RESOLUTION AUTHORIZING THE MAYOR, TOWNSHIP COUNCILAND SUPPORT STAFF TO MEET IN PRIVATE SESSION AND AUTHORIZINGTHE EXCLUSION OF THE PUBLIC FROM THAT PORTION OF THE MEETING DEALING WITH SPECIFIC ISSUES REQUIRING NON-PUBLIC DISCUSSIONS
WHEREAS, NJSA 10:4-6 et seq., a law known as the New Jersey
Open Public Meetings Act requires that the public be permitted
to be present at all meetings of public bodies; and
WHEREAS, NJSA 10:4-12 permits the exclusion of the public
only during the discussion by a public body of certain specific
matters; and
WHEREAS, the New Jersey Open Public Meetings Act requires
the adoption of a resolution by the Mayor and Council prior to
the public body’s right to exclude the public from any meeting;
and
WHEREAS, the Township Council of the Township of Evesham
finds it necessary to adopt a resolution authorizing the
exclusion of the public from a portion of this meeting in
accordance with the law.
NOW THEREFORE BE IT RESOLVED, by the Mayor and Township
Council of the Township of Evesham, County of Burlington, and
State of New Jersey as follows:
1. The public shall be excluded from a portion of this
meeting to allow and facilitate private discussion
among Mayor, Council and staff of the subjects listed
in this resolution.

AN ORDINANCE MAKING THE PROVISIONS OF SUBTITLE ONE OF TITLE 39
WITH VARIOUS TRAFFIC REGULATIONS APPLICABLE TO GRACE DRIVE AND ISABELLE COURT, EVESHAM TOWNSHIP, BURLINGTON COUNTY, NJ, AND REGULATING THE USE OF SAID ROADWAYS, STREETS, DRIVEWAYS AND
PARKING LOTS BY MOTOR VEHICLES
NOW, THEREFORE, be it Ordained by the Township Council of the Township of Evesham that the provisions of Subtitle One of Title 39 of the revised statutes of New Jersey for Various Traffic Regulations to be made applicable to the semi-public roads, streets, driveways and parking lots along Grace Drive and Isabelle Court located in the TOWNSHIP OF EVESHAM, COUNTY OF BURLINGTON; and the following regulations shall be enforceable based on the ‘Plan of Traffic Control and Accommodations, Sharp Road Estates”, prepared by Peterman Maxcy Associates, LLC, bearing a date of December 6, 2018, revised to June 26, 2019 and signed June 26, 2019:
SECTION 1: Chapter 150 of the Code of the Township of Evesham is hereby amended to add the following:
§ Grace Drive and Isabelle Court
It has been requested that the provisions of Subtitle One of Title 39 of the Revised Statutes of New Jersey be made applicable to the semipublic roads, streets, driveways, and parking lots on Grace Drive and Isabelle Court located in the Township of Evesham, County of Burlington, and the following regulations shall be enforceable:
A. §150-6 Parking prohibited at all times.a. Schedule I (§150-32) shall be amended to add the following:

ORDINANCE OF THE TOWNSHIP OF EVESHAMAMENDING CHAPTER 72, FEES AND CHAPTER 94 LAND USE REGULATIONS
WHEREAS, it has been determined that some of the construction fees included in the Ordinance do not contain all the categories for which a permit is required; and
WHEREAS, the Fire District is charged with providing comments to applications that are submitted to the Planning Board and Zoning Board of Adjustment which to date the Fire District has not been compensated for; and
WHEREAS, the Fire District should be compensated for the time spent to review the plans, provide comments and meet with the applicants.
NOW, THEREFORE, BE IT ORDAINED AND ESTABLISHED by the Township Council of the Township of Evesham, County of Burlington, State of New Jersey that Sections 72 and 94 of the Township Code should be amended to address these items as follows:
SECTION I. Amend section 72-1 Schedule of Fees as follows.

The fee shall be in accordance with the table below and the fee charged shall be in accordance with the classification placed on a site plan review by the Office of Community Development. The fee shall be due one time, at the time of initial application.

ORDINANCE NO. 22-12-2019
AN ORDINANCE AMENDING THE ADMINISTRATIVE CODE OF THE TOWNSHIP OF EVESHAM, FOUND AT CHAPTER 3, ARTICLE VA OF THE TOWNSHIP CODE
BE IT ORDAINED AND ENACTED by the Township Council of the Township of Evesham, County of Burlington, State of New Jersey that Chapter 3 of the Township Code be and is hereby supplemented as follows:
ARTICLE I: AMENDED SECTION. Section 3-28.1 paragraph A of the Code of the Township of Evesham, entitled “Township Planner” is hereby deleted and replaced with the following new paragraph A as follows:
A. There shall be a Township Planner, who shall be appointed by the Township Manager as an employee of the Township or as a Township contractor, and who shall serve at the pleasure of the Township Manager. The Township Planner's compensation may be set by the Township Manager, either as a Township employee within the parameters establishedby the Township's Salary Ordinance for that position, or as a Township contractor pursuant to the terms of a contract to be authorized annually by the Council.
(1) Notwithstanding the foregoing, the Township Planner shall keep track of all time expended on development and redevelopment applications, so that the applicable developer/redeveloper escrow accounts can be charged appropriately for the Township Planner's time.
ARTICLE II. Repealer, Severability and Effective Date.
1. Repealer. Any and all Ordinances inconsistent with the terms of this Ordinance are hereby repealed to the extent of any such inconsistencies.
2. Severability. In the event that any clause, section, paragraph or sentence of this Ordinance is deemed to be invalid or unenforceable for any reason, then the TownshipCouncil hereby declares its intent that the balance of the Ordinance not affected by said invalidity shall remain in full force and effect to the extent that it allows the Township to meet the goals of the Ordinance.

