Police said V.Vijayam of Godavari Street in Palaniappa Nagar was walking home from a grocery shop after making some purchases when she was inter- cepted by two men around 11am. The two, claiming to be police men, told her she was not sup- posed to wear jewels and asked her to remove her chain. Vijayam however appeared to have seen through their ploy and tried to walk away fast from the avenue. The men overtook her and brandising a knife snatched her gold chain, after the men fled, a shocked Vijayam informed her family members who lodged a complaint. A team of Valasaravakkam po- lice rused to the spot and launched a search based on the descrip- tions of the accused provided by Vijayam. The spot where she was intercepted was two streets from her house and she was not able to raise an alarm as they threat- ened to kill her, said an investi- gating officer. The woman told police the men had conversed in Armed men rob woman at Palaniappa Nagar Hindi. ‘We are questioning some migrant workers in the area’ he said. Police have not ruled out the involvement of members a gang from Ambivalli in Maharashtra who usually adopted the modus operandi to target the women in city.

UIDAI is the pet project of UPAgovernment, spending crores of rupees. Itwas introduced on 28th January 2009. Itproduces 12 digit numbers to those whoregistered themselves and was meant as ameans to enhance delivery of welfarebenefits and services. So far, over 700 millionAadhaar cards had been issued.

The government was making speedyarrangements then for registering Aadhaar.Now, the scheme is very much awry posinga lot ofproblems. The people are distressedfor getting it. They are forced to run frompillar to post with a lot of excuses by the government agencies. Theapplication forms are in short supply, simply saying no stock.

The people are even asked to come for registration after a gap of 4months which is unfair and time consuming. There are no properarrangements and understanding between various functionaries inmany localities. The helpline becomes useless since most of the time,it does not work. The staff behind the biometric centre are said to bediscourteous and uncooperative. The Directorate of Census Operationsis the primary agency and there are biometric failures in the metropolitanareas. It is learnt that only 75% coverage is done and 25% coveragehas yet to be completed. With the above challenges and deficiencies,the Supreme Court was hearing a batch of petitions challenging theconstitutional validity of the scheme as an encroachment into thecitizen’s rights to privacy.

They reported that the scheme is insisted upon by variousauthorities not only by the government departments. Senior advocate,Gopal Subramaniam averred that even it is insisted for getting themarriage registered under Special Marriage Act. Senior advocate AnilDivan complained that Bombay High Court Registrar had received anofficial communication for making Aadhaar mandatory for disbursementof salary to staff and judges. Subramaniam further argued that collectionof personal data under Aadhaar are even done by private contractorswhich is not government activity. Even though on the face of it is asingle document, it has linkages of iris scans and biometric data whichare important. If identities are either mistaken or exchanged, that willpose serious ramifications. It will prone to identity fraud and thesovereign state has the foremost right to protect its citizenry from thewrath.

The three Judge bench of the Supreme Court has deplored theefficacy of Aadhaar making mandatory for all government departmentsdespite its earlier restraint order issued on 23rd September 2013. TheCourt has warned the central and state governments if the scheme ismisused or violated in view of its intrinsic security feature embeddedinto it which has to be kept confidential.

The Court has asked the Solicitor General to take up the matter withall seriousness and write to Chief Secretaries of state and centralgovernments to implement its interim order in letter and spirit withoutany deviation and not to compel Aadhaar mandatory. The said casewill be taken up in the second week of July 2015 and they will reviewthe constitutional validity of the scheme. Even the government saysthat it is not mandatory but implements otherwise indirectly. It is truethat the government is able to save hundreds of crores of rupees inthe distribution of gas by the oil companies and could stop from unduemischief.

It seems that there is no protection of security features personaldata and biometric data if they are misused. What is the guarantee ofprotection by the government? It will be a grievous injury that affectthe fundamental right of a citizen to protect his privacy. To clear allthese misgivings, the government should release a White Paper on allthese aspects with clear explanations and take the people intoconfidence. The scheme should be reviewedin all totality taking intoaccount the court’s concerns not to make it mandatory for delivery ofvarious public services.

Rules relax for students’ passportsIn a relief to students applying for a passport to study abroad,

the Ministry of External Affairs has waived the requirement for produc-ing original certificates. A press released issued by regional passportofficer K.Balamurugan, said that it has come to the notice of the minis-try of external affairs that some passport applicants, especially stu-dents, are unable to produce the original certificates which are depos-ited with educational institutions.

In order to address this problem, the ministry was decided towaive the requirement of producing original certificates. In such cases,the passport applicants can submit a certificate from a recognised edu-cational institution stating that he/she is studying in that institutionand that the original certificates are retained with the institution. Theapplicants should produce photocopies of such documents duly at-tested by the educational institution along with a copy of the identycard issued by the institution.

In case of any doubt about the genuineness of the certificate, thesame will be referred to the issuing authority for verification.

The regional passport office has also decided to accept bankpassbooks for proof of address. In addition to that photo passbooksof banks authorised by Reserve Bank of India will also be accepted asproof of address and photo identity.
