With the increasing awareness about human rights, the prisons are, oflate, getting the attention they deserve. There has been a change in the perceptionof the society towards prisoners but it is not changing towards prison officials.Most of the training programmes organized before for the prison officers werefocused on the human rights issues or on other aspects of prison. No seriousefforts for the skill development of the officers have been taken so far. If theofficers who are running the jails are all the time under pressure and living astressful life then the effect of this will certainly be on the system.

I am very happy to host “2nd All India Training Programme on PresonalityDevelopment for Prison Officers” from Ist - 10th June, 2009. In fact Personalityis the image of one self and how we cut across others in society. Personality iswhat we perceive in our mind. What is inside, the thoughts or the conflict insidecontributes greatly to our physical appearance too. There is a certain image thatwe hold of ourselves and that is what is projected outside. Personality thereforeis what you are and it's your identity. I hope that this Training Programme onPersonality Development for Prison officers will certainly bring some positivechange in their personal and Professional life. BACKGROUND

The first training programme for the prison officers on personalitydevelopment was organized from 17th to 25th May, 2008. In fact this was the firsttraining programme for the prison officers organized by Dr. Ram Manohar LohiyaNational Law Univerity,Lucknow. The success of theprevious years experimentgave the chance to train moreprison officers from all overIndia. The Draft National Policyon Prisons and CorrectionalAdministration prepared bythe Bureau of Police Researchand Development, Ministry ofHome Affairs, Government ofIndia, New Delhi, 2007,provides for training of prisonpersonnel so as to build up a cadre of officers who possess appropriateprofessional and attitudinal orientation. The Draft National Policy enumeratesareas like physical fitness, development of communication skills, effective workingwith individuals and groups and government, knowledge the of rule of law, etc.This training programme was organized on the guidelines of the Draft NationalPolicy on Prison Reforms and Correctional Administration which contains the

provisions for Staff Trainingon PersonalityDevelopment based on thefindings andrecommendations of theresearch studies conductedby the Bureau of PoliceResearch and Development.This training programmewas organized for threedifferent batches and theprogramme was for threedays for each batch.

PURPOSE

Prison occupies a uniqueposition in society, as it is thefinal repository for the society’sfailures, of those persons whoare labeled as losers andtemporarily or semi permanentlyor permanently irredeemable.Pandit Jawahar Nehru, the firstPrime Minister of Indiaobserved that the fact must berecognized – that a criminal is largely created by social conditions and, insteadof being punished has to be treated, ‘and one is required to be treated for adisease. Mahatma Gandhi, the father of the Nation also expressed the ideathat “Crime is the outcome of a diseased mind and prison must have anenvironment of hospital for treatment and care’. His philosophy guides theworking of the prison departments in our country. One cannot imagine thissociety without this institution. In recent times, there is an inherent need tofocus our attention towards the Prison Administration and with this motive Dr.Ram Manohar Lohiya National Law University organized a training programmefor prison officials on personality development. The purpose to hold this trainingprogramme was to identify the lacunae present in the policies and programmes

of the prisons and to find theprobable solutions. As the aimwas to pave the way for theseofficials to develop theirpersonality in such a way soas to resolve their stressesand better manage theresources available to them,the stress was more onholding interactive sessionsof the participants.



OBJECTIVES

The PersonalityDevelopment Programme forthe Prison Officials organizedby the Dr. Ram ManoharLohiya National LawUniversity (sponsored by theBureau of Police Researchand Development) hadformulated certain objectiveswhich go as follows:

� To check and carry outsensitization of Prison Officials

� To identify the problem areas and deal with it efficiently

� To encourage effective communication

� To build up a positive attitude and deal with the work pressure

� To know oneself then to know others

� To manageTime and Stresseffectively

� To broadentheir vision and increasetheir sensibility tohumane aspect of prisona d m i n i s t r a t i o n ,including human rightsof prisoners and prisonstaff.

� To developtheir faith in the

contemporary canons of correctional philosophy.



PLAN OF THE TRAINING PROGRAMME

Three training programmes of each of these of three-day duration, wereorganized by Dr. Ram Manohar Lohiya National Law University, Lucknow fromIst June – 10th June, 2009 for the training of senior prison officials from differentstates.

The main emphasiswas on the personalitydevelopment of theparticipants rather than theusual training programmeswhich are conducted allover the country. It was anexperiment of its own kindwith a view to introducecertain innovative changesin the methodology andorientation of the othertraining programmes organized at the instance of the Bureau of Police Research& Development, New Delhi training and we hope it would pave the way forfuture trainings on the same lines. In this connection support and advice givenby Dr. B.V. Trevedi, Deputy Director, Bureau of Police Research, Prof. PurnimaAgarwal, Professor of Psychology Lucknow University and inputs given by the

faculty and studentsduring discussions provedto be beneficial instructuring the wholeprogramme.