AN ORDINANCE AMENDING THE TOWNSHIP CODE OF THE TOWNSHIP OF EVESHAM TO CODIFY THE CREATION OF THE EVESHAM TOWNSHIP YOUTH
ADVISORY COMMITTEE AT CHAPTER 34 OF THE TOWNSHIP CODE
WHEREAS, the Township Council of the Township of Evesham has determined the need to establish a Youth Advisory Committee to explore the special issues confronting teenagers within theTownship and to investigate and undertake various projects toenhance the quality of life for teenagers, and promoteopportunities for public service; and
WHEREAS, the Township Council of the Township of Evesham has determined it is in the best interest of the youth of the Township to establish a Youth Advisory Committee to promote and coordinate greater communication between teenagers and the Township government.
BE IT ORDAINED AND ENACTED by the Township Council of the Township of Evesham, County of Burlington, State of New Jersey that Chapter 34 of the Township Code be and is hereby supplemented as follows:
ARTICLE I: NEW SECTION. Chapter 34 entitled “Youth Advisory Committee” is hereby created. Section 34-1 of the Code of the Township of Evesham, entitled “Mission” is hereby created as follows:
The purpose of the Youth Advisory Committee of the Townshipof Evesham shall be to explore the special issues of theyouth community throughout the Township, and to include theyouth community as active participants in Township sponsoredactivities, to foster leadership and public service, which is included but limited too:
1. Explore leadership and public service throughparticipation in various meetings, activities, andevents.
2. Develop a means of communications with peers through the Township, including use of the Township's website, public access TV channel, and other platforms.
3. Develop and present other recommendations toTownship Council.
4. Serve as a community resource to organize and deployvolunteers for critical community activities.
5. Work towards establishing a stronger Evesham YouthCommunity.

ARTICLE II: NEW SECTION. Section 34-2 of the Code of the Township of Evesham, entitled “Membership and Organization” is hereby created as follows:
The Youth Advisory Committee shall be comprised as follows:1. A seven (7) member Executive Committee, including
a Council liaison.2. A general membership population encompassing teens
who may apply for membership through the Youth Advisory Committee Coordinator or his/ her designee.
3. All members of the Youth Advisory Committee shall serve without compensation.
ARTICLE III: NEW SECTION. Section 34-3 of the Code of the Township of Evesham, entitled “Executive Committee” is hereby created as follows:
1. There shall be two (2) adult advisors to be appointed to the Executive Committee by the Township Council, one of which may be a Council liaison. The other adult advisor will be the Youth Advisory Coordinator. The Coordinator will be an Evesham Township staff member, or their designee.
2. The remaining five (5) members of the ExecutiveCommittee shall be regular members of the YouthAdvisory Committee and shall be voted onto the Committee by the membership at large.
a. The Executive Committee will consist of thefollowing positions: President, Vice- President,Secretary, Treasurer, and Member- At- Large.
b. Members of the Executive Committee must be ingood standing with the organization in order to be eligible to run for office. If, at any time, the executive board member is no longerconsidered to be in good standing, they will be asked to step down from the position.
i. If incidents occur outside the organization that reflect poor standing or behavior, the adult advisors have the discretion to ask the board member to step down or seek removal for cause.
c. The President will be responsible forestablishing and implementing a year- long service project that seeks to benefit the community. 28
ARTICLE IV: NEW SECTION. Section 34-4 of the Code of the Township of Evesham, entitled “Terms” is hereby created as follows:
The terms of office for the members of the ExecutiveCommittee of the Youth Advisory Committee shall be asfollows:
1. A term of two (2) years for the two (2) adultsupervisors appointed by the Council to theExecutive Committee; and
2. A term of one (1) year for the remaining five (5)members of the Executive Committee, elected by themembership at large, to serve until the election oftheir successors.
ARTICLE V: NEW SECTION. Section 34-5 of the Code of the Township of Evesham, entitled “Duties” is hereby created as follows:
The Youth Advisory Committee shall administer, plan andmanage teen and youth initiatives of the Township of Evesham and shall communicate with teens, adults, and municipal officials to explore and undertake various projects to enhance the quality of life for teens and youth in the Township. It shall be a strictly advisory body with no power to regulate or promulgate rules and regulations beyond its internal organization and in conformance with this Code. The Executive Committee shall propose and coordinate volunteer initiatives in the community and report to the Township Council on an annual basis regarding the committee's accomplishments and future plans.
ARTICLE VI. Repealer, Severability and Effective Date.
1. Repealer. Any and all Ordinances inconsistent with the terms of this Ordinance are hereby repealed to the extent of any such inconsistencies.
2. Severability. In the event that any clause, section, paragraph or sentence of this Ordinance is deemed to be invalid or unenforceable for any reason, then the Township Council hereby declares its intent that the balance of the Ordinance not affected by said invalidity shall remain in full force and effect to the extent that it allows the Township to meet the goals of the Ordinance.
3. Effective Date. This Ordinance shall take effect upon proper passage in accordance with the law.

DISABILITY AND VETERANS AFFAIRS ADVISORY COMMITTEE AT CHAPTER 36OF THE TOWNSHIP CODE
WHEREAS, on March 19, 2019, the Township Council of Evesham Township adopted Ordinance 5-3-2019 creating the Township’s Division of Community Affairs and Senior & Disability Serviceswithin the Township; and
WHEREAS, on April 16, 2019, Township Council of Evesham Township adopted Resolution 139-2019 creating the Disability and Veterans Affairs Advisory Committee to support the mission of the Division of Community Affairs and Senior & Disability Services; and
WHEREAS, the Township Council of the Township of Evesham has determined that it is in the best interest of effectuating the purpose of the Division of Community Affairs and Senior & Disability Services to permanently establish the Disability and Veterans Affairs Advisory Committee to ensure engagement from members of the public and organizations familiar with those issues affecting veterans and persons with disabilities;
NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the TownshipCouncil of the Township of Evesham, County of Burlington, State of New Jersey that Chapter 36 of the Township Code be and is hereby supplemented as follows:
ARTICLE I: NEW SECTION. Chapter 36 entitled “Disability and Veterans Affairs Advisory Committee” is hereby created. Section 36-1 of the Code of the Township of Evesham, entitled “Creation;Duties; Membership” is hereby created as follows:
A. There shall be a Disability and Veterans Affairs Advisory Committee to assist the Director of Community Affairs in (i) identifying programs and services from outside of the Township that connect seniors, adults with disabilities and veterans with a full range of the services–public and private-needed to independently live and thrive within their community, (ii) exploring programmatic opportunities by the Division of Community Affairs and Senior &Disability Services to serve the veteran and disabled populations in Evesham Township, and (iii) otherwise supporting the mission of the Division of Community Affairs and Senior & Disability Services. The Committee shall be strictly an advisory body with no power to regulate or promulgate rules and regulations beyond its internal organization and in conformance with this Code.

