ELEVENTH ANNUAL REPORT OF OPERATIONS UNDER THEAIRPORT AND AIRWAY DEVELOPMENT ACT OF 1970, AS AMENDED

Section 24 of the Airport and Airway Development Act of 1970 (Public Law91-258) requires that the Secretary, Department of Transportation, submitan annual report to Congress of operations under Part II of the Act for thepreceding fiscal year. This report covers operations for the fiscal yearending September 30, 1980.

INTRODUCTION

With the enactment of the Airport and Airway Development Act of 1970 (P.L.91-258) the Nation moved toward improving the efficiency and safety of theairport and airway system. Reflecting the role of aviation in the economyand the benefits derived from safe and efficient operation, that statute(1) found the airport and airway system inadequate to meet the requirementsof the then current and projected growth in aviation, (2) declared substan-tial expansion and improvement was required to meet the demands ofinterstate commerce, the postal service, and national defense, and (3)established an expanded program of Federal matching grants to sponsors ofairports serving commercial and general aviation. Moreover, the Actestablished a system of user taxes paid into a trust fund to provide anassured, long-term source of funding.

The Act had been amended four times as of the end of Fiscal Year 1980. Itwas amended in 1971 (P.L. 92-174) to incorporate provisions involving theuse, preservation, and priority for expenditure of funds from the TrustFund. The Airport Development Acceleration Act of 1973 (P.L. 93-44) madefurther amendments to the 1970 Act, increasing annual authorizations forfiscal years 1974 and 1975 and increasing the Federal contribution forgrants at most airports. The Airport and Airway Development Act Amendmentsof 1976 (P.L. 94-353) approved July 12, 1976, made several major changes tothe Act, affecting among other things project eligibility, increasedoverall funding levels, distribution of funds, the project approvalprocess, and the percentage of the Federal contribution for most projects.The amendments also included an extension of the planning grant program andrevisions to the National Airport System Plan. Further amendments tofunding levels and an increased emphasis on projects to reduce noiseimpacts of airports were effective upon enactment on February 18, 1980, ofthe Aviation Safety and Noise Abatement Act of 1979 (P.L. 96-193).

THE AIRPORTS PROGRAM

The Airports Program covers among other things, the identification,planning, and development of the Nation's system of public airports toserve the needs of civil aviation in the fifty states, Guam, Puerto Rico,

American Samoa, the Trust Territory of the Pacific Islands, and the Virgin

Islands.

It is based primarily on provisions of the Airport and Airway DevelopmentAct of 1970 as amended. This law provides legislative recognition of an

important national need for improvement in the national airport and airwaysystem. Airport system improvements aimed at increased system capacity and

the accommodation of higher performance aircraft has been the goal of theAirports Program. Federal involvement is designed to assist municipalities

and other public agencies that own and operate the civil airports of thiscountry in funding airport planning and development that will (I) help

assure environmental acceptability and (2) provide for increased safety in

airport operations.

Principal activities in this program include: preparation of a National

Airport System Plan and other airports planning activities; administrationof a program of grants-in-aid for airport planning and airport development;

preparation of airport engineering, operations and safety standards;inspection of airports for safety of operations; participation in transfers

of Federal land and property for civil airport use; collection of fielddata for the airport data program; verification that public agencies

receiving Federal assistance continue to operate their airports for thebenefit of the public in accordance with their agreements; administration

of a general aviation grant state demonstration program; and promotion ofairport noise compatibility planning and actions to implement the resultant

plans.

AIRPORT PLANNING

National Airport System Plan (NASP). The Airport and Airway DevelopmentAct of 1970, as amended, requires the Secretary of Transportation to pre-pare a ten-year National Airport System Plan for the development of publicairports in the U.S. adequate for the needs of civil aeronautics, therequirements of national defense, and the special needs of the PostalService. In developing the plan, the Secretary is directed to give dueconsideration to the relationship of each airport to local transportationsystems, forecast technological developments in aeronautics, other modes ofintercity transportation, and factors affecting the quality of the nationalenvironment. Prepared by FAA, the first edition of the NASP covering theyears 1972 through 1982 was submitted to Congress in June 1973 and releasedto the public in September 1973. A revised NASP, 1978-1987, was deliveredto Congress in January 1978. A statistical revision, dated 1980-1989,was published in August 1980. The NASP is kept current, between majoreditions, by continuing revisions to a computer-stored data bank. Many ofthe revisions include the findings of airport master and system plans

funded under the Planning Grant Program (PGP).

