Mayor Lipuma presented Mr. Roberts an Outstanding Service Award in recognition of theconsulting services he had provided to the Town and the Community Association on John’s IslandRoad planning since 2005.
B. Cobble Hill Website Redesign Presentation
Mr. Weaver stated that last year Council approved funding of a complete redesign of the Town’s
website. Cobble Hill was awarded the contract and has been working with Mrs. Braswell
Edgerton and her team in development of the website. The focus was to make the site more user
friendly, interesting, and easier to navigate. He indicated it is not the finished design and content
has not been uploaded but he asked for feedback on the presentation.
Mr. Austin Dandridge, with Cobble Hill, presented an initial overview of the new design, look and
feel of Town’s new website.
C. Greene, Finney and Horton FY 2015/2016 Audit Presentation
Mr. Wilson stated this was the second presentation of the annual audit to Council from the
outside auditor. He requested that only members of Council ask questions during the
presentation.
Ms. Emily Sopczak with Green Finney and Horton made a presentation of the Town’s Fiscal Year2016-2017 audit report. She reviewed the Town’s audit with a PowerPoint presentation tohighlight the results of the audit and the financial condition of the Town as of June 30, 2016. Itemsdiscussed were:
• Responsibilities of the Town and of Audit firm
• Auditor opinion — the Town received an “Unmodified Opinion”
• Town’s Financial Condition
o Good financial condition as of June 30, 2016
• Town’s General Fund Balance; Revenues and Expenditures
o Unassigned fund balance is $5.4M• Revenues - $5.2 million for 2016; $540k or 11.5% higher than budget• Expenditures - $1.5M (23.4%) decrease from 2015

Mr. Jimmy Bailey, COO — Kiawah Island Community Association
Mr. Bailey expressed his appreciation to the Town and Ms. Tillerson for their leadership and spirit
of cooperation leading up to, during, and after Hurricane Mathew.
VIII. Old Business:A. Ordinance 2016-07 — An Ordinance to Re-Zone Parcel 207-05-00-116 to R-3/C
Residential/Commercial Zoning District and to Amend Article 12, Section 12-62, Zoning Map
Accordingly — Second Reading

Mrs. Johnson made a motion to approve the second reading of Ordinance 2016-07 to amend
the Zoning District Map from CS to R-3/C. The motion was seconded by Mr. Wilson and unanimously
passed.
B. Ordinance 2016-08 - An Ordinance to Amend the Town of Kiawah Island comprehensive Plan
Map lx.2, Future Land Use; To Change the Future Land Use Designation for the Subject
Property (207-05-00-116) from “Civic and Institutional” to “Mixed Use (Residential
Commercial)” — Second Reading
Mr. Weaver made a motion to approve the second reading of Ordinance 2016-08 to amend the
Comprehensive Plan Map. The motion was seconded by Mr. Wilson and unanimously passed.
IX. New Business:A. Approval of Accurate Window Cleaning ContractAmendment
Ms. Tillerson stated the Ways and Means Committee reviewed the contract amendment and
recommended approval. She stated Accurate Window Cleaning has been contracted with the
Town since 2011 to clean the exterior of the building including windows and gutters. Their
contract expires October 30, 2016 and they have completed their contractual time. With tentative
completion dates for the new Municipal Building being July 2017, the present building would only
need cleaning for seven months. Extension of the active contract at its present cost would carry
the Town through a seamless transition prior to the new building being bid out.
Mr. Wilson made a motion to approve the Accurate Window Cleaning Contract Amendment. Themotion was seconded by Mr. Weaver and was unanimously approved.
B. Approval of Contractor Selection for Beachwalker Drive Drainage Improvements
Ms. Tillerson stated the Ways and Means Committee reviewed the contract amendment at the
October meeting and recommended approval.
Mr. Lameo stated the Town contracted with W.K. Dickson Engineering to perform an analysis of
the aging storm drainage infrastructure from the Parkway to Beachwalker Drive to Town Hall. The
system report which outlined the needed repairs was presented to the Town with a list of repairs
and project was issued a “Request to Bid” per our regulations.
Bids were completed and returned from four companies, opened and reviewed by our
engineering firm and Town staff. IPW Construction Group, LLC of North Charleston was the low
bid at $139,071.60 and was found to meet the qualification requirements submitted in accordance
with Section 01110 of the Specifications. Ways and Means Committee recommended approval and
award of this contract to IPW Construction Group, LLC.
Mayor Lipuma made a motion to approve the proposal from IPW Construction Group, LLC in the
amount of $139,071.60 for storm drainage infrastructure repairs. The motion was seconded by Mr.
Weaver and was unanimously passed.
C. Approval of Amendment to Beach Patrol Contract

