    C qy igh t BusinessS a result of Public Law 501 whichA ecame effective May 27,1948 andwhich increased copyright fees,there was, during the year under review,a marked rise in the revenues of theCopyright Office. The total revenueswere $834,738.05, or an increase of 71percent over the highest previous year.

    As had been anticipated, the number ofregistrations decreased (15 percent), thelargest decline beiig in the categories ofunpublished music and certain miscella-neow cl- Registrations for booksincreased 5 percent and motion pictures 8percent; registrations for periodicals de-creaPed 9 percent and renewals of regis-trations 13 percent. Of the 193,236 itemstransferred to the collection of the Library,48,320 were books and pamphlets.Irnprouemcnts in the Catalog o Cokpright Entries

    Volume 2 of the Third Series of theCatdog o CoPpiht Entries, covering thecalendar year 1948, was produced with no&aqe in plan, but with a number ofadded features designed to improve its~ e s s .mportant among thesc addi-tionswas a classified index in the PublishedMusic Catalog, which provides acceps tocurrent pductions by medium-of-per-formance and broad subject headings.Thc inclusion of brief, objectivesummariesfor moat motion pictures furnishes a guideto the content ofh. rief sectionswereadded to the Works of Arc and PeriodicalCatalogs, consisting of listsof books on artand photography, and listsof new periodi-eaIs published for theht time d+ the

    year. Additional indexing featuru wercalso added to the Works of Arc Catalog,and to the Map Catalog.Publicresponseto thesechanges hasbeenencouraging. Each year more people areusing the Catalog and recognizing it asconstituting in effect a national bibliog-raphy in each of the fields represented bycopyright registrations. The Catalog pro-vides information as to a number of t ypaof writings not available in any otherpublication.Producing the C d o g by the l~art co-nomical process, namely by photographingtypewritten cards, nvolves numerow tech-nical difEcultia. Marked progresr wasmade during the year in overcoming theseand in improving the readabiity andgeneral appearance of the C d o g .Codidat ion of the Card Catalog FilesOneof the duties of the CopyrightOffice

    is to supply information concerning copy-right claims which have been registutd.Because of the u n d t y of many en-q u i . s to when claims wen recorded itis usually more expeditious to refer to therecord in the card catalog rather than toother sources. The administration of theCopyright Office has been aware of themultiplicity of its files and the advisa-bility of consolidating all entries for agiven clam of material in a single file thusincreasing their prompt accessibility tothe public. As early as 1937 plans weredrawn tffecting a -tion and con-solidation of the reghation aes. Owingto lack of pmonntl and funds, and to aninaeaaipg workload, the consolidationcould only be undedccn on a piecemealbasis.

The pur-pose of thia Section is, through search andcorre~pondena, to advisc owners andagents of owners of copyrights how to per-fect their daima,when they have not doneso, by registering thun in the CopyrightO h , s required by law.This d c e as been pdt ab le , not onlyto the holdera of copyrights, who, havingrcgintmd may thus enforce thcir rights atlaw, but to the Copyright Office and theLibrary of Congrea~as well. In eightmonth, the Copyright Oi3ice nccivtdthrough the Compliana Section few inthe amount of $18,014.00. The Library,on its part, d v e d books and 0 t hmaterials valued at $13,023.00. Fees andmaterials together thus totaled $31,357.00,which is almost three times the expenseincurred by the project. Having p ditself a practical asset to the Library, how-e m , the Section, with additional pason-n 4 prop- to extend its suvice to otherfields, inducting music, maps, motionpictures, periodicals, etc., in which themwould appear to be many published, butaa yet unregiatmd claims o copyright.

On August 29,1917, h etransferred to the Copyright Oace andsince that time had been engaged incataloging work.     For many yearsEnglish a u t h nd pub-liahera have complained about the "manu-facturing clause" in the copyright law ofthe United States. Recently dollar ~h or t-ages, together with exchange regulationsin force in many countrica, have made itextremely &&cult for mast foreign au thmto register copyrights in thb country. OnJune 3, 1949, Public Law 84, an actdesigned to remedy the situation, becamelaw.

