UPPER CANADA SUNDRIES: Correspondence of the Civil and Provincial, 1766-1841

Volumes 1-261 18.6m Finding Aid 881

Correspondence, petitions, reports, returns and schedules, certificates, accounts, warrants, legal opinions,instructions and regulations, proclamations and other documents received by the Civil Secretary and bythe Provincial Secretary and Registrar of Upper Canada, 1791-1841, together with copies of somedocuments of 1766-1809 made for reference purposes, form a very miscellaneous series known as the"Upper Canada Sundries". This arises in part from the vaguely defined boundaries of the two offices inthe earliest years, and in part from plurality of office holding, whereby one man held two (or more)offices and filed all the records in a single sequence. Both secretaryships were at times filled by one man. Both the Civil and the Provincial Secretary held other minor offices. The records reflect their many andvaried responsibilities.

Drafts of replies to the incoming correspondence and some drafts of speeches prepared by the CivilSecretary are found in RG 5, A 2. Some additional incoming petitions and addresses, as well as Speechesand Messages for the Legislature, are found in RG 5, B 3. Further correspondence and other records ofthe Civil Secretary are found in RG 7, notably series G 14 (volumes 2-7) and G 16 B. For the period after1841, the principal series of incoming correspondence for the Civil Secretary is found in RG 7, G 20 andof the Provincial Secretary in RG 5, C 1. Several volumes of pre-1841 correspondence are found in RG5, C 1 and letterbooks of outgoing correspondence in RG 5, C 2. Some records of the ProvincialSecretary's functions as Registrar are found in the B series of RG 5 while others were inherited by hissuccessors and are found in RG 68 (records of the Registrar General of Canada).

Information on the organization and functioning of the two offices — civil (or private) Secretary to theLieutenant Governor and of Provincial Secretary and Registrar — prior to the union of Upper and LowerCanada can be found in the Report by John Macaulay, 1839, published in the Journal of the LegislativeAssembly for Upper Canada, 1839, Appendix, volume 2 part 1, pages 310-321.

Arrangement of the documents within the Sundries is chronological, except that enclosures are filed underthe date of their covering letter. Undated material is filed at the end of the appropriate month or year.

Finding Aid 881 is a calendar of the complete series, providing a description of each item. The calendarwas compiled over a long period and reflects several changes in descriptive standards. In general, thenature of the item, its author and recipient, the contents and the date are specified, as well as its extent inpages. A copy of the Shelf List (which follows this inventory entry) is included in the Finding Aid topermit rapid identification of the microfilm reels on which the documents appear.

This series has never been systematically indexed, although index cards for petitions and correspondencerelating to land grants, sales and leases were prepared prior to the final arrangement of the series. Itshould be noted, however, that these cards describe only a small fraction of the collection, and notnecessarily all of the documents relating to land matters; that the entries were made for the names ofpetitioners or correspondents, and only rarely for the name of a township under survey or othergeographical headings; and that the description is general to the point of vagueness. Between 1979 and1987, efforts were made to identify the modern page references for those index entries. Entries for whicha location in RG 5, A 1 could not be identified were removed from the index in 1987.

Access to the original documents has been restricted for conservation purposes. The complete series hasbeen microfilmed.

RESEARCHERS MUST USE THE MICROFILM.Absolutely no photocopying from the originals is permitted. For illustration or exhibition purposes,photographic copies from the originals can be provided, at the standard charge for such reproductions. Reader-printer copies from the microfilm can be provided at a nominal charge. When the series isconsulted through interlibrary loan, the borrowing library may make copies of selected items for referenceuse without specific authorization from the Public Archives of Canada. Copies can be certified wheresuch is necessary for legal purposes. Requests for certified copies, for photographic copies or forextensive portions of a volume should be referred to the Public Archives of Canada.

Citations should follow the style illustrated below. Requests for photocopies should follow the shortformat, but include the microfilm reel number.

The series is a composite of several sub-series:

- petitions for pensions, pardons, appointments and other benefits (largely undated), ca.

1792-1841;

- registers of petitions received, 1830-1841;

- addresses of Loyalty to Sir Charles Poulett Thom, 1839-1840, and replies to the circular

on Union of Upper and Lower Canada, 1839-1840;

- and Speeches and Messages to the Legislature with Addresses from it, 1799-1840.

The arrangement and origin of the series is now obscure.

Finding Aid 842 provides a descriptive list of the documents within the various sub-series and

explanatory notes on their arrangement, as well as notes on the material removed from volumes

13-18 and reintegrated with RG 5, C 1 in December 1981 (i.e, addresses in response to the

Rebellion Losses Bill and the Montreal riots, 1849, and the petitions relating to prohibitory liquor

laws, 1856).

Finding Aid 842 completed in 1981; some reboxing carried out in 1974; volumes 13-18 (pages2023-2598) integrated into RG 5, C 1, December 1981.

No further work required at present; indexing would be beneficial.

