TII PROJECT ACTIVITIES Activities supported by The UK Prosperity Fund

Seminar in Collaboration with ICFAI Business School, December 23, 2016, Dehradun Transparency International India (TII) organized seminar in collaboration with ICFAI Business School on “Combating Corruption through Collective Action” on December 23, 2016 at The ICFAI University, Dehradun, Uttrakhand. Shri Anil Kumar Raturi, IPS, Vigilance Director, Vigilance Establishment Uttarakhand, Dr. Pawan Kumar Aggarwal, Vice Chancellor of ICFAI University, Dehradun, Shri A.K.Jain from Transparency International India and Prof. Raghvendra Sharma, ICFAI Business School shared their views on mentioned topic during the seminar. Dr. Aggarwal said that “corruption through policies kills economy and justice delayed is justice denied. So sooner we fight corruption better will be the future.” While delivering Introductory remarks Shri A.K. Jain, said, “Corruption should be fought strongly and it should be eliminated rather than reduced.” He mentioned that PIL (Public Interest Litigation) and RTI (Right to Information) are very strong weapons against corruption. These tools force even the highest of the authorities to answer their action. He quoted the example of Reliance and BHEL where PIL was used against them. Shri Anil K. Raturi, mentioned in his opening statement that, “Corruption begins from us. As the charity begins from home similarly corruption begins from us. It is not a quantum, but its tendency.” He further said that ethics, moral and legality combine together to fight corruption. Transparency International India (TII) in collaboration with Jammu and Kashmir Right to Information (JKRTI) Movement organized seminar on ‘Combating Corruption through Tools of Good-Governance’ at Public Administration and Rural Development (IMPA) M A Road Srinagar on February 28, 2017.

Chief Guest Justice Bashmir Ahmad Kirmani, who is also member of state accountability commission, said Corruption deeply, rooted in JK; need to curb it for future generations. People have lost spirituality.

The daylong seminar was attended by RTI activists, local entrepreneur and members of civil society.

Shri Zaffar Iqbal, Member of Transparency International India from valley, while sharing his experience in the anti corruption work, said that the transparency in each government department is missing. Executive Director, Transparency International India, Rama Nath Jha, briefed the audience about TII, history and present work of organization. He urged for strengthening of the anti-corruption

Patna Consultation

February 19, 2017: A consultation on the theme of ‘Combating Corruption through Tools of Good Governance’ was held in Patna.

Consultation at Sikkim University

February 22, 2017: A discussion was held with Law students at Sikkim University at Gangtok, Sikkim. The discussion focused on shortcoming of the present Prevention of Corruption Act and how adequate changes can be made in the present Act by adopting some provisions from UK Bribery Act and FCPA.

CIDCO signed a Memorandum of Undertaking with TII for training their staff and vendors on public procurement and Integrity Pact.

Training Program organized for the senior officials of Shipping Corporation of India on theme of “Best Practices in Public Procurement and Integrity Pact” on 6th April 2017 at Maritime Institute, Mumbai. The special invitee for the training program was Mr. S. S. Hussain, Independent External Monitor, SCI. The trainers for the program were Mr Anup Mehra, Former Director (Commercial), MOIL Ltd, Mr. Vivek Mehrotra, Former Secretary, Ministry of Minority Affairs, GOI. The training was attended by over 40 senior officers from SCI

Training program for the CIDCO staff, April 7, 2017, Mumbai For the first time after the Real Estate Regulation Act was passed in 2016, TII conducted a dedicated training program on the new Act for the staff of CIDCO on April 7,2017 at Mumabi. The trainers were Mr. M.P.Juneja, Former CTE, CA. Ramesh Prabhu, RERA Specialist and Ms. Jot Prakash Kaur, TII. Topics like Public Procurement and Integrity Pact during the training program were also included.

National Seminar organized by TII-Kerala Centre on the theme of “Transparency in Public Procurement” on 29th April 2017 at Kochi. Shri E. Review of Integrity Pact Contract as per the latest Standing Operating Procedure (SOP) issued by the CVC

Integrity Pact Cell reviewed the Integrity Pact document/template of the Shipping Corporation of India as per the latest Standing Operating Procedure (SOP) issued by the CVC and sent compiled suggestions.

Complaint movement received from Vendors of PSUs to concerned Authorities

Integrity Pact Cell received few complaints from Vendor of PSU under Integrity Pact. The Same have been forwarded by TII to the competent authority for further action.