The current NASP includes about 3,600 locations, for which a total of $12.7

billion In airport development needs is identified for the ten-year period.

ENVIRONMENTAL CONSIDERATIONS

The Federal Aviation Administration (FAA) considers and weighs environmentalvalues in evaluating proposed Federal actions relating to airports. Federalactions of potential environmental concern include: (1) adoption of theNational Airport System Plan, (2) approval of an airport location, (3) approvalof a new or revised airport layout plan, (4) approval of funding for airportdevelopment, (5) requests for conveyance of government land for airportpurposes, and (6) approval of the release of airport land.

FAA Airports Program procedures identify types of actions which require anenvironmental assessment and consultation process. This process provides theFAA, other agencies, and members of the public with an understanding of thepotential environmental impacts of a proposed action. Section 102(2) (C) of theNational Environmental Policy Act of 1969 (NEPA) requires an environmentalimpact statement when an action would produce a significant impact on theenvironment; otherwise, a finding of no significant impact is prepared. Specialconsideration and findings have been required under section 16(c)(4) of theAirport and Airway Development Act of 1970, as amended (Airport Act), for proj-ects involving airport location, runway location, or major runway extensions.Other laws have particular requirements relative to specialized concerns such asair quality, water quality, public recreational lands, historic and archeologi-cal sites, endangered species, coastal zones, wetlands, and floodplains.

Initial review of proposed Federal airport actions identifies the extent ofenvironmental study and coordination required. If an action is not in a cate-gory requiring environmental assessment and does not have the potential,either individually or through cumulative effects, of significantly affectingthe environment, it is categorically excluded from environmental processing. Asexperience has been gained in the environmental field, FAA procedures have cate-gorically excluded more and more projects from environmental processing.

In Fiscal Year 1980, 5 Federal airport actions were environmentally approvedthrough environmental impact statements prepared pursuant to NEPA, and 54actions were approved through findings of no significant impact undersection 16(c)(4) of the Airport Act. The majority of actions had no measurableimpact and were categorically excluded from further environmental review.

On November 29, 1978, the Council on Environmental Quality published its finalregulations establishing uniform Federal procedures for implementing the proce-dural provisions of NEPA. These regulations prompted the preparation of newimplementing procedures by each Federal agency to fit its own programs. TheAirports Program's implementing procedures are contained in Appendix 6 of FAAOrder 1050.1C, Policies and Procedures for Considering Environmental Impacts.Additional, more detailed guidance on how to assess environmental impacts andprepare environmental documents was published separately in Order 5050.4,Airport Environmental Handbook, in March 1980.

The Airports Program procedures and detailed guidance incorporate three majornew directions. One is the revision of the environmental assessment document to

streamline it and make it usable as the key mechanism for determining whether

any potential impacts appear significant enough to warrant further study and torequire the preparation of an environmental impact statement. To helpaccomplish this, the second major effort has been the development of thresholdsof significance for each category of impact. When the analysis required in theenvironmental assessment shows that a particular threshold (of noise, forexample) would not be exceeded by the proposed action, no further analysis ofthat impact is required. If no categories of impact exceed their thresholds ofsignificance, the FAA will prepare a brief finding of no significant impact.When certain thresholds are exceeded and an environmental impact statement isrequired for the proposed action, further detailed study will be performed onlyon those impacts with significant implications. The third major thrust of thenew guidance has been to integrate all other special purpose environmental lawsand requirements (e.g., endangered species legislation, coastal zone managementprograms, executive orders on wetlands and floodplains) with the NEPA proceduresto achieve the Department of Transportation's objective of one-step environmen-tal processing for Federal actions.

