    SPECIAL MEETING November 23, 2020

    CALL TO ORDER The special meeting of the Board of School Directors of the Upper Perkiomen School District was called to order by President Kerry Drake, at 7:02 p.m. as a virtual and in-person meeting. The following Board members attended: Peg Pennepacker, Dr. Kerry A. Drake, Melanie R. Cunningham, Keith McCarrick, Raeann B. Hofkin, Mike W. Elliott, Judy Maginnis, Dana E. Hipszer, and Stephen L. Cunningham. Administration in attendance were: Allyn J. Roche, EdD., Andrea Farina, EdD., Sandra M. Kassel, Kimberly Bast, and Georgiann Fisher. Others in attendance were: Kyle Somers, Rob Carpenter, EdD., Bobby Kurzweg, Jessica Kuntz, Shannon Downs, Jim Papeika, Jennifer Hartzel, Cheryl Barger, Amy Fadil, Tanya Kennedy, Matthew Tomlin, and Cookie McGowan,

    PRESENTATIONS/DISCUSSION A. Winter Athletics - Mr. Kurzweg (Athletic Director) and Dr. Carpenter (UPHS Principal)

    Mr. Kurzweg and Dr. Carpenter talked about the success of the Fall Athletic program due toall participants complying with the Health and Safety Plan and following the guidelines. They presented the Updated Health and Safety Plan and talked about the updated mask mandate for Winter Athletics. New sport specific guidelines were discussed.

    Board members had many questions and comments.

    DISCUSSIONS A. Review of Montgomery County and Local Municipality COVID-19 Metrics/Data

    Dr. Roche shared a few slides showing updates since the last time the Board met. He talkedabout the Montgomery County Board of Health Order that required all schools to be in Full Remote Learning for the period of November 23rd – December 6th. Dr. Farina explained the chart showing how many cases it would take for schools to close. Dr. Roche and Mr. Somers talked about the Attestation document that needs to be submitted to PDE. Dr. Farina and Dr. Roche said that one of the factors that has to be considered is the Personnel impact.

    B. Date of Transition from the Full Virtual Instructional Model to the Hybrid Instructional ModelDr. Roche shared a slide of all the factors to consider at this time including the PA DOH

    guidance, the Montgomery County guidance, and staffing/students concerns with isolation/quarantine challenges that could lead to potential functioning closures. Dr. Roche said the administration recommendation, based on all of the factors and conversations he has been having for weeks and looking at the numbers, would be to shift the start date of the transition to the hybrid model until after the winter break, specifically January 19th, which would give a full two weeks following the winter break. He announced that if the Board was interested in making that a motion they could add it to the agenda for tonight.

    Motion by Stephen Cunningham, seconded by Keith McCarrick, to add the motion, to approve the administrative recommendation for an adjusted date to transition to a K-12 Hybrid Instructional Model beginning January 19, 2021, to the agenda as an Action Item. Motion carried; all voted aye.

    PUBLIC COMMENTS ON ACTION ITEMS ONLY Jessica Kuntz, Red Hill, expressed her displeasure in the students being in a virtual program.

    Shannon Downs, Upper Hanover Township, shared her frustration with students being out of school and feels there would not be a problem if the safety protocols are followed.

    Jim Papeika, Marlborough Township, thanked everyone for their work in dealing with this difficult situation. He asked about considering putting out a new parent declaration for parents who had considered the holidays when making their choice earlier.

    Jennifer Hartzel, East Greenville, asked if the Western Center students will be going to school in December or if they had to wait until January. Cheryl Barger, Pennsburg, asked if the length of English and Math classes will be increased. She said it has been greatly reduced in the virtual model. Amy Fadil, Upper Hanover Township, asked if the closure would get extended is there a plan for PSAT’s. She stated that Wednesday is not a free day and her high school student is working all day and reaching out to teachers. Tanya Kennedy, Hereford Township, not happy with decision to bring sports back but not the other activities. She has concerns about a date of December 7th to have any students or staff being in school. She said her family is pleased with the education her son is getting in order to keep everyone safe. Matthew Tomlin, Hereford Township, commented about the district not being able to get Hereford data. Cookie McGowan, Upper Hanover Township, thanked everyone and said it is disheartening to listen to angry comments because she feels the district and board is doing the best out of concern for the safety of everyone.

