Between FY10 and FY15, Arizona experienced the largest increase in the number of children in foster care in the Nation. In Maricopa County Judicial caseloads for FY 14- FY 15 were 3x’s higher and number of children 4x’s higher than they were in FY 05.

3 Main Routes after Dependency
FAMILY REUNIFICATION
The parent(s) complete services offered by the State and are reunited with the child(ren). Or,
the Court determines that there is not a
dependency case need.
GUARDIANSHIP
The Court cannot reunite the family together,
however, there is a familythat can step in to care for the child(ren) for a period which can be
temporary or permanentplacement.
SEVERANCE
The Court makes a determination that the
family can no longer care for the child(ren) andcannot change those circumstances that brought the matterbefore the court,
therefore, the child(ren) may be adopted.

Title 14 Guardianships Any person interested in the welfare of a minor may petition the
Court for appointment of a Title 14 guardian
When someone other than the parent wants to be appointed bythe Court to take over parental responsibilities
Title 14 Guardianships are not part of a dependency action
Kin and Relatives of the minor usually file petitions forguardianships
Currently over 13,000 children in Maricopa County are active under Title 14 Guardianships

On August 12, 2005, an Arizona law went into effect that permits minors who are at least 16 but not yet 18, to apply to be emancipated or to be declared legally an adult
The minor must prove they are financially self-sufficient, able to provide their own food, housing and medical care without parental assistance

relative adoptive parent is suitable to adopt in addition to presiding over Adoption hearings
In 2014, an Adoptions Unit was created in an effort to improve case processes, case flow efficiencies, and customer service

Mental Competency and Restoration
A Rule 11 Mental Competency may be court ordered to determines whether or not a juvenile understands the process of the court
A Rule 11 is not a psychological evaluation
The juvenile will be found to either becompetent, incompetent but restorable, ornot competent - not restorable
If a juvenile has been found incompetentbut restorable, a restoration provider isassigned to “teach” the juvenile about what happens during the court proceedings
During the restoration process, the juvenilemay be found competent or not competent

The Juvenile will be given a minimum length of time to be housed at the facility, not to exceed their 18th birthday. They will receive schooling, counseling as needed and will be released upon the Dept. of
Corrections determination.
