MODULE 1An Introduction to Contract Law and the South African Legal System• Discuss how the law of contract developed from

Roman, Roman-Dutch and English roots into a constitutional era

• Demonstrate an understanding of how commercial and contract law fits into the South African legal system

• Define the courts of the republic, the doctrine of the stare decisis, interpretation, and court judgements

• Outline the branches or divisions of South African law• List the differences between private and public law

and identify from which system of law a particular role or contract originates

Contracts of Insurance and Agency Contracts• Differentiate the agency contract, and the insurance contract

from other forms of contracts• Review the essential elements of a valid contract of agency• Solve practical legal problems with regard to agency contracts,

credit agreements and contracts of mandate• Apply the law to the facts to come to a reasoned conclusion

about a problem • Summarise some of the important consequences

of entering into a contract of insurance
