BY-LAW NUMBER 6 OF 2014

THE CORPORATION OF THE TOWN OF ST. MARYS

BEING A BY-LAW TO REGULATE TRAFFIC AND PARKING WITHIN THE LIMITS OF THE TOWN OF ST. MARYS.

WHEREAS it is deemed expedient to provide for the regulation of traffic and parking within the limits of the Town of St. Marys;

AND WHEREAS the Municipal Act, 2001, S.O. 2001, c.25, as amended Section 10 gives the Corporation of the Town of St. Marys the power to pass by-laws respecting its highways, including parking and traffic on highways;

AND WHEREAS the Council for the Corporation of the Town of St. Marys deems it expedient to regulate traffic and parking within its boundaries;

NOW THEREFORE BE IT ENACTED by the Council of the Corporation of the Town of St. Marys as follows:

1. Definitions

1.1 "Accessible Parking Permit" means a disabled person Parking permit issued under the Highway Traffic Act and is currently valid, or a similar permit, number plate or other marker or device bearing the international symbol of access for the disabled and lawfully issued by another jurisdiction that is currently valid and recognized under the Highway Traffic Act;

1.2 "Accessible Parking Space" means a parking space designated under this By-law for the exclusive use of a Vehicle displaying a Disability Permit;

1.3 "Authorized Sign" means any Traffic Control Device or Traffic Control Signal that has been erected on a Highway under the authority of this By-law for the purpose of regulating, warning or guiding Traffic;

1.4 "Boulevard" means that part of the Highway situated between the Curb line and the nearest lateral property line of the lot abutting the Highway, including a driveway, but does not include a Sidewalk or Shoulder or Multi-Use Trail;

1.5 "CAO/Cierk" means the Chief Administrative Officer/Clerk of the Town of St. Marys or designate as appointed by Council;

1.6 "Commercial Motor Vehicle" means a Motor Vehicle having permanently attached thereto a truck or delivery body and includes ambulances, hearses, casket wagons, fire apparatus, buses and tractors used for hauling purposes on the Highways;

I. 7 "Community Safety Zone" - means a part of a Highway which is designated by the Town as an area where public safety is of special concern, and where fines imposed upon conviction of a moving violation, are increased;

I .8 "Core Area" means the area shown on Schedule 14, but specifically described as the area bound by Peel Street, Jones Street, Water Street and Trout Creek;

1.9 "Corporation" means the Corporation of the Town of St. Marys;

1.10 "Council" means the Council of the Corporation ofthe Town of St. Marys;

1.11 "Crosswalk" means

(a) that part of a Highway at an Intersection that is included within the connections of the lateral lines of the Sidewalks on opposite sides of the Highway measured from the Curbs or, in the absence of Curbs, from the edges of the roadway, or

(b) any portion of a Roadway at an Intersection or elsewhere distinctly indicated for Pedestrian crossing by signs or by lines or other markings on the surface;

1.12 "Curb" includes the built-up edge of the traveled portion of a Highway;

1.13 "Curb line": (a) where a Curb has been constructed, means the line of the Curb; and (b) where no Curb has been constructed, means the edge of the Roadway;

1.14 "Designated Parking Space" or "Designated Parking Spaces" means a parking space designated under this by-law for the exclusive use of a vehicle displaying a permit in accordance with the requirements of this By-law;

1.15 "Director of Operations" means the Director of Operations of the Town of St. Marys or a designate appointed by the Director of Operations to act on behalf;

1.16 "Gross Weight" means the combined weight of Vehicle and load;

1.17 "Heavy Vehicle" means a commercial Vehicle for which Gross Weight as shown on the registration permit issued under the Highway Traffic Act exceeds 3 tonnes; does not include a vehicle operated by or on behalf of the Corporation or a school vehicle which is in the course of transporting children or persons with a disability to and from school"