ENERGY CONSERVATION REQUIREMENTS

On August 29, 1980, DOT issued a final rule implementing Executive Order12185, Conservation of Petroleum and Natural Gas in 14 CFR Part 152,Subpart G. That Executive Order, which implements section 403(b) of thePowerplant and Industrial Fuel Use Act of 1979 (P.L. 95-620), requiresFederal agencies which administer programs of financial assistance to takeactions which maximize the efficient use of energy and conserve petroleumand natural gas in programs funded by those agencies.

The regulation requires that each sponsor perform an energy assessment (asdefined by the rule) for each Federally-assisted building construction ormajor building modification which will exceed $200,000 in constructioncost. The building design, construction, and operation shall incorporate,to the extent consistent with good engineering practice, the mostcost-effective energy conservation features identified in the energyassessment. Furthermore, each sponsor shall require fuel and energy con-servation practices in the operation and maintenance of the airport andshall encourage airport tenants to use these practices. The FAA isdeveloping technical guidance which will be available in the spring of 1981to help airport operators comply with this regulation.

PLANNING GRANT PROGRAM (PGP)

The Airport and Airway Development Act of 1970, as amended, authorized theFederal Aviation Administration (FAA) (through delegation from theSecretary of Transportation) to make grants to planning and public agenciesfor preparation of airport system and master plans respectively. Theprogram was designed to promote the effective location and development ofpublicly owned airports and to develop a national airport system plan.

System plans are developed by a state or areawide planning agency to for-mulate air transportation policy, determine airport facility requirementsneeded to meet forecast demands, and to establish the framework fordetailed airport master planning. Airport master plans, which are devel-oped by the airport owner, focus on the nature and extent of developmentrequired to meet the future aeronautical demand at a particular facilityover a 20-year period.

Since the inception of this program in fiscal year 1971, 2,035 planninggrants have been issued totalling $96.8 million. Of these, 1,829 were formaster plans and the remaining 206 were for system planning projects.Included in the latter were the initiation of state system plans for theCommonwealth of Puerto Rico, the Trust Territory of the Pacific Islands,and all states except Alaska, Arkansas, Connecticut, Mississippi, andNebraska.

When the program first began, the Federal Government provided up to two-thirds of the cost of planning grant projects. However, amendments to theAirport and Airway Development Act increased the Federal share of planningprojects to 75 percent of the cost of airport system plans, 90 percent formaster plans at general aviation airports and 75 to 90 percent for masterplans at air carrier airports depending upon the number of passengersenplaned. The rate for master plans was higher in a few states with largeareas of publicly owned land.

During fiscal year 1980, $10,396,397 was obligated through the PGP for 165projects. Discounting recoveries from closeouts of prior year grants, thenet obligations for fiscal year 1980 totalled $9,999,997. This amountexhausted all but a few dollars of available program funds. Twenty-five ofthe 165 projects ($2,125,424 in PGP funds) were for airport systemplanning. The remaining 140 projects were for airport master plans at 56air carrier/commuter ($4,868,462) and 84 general aviation/reliever($3,402,511) locations. A detailed breakdown by location of the grants isshown in Appendices A and B.

Emphasis in airport planning and development is placed upon maintaining theability of the airport system to accommodate projected aviation demand. Acritical issue affecting the existing system is the annoyance caused bynoise from aircraft taking off and landing at airports. To assist airportowners in examining the effects of aircraft noise on a community and indeveloping mitigation measures, the Department of Transportation

established a program to encourage the development of airport noise controland land use compatibility (ANCLUC) plans as part of PGP funded masterplans. During fiscal year 1980, grants totalling $791,641 were issued to16 airports for such planning. This, when added to grants issued in fiscalyears 1977 through 1979 results in a total of 54 airports that are par-ticipating in the program. This aspect of the airport planning process hashelped to establish a forum for dialogue between airport operators, users,and citizens in noise impacted jurisdictions. Because this program hasbeen considered beneficial, the eligible airport sponsors with noiseproblems were able to incorporate noise planning into their overall masterplanning.