    PUBLIC COMMENTS Jim Papeika, Marlborough Township, appreciates what everyone has done and asked again about considering to reissue a new parent declaration.

    BOARD COMMENTS Dr. Drake thanked everyone for taking the time during a holiday week and asked everyone to have a happy, safe and healthy Thanksgiving.

    ELECTION OF TEMPORARY PRESIDENT Motion by Mike Elliott, seconded by Melanie R. Cunningham, that Keith McCarrick, be

    elected as Temporary President of the December 7, 2020 reorganization of the Board of School Directors. Motion carried; all voted aye.

    ELECTION OF OFFICERS A nomination for Melanie Cunningham to be elected as President of the Upper

    Perkiomen School Board was made by Raeann Hofkin.

    Motion by Raeann B. Hofkin, seconded by Melanie R. Cunningham that nominations for President be closed. Motion carried; all voted aye.

    Sandra Kassel called for a Roll Call Vote. ROLL CALL VOTE: M. Cunningham – yes, S. The following Board members attended: Stephen Cunningham, Kerry Drake, Mike Elliott, Dana Hipszer, Raeann Hofkin, Judy Maginnis, Keith McCarrick, Peg Pennepacker, and Melanie Cunningham. Administration in attendance were: Allyn J. Roche, EdD., Andrea Farina, EdD., Kimberly Bast, Sandra M. Kassel, and Georgiann Fisher. Others in attendance were: Kyle Somers, Doug Kenwood, Jim Roth, Enoc Padilla, Ethan Wambold, Robert Carpenter, EdD., Bobby Kurzweg, Sean Lyman, Jessica Kuntz, Heather Maiden, and Mary Cannon.

    BOARD PRESIDENT’S REPORT President Cunningham thanked Kerry Drake, Raeann Hofkin, and Mike Elliott for their time on the cabinet and congratulated and welcomed Judy Maginnis. Mrs. Cunningham said she is looking forward to a great year.

    SUPERINTENDENT’S REPORT Dr. Roche reported that it is hard to believe that everyone is still dealing with the impact of COVID-19 and stated that it is encouraging to hear about the vaccine. He thanked everyone for the support of the school district community. Dr. Roche said there is a revised school calendar on the agenda reflecting the hybrid model with the Blue and Gold days beginning on Tuesday, January 19, 2021. Dr. Roche announced that the Fall Sports teams were voted to be awarded the best sportsmanship award from the league this past season. Dr. Roche congratulated the student athletes, coaches, parents and athletic trainers on their success. Dr. Roche presented important information regarding the district and the continuing COVID-19 procedures and protocols. Dr. Roche explained the PDE Attestation Form and Compliance. He shared that the district needs everyone’s support with contact tracing, and talked about the Optional Rapid Antigen testing, in conjunction with CHOP. Dr. Roche said that with the Montgomery limits if athletics would be approved there may not be the ability to have any in person spectators.

    STUDENT REPRESENTATIVE TO THE BOARD REPORT Enoc Padilla and Ethan Wambold reported on happenings at the high school. They reported that 38 members were inducted into the National Honor Society and that Parent Teacher conferences were held on November 23rd and 24th. They announced that 22 Upper Perkiomen athletes were selected by the Pioneer Athletic Conference in their respective sports and received first and second team honors. It was announced that if you purchase items through Amazon smile it will benefit the Upper Perkiomen Education Foundation.

