SPECIAL NOTICE
Prior to the award of the contract, the Contractor shall file with the Michigan Department of Transportation’s Ishpeming Transportation Service Center located at 100 S. Westwood Drive, Ishpeming, MI 49849:

• Owners Protection Insurance Insurance: The Contractor will be required to furnish a certificate of insurance showing they have complied with Section 107.10 of the Standard Specifications for Construction. Form 1304A, annexed hereto, shall be used for certifying insurance.

PROGRESS CLAUSE CS 52041 US-41/M-28 ROCK EXCAVATION IN MICHIGAMME TOWNSHIP
PROGRESS CLAUSE: After receiving Notice of Award, start work on the date approved by the Engineer. In no case, shall any work be commenced prior to receipt of formal notice of award by the department.
All contract work shall be completed and billed no later than September 24, 2021. Once work commences it shall be continuous until all work is completed. The contract work shall be completed in 20 work days.
Failure to meet the above-mentioned completion date and work day requirement shall result in liquidated damages as described in Section 108.10 of the Standard Specifications for Construction.
The low bidder(s) for the work covered by this proposal will be required to meet with Department representatives to work out a detailed progress schedule. The engineer will arrange the time and place for this meeting.
Failure on the part of the contractor to carry out the provisions of the Progress Clause, as established, may be considered sufficient cause to prevent bidding future projects until a satisfactory rate of progress is again established.

PROJECT LOCATION
The project is located on US-41/M-28, control section 52041 beginning 715 feet east of West Railroad Street (CS BMP is 25.849) and 830 feet east of West Railroad Street (CS EMP is 25.827) in Michigamme Township, Marquette County. The project consists of excavating rock along the north side of the highway.
The exact locations of work will be as directed by the Engineer.
PROJECT DESCRIPTION
Mark the approximate right of way limits as needed to ensure work and equipment stays on the US-41/M-28 highway right of way. The approximate right of way limits are described below. Remove vegetation, brush, trees and stumps from the slopes as needed to perform rock excavation. Excavate rock overhanging the existing ditch back slope on the north side of the highway and according to the rock removal photos included with this project log. Rock removal will extend up to 100 feet north of the US-41/M-28 centerline. Rock excavation work will be according to Section 205 of the MDOT 2012 Standard Specifications for Construction. If using explosives for rock excavation see subsection 107.17 of the MDOT 2012 Standard Specifications for Construction. Restore slopes with exposed soil using slope restoration items.
Any damage to the vegetated slopes, gravel shoulders, and HMA pavement to excavate rock must be repaired and restored by the contractor at no cost to the department. See subsection 104.07.B, Safety and Health Requirements and subsection 107.07, Protection and Restoration of Property of the MDOT 2012 Standard Specifications for Construction.

MEASUREMENT AND PAYMENT
All completed work will be paid for as one lump sum. Estimated quantities to complete the work are included in the bid proposal for information only. The contractor is responsible for verifying these items and quantities. No additional payment will be paid for increases in quantities or additional items necessary to perform the work as described in the log of project.

GENERAL PLAN NOTES
GENERAL Mile points are only approximate and exact locations of the work shall be designated by the Engineer prior to Construction.
UNDERGROUND UTILITIES For the protection of underground utilities and in conformance with MCL 460.171 et seq, the Contractor shall contact MISS DIG System, Inc. by phone at 811 or 800-482-7171 or via the web at either elocate.missdig.org for single address or rte.missdig.org, a minimum of 3 work days prior to excavating, excluding weekends and holidays.
VEHICLES AND MATERIALS STORAGE The Contractor shall not park any vehicles nor store any equipment on any Public Recreational Property. Access to Recreational Sites must be maintained at all times.
SPECIFICATIONS FOR CONSTRUCTION The improvements covered by these plans shall be done in accordance with the MDOT 2012 Standard Specifications for Construction.
ADJUSTING MONUMENT BOXES All government corners on this project shall be preserved, whether shown or not. It may be necessary to place or adjust monument boxes, as required.
SOIL EROSION MEASURES Appropriate soil erosion and sedimentation control measures shall be in place prior to earth-disturbing activities. Place turf establishment items as soon as possible on potential erodable slopes as directed by the Engineer. Critical ditch grades shall be protected with either sod or seed/mulch or mulch blanket as directed by the Engineer.