Another noteworthy accomplishment during the year was the issuance of 14grants totalling $1,147,115 in PGP funds for continuous airport systemplanning. The objective of continuous planning is to insure that existingsystem plans remain responsive to the air transportation needs of the area.To accomplish this objective, grants are given to responsible planningagencies to continuously monitor aviation activity and update, asnecessary, the appropriate sections of the system plans. This has provento be an efficient way to keep system plans current and contributed to thestrengthening of the aviation expertise of state and metropolitan areaplanning organizations. System plans that are not maintained through con-tinuous planning usually have a five-year life.

AIRPORT DEVELOPMENT AID PROGRAM (ADAP)

Section 14 of the Airport and Airway Development Act of 1970, as amended,

authorized the Secretary of Transportation to make airport development

grants in order to bring about, in conformity with the National Airport

System Plan (NASP), the establishment of a nationwide system of public air-

ports adequate to meet the present and future needs of civil aeronautics.

The Airport and Airway Development Act Amendments of 1976 (P.L. 94-353),

enacted on July 12, 1976, amended funding levels and added several new eli-

gible items of development. Further amendments to funding levels and an

increased emphasis on projects to reduce noise impacts of airports were

effective upon enactment on February 18, 1980, of the Aviation Safety and

Noise Abatement Act of 1979 (P.L. 96-193).

The 1976 Amendments raised the annual program level from $310 million,

established in 1973, to a range of $500 million to $610 million over the

five-year period through fiscal year 1980. The Aviation Safety and Noise

Abatement Act of 1979 further in, ased the final year of the program to

$667 million. These amendments .-ovided $435 to $569 million annually for

airports serving all segments of aviation including a category of air

carrier airports identified as commuter, and $65 to $95 million annually

for general aviation airports, including airports that relieve congestion

at high density locations. (Charts on following pages show the percentage

distribution of the annual contract authority.) The 1976 and 1980 amend-

ments also revised the percentage of Federal participation in eligible air-

port development upward from previous levels of 50 and 75 percent. ADAP

participation at all except the busiest airports was 90 percent through

September 30, 1978, dropped to 80 percent for fiscal year 1979, then

increased to 90 percent again for 1980. Air carrier airports, other than

commuter airports, whose total annual passenger enplanements are one-

quarter of one percent or more of the total annual passenger enplanements

of all such airports received Federal participation at 75 percent. There

were slight upward adjustments in states containing a high percentage of

public land.

The 1976 Amendments permitted certifications to be accepted from sponsors

indicating that they would comply with all program statutory and admin-

istrative requirements. They also allowed for multi-year grants for ADAP

projects extending over several years, and authorized funds for grants to

states to assist them in developing their own general aviation airport

development standards, other than standards for safety of approaches. A

maiimum of $25,000 for a single state was established for development of

standards.

PROPOSED LEGISLATION

The legislative authority to execute development grants expired as of

September 30, 1980. Several versions of legislation to continue an airport

grant program in modified form were considered before adjournment of the

96th Congress and new proposals are now being considered by the 97th Congress.

PRIMARY GOALS

The primary goals of the ADAP are to:

Increase safety and security of aircraft operations at the Nation'scommercial service airports with projects such as those which in.oreasethe ability to respond to aircraft accidents, minimize pavementslipperiness, and secure operational areas.

Maintain the functional integrity of airport landing areas at theNation's public-use airports through the rehabilitation of pavementsand lighting systems.

Improve the existing substandard airport facilities at the Nation'spublic-use airports by bringing airports up to recommended designstandards. In meeting these standards, aviation facilities will beconstructed and operated with regard given to minimizing current andprojected noise impacts on nearby communities.

Upgrade existing public-use airports to serve larger and moredemanding aircraft.

Increase the capacity of public-use airports to expeditiously handleaircraft operations thereby minimizing congestion and delays.

Provide air access to communities or remote areas through developmentof additional public-use airports.

