booking will be valid onlyif made in writing to the Company’s Head Office and signed by theperson who made the booking or your travel agent on your behalf.The company reserves the right, in its absolute discretion, to request notification of consent from each member of the party in respect ofwhom the cancellation is made.

No cancellation fee will be payable where cancellation is due to anincrease in the total price of your journey/holiday, provided that suchcancellation is made within seven days of receiving notification of theincrease from the Company.

5. CHANGES OR CANCELLATIONS BY THE COMPANYArrangements for journey/holidays are made many months in advanceand changes may have to be made to brochured itineraries, for example, a change of flight schedule. Any change will be notified to you at time of booking or as soon as is reasonably possible.

Occasionally, circumstances occur that involve either a major change or cancellation of an itinerary. For the purposes of these BookingConditions, these are as follows:

i) a change of departure date, point, time or return time by more than five hours ii) a portion of the journey/holiday is not available for reasons beyond the control of the Company and/or of any carrier or supplier iii) an insufficient number of bookings has been taken iv) security risks v) industrial action

If, after your reservation has been confirmed but before departure, amajor change to your itinerary becomes necessary, there are variousoptions available to you:

(i) accept the changes as given to you (ii) accept the same journey/holiday on an alternative date or accept an alternative journey/holidaywith the appropriate adjustment to your invoice (subject to availability)(iii) cancel your reservation and receive a full refund. (In the case ofindustrial action that affects only part of the journey/holiday, you maynot choose this option.)

The Company does not guarantee and will not be liable in respect ofchanges or delays to departures or arrivals where such changes ordelays are reasonably required or beyond the control of the Companyand/or of any carrier or supplier.

If, after departure, a major change occurs, the company will use its bestendeavours to make suitable alternative arrangements at no cost toyou. If this is not possible or if you choose not to accept the alternativearrangements made, the Company will, where appropriate, providetransport back to the place of departure or to such place as can beagreed.The company will not accept any liability for any changes ordelays which become reasonably or sensibly necessary or which occuras a result of industrial action or any other circumstances unforeseeableor beyond the control of the Company and/or of any supplier or carrier.

6. SURCHARGES The prices shown are based on known costs and exchange rates on 1 July 2006 and the Company does not expect to have to makechanges.

The company guarantees that once your reservation is confirmed thatno surcharges will be imposed, except where there is an unforseenincrease in national or local taxation, or adverse fluctuation in currencyexchange rates affecting the cost structure of your journey/holiday.Such surcharge will not be applicable to any bookings where the full balance has been paid.

In the unlikely circumstance that a surcharge is necessary, the Companywill inform you or your agent in writing as soon as possible of any proposed increase. Providing the Company is notified within seven days of receiving notice of such increase, you may choose to cancel the journey/holiday with full and immediate refund of any monies already paid.

7. COMPANY COMMITMENTThe Company accepts responsibility for ensuring that all elements ofthe journey/holiday we are contractually obliged to provide are asdescribed in its brochure and are of a reasonable standard. However,brochures are prepared many months in advance and circumstances

may subsequently change.You will be informed of these at time ofbooking or as soon as reasonably possible.

The Company also accepts responsibility for any personal injury, illnessor death affecting you, or any person included in the booking, causedby the negligence of its employees, agents or suppliers sub-contractedby it to provide any part of the confirmed arrangements provided that:

i) such agents or suppliers or employees were acting within the scopeof or in the course of their employment when the incident occurred.

ii) you notify the Company of any claim within 28 days of completionof the journey/holiday.

iii) you agree to assign to the Company any rights against a supplier or any person that you may have relating to the claim and agree to cooperate fully with the Company.

iv) the Company’s liability in respect of any air, sea, river, road or railcarrier is restricted by the appropriate ticket conditions (see BookingCondition 2).

The Company does not accept responsibility for any loss or damagesuffered as a result of any event beyond its control or the control ofthe relevant agent or carrier or supplier.