    SOLICITOR’S REPORT/SUNSHINE ACT ANNOUNCEMENTS Mr. Somers reported that the Board met virtually on December 2, 2020 for the purpose of discussing a matter of litigation involving a tax assessment appeal as well as a matter of personnel involving an administrative employee, and to receive information but not deliberate on two additional items.

    Mrs. Hofkin announced that this is the First Read of these policies and reminded the Board members that if they had questions there is still time to ask them. Dr. Farina encouraged everyone to pay special attention to discipline, expulsion, and suspension.

    OLD BUSINESS Motion by Keith McCarrick, seconded by Mike Elliott, to approve Motion A and B as follows:

    A. Motion to approve Upper Perkiomen School District to participate in Winter Athletics asper PIAA guidelines and the revised UPSD Winter Athletics Health & Safety Plan. VOTE:

    Dr. Carpenter and Mr. Kurzweg reviewed the revisions and a discussion was held with administration and Board members and Public Comments were allowed.

    Sean Lyman, Upper Hanover Township, talked about how disappointing it would be to not have winter sports. He said everyone will follow the guidelines. Jessica Kuntz, Red Hill, said how kids played sports in the outdoor season and it all went well and it is important for kids to play. Heather Maiden, Marlborough Township, talked about the need for kids to play, the isolation is taking a toll on kids. She said all leagues have been following guidelines.

    Purpose A student who is eligible to attend District schools and is married and/or pregnant/parenting shall not be denied an educational program solely because of marriage, pregnancy, pregnancy-related disabilities, or potential or actual parenthood.[1][2]

    Authority The Board reserves the right to require as a prerequisite for attendance in the regular classes and participation in the extracurricular program of the schools that each pregnant student present to the Superintendent or designee a licensed physician's written statement that such activity will not be injurious to her health nor jeopardize her pregnancy.

    Guidelines A pregnant/parenting student whose mental or physical condition prevents her from attending regular classes, when such condition is certified by a licensed physician, may be assigned to an alternate educational program. The district may offer separate, modified educational programs or special courses in order to maintain appropriate educational opportunities for pregnant and parenting students.A student who has received modified educational program for reasons associated with her pregnancy or parenting shall be readmitted to the regular school program upon her request and the written statement of a licensed physician that she is physically fit to do so.

    Delegation of Responsibility The Superintendent or designee shall develop administrative regulations for implementing this policy.

    234-AR PREGNANT/PARENTING/MARRIED STUDENTS

    District administrators will not exclude married, pregnant or parenting students from attending school and participating in extracurricular activities. Based upon the general rule for student attendance, married, pregnant and parenting students must satisfy all compulsory school attendance requirements established by the Board but may obtain an excuse from attending school in accordance with applicable Board policy and administrative regulations. A pregnant student may inform a teacher, nurse, counselor or other school staff about the pregnancy. The staff member, upon receiving consent from the student, will inform the principal of receipt of the information. The principal and/or nurse or designated counselor will meet with the pregnant student, explain the rules for attendance, provide information regarding the resources available, and give the student the Student Health Report to be completed by the student’s licensed physician. The student must return the completed Student Health Report signed by the licensed physician after her next physician’s appointment. A nurse or school counselor will be designated by the principal to serve as the resource/contact person for the student. The designated individual will maintain and provide a list of resources available to the student, will communicate with local community agencies that can provide relevant assistance, and will assist the student in accessing available social services that will enable the student to remain in school to achieve graduation. The principal and designated resource/contact person will review the completed Student Health Report and will determine and implement any special considerations or limitations, attendance exceptions, and modifications to the educational program are required for the student. Guidelines For Attendance Of Pregnant/Parenting Students 1. Pregnant Student – The resource/contact person will make an effort to ensure that the student stays enrolled and

    attends school consistently. 2. Complicated Pregnancy – If complications arise during pregnancy that cause attendance at school to be harmful to the

    physical or mental health of the student or infant, the student must submit to the resource/contact person a statement from the licensed attending physician specifically supporting the absence and requesting homebound instruction for a specific period of time.