STATUTORY CRITERIA

Statutory criteria relating to the ADAP included the following:

The project had to be reasonably consistent with plans (existing atthe time of approval of the project) of planning agencies for thedevelopment of the area in which the airport is located.

Sufficient funds had to be available for that portion of the projectcosts which were not paid by the United States.

The project had to be completed without undue delay.

The public agency or agencies which submitted the project applicationhad to have legal authority to engage in the airport development asproposed.

All project sponsorship requirements prescribed by or under theauthority of the Secretary had to be met.

The project had to include provision for the installation of landingaids specified in the Act and determined by the Secretary to berequired for the safe and efficient use of the airport by aircraft,taking into account the category of the airport and the type andvolume of traffic using the airport.

Fair consideration had to be given to the interest of communities inor near which the project was to be located.

All proposed projects involving airport locations, major runwayextensions, or runway locations were submitted to the EnvironmentalProtection Agency and the Department of Interior for their review.The proposals were reviewed as to their adverse impacts on naturalresources, including but not limited to fish and wildlife, naturalscenic and recreation assets, water and air quality and other factorsaffecting the environment. Approval of these projects was not givenunless the Secretary, following a full and complete review which wasmade a matter of public record, determined that no feasible and pru-dent alternative existed and that all possible steps would be taken tominimize any adverse effects.

The public agency sponsoring the project, if it involved airportlocation, an airport runway, or a runway extension, had to certify tothe Secretary that there was afforded the opportunity for publichearings for the purpose of considering the economic, social, andenvironmental effects of the airport location and consistency with thegoals and objectives of such urban planning as had been carried out bythe community.

The Secretary did not approve any project involving airport location,major runway extension, or runway location unless the governor of thestate in which such project was located certified, in writing to theSecretary, that there was reasonable assurance that the project wouldbe located, designed, constructed, and operated so as to comply withapplicable air and water quality standards. Where no state standardswere approved or where such standards were promulgated by theSecretary of the Interior or the Secretary of HEW (function delegatedto the EPA), certification was obtained from the appropriateSecretary. Notice of certification or of refusal to certify was pro-vided within 60 days after the project application was received by theSecretary.

The Secretary conditionally approved any such project applicationbased on compliance during construction and operation with applicableair and water quality standards.

Airport development had to be included in the NASP and comply with theairport development standards formulated or approved by the Secretaryof Transportation.

As a condition precedent to approval of airport development projects,sponsors gave certain written assurances to the Secretary as requiredby the Act. There had to be consultation with air carrier operatorsat air carrier airports and with fixed base operators on generalaviation airports prior to making a decision regarding any proposeddevelopment.

PROGRAM CRITERIA FOR ADAP

In order to meet the intent of the legislation, criteria were developed toaccommodate the goals set forth in the Act. Recognition was given to theneeds of all segments of aviation and to the prime goals of improvingsafety and increasing capacity.

Priorities were determined by considering various factors, such as workessentiality, and timing of need. This process was not purely a mathemati-cal computation, but rather the exercise of judgment in the application ofguidelines.

Programs of approved projects were developed on a continuing basis andallocations were announced periodically. All requests within a givenstate, when projects met basic eligibility requirements, were ranked bypriority and programed to the extent of available funds. Programs weremonitored on a national basis to assure that the priority levels of proj-ects were uniformly applied throughout the Nation.

IMPLEMENTATION

Policy and procedures for administering the ADAP were developed andpublished in Part 152, Federal Aviation Regulations, which was revised inMay 1980 to simplify and clarify grant requirements. This regulation pro-vides guidance on: (1) procedures for submission of requests for aid; (2)consideration of environmental effects; (3) eligibility of airport develop-ment items or facilities, (4) landing aid requirements; (5) requirementsfor public hearings to consider the social, economic, and environmentalaspects of proposed airport development; (6) applicability and effect ofthe Uniform Relocation and Real Property Acquisition Policies Act; (7) pro-cedures to assure nondiscrimination in the exercise of the grant program;and, (8) procedures for project approval.

