SECTION 1. SHORT TITLE.3

This Act may be cited as the ‘‘Military Pay Protec-4

tion Act of 2013’’.5

SEC. 2. EMERGENCY APPROPRIATION OF FUNDS TO PRO-1

 VIDE PAY AND ALLOWANCES FOR MEMBERS2

OF THE ARMED FORCES AND SUPPORTING3

CIVILIAN AND CONTRACTOR PERSONNEL4

DURING GOVERNMENTWIDE SHUTDOWN.5

During a Governmentwide shutdown, the Secretary 6

of the Treasury shall make available to the Secretary of 7

Defense (and the Secretary of Homeland Security in the8

case of the Coast Guard), out of any amounts in the gen-9

eral fund of the Treasury not otherwise appropriated, such10

amounts as the Secretary of Defense (and the Secretary 11

of Homeland Security in the case of the Coast Guard) de-12

termines to be necessary to continue to provide the fol-13

lowing:14

(1) Pay and allowances (without interruption)15

to the following:16

(A) Members of the Army, Navy, Air17

Force, Marine Corps, and Coast Guard, includ-18

ing reserve components thereof, who perform19

active service during the funding gap.20

(B) At the discretion of the Secretary of 21

Defense, such civilian personnel of the Depart-22

ment of Defense who are providing support to23

the members of the Armed Forces described in24

paragraph (1) as the Secretary considers appro-25

priate.26

(C) At the discretion of the Secretary of 1

Defense, such personnel of contractors of the2

Department of Defense who are providing di-3

rect support to the members of the Armed4

Forces described in paragraph (1) as the Sec-5

retary considers appropriate.6

(2) Funding necessary to prevent interruptions7

or delays in the performance of domestic disaster re-8

lief and recovery operations.9

SEC. 3. GOVERNMENTWIDE SHUTDOWN DEFINED.10

In this Act, the term ‘‘Governmentwide shutdown’’11

means any portion of a fiscal year during which none of 12

the appropriation bills for the fiscal year have become law 13

and an Act or joint resolution making continuing appro-14

priations for the fiscal year is not in effect.15