Training Programme for the Sr. Official of Bharat Electronics Limited, 22-26th August 2017 at Ghaziabad Transparency International India (TII) hosted five-day training programme on 22 – 26 August 2017 with Bharat electronics Limited (BEL), Ghaziabad Unit, Uttar Pradesh. Training Programme for the Vendors of CIDCO, 21th December 2017 at Navi Mumabi TII organized Training Programme on “Integrity Pact” for CIDCO Vendors on 21st December, 2017 at CIDCO Auditorium, CIDCO Limited, Navi Mumbai. Shri A.K. Mehra, IEM, SAIL and former Commercial Director, MOIL and Shri V. K. Jain, Former ED, Air India and Member, IIMM, were the distinguish Speakers.

Project - ALAC

Complaints received during January to August During the December 2016 to Nov. 2017, a total of 126 initial contacts/complaints were received at Delhi through ALAC Helpline and email. The victims directly lodge their complaints on helpline number and these complaints are followed up by ALAC team. ALAC team successfully closed cases of corruption and citizen’s grievances. Some of successful interventions are being furnished below:

• ALAC wing of TI India received complaint on Anti Corruption helpline against SHO of a Police Station and local NDMC officers regarding harassment of a petitioner for Teh Bazari. The matter was taken up with appropriate authorities.

• ALAC wing of TI India received complaint on Anti Corruption helpline against Police inaction regarding dowry case from Ms. Sweta Devi. The matter was taken up with appropriate authorities and letters were wirtten to competent authorities.

• ALAC received complaint from Shri Manish Gohel, Employee, Gujarat Gas Limited (GGL) through an e-mail dated Jun 11, 2017 alleging the corruption in Gujarat Gas Limited. Our Executive Director, Shri Rama Nath Jha wrote letter to Chief Vigilance Officer of Gujarat Gas Limited to take appropriate action against guilty.

• ALAC received complaint on our helpline number (011-26232323) from Shri Prasad regarding non increment of grade pay and submitted RTI drafted by TII.

• ALAC received a complaint from Shri Hari Sankar Rout, Secretary, Social Welfare Agency & Training Institute (SWATI), Orissa through an e-mail dated June 8, 2017

against the Odisha PVTG Empowerment and Livelihoods Improvement Program (OPELIP) regarding selection of NGO for partnership of OPELIP for Micro Project, KKDA, Kandhamal. It is alleged that the selection was not fair and transparent. It is further alleged that selected organization was nor competent neither having any field presence in the district nor experience in the livelihood. Our Executive Director, Shri Rama Nath Jha wrote a letter to Central Vigilance Commissioner, CVC to take appropriate action.

• ALAC Team received complaint regarding the admission of 5 students in Jawahar Navodaya Vidyala Samiti (JNVST) in Jharkhand; the matter is forwarded to C.B.S.E & JNVST Commissioner.

Success Story 1. Shri Ramesh*(Name Changed) was working as Operation Manager in reputed organisation M/s

Shanti Travels Ltd. One day Mr. Ramesh got his termination letter without any prior notice & reasonable cause. Even after the termination he did not received his legitimate salary and other benefits. After that, he approached ALAC wing of Transparency International India with his problem. Shri Pankaj Kumar With the help of Executive Director, TII drafted legal notice and also filed a petition in Labour Court. After duly follow up Mr.Ramesh got favourable outcome.

2. ALAC team received a complaint from M/s Khan & Co. alleging that their claim is delayed for unjustified reason by officials at The Oriental Insurance Company Ltd.

After the careful perusal of the above complaint our legal team believes that the above

mentioned case has not been appropriately pursued by the officials of The Oriental Insurance Company Ltd. We took up the matter and wrote letter to competent authority of the organisation to expedite the process as per law.

Shri A. K. Jain, Treasurer, Participated in RTI Training program at Ranchi Five day training program organized on Right to Information (RTI) Act and Transparency at Srikrishna Public Training Institute, Ranchi. Shri A. K. Jain shared his experience and views on RTI as an activist. Dr. Vishu Rajgadia, Secretary, Jharkhand Centre of TII also shared his views. Suggestions sent to DoPT for RTI The Department of Personnel and Training, Government of India has invited comments/suggestions on a new set of draft rules to implement The Right to Information Act 2005. TII made some suggestions in a tabular form and sent to DoPT.

