2006, we served some i n t e r roga to r i e s and a Request

for Product ion on Mr. Gi l l esp ie . We d i d n t

5 treceive a response. On May of 2006, I sent an

e-mai l to Mr. Gil lesp ie advis ing him t ha t the

in te r roga tor ie s were overdue and it s our good-

f a i t h e f fo r t to t ry to resolve it. Fina l ly a week

ago, on June 21 s t 2006, very untimely, we

rece ived responses to the i n t e r roga t o r i e s and a

response to the Request for Produc t ion and a

number of object ion to each but , of course ,

untimely object ions to discovery are waived under

13 i n t e r roga tory answers and t ha t did not happen.

14 So, what we r e seeking today i s an order , Your

15 Honor, compell ing him to respond to the

16 i n t e r r oga to r i e s without the ob jec t ions and for

17 a t t o rn e y s fees . He r a i sed a number of ob jec t ions

18 on pr iv i l ege and t h e r e s some debate, I be l i eve ,

19 st ll in the appe l l a t e cour t s about whether

2 pr i v i l e ge s can be waived by not t imely objec t ing .

21 But regard less of whether they can or cannot , he

d i d n t provide a pr iv i l ege log as r equ i r ed by

23 Flor ida Rule of Civ i l Procedure 1.280 (b) (5) .

4 As fa r as the i n t e r r oga to r i e s , in a number of

25 the answers he says he was r e ly ing on Flo r ida Rule

of Civ i l Procedure 1.340, sub paren C, which, as

2 Your Honor knows, i s the opt ion to produce

3 records . The only problem was, he d i d n ' t produce

4 any records , d idn ' t make any ava i l ab le to us and

5 d i dn ' t point to us in these unproduced o r

undeclared records where we could f ind the answers

7 to i n t e r ro g a t o r i e s . Ins tead , h is response was,

8 You have these records , and he says we have them

9 from rep re sen t ing him in the pas t . But I would

1 poin t out to the Court two th ings : F i r s t o f a l l ,

11 t h a t ' s not proper procedure under Rule 1 .340(c ) ;

12 you can ' t j u s t say, you a l ready know , t h a t ' s not

13 the way you respond. And second, our

14 r ep resen ta t ion of him ended some four or f ive

IS years ago. So, whatever has happened the l a s t

6 four or f ive years , we c e r t a in ly have no idea

17 about . So, hi s responses are de f i c i e n t in t h a t

18 regard .

19 Now we've a l so moved to con t inue h i s August

4 MR GILLESPIE: Good af te rnoon, Judge. I did

5 respond to the defendant s Request for Product ion.

6 Attached i s a - - to my p l a i n t i f f s Motion for an

7 Order of Protec t ion , Exhibi t 3. I address each

area of product ion. This i s in reply to

9 defendan t s Request for Product ion. They were

1 demanding tha t I come to t he i r of f i c e on May the

4U, 2006 a t 9:00 a.m. I objec ted to t h e i r

12 reques t and I t o ld him I wi l l not appear i n h i s

13 of f i c e for any reason due to h is t h r e a t s aga ins t

14 me. And Judge he has asked for a b a i l i f f to be

15 here; for him to ask me to come to h i s of f i ce , I

16 th ink , i s outrageous.

17 I offered to - - in the a l t e rna t i ve , I of fe red

18 to respond to h is reques t by mai l ing copies of the

19 i tems requested subject to ob jec t ion by May 15 t•

20 He never responded to t h i s o ther than to f i l e h is

21 Motion to Compel. And with regard to the

22 in te r roga tor ie s , I gave him the same answer I

23 wil l provide the answers subject to ob jec t ion by

24 May 15 t; again he did not respond to t ha t o ther

25 than to f i l e a Motion to Compel. And he f i l ed

tha t Motion to Compel before May 15th

• So, when

2 he did tha t , I took tha t as a cons t ruc t ive

re jec t ion of what he was offe r ing - - of what I

4 of fe red him and, therefore , I j u s t responded to

5 his Motion to Compel with t h i s l e t t e r o f

6 pro tec t ion and the responses are a t t ached .

7 I also noted tha t he has - - a l l the i tems

8 requested to which you are e n t i t l e d by way o f your

9 pr i o r r ep resen ta t ion of me. Now Mr. Rodems has

1 t o ld the Court t ha t t h i s was four or f ive years

11 ago and t h a t s t rue , but nothing pe r t i ne n t to t h i s

12 case has happened dur ing t ha t t ime. The mat te r s

3 t ha t he knows about involve fraud and breach of

14 cont rac t are from t ha t t ime per iod .

15 I m asking the Court in my Order of

6 Protect ion to l imi t t he i r tha t the records

7 asked to be produced are kept in Ocala . I f Mr.

18 Rodems wants to view them because he r e j e c t e d my

19 of f e r to send copies , then he can view them a t the

2 Marion County Law Library upon not ice to me. And

21 the law l i b r a ry has f ac i l i t i e s t he re to copy the

22 documents for Mr. Rodems. It s a l so a secure

23 f a c i l i t y with a ba i l i f f present as i s requ i red

24 here .

25 As to the discovery where I invoke the

a t torney-c l ien t pr iv i l ege , I m going to ask t ha t

2 t ha t discovery be prohib i ted . He s asked for my

3 medical records which bear nothing on t h i s case

4 whatsoever. I v e asked - I v e invoked the

5 doc to r -pa t i en t p r iv i l ege and asked for t ha t

6 discovery to be prohib i ted .