a. Description. This work consists of providing all labor, materials and equipment to maintain traffic as specified herein for rock excavation work on US-41/M-28 east of West Railroad Street in Michigamme Township, Marquette County.
b. General. Maintain traffic in accordance with the standard specifications, including any supplemental specifications, and as specified herein.
1. Coordinate work operations with contractors performing work on other projects within or adjacent to the Construction Influence Area (CIA), as outlined in the coordination clause.
2. MDOT maintenance crews and/or Contract Maintenance Agencies may perform maintenance work within or adjacent to the CIA.
c. Construction Influence Area (CIA). The CIA includes the right-of-way of the following roadways, as described below:
1. From the point where advance construction warning signing begins to the point where construction signing ends.
2. In addition, the CIA includes the rights-of-way of any intersecting roads and ramps adjacent to the work zone for a distance of approximately 500 feet in advance of the state trunkline.
d. Traffic Restrictions. Maintain traffic in accordance with the maintaining traffic typicals contained herein, except as noted below. Changes or adjustments to the maintaining traffic typicals may be necessary to fit field conditions, subject to approval of the Engineer or as determined by the Engineer.

3. Conduct all work during daytime hours only.
4. Where work cannot be performed using shoulder or lane closures, maintain two-way traffic at all times on the trunk line and all intersecting roads using traffic regulator control. Place the arrow panel, signs and channelizing taper for the traffic regulator operation at locations approved by the Engineer for adequate visibility by oncoming traffic.
5. A single traffic regulating sequence is allowed to cover a maximum closure length of 0.5 miles unless otherwise approved by the Engineer.
A. Do not utilize more than 1 traffic regulator operation at one time.
6. No more than 1 shoulder closure is allowed on US-41/M-28 at one time.
A. The maximum closure length is 0.5 miles unless otherwise approved by the Engineer.
B. Do not close shoulders on both sides of the road at the same time, at the same location.
7. Traffic stoppages for rock blasting are not allowed between the hours of 7:00 am and 9:00 am, nor between the hours of 3:00 pm and 5:00 pm. Utilize a traffic regulator sequence or law enforcement to stop and hold traffic. Traffic stoppages will be allowed for a duration of no longer than 10 minutes for the purposes of rock excavations requiring blasting. Total closures will be only allowed once per hour.
8. Maintain driveway access to all businesses and residences during construction. Prior to any temporary closures, coordinate with affected owners during construction.
9. Once work is initiated that includes any lane restrictions, continue until that work is completed. Remove any lane restrictions where no work has taken place for more than 1 day. No additional payment will be made for removal or replacement of lane restrictions resulting from a lack of work.
10. Crossroads must remain open to traffic at all times. Use intermediate traffic regulators at each intersection approach and commercial driveways within the closure limits, as directed by the Engineer. Use traffic regulator control as directed by the Engineer for cross street traffic while working through intersections.