Workshop on Tools of Good Governance Transparency International India organized a Workshop on Tools of Good Governance at Bihar Chamber of Commerce & Industry, Patna on 22 July 2017. Shri A.K. Jain, Treasurer, TII, Shri Ashok Kumar Singh, Social activist, Shri Pankaj Kumar, Director (ALAC & PAHAL) and Shri Brij Bhushan Singh, Project Manager (IP & PAHAL) are the key speakers in this workshop. It was attended by more than 70 youth volunteers/students.

Project PAHAL TII received financial support and project approval to implement the project “Promoting Good Governance and Fighting Corruption through Multi-level Interventions in Bihar & Jharkhand” from India Development and Relief Fund (IDRF). Project aimed at raising awareness of the poor, marginalized & illiterate peoples about their legal rights, entitlements and promoting the tools of good governance in the state of Bihar & Jharkhand.

Base Line Survey: For the implementation of the project “Promoting Tools of Good Governance & Transparency through multiple interventions in state of Bihar and Jharkhand” under the project PAHAL, TIIs team conducted a Base Line Survey in the four District of Bihar namely Begusarai, Darbhanga, Madhubani and Sheohar and Jharkhand namely Deoghar, Koderma, Ranchi Rural and Sahibganj in September-October 2017. A baseline survey is the starting point for monitoring so that later changes in its attributes can be measured. This provides a marker with which status in future date can be compared. Perhaps the most important and challenging task during base line survey was developing questionnaire including questions that accurately measure the opinions, experiences and behaviors of the rural citizens. A questionnaire was prepared with the help of partner NGOs and CBOs to know the actual status of the schemes of the state government. In this Survey, TII team noticed that villagers are positively participating in this survey and share own views on all issues.

Volunteer: For the effectiveness, implementation & smooth operation of the project, local volunteers act as back bone of Project Pahal. For induction of volunteers, TII official interacted with local students of University/Colleges. Two volunteer induction programs especially for those pursuing careers in the field of Social work were organized. Many volunteers joined and later training program has been conducted for them on various tools of good Governance. Shri Raj Kumar John joined TII as full time Volunteer Coordinator.

Literature review of Good Governance Schemes of the Bihar & Jharkhand: List of Good Governance Schemes as implemented in Bihar & Jharkhand and related books and other references are reviewed. We have also collected working procedures and directives of government departments on various schemes of State Govt.

Meeting at Local Level in Bihar & Jharkhand: Selected volunteers and Pahal team visited in project intervention areas of Bihar & Jharkhand to understand issues emerging at grassroots’ level. At Panchayat level, the team held many meetings with Mukhiyas, Sarpanchs & elected representative of PRIs. During interaction, TII team shared basic information about TII and Pahal project. Helpline number was shared with the people so that they can share difficulties faced by them to get their entitlements

Meeting at Patna University: Pahal team visited Patna University, Patna & shared information related to vision, mission and overall goal of TII and project Pahal with head of the departments of college and students of Patna University especially students of the Bachelor of Social Work (BSW) & Master of Social work (MSW). We motivated them to become Volunteer and join TII to fight poverty, inequalities and improve the living standards of poor people.

IEC Material: IEC materials (Passbook of entitlement) is developed to increase awareness and understanding among the rural population about local development schemes, entitlements & their rights and the importance of availability/accessibility of information for participation in local governance as it will generate a sense of ownership and understanding amongst them.

Vigilance Awareness Week 2017

Theme My vision-Corruption Free India Like every year, Central Vigilance Commission in its endeavor, observed Vigilance Awareness Week from 30th October to 4th November 2017. This year CVC has decided the theme “My Vision-Corruption Free India”. Transparency International India requested many Public Sector Undertakings (PSUs) for Joint Outreach Program. TII received invitation from many PSUs for delivering a lecture on different issues during the Vigilance Awareness Week. Adml. (Retd.) R. H. Tahiliani Memorial Lecture

TII,been besides normal activities has been, organizing Annual lecture since 2009, with a view to creating discourse on problems and engaging intellectuals and active citizens in the movement. TII also released its souvenir on 20th year of TIIs impactful existence. TII organized Adml. (Retd.) R. H. Tahiliani Memorial Lecture on January 29, 2017. Lecture delivered by Justice G.S. Singhvi, Former Judge of Supreme Court of India & Chairperson of the Competition Appellate Tribunal.

With the passing away of revered Admiral R. H. Tahiliani, former Chairman and Mentor of TII, the annual lecture was held in the memory of Admiral Tahiliani.