7 As to the discovery I objec ted to , I ask the

8 Court to proh ib i t t ha t discovery and to r e ly on

9 the records under Rule 1.340(c) , opt ion to produce

1 records . The records are a l ready in t h e i r

possess ion and, spec i f ica l ly , those records are

12 the answers to i n t e r roga to r i e s in two cases : That

3 would be the Amscott lawsui t and the Ace l awsu i t .

14 The discovery for produc t ion of documents in those

15 lawsui ts , a depos i t ion on May 14 2001,

16 se t t lement on October 30 t and November p o f 2001

17 and another depos i t ion on October 10 lh 2000 and

18 another se t t lement on June 12 t 2000. I fee l

19 t ha t they have every th ing t ha t t h e y r e e n t i t l e d

20 t o .

9 about t he i r Motion to Continue Summary Judgment.

18 followed, but he cont inues to repeat it in every

19 plead ing and then, you know, the idea i s t ha t , I

20 guess, i f you ve got j ud i c i a l immunity from what

21 you say - - but the bottom l i ne i s , i s t h a t t h e r e s

22 been nothing but cord ia l behavior on our par t .

23 We ve asked him to send the records to us . He s

24 phras ing t h i s record - - the l e t t e r of Apr i l 29 th

2 records . He's the one tha t asse r t ed he would send

l a t e . He f i l ed no object ions , he did not f i l e a

5 Motion fo r Continuance, he did not ask me for a

6 cont inuance, he did not f i l e a Motion for

7 Pro tec t ive Order. He j u s t did not do anyth ing

8 un t i l a week ago, knowing t ha t t h i s hear ing was

9 the books by t ha t t ime.

1 As fa r as his argument the records are in our

possess ion, we are en t i t l ed to discovery in t h i s

12 case of the mat te rs t ha t he has. I f he has

13 records tha t he says we can gather a l l the answers

14 t ha t we're seeking, h e s got an ob l iga t ion to

15 produce those . He can t j u s t say, you have them N

16 or you know the answer N; t h a t s not a proper

17 discovery response .

18 We're in a s i t ua t ion here, Judge, where Mr.

19 Gi l l esp ie i s not fol lowing the Flor ida Rules of

2 Civ i l Procedure. And so we're here saying, look,

21 the ru les say 3 days to respond; i you choose to

not respond for severa l months and u n t i l a week

23 before the hearing, you know, we have - - we re

24 e n t i t l e d to have the ru les complied with by Mr.

25 Gi l l esp ie . And we would ask you to ru l e h i s

objec t ions unt imely as the case law h o l d s , o rd e r

2 him to prov ide the d i scovery . And if you want to

3 s e t a spec ia l procedure for how he can produce the

4 records to us, I d o n t have any problem with t ha t ,

5 but t h a t d o e s n t excuse f a i l i n g to respond to the

6 Request for Product ion u n t i l a week ago or the

i n t e r ro g a t o r i e s un t i l a week ago.

9 THE COURT: Jus t a moment. Mr. Rodems,

1 address the i ssue of the l oca t ion of p roduc t ion in

t h i s s i t u a t i o n where y o u r e ask ing p ro d u c t i o n from

2 the p l a i n t i f f and y o u r e ask ing for it to be

3 produced in Hil lsborough County.

14 MR RODEMS: Well , the - he brought the case

5 in Hil lsborough County, Mr. G i l l e s p i e d id . And we

16 t h ink it s ap p ro p r i a t e s ince t h i s i s - obviously

7 hear ing t h i s case in Hil lsborough County, we t h ink

18 it s appropr ia te to have the records t h a t we ve

9 reques ted produced here . I f he wants to charge us

2 15 cen t s a page, if the records d o n t exceed 1,000

2 pages , w e l l be happy to pay 15 cen t s if he can

22 send us cop ies . I have no o b j e c t i o n to t h a t as a

THE COURT: As to the produc t ion , the Rule

12 1.340(c) wil l apply , Mr. Gi l l esp ie , if

13 appropr ia te , as to records t ha t are in your

14 possess ion and kept in the ordinary course of your

record-keeping. I bel ieve you wil l f ind if you

16 research tha t ru le and the terms of the ru l e t ha t

17 tha t permits the opposing party to i n spec t those

18 records as they are kept, In the l oca t ion t ha t

19 they are kept. So, you have the a l t e rna t ive to

comply in tha t manner. In some of your responses ,

21 I th ink you suggest tha t tha t i s not acceptable to

22 you, but I m j u s t t e l l i ng you tha t i s one of your

23 opt ions . I t i s not an opt ion tha t records kept in

24 someone e l s e s possess ion , whether it i s the

p la in t i f f , the defendant or a co-defendant or co

p l a i n t i f f , it i s a r i g h t t h a t e x i s t s only as to

2 the pa r ty d i r e c t l y responding. So you must

respond to t h e Request for Product ion e i t h e r by

4 as I say making those records a v a i l a b l e wherever

5 they are kept in your possess ion; you can make

6 co p ies o f them sub jec t to p r i o r agreement of the

7 p a r t i e s as to volume co s t and t h e l i k e , which i s

R t y p i c a l l y done; or you wil l have to produce them

9 in Hi l l sborough County.

23 cont inuance, I would need t ime to complete the

24 discovery. So, i f Mr. Gi l l esp ie can coopera te

25 with me in ge t t ing a hear ing scheduled with in the