The Disability and Veterans Affairs Advisory Committeeshall meet at least eight (8) times each year.
B. The membership of the Disability and Veterans Affairs Advisory Committee shall consist of fourteen (14) members who shall be appointed by the Mayor and serve without compensation, from the following categories:
(i) 2 members being residents who experience disabilities;
(ii) 2 members being residents who are veterans;(iii) 2 members being residents who are caregivers to
persons with a disability or veteran;(iv) 2 members who are officers or employees of a public
or private service provider organization who provide services to disabled persons or veterans and who do not need to themselves be residents of Evesham Township;
(v) 2 members who are healthcare practitioners who provide services to disabled persons or veterans and who do not need to themselves be residents of Evesham Township;
(vi) 1 member who is an officer or employee of an advocacy group supporting issues involving individuals with disabilities who need not be a resident of Evesham Township;
(vii) member who is an officer or employee of an advocacy group supporting issues involving veterans who need not be a resident of Evesham Township;
(viii) member of the Township Council; and(ix) The Director of Community Affairs or his or her
designee;
C. Members of the Disability and Veterans Affairs Advisory Committee shall be appointed for a one (1) year term from January 1 through December 31. The annual appointments shall be made annually at the Township’s Reorganization Meeting.

A RESOLUTION ESTABLISHING GOALS FOR CONTRACTINGWITH VETERAN OWNED BUSINESS ENTERPRISES,HIRING VETERANS IN THE MUNICIPAL WORKFORCE
AND RECOGNIZING THE MILITARY SERVICE OF RESIDENTSIN THE CIVIC AFFAIRS OF EVESHAM TOWNSHIP
WHEREAS, the New Jersey Local Public Contracts Law, N.J.S.A. 40A:11-1 et. seq. (the “LPCL”) permits counties and municipalities to establish by resolution qualified veteran-owned business enterprise (VOB) and service-connected disabled veterans owned business enterprise (SDVOB) contracting programs; known as veterans business entities (VBE) and
WHEREAS, the LPCL further authorizes municipalities to establish goals for the municipality in setting aside a certain percentage of the dollar value of total procurements to be awarded as contract to VBEs; and
WHEREAS, the LPCL provides that municipalities that have set goals for contracts awarded to VOBs shall make a good faith effort to attain any goal by tracking the award of contracts to VBEs; and
WHEREAS, the Township Council of Evesham Township recognizes the importance of publicly recognizing veterans for their service in the normal course of carrying out local government functions; and
WHEREAS, the Township Council of Evesham Township has determined that, subject to the compliance with the LPCL and other state regulations concerning procurement and New Jersey Civil Service rules concerning hiring that it is in the best interest of the Township to encourage the participation of veterans in the business of local government, the workforce and in the civic affairs of the community.
NOW, THEREFORE, BE IT RESOLVED, by the Township Council of Evesham Township, that the following goals are hereby established:
1) Proactively notify veteran-owned businesses registered with the State of New Jersey (https://www20.state.nj.us/TYTR_SAVI/vendorSearch.jsp) of each public bid opportunity;

2) In the procurement of goods and services and construction,in accordance with N.J.S.A. 40A:11-42(d), the Township shall make a good faith effort to award 6% of the total contract dollars to Veteran Business Enterprises. Inachieving this goal, the Township shall consider the portion of any public contract awarded that may be performed by a VOB or SDVOB subcontractor;
3) In the Procurement of goods and services and construction, in accordance with N.J.S.A. 40A:11-42(d), for contracts awarded to non-veteran prime vendors, where there are not three qualified veteran bidders, we shall request that 6% of the contract be awarded to qualified veteran subcontractors who are certified in the state of New Jersey in the New Jersey Selective Assistance Vendor Information (NJ SAVI) database;
4) In the hiring of employees, the Township, subject to all applicable New Jersey Civil Service regulations shall make a good faith effort to achieve the goal of a minimum 5%veteran workforce;
5) A discount for veterans on local license and permit fees;
6) Preferred parking for veterans in municipally-owned lots;
7) Promote State fee exemption for local metered parking;
8) A municipal commuter lot permit fee waiver / reimbursement for purple heart recipients;
9) Hold at least one “Patriot Day” public celebration honoring the service of veterans on Memorial Day, Veterans Day and/or the anniversary of 9-11;
10) Public recognition of the service of a resident of the community who has served in the military on an annual basis.

BE IT FURTHER RESOLVED that in order to achieve the goals established by this resolution the Township shall make best efforts, in accordance with N.J.S.A. 40A:11-43, to advertise to the VOB and SDVOB community the Township goals, to track the award of public contracts to VOBs and SDVOB subcontractors and assist those enterprises in the participation of the procurement process.

DEDICATION BY RIDER TRUST FORDISABILITY AND VETERAN AFFAIRS ADVISORY COMMITTEE
PURSUANT TO N.J.S.A 40A:5-29
WHEREAS, permission is required for the Director of the Division of Local Government Services for approval as a dedication by rider of revenues received by a municipality when the revenue is subject to reasonably accurate estimates in advance; and,
WHEREAS, N.J.S.A. 40A:5-29 provides for receipt of program contributions by the municipality to provide for the operating costs to administer this act; and,
WHEREAS, N.J.S.A. 40A:4-39 provides the dedicated revenues anticipated from the Disability and Veteran Affairs Advisory Committee are hereby anticipated as revenue and are hereby appropriated for the purpose to which said revenue is dedicated by statute or other legal requirement.
NOW, THEREFORE, BE IT RESOLVED, by the Township Council of the Township of Evesham, County of Burlington, State of New Jersey as follows:
1. The Township Council hereby requests permission of the Director of the Division of Local Government Services to pay expenditures for the Disability and Veteran Affairs Advisory Committee as per N.J.S.A. 40A:5-29.
2. The Municipal Clerk of the Township of Evesham is hereby directed to forward two certified copies of this resolution to the Director of the Division of Local Government Services