    3. Parenting Student – Following the birth of an infant, a female requires a period of time to recuperate from childbirth and

    arrange for child care. The student must submit to the resource/contact person a statement from the licensed attending physician stating the birth date of the infant. The district will provide homebound instruction to the student for a period up to six (6) weeks following the birth. Following the six-week postpartum period, the female student will be required to follow all Board policies regarding general student attendance.

    The principal will allow any student who has been absent from school due to pregnancy or parenting to re-enter the school in the same manner as any student whose nonattendance is a result of an excused absence or temporary disability. A student over compulsory school age who leaves school due to pregnancy or parenting, without achieving a high school diploma, will be permitted to re-enter school until the age of twenty-one (21). Homebound Instruction Becoming a pregnant or parenting student does not, in itself, necessitate that a student receive homebound instruction. A student requesting homebound instruction must submit to the resource/contact person a written certification from a licensed physician that homebound instruction is required for the student, based on the specific reasons stated. The required certification will be forwarded to the principal, who will determine if the district will provide homebound instruction. Excuses From Attending School The principal may temporarily excuse attendance by a pregnant or parenting student for mental, physical or other urgent reasons, for a period not to exceed three (3) months. A student requesting a temporary excuse from attendance must submit to the resource/contact person written satisfactory evidence to support the absence. The request and supporting evidence will be forwarded to the principal, who will determine if the absence will be approved. Exceptions To Compulsory Attendance Requirements Although pregnancy and parenting are not specifically stated as conditions for excusal from school, the Board may excuse attendance if a student submits written evidence that attendance would be harmful to the physical or mental health of the pregnant or parenting student. Also, “urgent reasons” can be construed to allow the Board to permit an excuse from attendance when a student submits written evidence of extenuating circumstances that require the pregnant or parenting student to not attend school. Any excuse from attending school for longer than temporary periods will not be final until the Board obtains the approval of the Secretary of Education. The district will maintain and submit to the Secretary of Education documentation regarding the reason(s) for an excuse from attendance and will request approval in all cases where nonattendance is being sought for longer than a temporary period. The district will not allow the use of a domestic work permit by a pregnant or parenting student as a reason to be exempt from compulsory school attendance. THE FOLLOWING IS OPTIONAL, BASED ON THE DISTRICT’S AVAILABLE PROGRAMS. The district may offer separate, modified educational programs or special courses in order to maintain appropriate educational opportunities for pregnant and parenting students. Such programs and courses will be comparable to the established curriculum, and attendance by students will be voluntary.

    Purpose The Board finds that student conduct is closely related to learning. An effective educational program requires a safe and orderly school environment. Authority The Board shall establish fair, reasonable and nondiscriminatory rules and regulations regarding the conduct of all students in the Upper Perkiomen School District during the time they are under the supervision of the school or at any time while on school property, while present at school-sponsored activities, and while traveling to or from school and school-sponsored activities.[1][2][3][4][5] The Board shall adopt a Discipline Code to govern student discipline, and students shall not be subject to disciplinary action because of race, sex, color, religion, sexual orientation, national origin or handicap/disability. Each student must adhere to Board policies and the Discipline Code governing student discipline.[2][3][4][5][6][7] The Board prohibits the use of corporal punishment by District staff to discipline students for violations of Board policies and District rules and regulations.[8] Any student disciplined by a District employee shall have the right to notice of the infraction.[9] Suspensions and expulsions shall be carried out in accordance with Board policy.[9] In the case of a student with a disability, including a student for whom an evaluation is pending, the District shall take all steps required to comply with state and federal laws and regulations, the procedures set forth in the memorandum of understanding with local law enforcement and Board policies.[5][10][11][12][13][14] Off-Campus Activities This policy shall also apply to student conduct that occurs off school property and would otherwise violate the Discipline Code if any of the following circumstances exist:

    1. The conduct occurs during the time the student is traveling to and from school or traveling to and fromschool-sponsored activities, whether or not via School District furnished transportation.