COMMISSIONS and LETTERS PATENT, Upper Canada and Canada West, 1788-1858

Volumes 1-6 18 cm Finding Aid 1508

Commissions appointing public officials and letters patent recognizing inventions for the provinces of

Upper Canada and Canada West, 1788-1858, were formed into a series at some point in the past. These

documents would have been accumulated by the Provincial Secretary through his responsibility for

engrossing such public instruments and affixing the Great Seal to them, or in his capacity as Provincial

Registrar for recording their issuance. The reasons for these commissions not having been delivered to

the nominees have not been investigated.

Equivalent series for Lower Canada and Canada East are to be found in RG 4, B 9 and B 10, where some

stray items for Upper Canada were identified but their transfer was not considered feasible when the

series were reviewed in 1984. Registers and entrybooks of letters patent, commissions and instruments of

revocation are to be found in RG 68, together with extensive indexes for those records. For commissions

to administer oaths to Members of the House of Assembly, see also RG 1, E 11. For letters patent

relating to land grants, see also RG 5, B 18.

The commissions and letters patent were reviewed in 1984 and consideration was given to the transfer of

material identified as out of place. Where the documents had not been paginated within a series, transfers

were made to the proper series.

Finding Aid 1508 was prepared in 1984-1985 to supplement the shelf list as a description of the records.

The blank items in volume 3 were omitted from this detailed description, as was volume 4 — considered

to describe itself. The description in Finding Aid 1508 is alphabetic by type of commission, within each

volume.

UPPER CANADA: Statistical Returns from public officers, n.d., 1809-1840

Volumes 1-5 45 cm

Reports on the tenure, duties and emoluments of various public officials were compiled by the Civil

Secretary or the Provincial Secretary at various points between 1809 and 1840 in response to requests

from the Colonial Office. The information was used to prepare the Blue Books of Statistics (see RG 1,

E 13) on an annual basis from 1821 onward.

A general inquiry into the state of the public offices was made in 1809. Part of the report

for Upper Canada is to be found in RG 1, E 3, vol. 58A pages 112-149 and vol. 100,

pages 193-194, as well as in volume 1 of this series. Comparable data for Lower Canada

is found in RG 4, B 33, vol. 23.

Applications and recommendations for appointments to public offices and for relief (i.e. for pensions),

lists of applicants and of incumbents, and applications for examinations for the civil service formed a

series covering Upper Canada and Canada West, 1803-1876, including some overlap beyond

Confederation.

The lists of applicants and incumbents are arranged alphabetically by candidate's name or by district.

Volumes 15-21 were identified as overlapping the examination records in RG 4, B 33 and were

transferred to that series in 1986 to eliminate confusion arising from the overlaps between these two

series, as well as RG 5, B 8.

There is no finding aid for the series, beyond the Shelf List which follows this inventory entry. Some

volumes contain indexes, while the alphabetic arrangement of others facilitates access.

Conservation treatment is to be scheduled for the bound volumes of correspondence, to reduce the risk of

damage arising from that binding.

CANADA WEST: Civil Service Examinations

Letters of application, reports of references, certificates and results of civil service examinations for

1866-1867 were formed into a series. When the corresponding series in RG 4, B 33 was reviewed in

1986, these records were examined and consolidated with that series. The records in RG 4, B 33 were

found to cover earlier years for Canada West, while this series was found to contain some records of

Canada East. The transfer permitted consolidation and rationalization.

UPPER CANADA and CANADA WEST: Bonds, certificates and applications for licences,1801-1867

Volumes 1-78 6 m (indexes)

Correspondence relating to the issuance of licences and the fees paid, accounts and returns of licencesissued, bonds and certificates submitted by persons applying for licences and certain relateddocumentation, 1801-1867, form this composite series. Registers of certain bonds posted and licencesissued are to be found in RG 68 (for bailiffs, surveyors, and virtually all public officials after 1841). Itshould be noted that the records in this series are almost exclusively related to the application for licences;the licence itself would have been delivered to the person whose activities it served to authorize. Itshould also be noted that marriage licences were not required for those persons whose banns werepublished in their local churches.

The Collector of Customs was charged with the issuance of certain types of licences — notably those forauctioneers, pedlars and hawkers. He reported to the Civil Secretary periodically on the number oflicences issued and the fees collected. The returns he submitted rarely give the names of the personslicensed.

The records are arranged in several sub-series, by type of document submitted or licence applied for, andwithin each sub-series either alphabetically by name of applicant or numerically by the number assignedto the licence, certificate or bond in the office of the Provincial Secretary and Registrar.

The Shelf List which follows this Inventory entry provides an over-view of the sub-series. There is nosingle finding aid for the whole series. Several indexes have been produced for certain sub-series. Twoare available only in the Reference Room:

The report by Thomas Botham, the Commissioner appointed to inquire into the financial affairs of thecity of Brantford, 1865, included a schedule of evidence taken during the investigation. Of note is thetestimony of Thomas Broughten, Receiver and Manager of the Grand River Navigation Company. Aduplicate copy of the documents included a letter concerning the tabling of the report in the LegislativeAssembly of Canada. The report was identified as a file astray from the Provincial Secretary's NumberedCorrespondence series (RG 5, C 1) and has been reintegrated to permit access to it from the indexes andregisters for the main PSO series.