TARGET GROUPS OF THE TRAINING PROGRAMME

The target group of these three training programmes comprises of PrisonOfficials from various States of the country. 26 officials of different ranks rangingfrom Deputy Jailor to Senior Superintendent from various states like AndhraPradesh, Tamil Nadu, Haryana, Karnataka, and Uttar Pradesh attended theProgramme scheduled from Ist June- 10th June 2009. The intention for choosingsuch a target group was to enable a vertical interaction between the officials.

METHODOLOGY

The methodology adopted for writing this report focuses on the outcomesof different interactive group discussions held during the proceedings of thetraining programme. These were open house discussions and included personalexperiences of Prison officials during their job tenure. Another aspect was the‘exercises’ and ‘game techniques’ conducted by various resource persons duringthe training programme. All these indeed made the participants to freely expresstheir ideas, problems, difficulties and suggestions. In addition, a select group ofstudents of the University were attached to have informal interacts withparticipants to familiarize themselves with the matters connected to the prisonsand prison officials and own perceptions about them. For that purpose onestudent each was attached to all the participants. The student’s input has beena vital part of the methodology adopted for writing this report. Care has beentaken to portray the realistic picture of the participant’s perceptions of theproblems, the predicament they face and the solutions they think are desired tobe implemented.

Approximately 26 Prison Officials from various parts of the country wereengaged into discussions and this report is a true depiction of facts andexperiences of the Prison Officials.



The most significant outcome of the programme was the free and frankdiscussion of the key problems of prison administration in the country. If we gointo the history then we’ll find that lot of problems of jails were got space in thewritings of the political prisoners.

In the ice breakingsessions some of theparticipants raised suchcritical aspects like:

1) Training was the lastpriority of the agendaof the governmentbut with changingtimes, training is animportant tool for theskill development ofthe professionals.

2) Manpower shortage has been another bane of the Indian prison systemwhich needs to be beefed up for better prison management and security.Apart from reinforcing manpower, prison officials of all ranks also need tobe given special training and orientation for further improving prisonsecurity and making Indian prisons better places, yoked to the cause ofreforming and rehabilitating deviant members of the society.

3) Maintaining balance in the professional and personal life is an art and itcan be learned through such types of programmes.



4) Special skills arerequired in jailsbecause there alsoofficials are involvedin public dealing butthe type of public isdifferent. By littlechange in theattitude in oneselfcan bring lots ofchanges.

5) Some of the officialswere in the opinion that excessive regard to the prison inmates due tohuman rights activist. Even the jail officials have to adjust accordinglywith the prisoners so that they may perform their duties without anyproblem.

6) There are some instances in which prisoners tend to harass the jail officials.

7) There should be arrangements made for stress management for prisonofficials which will help them to remain strain free. This will help them inbetter management and controlling of prisoners.

8) Security ofprison officials shouldbe taken care of as theymay be havingapprehensions abouttheir security by virtueof having handledsome sensitiveprisoners.

9) The prisonofficials should beimparted knowledgeabout legal provisions



especially relatedto prison andprisoners.

10) A n o t h e rrequirement is toincrease innumber of stafffor efficientmanagement ofjails.

11) The biggestproblem faced byofficials all overIndia was that of overcrowding. This is because of large number of undertrials in the same prison. So there should be some promising alternativesto sort out this problem.

12) Prison officials should work on enhancing communication skills.

13) There should be Modernization of Prison Scheme leading to improvementof infrastructure by construction of new prisons and additional barracks,repair and renovation of existing prisons, improvement in water andsanitation, living accommodation for prison personnel.

14) The mainobjective of PrisonDepartment is not only toconfine prisoners anddeter them fromcommitting offences butalso to reform, rehabilitateand reintegrate them withthe society after theirrelease. With thisobjective of rehabilitationin view, a number of job



oriented vocationalcourses, yoga andmeditation classesshould be conductedto help prisoners tocope with individualneeds, socialobligations, andfamily responsibilities.

15) Award of prizes to thechildren of wardens inprison should begiven in order to improve the education of children and to encourage thewardens in the Prison Department to serve better, like who secure first,second and third places in the X standard and Intermediate Examinations.

16) It is believed that young offenders aged between 18 and 21 should not beconfined to prisons meant for adult offenders, as they become more proneto crimes while in the company of more experienced and hardened criminals.This at the same time will help the prison officials and staff to handle theprisoners in a better manner.

17) If an inmate commits willful disobedience, assault, use of criminal force,insult, treating immoraland indecent behavior,refuses to work, causeswillful damage,tempering, falseaccusation andconspiring to escape thanin order to control themthe Prison Act, 1894provides for punishmentslike: warning, labour (7days), hand cuff, fitter,confinement, penal diet,



etc., subject to theexamination and issue ofcertificate of fit by themedical officer in order tosustain the punishment.The power of prisonexecutive staff to inflictpunishment for prisonoffences is restricted tomaintain discipline. Thispower should beincreased and mustrequire the official to give in writing about the misconduct done andpunishment inflicted. This would help in checking exercise of arbitrarypower by prison officials and at the same time help prison officials tocontrol mischievous criminals.

