11 start with (b)) and do not contain any clause ordering that the Notice and Proof of Claim be sent by first class mail to potential Class Members. See Dkts.167-1 at 5, 170-1 at 5. The Memorandum of Points and authorities filed by Plaintiffs, however, states that notice will be sent by first class mail (see Dkt. 169-1 at 24) and the schedule proposed by Plaintiffs includes sending notice by first class mail (see Dkt. 169-1 at 28). Notably, the proposed schedule cites to paragraph 11(a) of the preliminary order, despite the fact that no paragraph 11(a) was included in the proposed preliminary order. The Court believes that notice would not be sufficient and would not satisfy due process requirements unless the Notice and Proof of Claim form are sent to potential Class Members by first class mail. Accordingly, the Court added clause 11(a) in the draft Order requiring as much. The Court also notes that the Memorandum of Points and Authorities filed by Plaintiffs states that the Publication Notice will be published in Investors Business Daily, The Wall Street Journal, and the Oregonian. Dkt. 169-1 at 24. The first proposed order submitted to the Court similarly included an order that the Publication Notice be published in each of Investors Business Daily, The Wall Street Journal, and The Oregonian. Dkt. 167-1 at 6. The amended proposed order submitted to the Court removes the requirement that the Summary Notice be published in The Wall Street Journal and The Oregonian. Dkt. 170-1 at 6. The Court believes that notice is sufficient without publishing the Publication Notice in the The Wall Street Journal and The Oregonian because the Publication Notice will be individually sent to potential class members by first class mail. Thus, the Court does not include the additional publications in the draft Order. Finally, the Parties are also to inform the Court by noon tomorrow of any agreed-upon date(s) for the Settlement Hearing, and if no dates can be agreed upon by all Parties, the Court will select a date.