The lawmay also, to some degree, promote thegradual attainment of world-wide biblia-graphical ccmmls. National librarieeabroad will doubtless prepare many of tbe .catalog cards produced in response to tbenew act, in cooperation with the UnitedStates Copyright Office. This oint laborshould go a long way toward standardizingAmerican and foreign library techniques.The loss of the $4 fee will reduce tbe

    revenues of the Copyright ma, butprobably, on balance, will not d t nloss to the Federal Government. TheLibrary of Congress now buys and cata-logs each year thousands of foreign w a l aMost, if not all, of the foreign works sentto the Copyright Office will be needed bythe Library for its awn collections or forits exchange operatiom. The increme inthe number ofworks deposited, and a can-sequent duction in tbe number whichmust be purchased, the value of the ex mcopy and the saving of the expense dcataloging should mart than offact tbeloss of the fee on the small number ddeposits made prior to the new act.

    2. Even more important are the changeswrought by this act in provbions of tbecopyright law regarding books and period-icals in the English language. Prior to tbepassage ofPublic Law 84 a book publishedabroad in the English language had to beregistered in the United States CopyrightOilice within sixty days of publication a dwas required to be manufa& in tbeUnited States within four montbs thereaftu in order to secure United Statercopyright protection. With a few urctptiom no copy manuEacturtd abroad couldbe imported into thc United States whilethe American copyright rubsiisted.The effect was to deprive almost allworks published abroad in the Englishlanguage of American copyright protee

    Public Law 84 allows six months frompublication abroad within which t6 regis-ter and five years n which to manufacturein the United States. It a h dds 1,500 tothe number of copies that may be importedunder the provisions of the Copyright Actwithout 1 of copyright.

    It k expected that the new law willincrease the number of English booksreprinted in the united States. Thc ex-tendon of the period of five years shouldmake it possible for an Amuican pub-lisher to determine whether a book is asuccess in England and Canada Woredeciding whether to publish it hat. Theright &to import 1,500 copies to test theAmerican market should p t l y d t ndetermining whether the Act will appealtoAmcrican as well as o British and Cana-dian tastes.

    America and the President of theRepublicof the Philippints issued prochmtiom onOctober 21, 1948 which extended copy-right protection in each country to thenationals of the other. The Philippinecopyright law is modeled aftcr the law inthis country and like it requites rcgbtra-tion, and tbat a copyright notice be placedin each work.

    Outstanding Cojyight CastsThe outstanding court decision of the

    year, as far as international copyright lawis concerned, is Todamcrica Musica Ltda. v.Radio Corfwation of America, 171 F (2d)369 (C. C. A. 2d, 1948). It was an actionfor infringement of the mechanical repro-duction rights to the Brazilian tuneTico." The plaintiff relied upon theBuenos Aim Convention of 1910, towhich both Brazil and the United Statesare signatories. The court held thatneither that Convention nor the Residen-tial Proclamation relating thereto specifi- 'cally mentioned mechanical reproductionrighe and that section l(e) of the copy-right law required a Presidential Procla-mation for the enforcement of such rightsby the owner of a foreign copyright whois not domiciled in the United States.Thia decision indicates a need for the es-tablishment, by means of PresidentialProclamations, of rcciprocaI relations con-cerning mechanical reproduction rights,with each of the thirteen member repub-lics of the Buenos Aires Convention whichhave previously relied upon it for inter-national protection of those rights.

    In the Annual Report for last yearmention was made of the poaclibiiity thatthe Supreme Court would have an oppor-

    trtnity to review the holding of the FourthCircuit Court of Appeals that copyrightwas a divisible, rather than an indivisiblebuirdle of rights. In the case of W&h e . Commissioner, 69 S. Ct. 1120 (1949),a majority of the court based its decisionon the tax question and omitted any diicussion of the interesting copyright prob-lem. The minority noted that the court'sdecision, by the plain implication of itadence, rejected the notion of indivisibilityof copyright but clung to the conclusionwhich was derived from that concept.Thus the validity of the concept of theindivisibility of copyright is probably stilluncertain.

    In Khan v. LdoFeut, Inc., 78 F. Supp. 754@. C. N. Y., 1948) the court threw doubton the rule that it is not a violation ofcopyright to make and sell phonographm r d s of a copyrighted nondramaticsang, saying: "COTCOTM. Montgomery Wmd6r Co., Inc., et al., 9 Cir., 121 F. (2d) 572,is not the law in this Circuit so far as I amadvised. I hesitate to believe, for in-stance, that the copyright of a book couldbe avoided by reading it over the radioto a public audience, instead of printingit." Cf. Krepborg v. Durante, 21 U. S.P. Q. 557 (S. D. N. Y., 1934); 22 U. S.P.Q.248 (S.D.N.Y., 1934).