UPPER CANADA and CANADA WEST: Clerk of the Crown in Chancery, election records,1808-1866

The election records accumulated by the Clerk of the Crown in Chancery (ancestor to the Chief Electoral

Officer) for Upper Canada and Canada West have long been identified as a series within RG 5, although

they may seem more appropriate to RG 14. The Clerk of the Crown in Chancery is identified in lists of

the Civil Establishment as an official of Parliament. During the reorganization of this series, undertaken

in 1983 and 1986, consideration was given to transferring these files to RG 14 (Records of Parliament),

but the decision to keep them in their present place was based on practicalities and the extent to which the

records had been referred to under the present call number.

The election records consist of Writs and Returns plus a variety of supporting documents: the

Qualification of a candidate, the Oaths of the Returning Officer and Poll Clerks, Recapitulations of votes,

broadside Proclamations of the polls, Commissions to Returning Officers, etc. The records cover both

general elections and by-elections, 1844-1866, for both the House of Assembly and the Legislative

Council (the latter being elective after 1856). Relatively little pre-1841 material survives, chiefly some

correspondence, receipts and lists. There is one poll book in the series (volume 18).

The arrangement of the records is in two rough sequences: the order of pages 1-2080 is predominantly

chronological, while the order for pages 2101-3717 is first by House, then by date. The pagination was

begun about 1971 and completed in 1986 (when a gap was left, omitting page numbers 2081-2100).

During the reorganization of the series, several items relating to Lower Canada (chiefly from the old

volume 1) were transferred to RG 4, B 72 and several post-1867 items were transferred to RG 6. This left

gaps in the page number sequence, as noted in Finding Aid 1460.

Finding Aid 1460 has been prepared to overcome the problems arising from the unsatisfactory

arrangement of the first half of this series and to provide a checklist of the Writs and Returns which

survive. The order of description is chronological within the basic sub-divisions of House of Assembly

and Legislative Council, with the ridings listed in alphabetic order for each general election and in

chronological order for by-elections. The finding aid identifies the page numbers for the surviving

records but does not specify their nature.

Access to this series is restricted, pending the scheduling of conservation treatment. Many of the

documents are fragile, with severe mold damage, or on parchment which is awkward to unfold. Requests

for consultation of this series must therefore be channelled through the Section Chief of

Pre-Confederation Archives.

The broadsides scattered throughout this series have been catalogued by the Canadian Institute for

Historical Microreproduction under a programme begun in 1982 to identify printed material and to

prepare microfiche copies of all items determined to be unique. When the CIHM microfiche become

available, researchers will be asked to use them rather than to consult the oversize, fragile broadsides and

thus to minimize the risks to their preservation arising from handling.

returns formed the basis of the statistical reports in the Blue Books (for which, see RG 1, E 13). Further

statistical data on population and assessment may be found printed in the Journals of the House of

Assembly. There may be some returns in the Upper Canada Sundries (RG 5, A 1). The returns were

submitted to the Civil Secretary pursuant to the "Census" Act of 1823 and subsequent provincial

legislation.

In preparation for microfilming, the series was reviewed, volume 7 unbound sand many fragile items

repaired. The series is being withdrawn from circulation as a conservation measure.

UPPER CANADA: Commission of Inquiry into the State of the Public Departments; 1839-1840

Volumes 1-18 55 cm

A Commission of Inquiry was established in response to an Address from the House of Assembly to the

Lieutenant Governor of Upper Canada in 1839. The twenty Commissioners worked in eight committees

to examine the conduct of business in the government departments. Minutes, reports, correspondence,

memoranda and other records of the commissioners form this series.

The results of the Inquiry were published as part of the Sessional Papers of 1839-1840 (Appendix,

volume 2), under the title Report on the Public Departments of the Province .... (Toronto: W. J.

Coates, 1840). The reports on the Executive Council and on the Indian Department were published as a

separate document. The text of the Supplementary Report of Committee 3, commenting on the

observations in Lord Durham's Report regarding the composition and responsibility of the Executive

Council is found in MG 9, D 3, volume 5.

The arrangement of the records is by committee, then according to the numbering system exhibited by the

records themselves. The Shelf List which follows this inventory entry provides an over-view of that

arrangement and serves as the sole finding aid for the series.

UPPER CANADA and CANADA WEST: Civil Secretary, records relating to theaudit and payment of public accounts, 1792-1865

Volumes 1-42 2.15 m

A committee of the Executive Council held responsibility for auditing the public accounts for the CivilEstablishment of Upper Canada. The preparation and presentation of accounts for audit was co-ordinatedby the Clerk of the Executive Council and the Civil Secretary to the Lieutenant Governor. The CivilSecretary also managed the issuance of warrants for payments, directed preparation of estimates andassembled periodic reports on civil expenditures. A wide range of correspondence was generated by thetransmission of statements and vouchers, requests for amendments or replacement of supportingdocuments, and compilation of estimates and reports. The principal correspondents were the ReceiverGeneral and the Inspector General of the Provincial Public Accounts, plus the Treasury and the AuditOffice in London.