AUTHORIZING SALE OF SURPLUS PROPERTY
WHEREAS, the Township of Evesham is the owner of certain
surplus property as listed in Schedule A attached hereto, which
is no longer needed for public use; and
WHEREAS, the Township Council of the Township of Evesham is
desirous of selling said surplus property in an “as is” condition
without express or implied warranties.
NOW THEREFORE, BE IT RESOLVED by the Township Council of the
Township of Evesham, County of Burlington, State of New Jersey as
follows:
(1) The sale is being conducted pursuant to Local Finance
Notice 2008-9.
(2) The sale of the surplus property shall be conducted
through pursuant to State Contract 19DPP00272/T2581 in accordance
with the terms and conditions of the State Contract. The terms
and conditions of the agreement entered into with Municibid is
available online at Municibid.com and also available from the
Township of Evesham.
(3) The sale will be conducted online and the address of
the auction site is https:/municibid.com.
(4) A list of the surplus property is attached hereto as
Schedule “A”, and made a part hereof; and
(5) A notice of the sale will be published in a newspaper
circulating in the Township of Evesham.
(6) The surplus property as identified shall be sold in an
“as-is” condition without express or implied warranties with the 54

successful bidder required to execute a Hold Harmless and
Indemnification Agreement concerning use of said surplus

RESOLUTION AUTHORIZING THE AWARD OF A CONTRACT FORSOFTWARE LICENSE RENEWALS
THROUGH THE STATE OF NEW JERSEYCOOPERATIVE PURCHASING PROGRAM I-NJCP
WHEREAS, the Township of Evesham wishes to provide for a
Software License Renewals for use by various Evesham Township
Departments from an authorized vendor under contract by the
Division of Purchase and Property, Department of Treasury, State
of New Jersey; and
WHEREAS, SHI, 290 Davidson Avenue, Somerset, New Jersey
08873 has been awarded New Jersey State Contract Number 89851 to
provide for Software License Renewals for the period September
1, 2015 to June 30, 2020; and
WHEREAS, the MIS Manager has recommended the award of this
contract, price and other factors considered; and
WHEREAS, the cost for this purchase shall not exceed
$150,000.00; and
WHEREAS, this is an open-ended contract and the Township is
not obligated to order, accept or pay for the goods and services
hereunder until an order is placed; required certification of
available funds shall be made when goods or services are ordered.
NOW THEREFORE, BE IT RESOLVED, by the Township Council of
the Township of Evesham, County of Burlington, State of New
Jersey, as follows:
1. That SHI, 290 Davidson Avenue, Somerset, New Jersey
08873 be awarded a contract for the Software License Renewals for
the period December 03, 2019 to June 30, 2020 as recommended by
the MIS Manager, in an amount not to exceed $150,000.00.
2. That the aforesaid contract is a term contract
permitting the purchase of items at a stated price on an “as-
needed” basis, at which time certification of available funds shall 58

AWARD OF BANKING SERVICES TO OCEANFIRST BANK
WHEREAS, the Township Council of the Township of Evesham has
determined to provide for banking services in connection with
financial matters in the Township of Evesham; and
WHEREAS, the Township Council of the Township of Evesham
requested proposals for banking services for a three-year term to
be effective from January 1, 2020 to December 31, 2022; and
WHEREAS, on October 20, 2019 and October 21, 2019, in
furtherance of said banking services, the Township of Evesham,
consistent with the Local Public Contract Law (N.J.S.A. 40A:11-
1), advertised a request for proposals (hereinafter referred to as
the “RFP”) for such township banking services; and
WHEREAS, in response to the RFP, the Township of Evesham
received four (4) proposals for banking services on November 15,
2019.
NOW, THEREFORE, BE IT RESOLVED, that the Township Council of
the Township of Evesham award the contract to OceanFirst Bank,
1001 Asbury Avenue, Ocean City, New Jersey 08226 to provide the
highest level of banking services and the most economic and
efficient standards that will be in the best interests of the
Township of Evesham and its taxpayers; and
BE IT FURTHER RESOLVED, that the Mayor, Chief Financial
Officer, and Township Clerk are hereby authorized to execute any
and all documents in connection with the submitted proposal and
designation of OceanFirst Bank as an official depository of the
Township of Evesham, County of Burlington, State of New Jersey.

WHEREAS, the Evesham Township Council on the 3rd day of
December, 2019, appointed the firm Insurance Administrator of
America, Inc., The IAA Building, 1934 Olney Avenue, Cherry Hill,
New Jersey 08003 as Township Third Party Administrator for the
term January 1, 2020 to December 31, 2020; and
WHEREAS, the "Local Public Contracts Law" (N.J.S.A. 40A:11-

THIS AGREEMENT, made and entered into this day of
, 2019 by and between the TOWNSHIP OF EVESHAM, having
its principal place of business at 984 Tuckerton Road, Marlton, New
Jersey, 08053, in the County of Burlington, a public body corporate
and politic of the State of New Jersey, (hereinafter referred to as
the "TOWNSHIP") and the firm of Virtua Medical Group, P.A., dba
Virtua Occupational Health, Barry Brown Health Education Center,
106 Carnie Boulevard, Retail Suite, Voorhees, New Jersey 08043
(hereinafter referred to as "Pre-Employment and Medical Services
Provider");
W I T N E S S E T H
WHEREAS, the Pre-Employment and Medical Services Provider has
been appointed by the Township of Evesham as the Township Pre-
Employment and Medical Services Provider for a one year term to
commence on January 1, 2020 and expire on December 31, 2020; and
WHEREAS, the Pre-Employment and Medical Services Provider are
practitioners of a recognized profession and are licensed to
practice in the State of New Jersey; and
WHEREAS, the "Local Public Contracts Law" (N.J.S.A. 40A:11-1
et seq.) requires that the Resolution authorizing the award of
contracts for “professional services” without competitive bids and
the contract itself must be available for public inspection; and
WHEREAS, this contract is made subject to N.J.S.A. 19:44A-20.4
et seq., N.J.S.A. 40A:11-1 et seq. and Chapter 27 of the Code of
the Township of Evesham.
WHEREAS, the Township Council of the Township of Evesham
desires to recognize the aforesaid appointment and provide
compensation by way of a written contract for services which may be
performed by the Pre-Employment and Medical Services Provider.
NOW, THEREFORE, in consideration of the mutual promises
contained herein, the parties hereto agree as follows:83