1.18 "Highway" includes a common and public highway, street, avenue, parkway, driveway, square, place, bridge, viaduct or trestle, any part of which is intended for or used by the general public for the passage of Vehicles and includes the area between the lateral property lines thereof;

1.19 "Highway Traffic Act" means the Highway Traffic Act, R.S.O. 1990, Chapter H.8, as amended;

1.20 "Horse Drawn Carriage" means a carriage, wagon, dray or other conveyance or vehicle with a driver and drawn by horses;

1.21 "Intersection" means the area embraced within the prolongation or connection of the lateral Curb lines or, if none, then ofthe lateral boundary lines of two or more Highways that join one another at an angle, whether or not one Highway crosses the other;

1.22 "Motor Assisted Vehicle" includes a motor-assisted bicycle, roller skate, roller blade, skateboard, coaster, toy Vehicle, mini-bike, go-cart, scooter and any other motor-assisted transportation device that weighs not more than 55 kilograms and that does not have sufficient power to enable the transportation device to attain a speed greater than 50 kilometres per hour on level ground within a distance of 2 kilometres from a Standing start, but does not include a wheelchair;

1.23 "Motor Vehicle" " includes an automobile, a motorcycle, a motor-assisted Vehicle unless otherwise indicated in this By-law, and any other Vehicle propelled or driven otherwise than by muscular power, but does not include a street car or other motor Vehicle running only upon rails, a power-assisted bicycle, a motorized snow Vehicle, a traction engine, a farm tractor, a self-propelled implement of husbandry or a road-building machine;

1.24 "Multi-Use Trail" means the part of a Highway with surface improved with asphalt concrete, or gravel for use of Pedestrians, non-motorized Vehicles, and Motor Assisted Vehicle;

1.25 "Municipality" means the Corporation of the Town of St. Marys;

1.26 "Municipal Law Enforcement Officer" means a by-law enforcement officer appointed by the Town;

1.27 "On-Road Allowance Parking Permit" means a permit to park a motor vehicle on highways or parts of highways specified on the permit during the times authorized therein;

1.28 "Parade" means a procession or body of Pedestrians, numbering more than 1 0, Standing, marching or walking upon any Highway, or any group, of ten or more Vehicles, except funeral processions, Standing or moving on any Highway.

1.29 "Park" or "Parking", when prohibited, means the Standing of a Vehicle, whether occupied or not, except when Standing temporarily for the purpose of and while actually engaged in loading or unloading merchandise or passengers;

1.30 "Peace Officer'' means a Police Officer and/or a Municipal Law Enforcement Officer;

1.31 "Pedestrian" means any person afoot, any person in a wheelchair, any child in a wheeled carriage, and any person riding a non-motorized bicycle with wheels less than 50 centimeters in diameter;

1.32 "Police Officer" means a member of the Ontario Provincial Police or a person authorized by the Ontario Provincial Police thereof to regulate or direct Traffic;

1.33 "Provincial Offences Acf' means the Provincial Offences Act, R.S.O. 1990, c., P.33, as amended;

1.34 "Roadway" means the part of the Highway that is improved, designed or ordinarily used for vehicular Traffic, but does not include the Shoulder, and, where a Highway includes two or more separate Roadways, the term "Roadway" refers to any one Roadway separately and not to all of the Roadways collectively;

1.35 "Shoulder'' means that portion of a Highway lying adjacent to the Roadway that is improved with granular or paved surface and is not intended for the passage of Motor Vehicles;

1.36 "Sidewalk" means that portion of a Highway with a surface improved with asphalt, concrete or gravel, intended for the use of Pedestrians, located between the Curb line and the nearest lateral property line of the lot abutting the Highway;

1.37 "Stand or Standing" when prohibited, means the halting of a Vehicle, whether occupied or not, except for the purpose of and while actually engaged in receiving or discharging passengers;

1.3 8 "Stop or Stopping" when prohibited, means the halting of a Vehicle, even momentarily, whether occupied or not, except when necessary to avoid conflict with other Traffic or in compliance with the directions of a police officer or of a Traffic control sign or signal;