The duties performed and records kept by the officers of the Civil Establishment are detailed in theReport on the Public Departments of the Province ... (Toronto: W. J. Coates, 1840) and the Reports onthe Executive Council and Indian Department (Toronto: Robert Stanton, 1840). The audited publicaccounts for the Civil Establishment included statements from military agencies which provided goods orservices to the civil government. Accounts for the Indian Department were not usually included with thecivil expenditures. The dividing line between civil and military expenditures and the use of MilitaryChest funds for civil expenses were often obscured by circumstances, notably during the War of 1812 andthe Rebellions of 1837-1838.

The submissions to the Board of Audit (RG 1, E 15 B) were reviewed in 1984-1987 and their originalorder was reconstructed. Concurrently, records in RG 5, B 34 were reviewed and documents identifiableas having been audited were reintegrated with the submissions. [A record of the transfers has been kept.] Review of both series was completed in 1993-1994. The records remaining in RG 5, B 34 werereorganized into three subseries. The correspondence (volumes 1-11) remains in chronological order. Documents attached to covering letters were left in place. Loose reports, statements, vouchers and otherdocuments (volumes 12-27) were arranged by "responsibility centre" (the office charged with the functionthey document). Administrative records generated by the various offices involved in the land grantingsystem were treated as created by a single agency. The minute books, registers and account books(volumes 28-42) were grouped by the function they record, then by date.

Relationships with records elsewhere (notably RG 1, series E 1, E 15 B, L 6 and L 7, and RG 5, seriesA 1, B 2, B 13, B 22 and B 24) were investigated but bound volumes identified as misfiled were notimmediately transferred. Appropriate cross-references are being provided in the inventory entries andfinding aids. Relationships with entrybooks of warrants for payment and other records in RG 19 remainto be determined.

These records were received in 1906 from the Secretary of State's office and designated as part ofthe S Series until the creation of RGs 1, 4 and 5 in 1950. The rationale for the peculiar divisionof minute books, account books and registers amongst series in RGs 1, 5 and 19 was notrecorded.

The bound volumes and oversize documents in this series will not be photocopied where suchtreatment poses a risk of damage.

The shelf list following this inventory entry provides an over-view of the content andarrangement of the records, at the volume level for correspondence, minute books and registers,and at the file level for other documents. The types of records and the activity they document arespecified where volume titles are not self-explanatory. There is no detailed finding aid for thisseries, but Finding Aid 1944 provides some explanation of specific relationships to RG 1, E 15 B.

The various records forming this series illustrate the Civil Secretary's role in the audit process and otherfinancial responsibilities; the manner in which submissions were prepared for audit and the roles ofspecific officials. The series structure is artificial and the contents are fragmentary.

Correspondence exchanged by the Civil Secretary with the Receiver General, Inspector Generaland other officials (volumes 1-11) illustrates the complexities of financial systems for preparingestimates, authorizing payments and auditing statements of expenditures or revenues.

The loose documents (volumes 12-27) are best understood in relation to the audited submissions(RG 1, E 15 B to 1841 and E 15 C after 1841). The draft and duplicate statements and vouchersfor expenditures of the governor's office and the maintenance or repair of Government House,when compared to audited submissions, serve to illustrate the preparation of accounts forverification. Evidence for the original order and the relationship between vouchers andstatements is so limited that most documents in this sub-series cannot readily be identified asdrafts, duplicates or parts of submissions for audit. Many post-1840 items are endorsed as havingbeen submitted too late for audit before the union of Upper and Lower Canada. Some documentsare unique in style, clearly prepared for special financial purposes.

The bound volumes (28-42) exhibit stronger relationships to other series. The entrybooks ofMinutes and Observations cannot be understood in isolation from related records in RG 1, E 15 Bnor the Receiver General's account books in isolation from related records in RG 19. Severalvolumes of sheriff’s accounts exhibit no immediate connection to the audit process.

NOTE: the complete series was reviewed by the contractors working on RG 1, E 15 B andmaterial was reintegrated there where deemed appropriate. The shelf list was revised in 1986 toreflect the elimination of certain volumes. A further review was carried out in 1993-1994 whenthe finding aid for RG 1, E 15 B was being edited, and some further reintegration with that serieswas carried out. Material deemed not to be part of the audited public accounts was transferredto RG 5, B 34 and reintegrated there. The principles for that work were:-- to set the correspondence in chronological order; vouchers, statements and other

financial documents attached to letters were left in place.-- to group the financial statements, vouchers and related documents by "responsibility

centre": the office(r) in charge of an activity or function, then arrange the documents bydate.

-- to describe the documents in general terms: identifying the activity recorded, the types ofdocuments, the relationships to other series — but not specifying the number of items in afile (as was done for the audited public accounts).

The inconsistent numbering of bound volumes at the end of RG 5, B 34 is to be altered.