1. Scope of Services. The Pre-Employment and Medical
Services Provider shall perform professional Pre-Employment and
Medical services for the Township of Evesham in accordance with
their proposal dated November 6, 2019.
2. Township Responsibilities. The Township shall furnish to
the Pre-Employment and Medical Services Provider, for the
performance of their services, any and all necessary data and
studies.
3. Compensation. This is a term contract permitting services
at a stated price on an “as needed” basis, in an amount not to
exceed $25,000.00, at which time certification of available funds
shall be provided for each service by means of an encumbered purchase
order, in accordance with Local Public Contract Regulation 5:30-
14.5(c)2ii. No work may be performed unless authorized in advance
by the Township Manager and certified by the Finance Director as to
the availability of funds. Billing for said purchase order shall
not exceed the amount listed in the purchase order. The terms and
conditions listed in this contract shall apply in the event of any
conflict with the proposal submitted by the Risk Management
Consultant. Payments shall be made on a monthly basis, depending
upon the payment option selected by the Township as reflected in
the proposal attached hereto as Exhibit B.
Payment shall be pursuant to the submission of the appropriate
voucher(s) which shall specify the services rendered.
Reimbursement for out-of-pocket expenses shall be limited to
the following categories unless otherwise allowed by the Township
Manager: reproduction costs for maps, plats and plans,
reproduction costs associated with submissions to any agency or
court, reproduction costs for presentations made to the Council,
Administration officials, Courts or any outside agency on behalf
of the Township of Evesham, filing fees and escrows advanced on
behalf of the Township by the vendor to file any application or
matter before any court, board or agency and/or miscellaneous costs
such as long distance telephone costs, conference call costs, court
imposed or required mediation fees, fees to arbitrators, parking

fees and tolls used in connection with Township business. Other
categories of reimbursable “out-of-pocket expenses” may be allowed
by the Township manager so long as such expenses are reasonable
and ordinary.
To the extent that hourly billings are allowed under this
contract which would authorize compensation to the professional on
a time-spent basis (e.g., $150/ per hour), the following detail
shall be set forth in every billing: date of service / description
of work performed / amount of time spent on the matter. Time shall
be shown in discrete entries describing the work performed for
EACH task and time spent to perform EACH such
task to the tenth of an hour. “Run on paragraphs” showing a
collection of tasks without such detail shall be a basis to reject
the bill.
4. Term. This contract shall commence and take effect on
January 1, 2020 and expire on December 31, 2020.
5. Pre-Employment and Medical Services Provider
Responsibilities. The Pre-Employment and Medical Services Provider
shall perform the aforementioned services in an efficient and
expeditious manner. The Pre-Employment and Medical Services Provider
shall be responsible to insure that both the time constraints and
the financial constraints of this contract are not compromised
without adequate written notification and explanation as to the
nature of such compromise. The Pre-Employment and Medical Services
Provider shall be responsible to submit proper documentation for
payment of services authorized by this contract in a manner
prescribed by the Township and according to law.
All notices, correspondence, copies of work product, and
billing statements for the Township shall be addressed to the
Township of Evesham, 984 Tuckerton Road, Marlton, New Jersey 08053.
Professionals (auditors, engineers, attorneys) must obtain
authorization for any work performed under this contract from the
Township Manager or by formal vote or resolution of the Township
Council. Any work not specifically authorized may be rejected for
payment in the discretion of the Township Manager when reviewing
invoices, vouchers and submissions.

6. Insurance. During the term of this Agreement, the Pre-
Employment and Medical Services Provider shall maintain and continue
in full force and effect a policy of insurance indemnifying itself
against any and all forms of professional malpractice and/or other
types of liability in a minimum amount of $1,000,000.00. The Pre-
Employment and Medical Services Provider shall provide to the
appropriate officials of the Township of Evesham a copy of a
certificate of insurance as verification of the existence of said
insurance policy. Said officials shall review the certificate for
sufficiency.
7. Affirmative Action Mandatory Language. (See Exhibit A)
8. Hold Harmless. The Pre-Employment and Medical Services
Provider shall indemnify and save harmless the Township, its
officers, employees and agents from all claims, suits or actions
brought against the said Pre-Employment and Medical Services
Provider, its officers, employees and agents, for or on account of
any injuries or damages received or sustained by any party or parties
by or from the acts of the Pre-Employment and Medical Services
Provider or its servants, agents and employees, in doing the work
and rendering the service herein contracted for, or by or in
consequence of any negligence in operations or any improper material
or equipment used, or on account of any act or omission of the Pre-
Employment and Medical Services Provider or of its servants, agents
and employees; or on account of or in consequence of the performance
of this contract, whether or not such injuries to persons or damages
to the property are due or claimed to be due to any negligence of
Pre-Employment and Medical Services Provider, its employees, its
agents or servants; and also from all claims or damage for
infringement of any patent in fulfilling this contract. This
indemnity shall include attorneys' fees and costs and all other
expenses incurred in the defense of any suit.
9. American Disabilities Act. The Pre-Employment and Medical
Services Provider shall comply with the requirements of the American
Disabilities Act where applicable.
10. Termination. The Township reserves the right to terminate
the contract upon fifteen (15) days notice. The Pre-Employment and

Medical Services Provider may terminate the contract upon fifteen
(15) days notice in the event the Township fails to comply with its
responsibilities under the terms of this Agreement.
11. Integration. The parties agree that the terms and
conditions of this Agreement contain the complete Agreement of the
parties and any oral understanding to the contrary are specifically
disavowed.

Evesham Township currently has a contract with Fortress Protection, LLC for the Monitoring and Systemmaintenance of the Existing Fire, Elevator and Burglar Alarms in Township Facilities. The contract requires thevendor to monitor the existing alarm systems as well as provide maintenance to the systems when needed.
The contract term is for one year with an option to renew for one additional year. Fortress Protection has beenproviding a satisfactory service, without issues, meeting all requirements in the contract. Therefore, I am requestingapproval to renew the contract with Fortress Protection, LLC for Monitoring and System maintenance for ExistingFire, Elevator and Burglar Alarms in Township Facilities for the optional one year. This contract term will beJanuary 16, 2020 to January 15, 2021 and will have a not to exceed amount of $50,000.00. A copy of FortressProtection’s letter of agreement is included. A certification of funds for the monitoring and annual inspections isattached. Service work related to this contract will be on an as needed basis.

