No such restatement actually has occurred, and no proposed second

amended complaint has been provided. For all of the reasons set forth in defendants' letters of February 27 and 28, 2012, the request is denied. Without in any way limiting the foregoing, the Court sees no sufficient reason for relieving plaintiff of his commitment or, even if he were relieved, no reason to believe that any second amended complaint would alter the result in this case. confidential by the defendants pursuant to paragraph 12 of the protective order, essentially because (a) plaintiff contends that there is not good cause for confidential treatment of those documents and (b) it intends to refer to the contents in a forthcoming motion and would prefer that they not be obliged to seal the relevant portions of their papers. Paragraph 12 of the confidentiality order requires that a party objecting to a confidentiality designation by an adversary first serve a written statement identifying the reason for the objection, that the parties thereafter meet and confer to attempt to resolve the objection, and that a motion may be made only if the parties have failed to resolve the issue themselves. Plaintiffs affidavit, however, is silent as to whether plaintiff complied with this essential precondition to the making of this motion. The motion therefore is denied. The Court notes also that the plaintiff filed its moving affidavit under seal although it was not, and given its contents could not have been, designated as confidential. Before deciding whether to file another motion, assuming that the parties are unable to resolve the matter entirely without court intervention, plaintiff might well consider the burden that a motion of this character imposes on the Court and its adversary and whether that burden is justifiable in light of the fact that its position would be considerably stronger if and to the extent that documents designated confidential in fact were used on a substantive motion calling for judicial action. MEMORANDUM AND ORDER denying 191 Motion to Strike Document No. 189 .There has been a serious breakdown in the discovery process in this case, as evidenced by the multitude of discovery motions filed. Indeed, between September 20, 2013, and October 17, 2013, the parties have filed five such motions, including the motion to strike, and counsel for the defendants have indicated that another one is on its way. Counsel should know that this is an unsuitable manner in which to conduct litigation. See, e.g., Family Dollar Stores, Inc. v. United Fabrics International, Inc., No. 11 Civ. 2574, 2012 WL 1123736, at *9 (S.D.N.Y. April 4, 2012) (admonishing counsel for failure to cooperate in discovery).