8. INSURANCE – FOR UK RESIDENTS ONLYVenice Simplon-Orient-Express Limited strongly recommends that youhave travel insurance in the interests of you and your party. Due tochanges made by the Financial Services Authority, the Company is notable to offer insurance, however, the Company has made arrangementswith Preferential Insurance Service Limited to offer clients on anoverseas journey/holiday single or multi-trip policies. Please call directon 0870 607 7277 for a quote and instant cover.

Should you decide not to take out insurance,Venice Simplon-Orient-Express Limited will not be held responsible for any losses incurred as a result.

9.TRANSFERABILITY OF BOOKINGSIf you or any member of your party is prevented from travelling for anyunavoidable reason, you may transfer your reservation to another party.This is subject only to giving reasonable written notice and settling anyoutstanding balance of the journey/holiday price, which may include additional costs incurred to make the transfer.

10.TRAVEL DOCUMENTSTravel Documents, which are valid only for the passenger(s) named,will be issued after receipt by the Company of full payment for yourreservation and not normally later than 10 days prior to departure.

Please take your confirmation of booking with you on departure.

11. LUGGAGEYou should ensure that you, or any member of your party, do not carryany substances or articles, which are dangerous, may cause damage orinconvenience to other passengers or their luggage, or are prohibited in any of the countries through which your luggage is carried.

All luggage is carried at your own risk and the Company accepts no liability for any loss of, damage to or delay to such luggage unlessthrough its own wrongful act or wilful neglect or that of its employees,agents or suppliers sub-contracted by it to provide any part of thearrangements detailed in the brochure.The Company’s liability shall, inany event, be restricted to US$3,750 per passenger.

12. COMPLAINTSIf you have a problem or complaint during your journey/holiday, pleasebring it to the attention of the management immediately, so that theyhave the opportunity to put it right. Any further cause for complaintshould be put in writing and brought to the attention of the Companyat its Head Office, within 28 days of the completion of yourjourney/holiday.

13. PROMOTIONSTickets for travel on any Orient-Express Trains or Cruise product or for any travel documents relating thereto shall not be used for any promotional or advertising purposes without the prior written consentof the Company.

Accommodation Four categories of cabin are available: Superior, ‘A’ and ‘B’ deck, State

and Single. All compartments are air-conditioned and en suite with shower and toilet.

Dress The atmosphere is relaxed. At dinner an open-necked shirt is appropriate.

EASTERN & ORIENTAL EXPRESS

Accommodation Three categories of cabin are available, all with air-conditioning and

en suite, with shower and toilet: Pullman with upper and lower berth, and State

and Presidential, both with two single beds. During the day, beds are converted into

comfortable seating.

Dress The atmosphere on board combines refinement with relaxation. Men should

wear a minimum of jacket and tie at dinner. Smart-casual clothing is worn during

the day.

VENICE SIMPLON-ORIENT-EXPRESS

Accommodation On the British Pullman, in England, you are reserved a day seat,

and on the continental Wagons-Lits, overnight passengers have cabins equipped

with washing facilities and upper and lower berths. A lavatory is situated at one end

of each sleeping car.

Cabin Suite A suite is made up of two interconnecting double cabins at a per-person

supplement. At night, choose between single beds or keep one cabin as a lounge,

with upper and lower beds in the other cabin.

Dress There is only one rule: you can never be overdressed. It is customary for men

to wear a jacket and tie at dinner. During the day, dress is casual but smart.

Luggage Space is restricted to two suitcases and two smaller bags. Items required

for overnight should be packed into a lighter suitcase, which will go in your cabin.

Items not required until your destination should be packed separately and will be

carried in the luggage van, which is not accessible until your final arrival station.

English Channel Passengers will normally cross by Eurotunnel. Our hostesses

escort passengers during their transfer and via customs and immigration. If

Eurotunnel services are unavailable or, in the interests of passenger comfort,