RENEWAL OF CONTRACTMONITORING, SYSTEM MAINTENANCE, AND

IN TOWNSHIP
WHEREAS, the Township Council of the Township of Evesham has
determined to provide for the Monitoring, System Maintenance, and
Inspections for Existing Fire, Elevator, and Burglar Alarms in
Township Facilities for the Township of Evesham, same being more
particularly described in specifications which are on file in the
Office of the Township Clerk and available for public inspection
during regular business hours, and it appearing that the cost of
the aforementioned items will be paid with Municipal funds and
will exceed $40,000.00 in the fiscal year; and
WHEREAS, N.J.S.A. 40A:11-4 states that a contract, the cost
of which will exceed $40,000.00 in a fiscal year, shall be
awarded only after public advertising for bids and bidding
therefor; and
WHEREAS, there has been public advertisement for bids and
the Township Manager has received and opened the bids on December
28, 2018 for the purpose of awarding a contract for the
aforementioned purpose; and
WHEREAS, Fortress Protection, LLC, 1999 E. Marlton Pike,
Suite 3, Cherry Hill, New Jersey 08003 was awarded a contract by
way of previous Resolution 35-2019 Monitoring, System
Maintenance, and Inspections for Existing Fire, Elevator, and
Burglar Alarms in township for the period January 16, 2019 to
January 15, 2020, on an “as needed” basis, in an amount not to
exceed $25,000.00, adopted on January 15, 2019, and amended by
Resolution 149-2019 with an amount not to exceed $50,000.00.
WHEREAS, in accordance with the provisions of the bid
specifications and N.J.S.A. 40A:11-15, said contract may be
renewed by mutual consent; and

WHEREAS, the Superintendent of Public Works has advised
Township Council that, based upon the provisions of the bid
specifications, the Contractor has requested renewal of the
contract for the period of January 15, 2020 to January 14, 2021;
and
WHEREAS, the Township Council deems it in the best interest
of the Township to renew said contract as provided by the
provisions of the bid specifications; and
WHEREAS, this is an open-end contract and the Township is
therefore not obligated to order, accept or pay for the goods
and services hereunder until an order is placed, the required
certifications of available funds shall be made when goods or
services are ordered.
NOW, THEREFORE, BE IT RESOLVED, by the Township Council of
the Township of Evesham, County of Burlington, State of New
Jersey, as follows:
1. The Township Council, for the aforementioned reasons
hereby declares that Fortress Protection, LLC, 1999 E. Marlton
Pike, Suite 3, Cherry Hill, New Jersey 08003 is the lowest,
qualified responsible bidder for the aforementioned purpose and
hereby renews the contract with said entity for the Monitoring,
System Maintenance, and Inspections for Existing Fire, Elevator,
and Burglar Alarms in Township Facilities for the Department of
Public Works for the period of January 15, 2020 to January 14,
2021, in an amount not to exceed $50,000.00. Payment shall not
exceed the cost of the items specified in the bid proposal, said
award of contract being in accordance with the terms and
conditions of the Bid Proposal, the Notice to Bidders, and Bid
Specifications, copies of which are on file in the office of the
Township Clerk and available for public inspection during
regular business hours.

2. That the aforementioned contract is a “Term Contract”
permitting the purchase of items at a stated price on an “as
needed” basis, at which time certifications of available funds
shall be provided for each purchase by means of an encumbered
purchase order, in accordance with Local Public Contracts
Regulation 5:30-14.5(c)2ii.
3. That the Township Council hereby directs the Township
Mayor and Township Clerk to execute any contract documents which
are necessary to effectuate the terms of this resolution,
subject to review, revision and approval by the office of the
Township Solicitor.
I HEREBY CERTIFY that the foregoing resolution was adopted
by the Township Council of the Township of Evesham, County of
Burlington, State of New Jersey, at its meeting held in the

THIS AGREEMENT made and entered into this________day of
_________, 2019 by and between the TOWNSHIP OF EVESHAM, having
its principal place of business at 984 Tuckerton Road, Marlton,
New Jersey 08053 (hereinafter referred to as "Township") and
Fortress Protection, LLC, 1999 E. Marlton Pike, Suite 3, Cherry
Hill, New Jersey 08003 (hereinafter referred to as "Contractor"):
W I T N E S S E T H
WHEREAS, the Township of Evesham, pursuant to the Local Public
Contract Law, solicited bids for the purpose of providing for the
Monitoring, System Maintenance, and Inspections for Existing Fire,
Elevator, and Burglar Alarms in Township Facilities; and
WHEREAS, the Contractor has submitted the lowest, qualified,
responsible bid, and the Township Council, by way of a resolution,
has accepted same and awarded a contract for said purposes.
NOW THEREFORE, in consideration of the mutual covenants,
terms and conditions, the parties hereby agree as follows:
1. MATERIALS AND SERVICES. The Contractor shall provide
for the Monitoring, System Maintenance, and Inspections for
Existing Fire, Elevator, and Burglar Alarms in Township Facilities
in the Township of Evesham by Contractor on an “as needed” basis
in accordance with the terms and conditions of the Notice to
Bidders, Instructions to Bidders, Specifications, and the Bid
Proposal, hereinafter referred to as the Bid Documents, and the
Contractor’s request for renewal of the contract, copies of which
are on file in the Office of the Township Clerk and available for
public inspection during regular business hours.