Engagement with the Government

Meeting with Indian Railway

A discussion was held at the Rail Bhawan with Shri Sunil Mathur, Chief Vigilance Officer and departmental heads of Indian Railway and TII team was represented by Mr. P S Bawa, Advisor, Mr. Rama Nath Jha, Executive Director, Mr. Pankaj Kumar and Ms Jot Prakash Kaur, Project Directors, and Mr Brij Bhushan Singh, Program Manager. The meeting explored ways in which Railway could improve their ethical quotient. Apart from the possibility of introducing the tool of the Integrity Pact in procurements, the meeting focused on introduction of new technology to publicize information about hotlines of railways and sensitization of the public. TII extended all assistance regarding training and operation of the IP.

Meeting with Punjab Vigilance Commission, December 27, 2016

Transparency International India’s representative, Ms Jot Prakash Kaur, Project Director, Integrity Pact and CSF had a brief meeting with Mr. A S Rai, Inspector General of Police, Vigilance Bureau, Punjab, to explore possibility of collaboration between TII and Punjab State Vigilance Commission to forward the good governance agenda in the State.

UN Anti-Corruption Day

Every year December 9 is observed as the International Anti-Corruption Day, marked by the United Nations. TII observed the UN Anti-Corruption Day by organizing like debate, discussion, cartoon/painting competition, slogan writing, oath taking at Balwantray Mehta Vidya Bhawan, GK –II, New Delhi. Shri I. C. Srivastava, IAS (Retd.) Chairman, TII, was the Chief Guest of this Programe and other distinguished guest were Shri M. N. Krinshnamurthy, Board member, TII, Shri Omkar Razdan, Former Board Member, TII and Shri S. Ghosh.

• Shri I. C. Srivastava, Chairman, TII, addressed International Conference on Striking the Right Balance: Integrating Ethical Business Practices on 21st February, 2017 at New Delhi in ITC Maurya jointly organized by CII in partnership with International Anti Corruption Academy (Vienna,Austria).

public procurement policies in Infrastructure Sector in India Real Estate Regulatory Act 2016 of India has been passed with an aim to create a regulatory body for this enormous infrastructure sector that has until now, been unorganized & unregulated.

Public Procurement Policy in Infrastructure Sector This manual is meant to act as a guide for better understanding of the current public procurement policies in infrastructure sector in India. The publication, by the way of analyzing the policies, aims to provide an insight about the current situation and by way of highlighting risks in public procurement practices, makes recommendations to implement best public procurement policies. This manual should not be seen as exhaustive and is intended to inform the varied public procurement policies of the government for infrastructure sector. It analyzes the Public Procurement Bill, 2012 and lastly lists out important Supreme Court cases relevant for public procurement policies in Infrastructure sector.

State Chapter Activities Rajasthan Centre

• HCM Rajasthan State Institute of Public Administration, a State government institute for senior officers of Rajsthan State, invited Shri J. K. Sachdeva, IAS, (Retd.) on December 14, 2016 for discussing the role and duties of PA under the provisions of RTI, Act. The programme was attended by around 23 senior officers from various departments including PHED, Irrigation, JVVNL etc.

• HCM Rajasthan State Institute of Public Administration, a State government institute for senior officers of Rajasthan State, invited Shri Alok Kulshreshtha, retired Senior Executive of Nationalized Bank and life member of TII on December 15, 2016 for discussing the role and duties of SPIO under the provisions of RTI, Act. The programme was attended by around 23 senior officers from various departments including PHED, Irrigation, JVVNL etc.

• On December 17, 2016 Shri I.C. Srivastava, Chairman, TII addressed students & faculty at Rajasthan University Law College in a seminar on Reforms in Judiciary presided by Shri P. C. Jain Judge Rajasthan High Court ( Retd.). The seminar was attended by around 45 participants.

• On December 28, 2016, State Institute of Health and Family Planning invited Shri JK Sachdeva to discuss salient features of RTI Act with around 25 doctors of various hospitals and dispensaries. The participants were highly appreciative of the programme as most of the doctors were unaware of the provisions of the Act.

• On 30th April 2017 The Annual general meeting of TII - Rajasthan Center was organized at Hotel Ratnawali and in an Unanimous election new management committee was constituted. Justice S.N. Bhargava, Former C.J. Sikkim High Court – Patron, Shri I.C. Srivastava, IAS (Retd)– Patron, Shri G.S. Hora, Former Law Secretary, Rajasthan – Chairman, Shri J.K. Sachdeva, IAS (Retd) & Shri Rajendra Bhanawat, IAS (Retd) - Vice-Chairman, Shri S.S. Bissa, IAS (Retd) – Secretary General, Shri V.K. Singhvi – Secretary and Shri Alok Kulshrestha – Treasurer.

