12/10/2008 10 STIPULATION AND ORDER It is hereby stipulated and agreed subject to the approval of the court as follows: The Louisiana Firefighters' Action and the Minneapolis Firefighters' Action shall be identified as related to The Consolidated Action and, subject to the supervision and authority of Lead Plaintiff's and Lead Counsel, shall be coordinated with the Consolidated Action for all pre-trial purposes, pursuant to Case Management Order No. 1. The Bond Actions shall be consolidated and the docket number of the Louisiana Firefighters Action, Case No. 08 Civ. 9522, constitute the Master File number for the Bond Actions and any similar actions filed subsequently (the :Consolidated Bond Action) The Consolidated Bond Action shall be referred to as In Re: Citigroup Inc. Bond Litigation. All documents shall be failed in the Master File and noted on the Master Docket. No further docket need be made. The authority of Lead Plaintiffs and Lead Counsel in the Consolidated Action shall include the Consolidated Bond Action entries. Notwithstanding the provisions of Paragraph 6 in Case Management Order No. I, Bond Plaintiffs and their counsel, the law firm Bernstein Litowitz Berger & Grossmann LLP ("Bond Counsel"), shall, subject to the supervision and authority, of Lead Plaintiffs and Lead Counsel, be responsible for prosecuting all claims on behalf of investors in Citigroup Notes or other debt securities (collectively, "Citigroup Bonds") and preferred stock or, depository shares representing interests in preferred stock issued by Citigroup or its affiliates (collectively, "Citigroup Preferred Stock"). 142 ORDER granting in part and denying in part 86 Motion to Compel: Guided by these principles, the Court has completed a laborious review of each allegedly privileged document to determine whether it contains privileged communications that cannot be redacted from the purely factual portions of the document. For those documents or portions of documents that the Court finds are privileged, the Court has considered whether plaintiffs have shown good cause to override the privilege, and concludes that plaintiffs have not made such a showing. Each page of any given document is stamped with a single "image number" that identifies that document; multi-page documents are stamped with the same image number on each page. The Court finds that the documents corresponding to the following image numbers in on the CD-ROM that was given to it by Citigroup are not privileged, and so grants plaintiffs' motion to compel production as to the following documents as stated in this Order. The Court finds that the following documents fall within the bank examiner's privilege and that the privilege has not been overcome. Accordingly, the Court denies the motion to compel production as to the following documents as stated in this Order: Finally, the Court orders that the following documents be produced but redacted as set forth in this Order.