2. COMPENSATION. The Contractor shall receive payment as
set forth in his bid proposal dated December 28, 2018 and in the
manner specified in the bid documents; total payment for the term
of this contract shall not exceed $50,000.00. This is a term
contract permitting the purchase of items at a stated price on
an “as needed” basis, at which time certification of available
funds shall be provided for each purchase by means of an
encumbered purchase order, in accordance with Local Public
Contract Regulation 5:30-14.5(c)2ii.
3. TERM. The term of this agreement shall be from January
15, 2020 to January 14, 2021.
4. AFFIRMATIVE ACTION MANDATORY LANGUAGE. See Schedule “A”
attached hereto.
5. INSURANCE. The Contractor shall provide and maintain
all the necessary insurance including, but not limited to,
workmen's compensation, general liability, automobile and
professional liability in the amounts and in the type as
recommended by the Township insurance broker and as referenced in
the bid documents.
6. HOLD HARMLESS. The Contractor shall indemnify and save
harmless the Township, its officers, employees and agents from all
claims, suits or actions brought against the said Contractor, its
officers, employees and agents, for, or on account of, any injuries
or damages received or sustained by any party or parties by or
from the acts of Contractor or its servants, agents and employees,
in doing the work and rendering the services herein contracted
for, or by or in consequence of any negligence in operations or
any improper material or equipment used, or on account of any act
or omission of Contractor or of its servants, agents or employees;
or on account of or in consequence of the performance of this
contract; and also from all claims or damage for infringement of
any patent in fulfilling this contract. This indemnity shall 98

include attorneys' fees and costs and all other expenses incurred
in the defense of any suit.
7. AMERICAN DISABILITIES ACT. The Contractor shall comply
with the requirements of the American Disabilities Act where
applicable.
8. TERMINATION. The Township reserves the right to terminate
the contract upon fourteen (14) days’ notice. The Contractor may
terminate the contract upon fourteen (14) days’ notice in the event
the Township fails to comply with its responsibilities under the
terms of this Agreement.
9. CHOICE OF LAW/FORUM VENUE. In the event that any
disputes arise between the parties, or should any litigation be
instituted over this contract, this Contract shall be governed by
the laws of the State of New Jersey. Moreover, any action that
might arise between the parties, arising from this Contract, shall
be venued in the Superior Court of New Jersey, Law Division,
Burlington County, New Jersey.
10. INTEGRATION. The parties agree that the terms and
conditions of this Agreement contain the complete agreement of the
parties and any oral understandings to the contrary are
specifically disavowed.

WHEREAS, the Township Council, by way of a previous
Resolution, awarded a contract to Winner Ford, 250 Haddonfield-
Berlin Road, Cherry Hill, New Jersey 08034, Evesham Township Police
Department in the Township of Evesham in accordance with the terms
and conditions of specifications which are on file in the Office
of the Township Clerk and available for public inspection during
regular business hours; and
WHEREAS, the Chief of Police, the Township’s agent
responsible for said purchases for the Township of Evesham, has
advised the Township Manager by correspondence dated November 20,
2019, that the original awarded amount did not include all three
items, and that the contract should be amended to include all three
items and to amend said contract to the correct award amount of
$270,983.00, and that said changes do not materially expand upon
the size, nature, or scope of the original bid as described in the
specifications; and
WHEREAS, N.J.A.C. 5:30-11.4 provides that the governing body
may authorize change orders and amend contracts in accordance with
the procedures set forth in said regulations, and the Township's
Chief Financial Officer, as required by N.J.A.C. 5:30-5.1, has
certified that there are sufficient funds available for the purpose
of awarding a contract to said entity; and
WHEREAS, the Township Council has reviewed the aforementioned
request and desires to act favorably with respect to same and to
amend the contract accordingly and to approve the not to exceed
amount.
NOW, THEREFORE, BE IT RESOLVED by the Township Council of the
Township of Evesham, in the County of Burlington and State of New
Jersey, as follows:106

WHEREAS, the Township of Evesham has determined to provide for
the Golf Course Pro-Shop Merchandise in the Township of Evesham,
said services being more particularly described in specifications
which are on file in the Office of the Township Clerk and available
for public inspection during regular business hours; and
WHEREAS, the Township Manager has informed the Township Council
that the cost of the aforementioned items will be paid with municipal
funds and will exceed $40,000.00 in the current fiscal year; and
WHEREAS, N.J.S.A 40A:11-4 states that a contract, the cost of
which will exceed $40,000.00 in the fiscal year, shall be awarded
only after public advertising for bids and bidding therefor; and
WHEREAS, the Director of Golf, Recreation & Open Space has
informed the Township Council that he has publicly advertised for
bids and has received and opened bids in the Municipal Complex on
November 8, 2019 in accordance with the Local Public Contracts Law
for the purpose of awarding a contract for the aforementioned
purpose. The Director of Golf, Recreation & Open Space has informed
the Township Council that a certain entity is the lowest qualified
responsible bidder for said contract and has recommended that the
Township award such contract to said entity; and
WHEREAS, this is an open ended contract and the Township is
not obligated to order, accept, or pay for the goods and services
hereunder until an order is placed, and required certification of
available funds shall be made when goods or services are ordered.
NOW, THEREFORE, BE IT RESOLVED by the Township Council
of the Township of Evesham, County of Burlington, State of New
Jersey, as follows:
1. That the aforesaid contract is an open-ended contract

Clerk to return the bid security of the aforementioned successful
bidder after a contract is executed and after the successful bidder
has submitted to the Township a performance bond or other security,
if required.
5. That the Township Council hereby directs the Township
Mayor and Clerk to execute any contract documents that are necessary
to effectuate the terms of this Resolution, subject to review,

NOW, THEREFORE, in consideration of the mutual covenants,
terms and conditions, the parties hereby agree as follows:
1. MATERIALS AND SERVICES. The Contractor shall provide for the
Golf Course Pro-Shop Merchandise on an “as needed” basis in
accordance with the terms and conditions of the Notice to Bidders,
Instructions to Bidders, specifications, and the Bid Proposal,
hereinafter referred to as the Bid Documents, copies of which are
on file in the Office of the Township Clerk and available for
public inspection during regular business hours.
2. COMPENSATION. The Contractor shall receive payment as
set forth in his bid proposal dated October 30, 2019 and in the
manner specified in the bid documents; total payment for the term
of this contract shall not exceed $75,000.00. This is a term
contract permitting the purchase of items at a stated price on an
“as needed” basis, at which time certification of available funds
shall be provided for each purchase by means of an encumbered 116