11. Monitor the work zone for traffic delays and backups. Take action to correct delays longer than 10 minutes or traffic backups of more than 1/4 mile. If informed by the Engineer that these thresholds have been exceeded, take the following corrective action:
A. Stop all construction operations immediately.
B. Ensure the roadway is in a safe condition and open it to traffic.
12. Place plastic drums, as needed, in advance of any incomplete work, during non-working periods.
13. When utilizing a shoulder closure, do not occupy any part of the active traffic lane with personnel or equipment. If this situation cannot be avoided, then utilize a lane closure.
e. Traffic Control Devices.
1. General. Ensure all traffic control devices and their usage conform to Part 6 of the MMUTCD and must meet the “acceptable” criteria as defined in the ATSSA publication entitled “Quality Guidelines for Temporary Traffic Control Devices and Features” at the time of initial deployment and after each work order completion, and as specified herein.
A. Cover existing regulatory, warning and construction signs that are not applicable during construction.
B. Clean each sign, barricade, and channelizing device once per week and as directed by the Engineer.
2. Temporary Signs.
A. Provide temporary sign spacing and taper lengths as shown on Maintaining Traffic Typical M0020a.
B. Do not display signs more than 3 days prior to the start of work. When work is complete, cover temporary signs within 3 days.
C. Place additional W20-1 ("ROAD WORK AHEAD") signs on intersecting or adjacent roads where construction activities may be encountered.
D. If rock blasting is used, install additional temporary signing for a blasting zone as shown in the 2011 Michigan MMUTCD, Figure 6H-2. Signing shall also be provided for a any side roads entering the blasting area, as defined in 6H-2. Provide signs sized as listed in the Freeway or Expressway Column shown in Table 6F-1.
E. Distances shown between construction warning, regulatory and guide signs shown on the Maintaining Traffic Typicals are approximate and may require field adjustment, as directed by the Engineer.

F. Construct all temporary signs with legends and symbols flush to the signs face and not extending beyond the sign borders or edges.
3. Channelizing Devices.
A. Use traffic cones with a minimum height of 28 inches during daytime shoulder closures, lane closures, and local streets.
B. Place channelizing devices at a spacing (in feet) not to exceed:
in tapers: 1 times the posted speed (in miles per hour), 50 feet maximum.
in tangents: 2 times the posted speed (in miles per hour), 100 feet maximum.
C. Ensure all devices have sufficient ballast to prevent moving or tipping. If moving or tipping occurs, place additional ballast, as directed by the Engineer, at no additional cost to the Department. No more than two ballasts are allowed on each channelizing device.
f. Measurement and Payment. The estimate of quantities for maintaining traffic is based on signing and related traffic control devices for 1 shoulder closure and 1 traffic regulator sequence and blasting zone signs. This estimate also includes a maximum of 2 Type C lighted arrows (min 48 inch by 96 inch) to be in use at any one time.
1. No additional payment will be made for the joint use of traffic control items with other Contractors or MDOT maintenance.
2. No payment will be made for additional signage brought to the project site but not utilized.
3. Payment for additional W20-1 ("ROAD WORK AHEAD") signs on intersecting or adjacent roads where construction activities may be encountered will be part of the daily traffic control pay item.
4. No additional payment will be made for additional signing or maintaining traffic devices to expedite the construction.
The completed work, as described, will be included in the payment for the contract lump sum bid. The following pay items with quantities are included in the project log and bid proposal for information only:

SPECIAL PROVISION FOR
SLOPE RESTORATION, NON-FREEWAY

a. Description. This work consists of preparing all lawns and slopes on non-freeway projects designated for slope restoration on the plans or as directed by the Engineer and applying topsoil, fertilizer, seed, mulch with mulch anchor, mulch blanket, high velocity mulch blanket and permanent turf reinforcement mat to those areas. Turf establishment must be in accordance with section 816 of the Standard Specifications for Construction and Standard Plan R-100 Series, except as modified herein or otherwise directed by the Engineer.
b. Materials. The materials and application rates specified in sections 816 and 917 of the Standard Specifications for Construction apply unless modified by this special provision or otherwise directed by the Engineer. The following materials must be used on this project:
1. Seeding mixture as called for on the plans
2. Fertilizer, Chemical Nutrient, Class A
3. Topsoil Surface, Furnished or Salvaged, 4 inch. Remove any stones greater than 1/2 inch in diameter or other debris from all topsoil.
4. Mulch and Mulch Anchoring, Mulch Blanket and High Velocity Mulch Blanket
5. Permanent Turf Reinforcement Mat (TRM) must be 100 percent synthetic and consist of 100 percent ultraviolet (UV) stabilized polyolefin fibers sewn between two layers of black UV stabilized polypropylene netting with polyolefin thread. The TRM must meet the following “minimum average roll value” requirements:

c. Construction. Construction methods must be in accordance with subsection 816.03 of theStandard Specifications for Construction. Begin this work as soon as possible after final grading of the areas designated for slope restoration but no later than the maximum time frames stated in

subsection 208.03 of the Standard Specifications for Construction. It may be necessary, as directed by the Engineer, to place materials by hand.
Shape, compact and assure all areas to be seeded are weed free prior to placing topsoil. Place topsoil to the minimum depth indicated above, to meet proposed finished grade. If the area being restored requires more than the minimum depth of topsoil to meet finished grade, this additional depth must be filled using topsoil or, at the Contractor’s option, embankment. Furnishing and placing this additional material is included in this item of work.
Topsoil must be weed and weed seed free and friable prior to placing seed. Remove any stones greater than 1/2 inch in diameter or other debris. Apply seed mixture and fertilizer to prepared soil surface. Incorporate seed into top 1/2 inch of topsoil
Apply mulch at a rate of 2 tons per acre. Place Mulch Anchoring over the mulch at a rate specified in subsection 816.03.F of the Standard Specifications for Construction. Mulch Blanket and High Velocity Mulch Blanket must be placed in accordance with subsection 816.03.H of the Standard Specifications for Construction and as shown on Standard Plan R-100 Series.
Areas constructed with the TRM must be installed on prepared (seeded) grades as shown on the plans in strict accordance with the manufacturer’s published installation guidelines. The top edge of the TRM must be anchored in a minimum 6 inch deep trench. Operation of equipment on the slope will not be allowed after placement of the TRM. No credit for splices, overlaps, tucks or wasted material will be made.
If an area washes out after this work has been properly completed and approved by the Engineer, make the required corrections to prevent future washouts and replace the topsoil, fertilizer, seed and mulch. This replacement will be paid for as additional work using the applicable contract items.
If an area washes out for reasons attributable to the Contractor’s activity or failure to take proper precautions, replacement will be at the Contractor’s expense.
The Engineer will inspect the seeded turf to ensure the end product is well established, weed free, in a vigorous growing condition, and contains the species called for in the seeding mixture.
If the seeded turf is not well established at the end of the first growing season, the Contractor is responsible to re-seed until the turf is well established and approved by the Engineer.
If weeds are determined by the Engineer to cover more than 10 percent of the total area of slope restoration, the Contractor must provide weed control in accordance with subsection 816.03.J of the Standard Specifications for Construction. Weed control will be at the Contractor’s expense with no additional charges to the project.
d. Measurement and Payment. The completed work, as described, will be included in the payment for the contract lump sum bid. The following pay items with quantities are included in the project log and bid proposal for information only.:

2. Place Slope Restoration, Type B parallel (6 feet minimum) to the edge of the roadway, in areas that have a 1 on 3 slope and in any ditch with a grade less than 1.5 percent, or as directed by the Engineer. Slope Restoration, Type B includes furnishing all labor, equipment and materials required to install Topsoil Surface, Furnished or Salvaged; Fertilizer, Chemical Nutrient, Class A; Seeding Mixture; and Mulch Blanket.
3. Place Slope Restoration, Type C in areas that have a 1 on 2 slope, any ditch with a grade of 1.5 percent to 3 percent or as directed by the Engineer. Slope Restoration, Type C includes furnishing all labor, equipment and materials required to install Topsoil, Furnished or Salvaged; Fertilizer, Chemical Nutrient, Class A; Seeding Mixture; and High Velocity Mulch Blanket.
4. Place Slope Restoration, Type D in areas that have a slope steeper than 1 on 2, any ditch with a grade steeper than 3 percent or as directed by the Engineer. Slope Restoration, Type D includes furnishing all labor, equipment and materials required to install Topsoil, Furnished or Salvaged; Fertilizer, Chemical Nutrient, Class A; Seeding Mixture; and TRM.