• On 1st June TII- Rajasthan Centre, Vice-Chairman Shri Rajendra Bhanawat delivered a lecture to 2016 Batch IAS officers of Rajasthan Cadre at HCM Rajasthan State Institute of Public Administration (OTS) about various rules and responsibilities, how the discharge the same effectively by working in the transparent manner.

• On 6th June Shri Rajendra Bhanawat, TII-RC Vice-Chairman addressed officers responsible for Urban Governance at OTS. The topic was Team Building and Motivation.

• A two-day seminar (21-22 June) was organized by Indian Institute of Public Administration in Co-ordination with Transparency International India-Rajasthan Centre at Prakrit Bharati Academy Seminar Hall.

o On 21st June the subject was “The United Nations Performance and Future” on which Shri R.K. Huda, Retd. IPS, former DGP, Rajasthan & Haryana & Visiting Professor in American Universities Chief Speaker delivered a thought provoking lecture.

o On 22nd June ,TII Chairman Shri I.C. Shrivastava delivered the lecture on Ethical Values and Success Mantras, TII- Rajasthan centre chairman Shri G.S. Hora also addressed the audience on moral values in life. Chapter Secretary Shri V.K. Singhvi & Shri H.L. Chauhan & other members were also present, more than 150 participants actively participated in the seminars.

• On 27th June 2017 at Rajasthan High Court, TII Rajasthan Centre Chairman Shri G.S. Hora addressed Para Legal voluntaries on communication skills, observation, listing & drafting skills with specific emphasis on ethical and moral values.

• Shri G.S. Hora, Chairman, TII Rajasthan centre Vice-Chapter Shri J.K. Sachdeva and Shri Alok Kulshrestha, Treasurer met Shri Suresh Choudhary, Chief Information Commissioner, Rajasthan in his office to explore the possibility of Co-ordination and Co-operation in creating awareness about RTI Act.

• On 29th June 2017 Shri Rajendra Bhanawat, Vice-Chairman,TII Rajasthan Centre and Shri Alok Kulshrestha addressed a group of officers from Bhutan, at Jaipuria Institute of Management on various aspects of team building and leadership in organization particularly on ethics & Integrity.

Glimpse of TII Rajasthan Centre’s Activities

Uttar Pradesh Centre

• Annual General Meeting of U.P. Centre of TII was held on March 15, 2017. Chairperson Justice Kamleshwar Nath gave a brief account of the working of TII and about the projects of the UP Centre.

• TII-U. P. Center noticed that many MLAs/MPs have been re-elected dispite charges of Criminal cases of heinous crimes, pending before their earlier term, are still pending against them. It was also noticed that some cases under non-compoundable offences have been compounded. U.P. Centre has taken up the matter regarding cases with High Court of Allahabad by letter dated 23rd May 2017 and regarding functioning of Investigation and Prosecution with the State Government by letter dated 30th June 2017.

• In spite of efforts made earlier none of the State PSUs opted for Integrity Pact. Integrity Pact being a strong tool to curb corruption, U.P. Center decided to take up the matter, afresh, with the new State Government.

• On 14th June, 2017 Shri P.S.Bawa, Advisor TII, wrote letter to Justice Kamleshwar Nath, TII UP Centre Chairman regarding

• corruption prevailing In Lucknow Jail. Chairperson TII UP Centre forwarded the same to IG Prisons Sri P.K.Mishra for necessary action. IG has confirmed telephonically that action was taken promptly and Superintendent Jail and some staff had been transferred.

Kashmir Reader Bureau Chief felicitated by Transparency International India

Srinagar: Transparency International India on Tuesday felicitated Kashmir Reader Bureau Chief Moazum Mohammad for his work on public issues, especially RTI, corruption and stories about the victims of unexploded explosive shells at the erstwhile Tosamaidan firing range. The felicitation was given away by Justice (Retd) Bashir Ahmad Kirmani at the IMPA in presence of Transparency International India executive director Rama Nath Jha and Commonwealth Human Rights Initiative coordinator Venkatesh Nayak.

Besides these issues, Moazum did a slew of exclusive stories for Kashmir Reader on issues ranging from Sainik Colonies to government employees working part time in state-run media organizations. Moazum has also reported on media issues for media watchdog Hoot and other reputed news organizations like Caravan magazine.