    2. The student is a member of an extracurricular activity and has been notified that particular off-campus conductcould result in exclusion from such activities.[15][16]

    3. Student expression or conduct materially and substantially disrupts the operations of the school, or theadministration reasonably anticipates that the expression or conduct is likely to materially and substantially disruptthe operations of the school.

    4. The conduct has a direct nexus to attendance at school or a school-sponsored activity, for example, a transactionconducted outside of school pursuant to an agreement made in school, that would violate the Discipline Code ifconducted in school.

    5. The conduct involves the theft or vandalism of school property.6. There is otherwise a nexus between the proximity or timing of the conduct in relation to the student's attendance at

    school or school-sponsored activities.

  • Delegation of Responsibility The Superintendent or designee shall ensure that reasonable and necessary rules and regulations are developed to implement Board policy governing student conduct. The Superintendent or designee shall publish and distribute to all staff, students and parents/guardians the rules and regulations for student behavior contained in the Discipline Code, the sanctions that may be imposed for violations of those rules, and a listing of students’ rights and responsibilities. A copy of the Discipline Code shall be available in each school library and school office and may be printed in the student handbooks.[2][7] The building principal shall have the authority to assign discipline to students, subject to the policies, rules and regulations of the District and to the student's due process right to notice, hearing, and appeal.[17][18] Teaching staff and other District employees responsible for students shall have the authority to take reasonable actions necessary to control the conduct of students in all situations and in all places where students are within the jurisdiction of this Board, and when such conduct interferes with the educational program of the schools or threatens the health and safety of others.[17] Reasonable force may be used by teachers and school authorities under any of the following circumstances: to quell a disturbance, obtain possession of weapons or other dangerous objects, for the purpose of self-defense, and for the protection of persons or property.[8] Referral to Law Enforcement and Reporting Requirements For reporting purposes, the term incident shall mean an instance involving an act of violence; the possession of a weapon; the possession, use, or sale of a controlled substance or drug paraphernalia as defined in the Pennsylvania Controlled Substance, Drug, Device and Cosmetic Act; the possession, use, or sale of alcohol or tobacco; or conduct that constitutes an offense listed under the Safe Schools Act.[19][20][21] The Superintendent or designee shall immediately report required incidents and may report discretionary incidents committed by students on school property, at any school-sponsored activity or on a conveyance providing transportation to or from a school or school-sponsored activity to the local police department that has jurisdiction over the school’s property, in accordance with state law and regulations, the procedures set forth in the memorandum of understanding with local law enforcement and Board policies.[14][19][20][22][23][24] The Superintendent or designee shall notify the parent/guardian of any student directly involved in an incident as a victim or suspect immediately, as soon as practicable. The Superintendent or designee shall inform the parent/guardian whether or not the local police department that has jurisdiction over the school property has been or may be notified of the incident. The Superintendent or designee shall document attempts made to reach the parent/guardian.[14][20][25] In accordance with state law, the Superintendent shall annually, by July 31, report all new incidents to the Office for Safe Schools on the required form.[14][19][26][27][28][29] The Superintendent shall report to the Board the methods of discipline imposed by administrators and incidences of student misconduct, in the degree of specificity required by the Board.