The Financial and Departmental Commission was appointed by Letters Patent of 26 November 1862,

nominating Thomas Storrow Brown, William Bristow and George Sheppard to scrutinize the system of

keeping, checking and auditing the public accounts for the Province of Canada. The evidence books for

December 1862-November 1863 form this series.

The evidence books were published as Sessional Paper 11 for 1863. They were included in the First

Report of the Financial and Departmental Commission, May 1863 (Quebec: Josiah Blackburn, 1863) and

the Second Report of the Financial and Departmental Commission, February 1864 (Quebec: Josiah

Blackburn, 1864). The French text of the reports was printed as Premier rapport de la Commission

Financière et Départementale, mai 1863 (Québec: N.Aubin, 1863) and Second rapport de la Commission

Financière et Départementale, février 1864 (Québec; N. Aubin, 1864). Both are available in the Archives

Library (call numbers HJ 799, A 4 and HJ 799, A 4,1863-1864, respectively).

The state of the volumes is such that (pending conservation treatment), researchers arerequested to consult the published texts.

Volume 1 contains the documents and testimony submitted to the Commissioners, December 1862 -August 1863.

Volume 2 contains the documents and testimony submitted to the Commissioners, September-November1863.

Given the availability of the published text (which include both tables of contents and partial indexes), nodetailed shelf list or finding aid is contemplated for this series.

Minute book of the court proceedings in the treason hearings for the London District held by John B.

Askin, Thomas Radcliffe, Lawrence Lawrason, William Robertson and Thomas Ball, December 1837 -

March 1838 (vol. 1) and records relating to the trials, schedules of prisoners and documents seized from

the prisoners (vol. 2).

The minute book is indexed and annotated with the case file reference for each prisoner (cases A 1 to

A 50, B 1 to B 50 and C 1 to C 45). The supporting evidence, affidavits, petitions, recognizances and

other documentation has been restored to the original order where possible. It must be noted that there

are names on the schedules of prisoners which are not documented in the case files, and there are

documents for prisoners whose names are not on the schedules.

Related documentation is to be found in the State Minute Books of the Executive Council (RG 1, E 1) and

the Submissions to Council (RG 1, E 3), the Upper Canada Sundries (RG 5, A 1) and Colonial Office 42,

amongst other series.

The names of persons accused are being entered in the General Index.

Proceedings of the Courts Martial held at Fort Henry to try prisoners accused of treason during the

Rebellion of 1837-1838, together with correspondence and petitions relating to the trials, and pay lists.

Some reports of the proceedings are annotated with confirmation of the sentence by the Governor in

Council.

The reports have been organized into files, as indicated in the Shelf List which follows. Covering letters

which forwarded the proceedings to Council, a schedule of prisoners tried, pay lists of the Courts Martial

staff, and petitions relating to more than one prisoner, are included in separate files within the series.

Contemporary copies (apparently made for enclosure with despatches to the Colonial Office) have been

Related material can be found in the Minute Books of the Executive Council on State Matters (RG 1, E 1)

and the Submissions to Council (RG 1, E 3), as well as in Colonial Office 42 (see MG 11) and the Upper

Canada Sundries, amongst other series. Many documents relating to the treason trials were printed with

British Parliamentary Papers of this period.

Names of individual prisoners have been entered in the General Index.

The complete series of original files has been microfilmed (reels C-15690 and C-1569l). The originals

have been withdrawn from circulation for conservation purposes. Reader-printer copies can be supplied

from the microfilm, at the same charge as for xerox. When special copies are required for publication or

exhibition, photographs from the originals can be supplied, at the standard charge for such copies.

CANADA WEST: Rebellion Losses Claims, 1846-1847

Claims for losses incurred during the Rebellion of 1837 in Upper Canada and returns of

claims submitted, 1846-1847, form a partial series. Some files have been clearly

identified as being originally part of the Numbered Correspondence series of the

Provincial Secretary and have therefore been reintegrated in November 1980 in RG 5,

C 1. Further identification of such files may result in further reintegration.

The pages numbered 1377 to 1428 were transferred from RG 4, B 37 after being

identified as Canada West rather than Canada East. The records for Canada East are

found in RG 4, B 37, in RG 4, C 1 and in RG 19. The latter series is scheduled for

microfilming in 1987.

CANADA WEST: Municipal Records, 1842-1869

Volumes 1-12 46 cm

Indexes of ratepayers maintained under legislation relating to the Municipalities Fund,

1855-1868 (volumes 1-5), correspondence relating to the distribution of remaining funds,

1869 (volumes 6-8) and municipal by-laws, 1842-1844 (volumes 9-12) accumulated in

the office of the Provincial Secretary form three sub-series here, although there is no

direct relation between the by-laws and the records of the Municipalities Fund.

Related records are to be found in the Upper Canada Sundries (RG 5, A 1) for matters of

municipal administration before 1841 and in the Numbered Correspondence Files of the

Provincial Secretary (RG 5, C 1) for the period after 1841. There may also be

unnumbered material in the Provincial Secretary's correspondence (RG 5, C 4). There

are also registers of by-laws to be found in RG 1, E 12. The feasibility of their transfer

here has yet to be investigated.