1.39 "Town" means the Corporation of the Town of St. Marys";

1.40 "Traffic Control Device" means any sign, or Roadway, curb or Sidewalk marking, or other device erected or placed under the authority of this by-law for the purpose of guiding or directing Traffic;

1.41 "Traffic" includes Pedestrians, ridden or herded animals, Vehicles and other conveyances either singly or together while using any Highway for the purpose of travel;;

1.42 "Traffic Signal" means any device manually, electrically, or mechanically operated for the regulation of Traffic;

1.43 "Unauthorized Motor Vehicle" means a motor vehicle that does not have affixed thereto, or is not clearly displaying a current permit issued under this by-law;

1.44 "Vehicle" includes a Motor Vehicle, trailer, traction engine, farm tractor, road-building machine, bicycle and any vehicle drawn, propelled or driven by any kind of power, including muscular power, but does not include a motorized snow vehicle or a street car.



2. For the purpose of this By-law, where no definition is made herein and a definition is required, the applicable definition shall be as set forth in the Highway Traffic Act, R.S.O. 1990, Chapter H.8 as amended from time to time.

3. Peace Officer to Enforce By-law

3.1 A Police Officer may enforce all provisions of this By-law.

3.2 A Municipal Law Enforcement Officer may enforce all provisions of this By-law, except those pertaining to a moving Vehicle.

3.3 The Director of Operations or designate shall, in co-operation with the Ontario Provincial Police, be responsible for establishing, implementing and maintaining a proper and adequate administrative enforcement program to monitor and regulate the provisions of this By-law.

4. Obedience to Traffic Control Devices or Signals

4.1 No person shall fail to promptly obey a signal or direction given by a Police Officer or a Traffic Control Device, or a Traffic Signal.

4.1 Direction of Traffic by Police Officer

4.1 Where a Police Officer reasonably considers it necessary; (a) to ensure orderly movement of Traffic; (b) to prevent injury or damage to persons or property; or (c) to permit proper action in an emergency, he or she may direct Traffic

according to their discretion, despite the provisions of this By-law, and every person shall obey his instructions.

5. Traffic Control Signals and Traffic Control Devices

5.1 The Director of Operations or designate, with the approval of the Ministry of Transportation of Ontario where required by law, is authorized to place or erect and to maintain such signs and Traffic Control Signals authorized by Council, or as are required to regulate, warn or guide Traffic for the safety or convenience of the public.

5.2 The Director of Operations or designate, upon direction by Council, is authorized to place such pavement markings as they deem advisable for the purpose of directing and guiding Traffic and the parking of Vehicles.

5.3 The Director of Operations or designate is authorized, notwithstanding the other provisions of this By-law, to place, erect, maintain, move and require such Traffic Control Devices and Traffic Control Signals as are required for reasons of emergency or safety or for an activity for which the Town has granted a permit.

5. Traffic Control Signals and Traffic Control Devices (continued)

5.4 No person shall place, maintain or display upon or in view of any Highway or street allowance any unauthorized sign, signal, marking or device which purports to be or is an imitation of or resembles a Traffic Control Device or railroad sign or signal, or which attempts to direct the movement of Traffic, or which hides from view or interferes with the effectiveness of any Traffic Control Device or any railroad sign or signal, and no person shall place or maintain upon any Highway or street allowance any Traffic sign or signal bearing thereon any commercial advertising. This shall not be deemed to prohibit the erecting upon private property adjacent to Highways of signs giving useful directional information and of a type that cannot be mistaken for Traffic control. Where conflict exists between this section and the Municipality's Sign By-law 33-2005 the requirements of the sign by-law shall prevail. Any unauthorized sign, signal marking or device so erected shall be forthwith removed by the person or persons responsible for the placing of same, after notice, verbal or written, by the Director of Operations or designate or Ontario Provincial Police.

