AUCTION INFORMATION

Announcements made by Slifer Smith & Frampton Real Estate Auction Division at the time of sale will take precedence over any previously printed material and/or any other oral statements made.

THE PROPERTY IS BEING SOLD TO THE HIGHEST BIDDER IN AN AUCTION SUBJECT TO A MINIMUM BID OF $1,600,000. Once fi nal bid is accepted, if Buyer is declared the successful bidder, Buyer and Seller will immediately execute a Bid Acceptance Form; select either 4327 Streamside Circle, Residence 1, Vail, Colorado 81657, OR, 4367 Streamside Circle, Residence 6, Vail, Colorado 81657, as the Property; execute the Contract to Buy and Sell Real Estate.

The bidding will be open and verbal. In-person bids, online bids and telephone bids will be accepted. Bids may be placed prior to the auction.

To obtain a bidder card, Buyer must provide $50,000 in “good funds” via electronic wire no later than close of business the day prior to the auction. At the time of registration for the auction, Buyer must execute a registration Agreement in order to obtain a bidder card.

A seven percent (7%) Buyer’s Premium will be paid by the Buyer and added to the successful bid on the Property. If the Successful Bidder participated in the auction through the internet (online bidding), the Buyer’s Premium shall be eight percent (8%).

The Successful Bidder will pay an additional deposit of an amount equal to 10% of the Purchase Price (the “Earnest Money”). The $50,000 previously deposit will be applied towards the Earnest Money.

The closing will occur on September 23, 2009.

It is the Buyer’s sole responsibility to perform any and all inspections it deems pertinent to the purchase of this Property and to be satisfi ed as to the Property’s condition prior to bidding. This property is being sold in “as is – where is” condition, with no expressed or implied guarantees or warranties whatsoever. Personal on-site inspection of the Property is recommended and Bidders are advised to independently verify all information they deem important.

Broker participation is welcome. To qualify for registration the real estate broker must: Register their prospect with Slifer Smith & Frampton Real Estate using the Broker Registration Form. The form must be received and processed by close of business the day preceding the auction. The form must be signed by both broker and prospect. All brokers must provide evidence of their active real estate license with the submittal of their Broker Registration Form.

The sale of the Property is not contingent upon the Buyer obtaining fi nancing.