The arrangement of the records varies, as is demonstrated in the Shelf List which follows

this inventory entry.

A substantial proportion of the municipal by-laws and related correspondence in volumes

10-12 should be reintegrated into the main series of Numbered Correspondence (RG 5,

C 1) but the reintegration requires special arrangements since that series has been

microfilmed up to 1844. The numbered files of 1844-1848 (formerly shelved as volumes

12-14) were reintegrated into RG 5, C 1 in May 1986. A record of the file numbers so

reintegrated is maintained in the Pre-Confederation Archives Section.

UPPER CANADA Naturalization Registers, 1828-1850

Volumes 1-8 80 cm

Returns of persons naturalized, under terms of the Upper Canada statute 9 Geo. IV,submitted to the Provincial Secretary and Registrar on an annual basis. Subsequentlegislation altered the terms for residence and other requirements. The registersvaried in content; the name, occupation and residence are given in all cases but thedate of arrival in the province and age may also appear. Only adult males werenaturalized.

ARRANGEMENT The registers were transferred to the Archives in 1959 from the Department ofCitizenship and Immigration. They have been arranged in chronological order,subdivided by county or district. A shelf list filed at the beginning of each volumeidentifies the counties for which returns were made.

CANADA WEST: Provincial Secretary, correspondence referred to the Inspector General,1843-1867

Volume 1 (10 cm)

Correspondence from the Provincial Secretary's Numbered Correspondence Files was on occasion

referred to the Inspector General for information and advice. A certain number of such files was

transferred in 1970 from the Department of Finance (RG 19) to form this series.

When work began to re-establish the original order of the Numbered Correspondence Files (RG 5, C 1)

wherever feasible, the majority of the files in this series were transferred to that series. A few exceptions

remain pending further investigation of their placement in RG 5, C 4 or retention here.

CANADA WEST: Provincial Secretary's Office, Numbered Correspondence Files, 1821-1867

At the union of Upper and Lower Canada in 1841, the division of responsibilities between the offices of

Civil Secretary and of Provincial Secretary and Registrar was clarified, confirming an evolutionary trend.

Where the Civil Secretary had been the principal channel of communication for the government before

the Union, after 1841 the Provincial Secretary's office was the focus. This evolution in the bureaucracy

paralleled and reflected the development of responsible government in the political arena.

While the office of Civil Secretary to the Governor was unified after 1841, that of the Provincial

Secretary and Registrar continued a separation based on geography. The old territory of Lower Canada

was now termed Canada East and the old Upper Canada, Canada West. Parallel record-keeping systems

were established by the Provincial Secretaries, using a numbered file registry system.

Microfilming of the Registers and Indexes within this series was completed in 1975. The microfilming of

the files begun in 1977 was suspended in 1980 pending resolution of problems with misplaced files, then

resumed in 1991.

Researchers must use the microfilm, when available. The complete series is being withdrawn from

circulation as a protective conservation measure. Photocopying is permitted only from the microfilm.

Certification of copies for legal purposes can be provided at the National Archives of Canada. When

requesting photocopies, researchers should use the short form of citation illustrated below.

Letters, petitions, reports, returns and other documents received in the office of the Provincial Secretary

and Registrar for Canada West between 1841 and 1867 were entered in a numbered registry system.

Certain files antedating 1841 were brought forward for reference purposes and entered in the registry

system. Not all documents which were entered in the registry system have survived in their expected

locations. Many files were brought forward and preserved with related files of later date. As the main

channel of correspondence for the government, the Provincial Secretary redirected many documents to the

appropriate offices for action, where the files were incorporated into other registry systems.

A variety of incoming items of 1841-1867 were not numbered and have come to form the series C 4. The

texts of replies to the correspondence received (C 1) were recorded in the letterbooks forming series C 2.

While some drafts of those replies may be found attached to the incoming items, a substantial proportion

of the drafts were segregated and filed as the series C 3.

Files referred by the Provincial Secretary to other offices may be traced in certain record groups:

RG 1, L 3 - petitions referred to the Land Committee of the Executive Council.

RG 7, G 20 - correspondence received by or referred to the Civil Secretary.

RG 1, E 6 and RG 11 - files accumulated by the Board of Railway Commissioners and the Board

of Works.

RG 17 - files relating to immigration and to statistics referred to the Board of Agriculture.

RG 19 - files referred to the Inspector General, the Receiver General or the Minister of Finance.

Certain other files may now be in the custody of provincial archives, inasmuch as the Commissioner of

Crown Lands and certain other offices became provincial responsibilities at Confederation and the

records were transferred with the officials.

In his capacity as Registrar, the Provincial Secretary was responsible for retaining a copy of all

documents issued over the Great Seal of the province and of documents issued elsewhere which gave

jurisdiction to provincial officials (such as the royal Commission to a Governor). Records specific to the

Registrar's functions, including registers and entrybooks recording the texts of documents, were inherited

by his successor at Confederation and may now be found with the Registrar General's records in RG 68.