5.5 Electric Traffic Control Signal lights, comprising red, amber and green lights, are authorized and shall be installed at the Intersections set out in Schedule 3 hereto.

5.6 Stop signs shall be erected and maintained by the Director of Operations or designate at all Intersections as shown on Schedule 1 to this by-law and in accordance with the Highway Traffic Act.

5.7 All way Stops shall be established and maintained by the Director of Operations or designate at all Intersections as shown on Schedule 1 to this by-law and in accordance with the Highway Traffic Act.

6. Sidewalks for Pedestrians

6.1 No person shall use any Sidewalk for any purpose other than Pedestrian Traffic, except as specifically permitted in this or any other by-law.

7. Operation of Vehicles

7.1 No person operating a Vehicle travelling upon a Roadway at less than the normal speed of Traffic at that time and place shall fail to drive the Vehicle in the right-hand lane then available for Traffic or as close as practicable to the right hand curb or edge of the Roadway, unless the person is:

(a) Operating a Vehicle overtaking and passing another Vehicle proceeding in the same direction;

(b) Operating a Vehicle while preparing for a left turn at an Intersection or into a private road or driveway; or

(c) Operating a road service Vehicle.


7. Operation of Vehicles (continued)

7.2 No person while driving a Vehicle shall start, stop, turn or change the Vehicle unless such turn can be made safety and without interfering with other Traffic.

7.3 No person while driving a Vehicle shall turn such Vehicle within a Highway so as to proceed in the opposite direction on:

(a) Queen Street between James Street and Thomas Street (b) Water Street between Trout Creek and Elgin Street

(c) Wellington Street between Trout Creek and Elgin Street

(d) Church Street between Station Street and Elizabeth Street

7.4 With the exception of a person participating in a Parade, no person shall stand, sit or ride on or in any portion of a Vehicle not designed for the carrying of passengers or merchandise and no person shall operate Vehicle while any person is so standing, sitting or riding.

7.5 No person shall while driving a Vehicle allow such Vehicle to be reversed or backed before it is first ascertained by observation that such movement can be safely made;

7.6 No person shall while driving a Vehicle allow such Vehicle to be reversed or backed before there is given an unmistakable warning signal to Pedestrians and approaching Vehicles of such movement;

7.7 No person while driving a Vehicle shall allow such Vehicle to be driven upon or along any Highway so as to obstruct Traffic or when the Vehicle is so overloaded that the motive power, mechanical or otherwise, is unable to move such Vehicle at a reasonable rate of speed;

7.8 No owner or operator of a Motor Vehicle shall obstruct a street with a Motor Vehicle which becomes stalled or for any reason cannot be moved by its ordinary motive power or shall fail to arrange for the Vehicle to be immediately removed;

7.9 No person while driving a Vehicle shall allow such Vehicle to be driven so that it intersects a funeral procession in motion except under direction of a Police Officer;

7.10 No person operating a Vehicle involved in a funeral or other procession shall fail to drive the Vehicle as near to the right-hand edge of the Roadway as practicable and safe;

7.11 No person operating a Motor Vehicle shall drive on any Highway in the Town other than in a single file and no person operating a bicycle shall ride on any Highway in the Town other than in a single file.

7.12 No horse-drawn Vehicle shall be driven at a run or gallop.


7. Operation of Vehicles (continued)

7.13 No person shall drive, or attempt to drive on or over, or tamper with, or walk on any newly painted line or series of lines, on any Roadway or Shoulder, when the presence of such is indicated by signs, markers or otherwise.

7.14 No person operating a Vehicle shall use engine retarder brakes in the Town, except to avoid or reduce the impact of a collision or in the case of such other emergency;

7.1 5 No person shall drive a Vehicle, except an emergency Vehicle or a Vehicle authorized by the Director of Operations or designate or by a Police Officer, on any Highway that is roped, barricaded or marked by an Authorized Sign prohibiting its use.