Airport Development Aid Program Apportionments for Fiscal Year 1980

Appendix C to this report provides the apportionment of the $667 millionauthorization for fiscal year 1980 under the ADAP for airport development?rojects. Each air carrier airport sponsor and the Governor of each stateor the chief executive officer of the equivalent jurisdiction was notifiedof the sums apportioned in accordance with sections 15(a) (3) (A) and15(a) (4)(A) of the Airport and Airway Development Act of 1970, as amended.

Fiscal Year 1980 Development Activity

Although $667 million was authorized, the fiscal year 1980 DOT AppropriationsAct (P.L. 96-131) set the availability of funds at $640 million. An addi-tional 28 million was made avail3ble through recoveries from prior year's3rant.; making a total of $668 million available of which $667 million wereplace. under grant (obligated). This represents an all time high for obli-at ions for the development program.

A breakdown of the $667 million in obligations includes $544 million for817 new grant agreements, $5.9 million for up to 10 percent increases inexisting ADAP grant agreements, and $117.1 million for the fiscal year 1980portion of multi-year grants. The new grant agreements consisted of $443million for 519 projects at air carrier and commuter airports, and $101million for 298 projects at general aviation and reliever airports.

The largest percentage of obligated funds was used to establish or improvesystem safety and capacity through development or acquisition of items suchas new runways, runway extensions, taxiways, apron areas, approach aids,airfield lighting, crash/fire/rescue vehicles, and snow removal equipment,and to upgrade air safety in metropolitan areas by improving satellite air-port facilities for general aviation activity. During the year there were69 projects totalling $32.5 million to improve satellite airports at 65airports in 43 metropolitan areas. This brought the total, over two years,

for the newly instituted satellite program to $99.8 million for 178projects to improve 118 airports in 57 metropolitan areas.

The 817 airport development projects for which grant agreements were exe-

cuted during fiscal year 1980 are summarized in Appendix D by state andlisted in Appendix E with descriptive work items.

STATE STANDARDS PROGRAM

The Airport and Airway Development Act of 1970 as amended authorized the

Secretary of Transportation to make grants to any state, upon application,for developing standards for airport improvements at general aviation air-ports within a state.

The purpose of this program is to provide the states greater flexibilityin general aviation airport development by providing for construction stan-dards that are more closely related to local conditions.

During fiscal year 1980 four states received grants in dollar amounts asindicated below:

EQUAL OPPORTUNITY REQUIREMENTS

Provision of assistance under the Airport and Airway Development Act sub-jects the airport sponsor to a number of equal opportunity requirements.They are:

(1) Title VI of the Civil Rights Act of 1964.

*Title VI prohibits the recipient from discriminating on the basis

of race, color or national origin in providing benefits or deter-mining participation in federally assisted programs. Airportlessees and concessionaires must covenant to the same conditionin their agreements with the sponsor.

The FAA Civil Rights staff has primary responsibility for moni-toring compliance of Title VI. During Fiscal Year 1980, the FAARegional Civil Rights staffs completed 321 reviews, including 11on-site visits. Although 67 reviews determined noncompliancewith Part 21 requirements, all but one of the noncompliant spon-sors subsequently achieved voluntary compliance and no review ledto the initiation of enforcement procedures. In addition,Airports Regional personnel conducted a total of 1,264 compliancefield reviews and found all locations to be in compliance.

(2) Section 30 of the Airport and Airway Development Act Amendment of1976.

In the past fiscal year the FAA issued a final rule implementingSection 30 at 14 CFR Part 152, Subpart E. The regulationprohibits discrimination on the basis of race, creed, color,

national origin or sex in any employment activity of the airportsponsor and the aviation related lessees and contractors locatedon the airport. The regulation also prohibits the airport spon-sor from discriminating on the basis of sex and creed inproviding services, benefits and accommodations to the public, inmuch the same way that Title VI prohibits such discrimination onthe basis of race, color or national origin.