    Title Weapons

    Status Second Reading Purpose The Board recognizes the importance of a safe school environment relative to the educational process. Possession of weapons in the school setting is a threat to the safety of students and staff and is prohibited by law. Definitions Weapon - the term shall include but not be limited to any knife, cutting instrument, cutting tool, nunchaku, firearm, shotgun, rifle, replica of a weapon, and any other tool, instrument or implement capable of inflicting serious bodily injury.[1][2] Possession - a student is in possession of a weapon when the weapon is found on the person of the student; in the student's locker; and/or under the student's control while on school property, on property being used by the school, at any school function or activity, at any school event held away from the school, or while the student is coming to or from school. Authority The Board prohibits students from possessing and bringing weapons and replicas of weapons into any Upper Perkiomen School District buildings, onto school property, to any school-sponsored activity, and onto any public vehicle providing transportation to school or a school-sponsored activity or while the student is coming to or from school.[2][3] The Board shall expel for a period of not less than one (1) year any student who violates this weapons policy. Such expulsion shall be given in conformance with formal due process proceedings required by law and Board policy. The Superintendent may recommend modifications of such expulsion requirement on a case-by-case basis.[2][4] In the case of a student with a disability, including a student for whom an evaluation is pending, the District shall take all steps required to comply with state and federal laws and regulations, the procedures set forth in the memorandum of understanding with local law enforcement and Board policies.[2][5][6][7][8][9][10] Delegation of Responsibility The Superintendent or designee shall react promptly to information and knowledge concerning possession of a weapon.   • The Superintendent or designee shall notify the parent/guardian of any student directly involved in an incident involving weapons as a victim or suspect immediately, as soon as practicable. The Superintendent or designee shall inform the parent/guardian whether or not the local police department that has jurisdiction over the school property has been or may be notified of the incident. The Superintendent or designee shall document attempts made to reach the parent/guardian.[10][14][16] In accordance with state law, the Superintendent shall annually, by July 31, report all incidents involving possession of a weapon to the Office for Safe Schools on the required form.[10][13] The building principal shall annually inform staff, students and parents/guardians about the Board policy prohibiting weapons and about their personal responsibility for the health, safety and welfare of the school community. An exception to this policy may be made by the Superintendent, who may prescribe special conditions or administrative regulations to be followed.[2] In accordance with federal law, possession or discharge of a firearm in, on, or within 1,000 feet of school grounds is prohibited. Violations shall be reported to the appropriate law enforcement agency.[17][18] Transfer Students When the Upper Perkiomen School District receives a student who transfers from a public or private school during an expulsion period for an offense involving a weapon, the District may assign that student to an alternative assignment or may provide alternative education, provided the assignment does not exceed the expulsion period.[2]

    Second Reading Purpose The Board recognizes the danger that terroristic threats by students present to the safety and welfare of District students, staff and community. The Board acknowledges the need for an immediate and effective response to a situation involving such a threat. Definitions Communicate - shall mean to convey in person or by written or electronic means, including telephone, electronic mail, Internet, facsimile, telex and similar transmissions.[1] Terroristic threat - shall mean a threat communicated either directly or indirectly to commit any crime of violence with the intent to terrorize another; to cause evacuation of a building, place of assembly or facility of public transportation; or to otherwise cause serious public inconvenience, or cause terror or serious public inconvenience with reckless disregard of the risk of causing such terror or inconvenience.[1] Authority The Board prohibits any District student from communicating terroristic threats directed at any student, employee, Board member, community member or property owned, leased or being used by the District. In the case of a student with a disability, including a student for whom an evaluation is pending, the District shall take all steps required to comply with state and federal laws and regulations, the procedures set forth in the memorandum of understanding with local law enforcement and Board policies.[2][3][4][5][6][7] If a student is expelled for making terroristic threats, the Board may require, prior to readmission, that the student provide competent and credible evidence that the student does not pose a risk of harm to others.     Second Reading Purpose The Board recognizes that students have the right to request redress of complaints. In addition, the Board believes that the inculcation of respect for established processes is an important part of the educational process. Accordingly, individual and group complaints shall be recognized, and appropriate appeal procedures shall be provided. Definition For purposes of this policy, a student complaint shall be one that arises from actions that directly affect the student's participation in an approved educational program. Guidelines The student should first make the complaint known to the staff member most closely involved or, if none is identifiable, his/her guidance counselor; and both shall attempt to resolve the issue informally and directly. For complaints which must move beyond the first step, the student shall prepare a written statement of his/her complaint which shall set forth the specific nature of the complaint and a brief statement of the facts giving rise to it, the manner and extent to which the student believes s/he has been adversely affected, and the relief sought by the student. The complaint may then be submitted, in turn, to the building principal, and then the Superintendent within a suitable period of time allowed at each level for hearing of the complaint and preparation of a response. At each level the student shall be afforded the opportunity to be heard personally by the school authority. The student may seek the help of a parent or guardian at any step. Authority The Board and its employees shall recognize the complaints of students, provided that such complaints are submitted according to the established protocols developed by the Superintendent or designee.     Purpose