7.16 No person shall cause a vehicle or combination of vehicles to move upon a highway with the gross vehicle weight in excess of the posted maximum weight for the portion of highway to be travelled on.

8. Bicycles, Electric Bicycles, Motorized Wheelchairs, Mopeds, Skateboards, Rollerblades, All Terrain Vehicles

8.1 A person driving a bicycle or electric bicycle on the Roadway shall: (a) drive as near the right-hand side of the Roadway as practical, but may

occupy a lane of a Highway if the lane is not wide enough to share; and (b) exercise due care when passing a Parked, Stopped or Standing Vehicle or

one proceeding in the same direction.

8.2 No person shall drive a bicycle or electric bicycle with a wheel or wheels more than sixty-one (61 em) centimeters in diameter upon a Sidewalk in the core area, as set out in Schedule 14.

8.3 No person shall operate a motorized wheelchair at a rate in excess of a walking pace.

8.4 No operator of a motorized wheelchair shall drive their motorized wheelchair on the Roadway unless it is impracticable or unsafe to drive their motorized wheelchair on the Sidewalk. If the Roadway is used then the operator of the motorized wheelchair shall travel along the left Shoulder of the Roadway facing oncoming Traffic.

8.5 No person shall operate a Moped on a Sidewalk or multi-use trail.

8.6 No person shall at anytime use or operate skateboards, roller skates, in-line skates or other similar devices or mode of transportation on municipal Sidewalks in the core area, as set out in Schedule 14.

8.7 No person shall drive an all terrain Vehicle on public roads, Multi-Use Trails or road allowances and shall only be used on private property at the consent of the property owner.


9. Speed Limits

9.1 No person shall operate a Vehicle in excess of the rates set out in Schedule 7 to this By-law.

9.2 No person shall operate a Vehicle at a rate of speed in excess of twenty-five kilometers per hour within any park or playground, and park or playground areas shall include Veterans Circle (Flats) in the Town.

10. Through Heavy Truck Traffic Route

1 0.1 In this section, ''through heavy traffic" means the use of a Highway of a Vehicle, object or contrivance for moving loads, which, including the load, has a Gross Weight in excess of three tones and is in use for the purpose other than the making of a delivery or a pickup of a load or part thereof at premises abutting the designated Highway, but shall not include Motor Vehicles designated and used for carrying passengers or those ofthe Fire Department of the Town of St. Marys or road maintenance Vehicles.

10.2 No person shall operate a Heavy Vehicle on any Highway within the Municipality, except on the Highways or parts of Highways described in Schedule 10 of this By-law as "Heavy Vehicle Routes".

10.3 Notwithstanding subsection 1 0.2, a Heavy Vehicle may be driven to make a direct delivery to or collection from a bona fide destination in the Town, provided that the operator of the Heavy Vehicle proceeds by the most direct route between the nearest truck route and the place of delivery or pick up in the Town and on completion of the conduct of business, the Heavy Vehicle is returned by the most direct route to the nearest of the Truck Routes.

10.4 No person shall operate a Heavy Vehicle on the Highways set out in Schedule 10 under the heading "Time Limitations" except during the time periods set out in Schedule 1 0 under the heading "Time Limitations".

11. Tracking Mud or Debris Upon a Public Highway

11.1 No person shall drive, operate or permit to be driven or operated, any Vehicle or equipment of any nature or kind in such a manner as to track mud or debris upon a Highway;

11.2 Any person who tracks mud or debris upon a Highway contrary to subsection 11.1 of this By-law, in addition to any other penalty, shall be liable to the Town for costs of clean up or removal of the mud or debris.


12. Parking Regulations and Restrictions

12.1 All Parking in the Town of St. Marys shall be parallel Parking. No person shall Park a Vehicle on any street except upon the right-hand side of the Roadway, having regard for the direction in which the Vehicle is required to proceed, and when Parked on a Roadway, the right front and rear wheels or runners of the Vehicle shall be parallel to and distant not more than 0.3 metres from the right-hand edge of the Roadway adjacent to which such Vehicle is Parked.