Although compliance review procedures have not yet been

established, the Civil Rights staffs will have responsibility forassuring compliance with Section 30.

(3) Regulations of the OST 49 CFR Part 23 "Participation by MinorityBusiness Enterprise in Department of Transportation Programs.*

The OST issued a final rule setting forth requirements forparticipation of minority business enterprise (MBE) in contracts

let by recipients of financial assistance from the Department.The regulation prohibits discrimination on the basis of race,color, national origin or sex in the award or performance ofcontracts assisted in whole or in part by the Department.

Regional Civil Rights staffs gave preliminary review approval to

176 MBE programs. They also issued 55 notices of noncomplianceto sponsors for failure to submit a program or for deficienciescontained in the submissions. In no case was there initiation ofenforcement proceedings for failure to comply.

(4) Section 504 of the Rehabilitation Act of 1973.

Section 504 prohibits discrimination on the basis of handicap inany program receiving Federal financial assistance. Implementingregulations of the OST, 49 CFR Part 27, require recipients tomake certain existing and future facilities and programsaccessible to handicapped persons. In addition, the ruleprohibits employment discrimination by recipients againsthandicapped persons and requires recipients to make reasonableaccommodations to the handicaps of otherwise qualified employeesunless the accommodation would impose an undue hardship upon theoperation of the program.

(5) Age Discrimination Act of 1975.

This Act prohibits discrimination on the basis of age in programsand activities receiving Federal financial assistance. Itapplies to persons of all ages and permits some age distinctionsmeeting certain specific criteria in federally assisted programs.It does not apply to the employment practices of any employer. ANotice of Proposed Rulemaking was published by the Office of theSecretary, but a final rule has not yet been issued.

There is a complaint mechanism by which persons who believe they have beendenied one of the above guarantees may seek redress. Such complaints areinvestigated by the OST. In Fiscal Year 1980 the OST received twocomplaints against airport sponsors alleging discrimination in violation ofTitle VI; four complaints were filed under Section 504, and eightcomplaints were filed under the Minority Business Enterprise Regulation.In no case did the OST make a finding of discrimination against an airportsponsor.

(6) Executive Order 11246, as amended by Executive Orders 11375

and 12086.

When assistance under the ADAP is for construction, the primecontractor and its subcontractors having contracts in excess of$10,000 (or which aggregate to more than $10,000 in a 12-monthperiod) are subject to Executive Order 11246, as amended, andregulations of the Office of Federal Contract Compliance Programs(OFCCP) of the Department of Labor. The grantee is similarlycovered when it participates in the construction work. ExecutiveOrder 11246 prohibits discrimination on the basis of race, color,sex, religion or national origin against persons employed orseeking employment with federally assisted construction con-tractors and their subcontractors. Compliance with ExecutiveOrder 11246 and Department of Labor regulations is monitored by

the OFCCP.

SUMMARY DISTRIBUTION OF FUND AUTHORIZATION

FISCAL YEAR 1980

A summary follows of the distribution of funds authorized for fiscal year1980. The distribution was made in accordance with Sections 15(a)(3) and15(a)(4) of the Airport and Airway Development Act of 1970, as amended.

In accordance with Section 15 of the Act, funds apportioned to airportsponsors under the enplanement formula for air carrier airports which arenot obligated during the fiscal year for which they were first authorizedand the two fiscal years immediately following shall be added to the aircarrier discretionary fund. In addition, amounts apportioned to each stateunder the area/population formula for general aviation airports which arenot obligated during the fiscal year for which they were first authorizedand the fiscal year immediately following shall be added to the generalaviation discretionary fund.

Within these amounts, and subject to any annual obligational limitations,airport sponsors may plan airport development projects and request Federalassistance for the establishment of a nationwide system of public airportsadequate to meet the present and future needs of civil aviation.

For fiscal year 1980 the authorization was $667 million as shown in thetable below, but this amount was not available for grants since the fiscalyear 1980 obligational level was limited to $640 million in the Departmentof Transportation and Related Agencies Appropriation Act of 1980 (P.L. 96-131).