The arrangement of the records follows the original numerical sequence assigned by the Provincial

Secretary. This sequence reflected the chronological order of receipt. It has been preserved or

reconstructed wherever possible. Many blocks of files on special subjects, segregated in the past and

described in B series of RG 5, have been reintegrated into the numbered correspondence (series C 1).

In volumes 1-127 the files were paginated to preserve the original sequence of their contents, and their

integrity, since smaller items might go astray after the pins, ribbons and other fasteners were removed to

facilitate filming. The notices identifying files "brought forward" or "not found" at the time of filming

were not paginated. Frame counters were used in filming of subsequent volumes.

Finding Aid 995 is composed of several parts. Until 1985, the Registers and Indexes (described below)

were shelved as FA 995. They are now available only on microfilm (see the Shelf List for reel numbers).

Instructions on the use of the Registers and Indexes, the Shelf List and a table of abbreviations are filed

immediately following this inventory entry.

The Shelf List provides the most basic level of description. It identifies the volumes in which specific

blocs of files will be found, plus the titles of the Indexes and Registers (volumes 881-930). Chronological

and numerical sequences are readily apparent from it.

The Registers were compiled by office staff in the course of each day's activity, such that all letters

received on a certain day were assigned a number and described against it in the Register. Over the years,

practice varied regarding the detail provided under specific headings and the sequence of the columns

titled Author, Subject, Date of writing and receipt, Remarks or Action, and Filed with.

The Indexes were also compiled by office staff, apparently on a daily or weekly basis. The alphabetic

sequence is consequently far from perfect. Correspondence was indexed under the names of authors and

of persons whose cases formed the subject of the letter or petition, as well as by topic. The subject

categories varied over time, becoming more specific and systematic in later years. Entries for government

officials may be by their names or their titles, but is not consistently under either. Certain subjects may

seem impossible to locate; the key lies in determining the office/official responsible for the activity in

question. Thus, mention of Court Houses and Prisons (Gaols) should be sought under the heading

Sheriff. [See below, How to locate files ....]

Abbreviations were used extensively by the Provincial Secretary and his colleagues. A table identifying

the most common of them is available (following this inventory entry) as an interpretive aid to researchers

when consulting the Indexes and Registers within this series. The citations below illustrate the

recommended use of the abbreviation PSO/CW to identify file numbers. It should also be noted that the

term file is used in preference to docket, although both are equally correct.

used to identify the file as a whole. To specify documents within a file, the appropriate page or frame

counter number should be cited. A description of the document may be included for clarity.

How to locate files using the contemporary Registers and Indexes in RG 5, C 1(volumes 881-930) and related series

The contemporary Registers and Indexes in series C 1 serve to identify the files. They must beused in conjunction with the Shelf List in order to locate specific files. Except for those serving thepre-1841 "reference" files, each Register is paired with an Index. There is no cumulative index coveringthe whole period 1841-1867.

Subject entries were not made consistently according to the activity involved or the object of thatactivity. Thus, references to the dissolution of Parliament may be under D or P. There are peculiarities inentries relating to place names as well: Petitions from "the Inhabitants of This Township" should befound indexed under the initial letter of the municipality's name. Correspondence from specific officialsmay be indexed by their titles, by generic terms such as Sheriff, or by the geographic jurisdiction(township, county, district).

The Index was compiled concurrently with the Register, so the sequence of entries within major divisionsis chronological, not alphabetical. The entry for Mr. Tench would follow that for Mr. Thomas when theletters arrived in that sequence.

General principles for searches:

1 When searching for several files relating to a particular case or individual, it is best to begin withthe file of most recent date. The bringing forward of files was not consistently recorded in theRegisters. By working backward, one may rapidly find all the files on the case together andreduce or eliminate the need to search further.

2 When a file appears not to have survived, substantial information about the case may still beavailable in other sources. Chief amongst these are the letters sent to the author of the incomingletter and to officials involved in a case. Their texts are recorded in the letterbooks (series C 2).

3 Files referred to other officials should be sought in the appropriate Record Group. Thus, theremark "Refd Ex Cl 4 June" in 1861 would lead to the Submissions to the Executive Council(RG 1, E 7) and the corresponding Minutes (RG 1, E 1). Where there is a note in the style "Reptfrom Ex Cl 8 June", it should be presumed that the file was returned to the PSO and will be in itsproper numeric order.

Where the Remarks/Action column contains an extensive note on the history of a file and itsperegrinations through government offices, researchers may find it beneficial to obtain areader-printer copy of the Register entry. Abbreviations which seem puzzling at first glanceshould become clear as the investigation progresses through related series of records.

4 In preparation for microfilming, an identifier sheet was inserted to mark the absence of any file. These sheets note whether files were brought forward, transferred to other offices, or "not found". Some of the files "not found" before 1980 were subsequently located in the B series of RG 5. Where such files were filmed as a supplementary sequence for a year, the reel numbers arespecially identified in the Shelf List.