12.2 No person shall Park on any Highway a Motor Vehicle which is advertised, marked, priced or displayed for sale;

12.3 No owner or operator of a Vehicle Standing on any Highway shall fail to move it away at the request of a police officer when, in the opinion of such officer, Traffic congestion, proximity to a frre or any other condition renders the removal of such Vehicle expedient.

12.4 No driver or owner of a Motor Vehicle shall cause their Vehicle to be Parked upon any Highway or street within the Town between the hours of 2:00 a.m. and 6:00 a.m. of the same day except as set out in By-law No.6 of2014.

12.5 A person may park a horse drawn carriage within the designated area located at 64 Wellington Street South.

13. On-Road Allowance Parking Permits

13.1 On-Road Allowance Parking Permits for the parking of motor vehicles are hereby authorized and assigned and Council of the Town herein designated as the Designated Parking Spaces as set out in Schedule "4-2" of this by-law.

13.2 Where a sign has been erected and is on display indicating parking is prohibited without a permit, no person shall park a motor vehicle at any time within the Designated Parking Spaces unless such person is the holder of an On-Road Allowance Parking Permit issued under this By-law.

13.3 Only the residents of the properties set out in Schedule "4.2" of this by-law are eligible for an On-Road Allowance Parking Permit for the Designated Parking Places.

13.4 Any eligible person wanting an On-Road Allowance Parking Permit for one or more Designated Parking Places shall file an application with the Clerk of the Town. An application for an On-Road Allowance Parking Permit shall contain the following information:

a. name and address of applicant;

b. the licence number, make and year of the motor vehicle of which the applicant is the registered owner; and,

c. a statement that the owner of the motor vehicle is, at the date of application, a resident of a property listed in this By-law.


13. On-Road Allowance Parking Permits (continued)

I3.5 An On-Road Allowance Parking Permit shall contain the permit number, the name and address of the owner of the motor vehicle, and the make, year and licence number of the motor vehicle for which the permit is issued.

I3.6 An On-Road Allowance Parking Permit shall authorize parking within a Designated Parking Space at a time specified and approved by the permit, provided that no motor vehicle issued with a permit shall:

a) remain parked in a Designated Parking Space for a longer period of time than seventy-two (72) consecutive hours;

b) be washed, greased or repaired, except for such repairs as have been necessitated by an emergency;

c) be fitted with a display that it is for sale;

d) interfere with movement of traffic or the clearing of snow from the highway; and

e) interfere with maintenance and works on the highway.

I3.7 Any person who applies for an On-Road Allowance Parking Permit shall abide by the terms and conditions on the approved permit with the Municipality in the form prescribed by the Director of Operations.

I3.8 While a motor vehicle is parked within a Designated Parking Space pursuant to an On-Road Allowance Parking Permit issued pursuant to this By-law, the permit shall be placed on or affixed to the motor vehicle at the lower comer of the windshield on the driver's side of the motor vehicle.

I3.9 The Town may revoke any permit issued pursuant to this By-law if its holder is convicted of a breach ofthis By-law.

General

I3.10 Nothing in this By-law shall permit a motor vehicle issued with an On-Road Allowance Parking Permit to be stopped or parked at any location other than the Designated Parking Space when stopping or parking is prohibited by any applicable law including any provision of the Highway Traffic Act or the Town of St. Marys Traffic By-law 53 of 20 II, as amended.

I3.I1 Notwithstanding that a person may hold a permit authorizing parking within a Designated Parking Space at prescribed hours, such person shall be subject to the provisions of the Highway Traffic Act.

I3.12 Where official permit parking signs are erected and on display, no person shall park a vehicle at the side of any road between the limits set out by the official permit parking signs unless the vehicle displays a valid permit issued under this By-law.

13 .I3 All Designated Parking Spaces shall be identified by official permit parking signs.