    The Board recognizes that tobacco, nicotine delivery products (including but not limited to vape pens, vape mods, vape pods, electronic cigarettes, etc.) present a health and safety hazard that can have serious consequences for both users and nonusers and the safety and environment of the schools.

    Definitions

    For purposes of this policy, tobacco includes a lighted or unlighted cigarette, cigar, cigarillo, little cigar, pipe or other nicotine delivery products (including but not limited to vape pens, vape mods, vape pods, electronic cigarettes, etc.) or material and smokeless tobacco in any form including chewing tobacco, snuff, dip or dissolvable tobacco pieces.[1]

    For purposes of this policy, nicotine shall mean a product that contains or consists of nicotine in a form that can be ingested by chewing, smoking, inhaling or through other means.

    For purposes of this policy, a nicotine delivery product shall mean a product or device used, intended for use or designed for the purpose of ingesting nicotine or another substance. This definition includes, but is not limited to, any device or associated product used for what is commonly referred to as vaping or juuling.

    Authority

    The Board prohibits possession, use or sale of tobacco, nicotine and nicotine delivery products by students at any time in a school building and on any property, buses, vans and vehicles that are owned, leased or controlled by the District.[1][2][3]

    The Board also prohibits possession, use or sale of tobacco, nicotine and nicotine delivery products by students at school-sponsored activities that are held off school property.

    In the case of a student with a disability, including a student for whom an evaluation is pending, the District shall take all steps required to comply with state and federal laws and regulations, the procedures set forth in the memorandum of understanding with local law enforcement and Board policies.[4][5][6][7][8][9]

    Delegation of Responsibility

    The Superintendent or designee may develop administrative regulations to implement this policy.

    Additional Provisions - Tobacco Only

    The Superintendent or designee may report incidents of possession, use or sale of tobacco by students on school property, at any school-sponsored activity or on a conveyance providing transportation to or from a school or school-sponsored activity to the school police, school resource officer (SRO) or to the local police department that has jurisdiction over the school’s property, in accordance with state law and regulations, the procedures set forth in the memorandum of understanding with local law enforcement and Board policies.[9][10][12][13][14]

    A student convicted of possessing or using tobacco in violation of this policy may be fined up to fifty dollars ($50) plus court costs, or admitted by the court to alternative adjudication in lieu of imposition of a fine.[15]

    Use of Bicycles and Motor Vehicles

    Purpose The Board regards the use of bicycles and motor vehicles for travel to and from school by students as an assumption of responsibility by parents/guardians and students. Authority The Board shall permit the use of bicycles by students in accordance with any and all applicable district regulations, provided that students have been granted permission by the building principal and have obtained parental permission to ride a bicycle to school.[1] The Board shall permit the use of motor vehicles by secondary students in accordance with District any and all applicable district regulations, provided that such students have followed established procedures and obtained the required permit and have been granted permission by the building principal to drive a motor vehicle on school grounds.[1] The Board prohibits the use of skateboards, rollerblades, rollerskates, ATVs, snowmobiles, and other unregistered or unlicensed motor vehicles on school property. The Board shall not be responsible for bicycles or motor vehicles that are lost, stolen, or damaged, or for injuries arising from their use. Delegation of Responsibility The building principal or designee shall disseminate information regarding operating and parking of authorized bicycles and motor vehicles to affected students. The building principal or designee shall establish standards for granting permission and permits, which contain the warning that infraction of rules may result in revocation of the permit.     Care of School Property

    Purpose

    The Board believes that the schools should help students learn to respect property and develop feelings of pride in community institutions.