purchase order, in accordance with Local Public Contract
Regulation 5:30-14.5(c)2ii.
3. TERM. The term of this agreement shall be for the period
of December 3, 2019 to December 2, 2020 for the aforesaid purpose
for a price not to exceed the cost of the items specified in the
bid proposal.
4. AFFIRMATIVE ACTION MANDATORY LANGUAGE. See “Schedule A”
attached hereto.
5. INSURANCE. The Contractor shall provide and maintain all
the necessary insurance including, but not limited to, workmen’s
compensation, general liability, automobile and professional
liability in the amounts and in the type as recommended by the
Township insurance broker and as referenced in the bid documents.
6. HOLD HARMLESS. The Contractor shall indemnify and save
harmless the Township, its officers, employees and agents for all
claims, suits or actions brought against the said Contractor, its
officers, employees and agents, for or on account of any injuries
or damages received or sustained by any party or parties by or
from the acts of Contractor or its servants, agents and employees
in doing the work and rendering the services herein contracted
for, or by or in consequence of any negligence in operations or
any improper material or equipment used, or on account of any act
or omission of Contractor or of its servants, agents and employees;
or account of or in consequence of the performance of this
contract; and also from all claims or damage for infringement or
any patent in fulfilling this contract. This indemnity shall
include attorneys’ fees and costs and all other expenses incurred
in the defense of any suit.
7. AMERICAN DISABILITIES ACT. The Contractor shall comply
with the requirements of the American Disabilities Act where
applicable.

8. TERMINATION. The Township reserves the right to
terminate the contract upon fourteen (14) days’ notice. The
contractor may terminate the contract upon fourteen (14) days’
notice in the event the Township fails to comply with its
responsibilities under the terms of this Agreement.
9. CHOICE OF LAW/FORUM/VENUE. In the event that any disputes
arise between the parties, or should any litigation be instituted
over this Contract, this Contract shall be governed by the laws of
the State of New Jersey. Moreover, any action that might arise
between the parties, arising from this Contract, shall be venued in
the Superior Court of New Jersey, Law Division, Burlington County,
New Jersey.
10. INTEGRATION. The parties agree that the terms and
conditions of this Agreement contain the Complete Agreement of the
parties and any oral understandings to the contrary are specifically
disavowed.

WHEREAS, the Evesham Township Council on June 3, 2019 adopted
Resolution No. 184-2019, authorizing the Call of Performance
Guarantee – On-Site Improvements for Woodview Apartments –
“Remaining” Troth Road Sidewalk Improvements in the Township of
Evesham; and
WHEREAS, the Call of the Performance Guarantee will not be
required at this time due to the developer’s performance in
completing the necessary work; and
WHEREAS, the Evesham Township Director of Community Development
has reported by correspondence dated November 12, 2019 indicating
the property was inspected by said Director and all sidewalk
improvements were found to be acceptable; and
WHEREAS, it is the desire of the Township Council of the
Township of Evesham to rescind Resolution No. 184-2019.
NOW, THEREFORE, BE IT RESOLVED by the Township Council of the

REJECTION OF REQUEST FORRELEASE OF MAINTENANCE GUARANTEE
THE VIEW AT MARLTON, LLCBLOCK 1.10, LOT (S) 4, 5 & 7
LANDSCAPING IMPROVEMENTS – PB 14-17.02
WHEREAS, a certain Maintenance Guarantee was filed by The
View at Marlton, LLC, to insure the satisfactory completion of
improvements required by the Planning Board of the Township of
Evesham; and
WHEREAS, the Township Planner with the authorization and
consent of the Township Manager, has conducted a site inspection
and has reported by correspondence dated November 25, 2019, that
the required improvements have not sufficiently been completed to
justify release of said Guarantee; and
WHEREAS, the Township Council cannot release said Maintenance
Guarantee without a written report approving the required
improvements; and
WHEREAS, the Township Council wishes to safeguard the public
interest in the completion of the aforesaid improvements; and
WHEREAS, per N.J.S.A. 40:14B-78, should the developer not
complete the required improvements by December 12, 2019, nor provide
another maintenance bond to expire in six months, in the amount of
$27,397.41, the Township of Evesham is authorized to "Call" said
Maintenance Guarantee and institute legal proceedings against said
Maintenance Guarantee.
NOW, THEREFORE, BE IT RESOLVED by the Township Council of the
Township of Evesham, County of Burlington, State of New Jersey as
follows:
1. That the Township council rejects the request to release
the aforesaid Maintenance Guarantee.
2. That the developer is required to complete the required
improvements by December 12, 2019, or provide another maintenance
bond to expire in six months in the amount of $27,397.41.154

and issuer of the aforesaid Maintenance Guarantee forthwith.
I HEREBY CERTIFY that the foregoing Resolution was adopted by
the Township Council of the Township of Evesham, County of
Burlington, State of New Jersey, at their meeting held in the
Meeting Room in the Municipal Complex, 984 Tuckerton Road, Marlton,
New Jersey 08053 on December 3, 2019.

BLOCK 21, LOT 1.01LANDSCAPING IMPROVEMENTS – ZB 16-12.02
WHEREAS, a certain Performance Guarantee was filed by a third
party guarantor, as designated in paragraph two hereinafter, to
insure the satisfactory completion of certain improvements
required by the Zoning Board of the Township of Evesham; and
WHEREAS, the Township Planner has received a request on
January 31, 2019 for release of the Performance Guarantee; and
WHEREAS, the Township Planner with the authorization and
consent of the Township Manager, has conducted a site inspection
and has found such improvements have been installed or completed;
and
WHEREAS, the Township Planner has reported by correspondence
dated November 14, 2019 and has recommended release of said
Performance Guarantee; and
WHEREAS, the Township Council desires to release said
Landscaping Performance Guarantee.
NOW, THEREFORE, BE IT RESOLVED by the Township Council of the
Township of Evesham, County of Burlington, State of New Jersey, as
follows:
1. That the Township Council hereby declares that the
improvements as described in the hereinafter listed Performance
Guarantee have been completed within the required time.
2. That the Township Council hereby authorizes the release
of the said Performance Guarantee held by the Township of Evesham
as follows:

3. That the Township Clerk is hereby directed to return the
original of said Performance Guarantee to the developer together
with a copy of this Resolution when the requirements in Paragraph
four (4) are met.
4. That the Township Council declares that the release of
said Guarantee is contingent upon the following:
a. The developer file in the Office of the Township Clerk
a two (2) year Maintenance Guarantee in the amount of $9,205.20
for improvements and escrow payment in the amount of $500.00.
b. Payment of all outstanding escrow balances.
I HEREBY CERTIFY that the foregoing Resolution was adopted by
the Township Council of the Township of Evesham, County of