13 .I4 No person shall park in a Designated Parking Space, or be entitled to the benefit of an exemption under this By-law, unless a currently valid permit has been issued to that person and such permit is displayed on or in the vehicle in accordance with the requirements of this By-law.


14. Parking Prohibited

No person shall on any Highway Park any Vehicle or part thereof, in any of the following places: :

14.1 In a position that prevents the convenient passage of any other Vehicle into or out of a driveway or private Roadway;

14.2 Within 3 metres of a point on the curb or edge of the Roadway adjacent to any fire hydrant;

14.3 Within 10.8 metres of an Intersection;

14.4 On a Sidewalk or over any Boulevard;

14.5 Within six metres of the nearest Crosswalk or of an Intersection;

14.6 Within nine metres of a bridge or curve;

14.7 For the purpose of displaying the Vehicle for sale;

14.8 For the purpose of washing, greasing or repairing the Vehicle;

14.9 Within a distance of 4 metres of the tracks of any railway;

14.1 0 In a position which will prevent the convenient removal of any other Vehicle previously Parked or Standing;

14.11 In a manner known as double Parking, that is, on the same side of the Highway beside or adjacent to the side of another Vehicle Parked or Standing adjacent to the Curb side of such Highway;

14.12 In front of an entrance to the hospital

14.13 No person shall operate or Park any Vehicle upon any land owned by the Town which includes but is not limited to: playgrounds, trails, Boulevard, recreation or public park, or any utility right-of-way, except on such part thereof as the CAO/Clerk may designate by a sign or signs for vehicular use or Parking.

14.14 No person shall park, stand or stop a vehicle upon a highway or on a municipal parking lot or on private property in a accessible parking space unless that vehicle is transporting a disabled person or persons and also displays a valid accessible parking permit issued by the Ontario Ministry of Transportation. Schedule 4-1 On-Street Accessible Parking Spaces to this by-law.


15. Parking Restrictions on Specified Highways

15.1 When an Authorized Sign is on display, no person shall Park a Vehicle on any of the Highways or portions thereof set out in Schedule 4 to this by-law;

15.2 When an Authorized Sign is on display, no person shall allow a Vehicle to remain Parked on those parts of the Highways described in Schedule 6 to this By-law for a period of longer than three hours at any one time.

16. Loading and Unloading

16.1 Whenever possible, drivers of Motor Vehicles shall load such Vehicles or unload such Vehicles from the side and the driver shall Park the Vehicle within .30 meters of the Curb. No person shall cause their Vehicle to be backed up to the Curb except during actual loading or unloading, and in such case no longer than the actual loading or unloading required. The driver or owner of a Vehicle shall ensure that the horse or horses attached to the Vehicle, tlie motive power unit attached to the Vehicle, if such motive power unit is detachable from the Vehicle, shall be turned at right angles to the Vehicle and in the direction of movement of Traffic on the same side of the Highway.

16.2 When an Authorized Sign is on display, no owner or driver of a Vehicle shall permit their Vehicle to Stand or be Parked on any Highways or portions thereof, except for the purpose of taking on or discharging passengers, or for the loading or unloading of merchandise on the Highways, or portions thereof.

17. Emergency Vehicles

17.1 Nothing in this By-law prohibits police Vehicles, by-law enforcement Vehicles, ambulances, frre trucks or any other emergency Vehicle as well as municipal Vehicle engaged in Highway repair, maintenance, or inspections from being Parked on the Roadway by their operators in the performance of their duties.

18. Occupying recreation Vehicle or trailer while Parked

18.1 No person shall occupy any recreation Vehicle or holiday trailer as a dwelling or sleeping place at any time while it is Parked on a Highway.

19. Temporary Street Closing

19.1 No person representing a club, group, or organization, shall be allowed to block or close off a street without first obtaining: (a) Road Closure Application form the Municipal Operation Centre, 408 James

Street South, must be submitted at least 30 days in advance and; (b) Final consent from Council or in accordance with By-law No. 38 of2013

Delegation to Staff for approval.