5 Each incoming letter or petition, and related documents, were attached to a docket sheet bearingthe file number, a file title and notes regarding action taken. (In early years, the address panel ofa letter was often used in lieu of a docket sheet.) Microfilming practice has varied, such that thedocket sheet was at some periods filmed before the file contents and at other periods, after. Practice was consistent within each reel, making the docket sheet a reliable indicator of thebeginning and end of specific files. Please note that the documents within a file may not exhibitany particular chronological or other order, although some will exhibit numbers and letterscorresponding to a list prepared by the Provincial Secretary or some other official involved with acase. To the extent that a pin or ribbon has preserved an order of documents within a file, thatorder has been respected in the microfilming.

Specific guidelines for searches:

A To search for information about an individual, institution or corporate body:

1 Consult the Index for the appropriate year(s), under all known spellings of the surname, or likelyvariations. Names of associations may be filed under a key word -- such as Sons of Temperanceor the London & Quebec Telegraph Company under T ~ rather than by the first word. If theindividual held any public office, consult the heading for it also. Note the docket or file numbersgiven there.* (During the 1840s, entries were made in the style 32/15784 to identify both register page

and file number.)

2 Consult the Register corresponding to the year in question and locate the entry corresponding tothat file number. Information recorded under the headings of Remarks or Action and Filed Withwill indicate whether the Provincial Secretary retained the file, in place or brought forward, orreferred it to another office.

3 Provided that the file was not identified as having been forwarded elsewhere nor filed with itemsof later date, consult the Shelf List to identify the volume in which the file should be located andthe microfilm reel on which that volume will appear. Be cautious in correlating both year and filenumber, since the file sequences began anew at certain points (usually each January).

For example, "with 4803 of 57" in the Remarks for an item of 1856would lead to the 1857 Register entry for file 4803. The file may be there, or both it and4803 of 1857 may be noted as having been brought forward with yet another file number. Step 2 must be repeated until the Remarks indicate where the files came to rest.

4 Consult the relevant microfilm by retrieving the appropriate reel from the Self Service collectionin the Reading Room or requesting it on loan. Requests for photocopies should not be submitteduntil the file has been located and its existence been confirmed. B To search for information about an official or his activities

1 Consult biographical dictionaries, almanacs or works such as J. O. Coté's Political Appointmentsand Elections in the Province of Canada (Ottawa, 1867) to confirm names, titles, and dates inoffice.

2 Consult the Index for the appropriate year(s), under all known spellings of the official's surname,or likely variations, and under the appropriate office title. Note any docket or file numbers giventhere.

3 Consult the Register corresponding to the year in question and locate the entry corresponding tothe file number(s). 2 Consult the Index under appropriate terms for an abstract subject and under the titles of officialsor names of specific individuals or institutions known or suspected to have been involved (suchas the Chief Emigrant Agent for immigration or McGill College for education) and note thedocket or file numbers given there.

3 Consult the Register corresponding to the year in question and locate the entry corresponding tothat file number. Notes:Abbreviations used in reference to offices and officers are listed in their most common form. Whereseveral forms were used over time, all are listed.

As a general rule, abbreviations are formed by omitting the middle part of a word and setting the terminalletter above the line, as Novr, with or without a period or colon after the abbreviated word. A line may bedrawn below the letter set up, causing confusion about the nature of the letter if the line was carelesslydrawn.

When attempting to interpret abbreviations, consider- the subject matter under discussion and the officers who might be involved; personal names and

office titles can be confirmed by consultation of Coté's Political Appointments and equivalentvolumes;

- whether or not the initials or abbreviations match the titles of known offices and officers;

- whether florid styles of handwriting, the superscription of terminal letters and the use of theGermanic style for the double SS (appearing as fs) may have several interpretations.

Outgoing correspondence from the Provincial Secretary's Office was recorded in letterbooks, 1839-1867. The series

complements the incoming correspondence found in the Numbered Files (series RG 5, C l). The drafts found in

series C 3 may be compared with the final text of the outgoing correspondence as recorded in the letterbooks.

FINDING AIDSA set of indexes to the letterbooks serves as a means of access. The volumes have been shelved in the

Reference Room as Finding Aid # 996. The index gives the number of the page on which the reply will be

located; the file number of the incoming letter is generally noted in the margin, facilitating reference back to

that series. Likewise, the date of the reply is frequently noted in the registers of incoming correspondence

(see RG 5, C 1).

The SHELF LIST which follows provides a detailed list of the volumes with a correlation of the microfilm

reels on which they appear. The complete series has been microfilmed.

RESEARCHERS MUST USE THE MICROFILM

PHOTOCOPIESSince the series has been withdrawn from circulation for conservation purposes, xerox copies can NOT be

made from the originals. Reader-printer copies can be made from the microfilm, at the same charge as for

xerox. When special copies are required for publication or exhibition, photographs can be made from the

originals, at the standard charge for such copies. Reader-printer copies can be certified for legal purposes.