    Authority

    The Board charges each student in the District's schools with responsibility for the proper care of the school property, school supplies and equipment entrusted to the student's use.

    It is the policy of the Board that students who willfully cause damage to school property shall be subject to disciplinary measures. Students and others who damage or deface school property may be prosecuted and punished under law. Parents/Guardians shall be held accountable for the actions of their child.[1][2][3]

    The Board may report to appropriate juvenile authorities any student whose damage of school property is serious or chronic in nature. In no case shall referral to juvenile authorities be made without prior notification to the student's parent/guardian.[4]

    Delegation of Responsibility

    The Superintendent or designee may develop administrative regulations to implement this policy.[5][6]

    The Superintendent shall submit a report on incidents of vandalism to the Board on each occurrence.

    Vandalism reports shall include the number and kind of incident, cost to the District, and related information the Superintendent deems necessary.

    Purpose

    While there is no intent to refuse to cooperate with agencies sponsoring worthwhile contests, the Board's objective is to keep such cooperation within reasonable bounds.

    Delegation of Responsibility

    Participation in contests is optional with the individual school, upon approval by the Superintendent or designee.

    Guidelines

    Contests or projects shall not interfere with the operation of the regular course of study in classes, or require a teacher to sacrifice much time from the regularly planned program for students.

    The following considerations shall serve as guidelines for determining participation in contests: [1]

    1. The primary educational goals of the school and the needs and interests of students must be aconsideration at all times.

    2. Schools shall not be used to promote private or commercial interests.

    3. Schools shall not be used for direct sales promotion of individual competitive goods or services.

    4. All materials or activities initiated by private sources shall be judged on grounds of their directcontribution to educational values, factual accuracy, and good taste.

    5. Consideration shall be given in all cases to protecting students and teachers against unreasonableadded work and responsibilities.

    6. Participation by students shall be voluntary.

    Authority

    It is the policy of the Board that any student who is capable of and requests to do college-level work while in high school shall be permitted to do so and shall be given assistance in enrolling in advanced courses.

    Guidelines

    Any student whose admission to a college-level course is recommended by the building principal and approved by the Superintendent or designee may enroll in a course at any accredited college for college credits.

    If the student wishes to receive high school credit for the course, s/he may request permission from the building principal, through the counselor, to apply the course toward high school graduation requirements.

    All expenses for advanced college placement courses will be the responsibility of the parent or guardian.

    Authority

    In accordance with law, the Board shall permit disclosure of required student information about secondary students to representatives of postsecondary institutions and to representatives of the Armed Forces of the United States.[1][2][3]

    Equitable access to secondary students shall be granted to postsecondary education representatives, military recruiters and prospective employers.

    Guidelines

    Postsecondary institutions and military recruiters shall have access to secondary students’ names, addresses and telephone numbers, unless the student or parent/guardian requests that such information not be released without prior written parental consent.[2][3]

    The District shall notify parents/guardians of the right of the secondary student or parent/guardian to request that student information not be released to representatives of postsecondary institutions and/or military recruiters without prior written parental consent.[2][3][4]

    The District shall provide a list of graduating seniors, which shall be available to military recruiters by the first day of the academic year of graduation.[4]

    Military Personnel

    Military recruiters and all other members of the active and retired Armed Forces, including the National Guard and Reserves, shall be permitted to wear their official military uniforms while on District property.[5]

    Delegation of Responsibility

    The building principal shall determine under what conditions and when access to secondary students will be provided to representatives of postsecondary institutions, military recruiters and prospective employers.

    The building principal reserves the right to deny access to students when such access will materially and substantially interfere with the proper and orderly operation and discipline of the school; is likely to cause violence or disorder; or will constitute a violation of the rights of other students.