20. Conflict with Highwav Traffic Act

20.1 In the event of a conflict between the provisions of this by-law and the Highway Traffic Act, the provisions of the Highway Traffic Act prevail.

21 Conflict with Another Municipal By-law

21.1 In the event of a conflict between the provisions of this by-law and any other by-law of the Town, the provision that establishes the higher Standard to protect the health, safety and welfare of the general public shall prevail.

22. Validity

22.1 If a court of competent jurisdiction declares any subsection, section or part of this By-law invalid, it is the intention of Council that the remainder of the By-law shall continue to be in force.

23. Severability

23.1 The clauses, schedules and parts of schedules of this by-law shall all be severable and any part of any of the schedules hereto annexed may be by by-law altered by adding thereto or deleting therefrom;

25. Enforcement and Penalties

25.1 Except where otherwise expressly provided by this by-law or the Highway Traffic Act, every person who:

(a) contravenes any provision of this by-law; or

(b) is the owner of a Vehicle that is Parked or Stopped in contravention of this by-law, is guilty of an offence and on conviction is liable to any penalty as provided in the Provincial Offences Act, R.S.O. 1990, c. P.33, as amended.

25.2 A vehicle parked or left contrary to this By-law may be removed or impounded at the vehicle owner's expense.

25.3 The costs and charges incurred for removing, taking away and storing a motor vehicle pursuant to the provisions in this By-law, shall be a lien upon the motor vehicle, which lien may be enforced in the manner prescribed by the Repair and Storage Liens Act, R.S.O. 1990, c. R.25, as amended.

25.2 Notwithstanding all other provisions of this by-law, in respect of penalties for violations of the Parking and Stopping provisions of this by-law, any person may, upon presentation of a Parking infraction notice issued by a police officer alleging the commission of any of the offences under this by-law, pay out of Court within (5) five days from the date of said notice and penalty set out opposite such offence. Upon such payment no further proceedings shall be taken under this by-law in respect to the said alleged offence.

25.3 Such payment to be made to the Town of St. Marys payable at the Town Hall, 175 Queen Street East.

25.4 If a voluntary payment is not made in accordance with the procedure provided in Section 24.2, the procedure of the Provincial Offences Act, or any successors thereon, shall apply.

25.5 Any person who contravenes any section of this by-law for which a penalty is provided by the Highway Traffic Act is subject to such penalties.

25.6 All police Vehicles, by-law enforcement Vehicles, ambulances, fire trucks or any other emergency Vehicle as well as municipal Vehicles and Vehicles designated by the CAO/Clerk are exempt.

26. Repealed

26.1 By-laws No. 53 of2011 and all amendments thereto are hereby repealed on the day which this By-law comes into force and effect.


27. Enactment

27.1 This By-law comes into force and effect on the 25th day of March, 2014.

28. Short Title

28.1 The short title of this By-law is the Traffic and Parking By-law.

TOWN OF ST. MARYS- SPEED LIMITS

I. All speed limits within the Corporation of the Town of St. Marys shall be 50 kmlhr, with the exception of Section 10.2 ofthis by-law, and the following:

(a) Speed limit along Egan Avenue from James Street North to Wellington Street North shall be 40 km/hr.

(b) Speed limit along Maxwell Street from James Street South to Huron Street shall be 40 kmlhr.

(c) Speed limit along Thomas Street from town limits to Queen Street West shall be 40 kmlhr.

(d) Speed limit along Wellington Street South from Park Street to Jones Street East shall be 40 kmlhr.

1. One-way Traffic only on Highway commonly known as Veterans Circle (Flats).

2. One-way Traffic only on Jardine Street - westbound from Wellington Street to Water Street.

From Park Street to Jones Street East. This designation is effective 24 hours a day, seven days a week and every month of the year.