18) The importance of the reasonable diversification of prison institution like,separate institution fordelinquent children,adolescent offenders,habitual, professional andorganized criminals, womenoffenders, Leprosy unit, TBunit, under trial prisoners,Sub-jail and openinstitutions. This would helpin better prisonadministration andmanagement.



SWOT ANALYSIS

FOR PRISON OFFICIALS

Strengths

1. Objective ofrehabilitation—the mainobjective behind theprison reform scheme isthe rehabilitation, reformand reintegrate them withthe society after theirrelease. This works as adriving force for the jailofficials to take steps inthis direction.

2. Use of Human Right Commissions in unbiased manner—Officials remainin extreme pressure due to excessive regard to the prison inmates due tohuman rights activist. Even the jail officials have to adjust accordinglywith the prisoners so that they may perform their duties without any

problem.

Weaknesses

1. Lack of staff inprisons—it is difficult forthe prison officials tomaintain decorum in jailsdue to lack of staff, thisleads to problems in jailadministration.

2. Lack of CommunicationSkills

Opportunity

1. Stress Management—



There should bearrangements made forstress management forprison officials which willhelp them to remain strainand tension free. This willhelp them in bettermanagement andcontrolling of prisoners.

2. Modernization of PrisonScheme—There should beimprovement of infrastructure by construction of new prisons andadditional barracks, repair and renovation of existing prisons, improvementin water and sanitation, living accommodation for prison personnel.

Threat1. Harassment of Jail Officials by prisoners—In most of the jails, even jail

officials are harassed byprisoners leading toviolation of human rights ofofficials.

2. Overcrowding ofprisoners—It becomesdifficult for prison officialsto maintain and controllarge number of prisoners.There should be a definedproportion for number ofprisoners handled by aprison official.

3. Threat to security of prison official— Security of prison officials shouldbe taken care of as they may be having apprehensions about their securityby virtue of having handled some sensitive and hardened criminals.



FOR PRISON ADMINISTRATION

Opportunities

1. Recognizing the needfor improving theconditions of prisons,prison staff and theprisoners, GOI,Ministry of HomeAffairs in consultationwith the Bureau ofPolice Research andDevelopment (BPR &D) made analysis of theavailable infrastructureand assessment of the requirements of the State Governments to bring theprisons up to certain minimum standards, and formulated a plan, whichhas the following components:

a) Construction of additional jails to reduce overcrowding;

b) Repair and renovation of existing jails;

c) Improvement insanitation and watersupply; and

d) Livingaccommodation forprisons staff.

In order to addressthe deficiencies in theaforesaid areas of prisonadministration, theCentral Governmentintroduced a new schemeto be implemented over a



period of five years with anoutlay of Rs.1800 crore oncost sharing basis in the ratioof 75:25, the share of CentralGovernment being 75% andthat of the State Governments25%.

2. The Government ofIndia constituted acommittee inDecember 2005 under the Chairmanship of the Director General, Bureau ofPolice Research and Development (BPRD), to prepare a draft policy paperon prison reforms and correctional administration. This Committee is saidto have made many recommendations, which, if implemented, would makea lot of difference to our prison administration and management.

3. Another important problem relating to over-crowding of prisons can betackled by reducing the population of under-trial prisoners by speediertrials in special fast-track courts, Lok Adalats, special courts and via videoconferencing. Modern methods of information technology and e-governance should be pressed into service for improvements in this regard.

Threat

Talking about basic amenities within prisons, there is a lot which needs tobe done to ameliorate theconditions of prisoners.Adequate sanitation,improved prison wages, all-round entertainment facilitiesand better health check-upfacilities form the bare minimumrequired if prison are truly tobe a place for reforming andrehabilitating an individualrather than further hardened acriminal.



IMPACT ASSESSMENT

The trainingprogramme conductedwas a success as it wasgathered from thefeedbacks of theparticipants. Prison andprisoners are linkedwith the Prison Officialsthus there is a need todevelop and enhancetheir personality forbetter administration.The participants whoattended theprogramme promised to discharge their work in a more efficient manner withoutmuch stress. There was a switch over from problem oriented approach to solutionseeking approach. They devised an action plan for their future and promised to

work with a positiveattitude and build ahealthy relation withtheir seniors andjunior officers. Thetraining programmeoffered a platform forthem to developmutual relationshipwith the prisonofficials of otherstates and followsuccess examples ofeach other. Thisprogramme was able

to find solutions to some of the problems identified by the officers.