Ms. Tillerson stated the Ways and Means Committee reviewed the contract amendment at the
October meeting and recommended approval
Mr. Lameo stated the Town has contracted with Island Beach Services to supply Patrol Services
for the beach and its present contract time period of three (3) years and two (2) one-year
extensions has run its term, ending October 31, 2016.
Due to the recent storms, the Town has been preoccupied with debris removal and will need
additional time to create and send out the required bid packages for this contract. During this
time, the staff would request extending the present contract up to a maximum six months or
such time as the bids are returned and approved.
Mayor Lipuma made a motion to approve the Amendment to Beach Patrol Contract up to a
maximum six months. The motion was seconded by Mr. Weaver and unanimously passed.
D. Approval Selection of new Town Attorney an_d a One-Year Contract for Town Attorney ServicesEffective January 1, 2017
Mayor Lipuma stated that previous discussion outlined the scope, need, and search for a new
Town Attorney which resulted in the recommendation of Mr. Dwayne Green of the Green Law
Offices.
As a member of the Search Committee Mr. Wilson stated the Committee went through an
exhaustive search process with the release of a Request for Qualification (RFQ) which resulted in
six applicants. The six were evaluated and narrowed to two applicants. Both were interviewed
with the selection by unanimous vote, with Mr. Green as the recommended candidate. Mr. Wilson
stated Mr. Green was a highly qualified and experienced Municipal attorney.
Mr. Wilson made a motion to approve Mr. Green and Green Law Offices and enter into a one-year
contract in the amount of $80,000.00 beginning January 1, 2017. The motion was seconded by Mr.
Weaver and was unanimously passed.
X. Committee Reports:
Mr. Wilson stated he had no committee reports but reported on the continuing work being done
on the Johns Island Roads area. He stated Mr. Roberts is working on a proposal for grant funding
to do an engineering study on a bikeway that crosses Johns Island. He added the Mayor is going
to speak with Mayor Tecklenberg to discuss possible support from the City of Charleston for the
study and help funding the cost that is not covered by the grant. Members engaged in an in-depth
discussion of the study.
Mrs. Johnson reported on the upcoming Arts Council events:
• Charleston Symphony Orchestra on Saturday, November 5th at East Beach at 5:00pm
• Rescheduled Jeanne Robertson, humorist, November 9’ at East Beach at 7:3opm
• USC Concert Choir, November 18th at Church of Our Savior at :opm

Mrs. Johnson stated Environmental Committee will be meeting next week, Tuesday, November8th
Mr. Weaver reported the Public Safety Committee will be working on the assessment of the
Town’s Emergency Plan from the Hurricane. He indicated work has begun with Ms. Tillerson will
be evaluating staff on their roles and the response. Mr. Cave, the Town’s consultant, will begin
interviewing Council members for their input and reactions, and input will be complied from all
the different agencies involved along with the different entities on the Island. Mr. Weaver stated
resident input will also be requested for different areas such as communications.
Mr. Weaver reported on the Fire District’s Capital Improvement Plan which includes the rebuilding
both the Stations on the Island. One of the advantages of the new stations is they will allow for
the increase in the number of firefighters and apparatus which can be housed in the facility
thereby increasing the number of firefighters on each apparatus.
Mr. Weaver stated a variance was required and submitted to the Board of Zoning Appeals (BZA)
for the rebuilding of station on Flyway. The BZA approved the request at the October 17th meeting
and construction should begin in the near future.
Mayor Lipuma reported on the new Municipal Center stating that steel work is ongoing for the
main building and garage with sheeting expected to begin in the next week. Completion of the
project is in July of 2017, the small delay coming due to storms. The Mayor indicated he was
pleased with the work that had been performed by the contractor.
XI. Town Administrator’s Report:
Ms. Tillerson stated Mr. Lameo and Mr. Jordan would be presenting reports on the status ofbeach and boardwalks.
Mr. Jordan stated that immediately following the storm he did a GPS survey and compared it to a
survey done before the storm. He estimated a 20 to 100 feet erosion rate, depending on the
section which was confirmed, in more detail, by the letter received the Town yesterday from
Coastal Science and Engineering. He reviewed the highlights of the report;
Beach Update• Kiawah is fortunate to have an expansive healthy, dune system that weathered the storm
well• Kiawah’s beach suffered significant erosion during Hurricane Matthew.
o Erosion rates averaged 20-75 feeto Highest rates at Captain Sam’s spito 30 feet at Sanctuaryo 20 feet at Ocean Course
• Storm surge and heavy surf flattens the beach profile and removes sand from the upperbeach and deposits it on the lower beach or in underwater bars
• Beach will naturally heal as sand from these areas migrates back up the profile to the dunes.CSE expects significant recovery in the months ahead with most recovery-taking place afterthe winter season. Beaches generally erode during fall and winter (higher tides, NE winds)and accrete during spring/summer (lower tides, S winds)
Recommendations• Beach Walkovers

o Damaged portions of walkovers should be removed from the beach and rebuiltwith the seaward end of the steps as close to the existing primary dune aspossible. Ideally, beach should be allowed to recover before significantreconstruction takes place.
Sand Fencingo Installation of sand fencing is useful for promoting dune growth in flat, dry sand
areaso CSE does not believe sand fencing is necessary at this timeo If sand fencing is used in certain areas, it would be more beneficial to delay
installation until the spring season (prior to 1 May for turtle concerns) to benefitfrom the natural beach recovery cycle and avoid potential washout of fencingduring winter storms.
o Installation of sand fencing will need to be accomplished under a SCDHEC—OCRMgeneral permit. It will take about 45 days to get permit at an approximate cost of$3,000.
• Beach Repairo CSE does not recommend beach scraping or other emergency measures allowable
under OCRM emergency orders as the overall health of Kiawah Island will promotenatural recovery.
• Monitoringo CSE is scheduled to complete our annual beach survey in the upcoming weeks.
These data will be used to determine overall beach volume changes and localimpacts.
o The Town may should consider another monitoring effort in 3—6 months todocument recovery of the dune and monitor potentially threatened areas.
o Annual report will be delivered in February/March 2017 and will include detailedrecommendations on sand fencing if applicable
Mr. Wilson asked if work can be done under the permit obtained for the pervious beach
nourishment project. Mr. Jordan confirmed that the permit issued in 2015 was amended to allow
sand fencing on the east end until 2019. He added the Town could also apply for a permit to cover
the rest of the beach if it deemed necessary. Mayor Lipuma stated if the permit has a modest cost
he felt the Town should move ahead to with the permitting so it would be in place should sand
fencing need to be installed in a particular area.
Mr. Lameo reported that following the storm the most extensive damage was done to the beach
and boardwalks. There are approximate 175 public and private boardwalks along the beach.
Following the storm 80% to 85% of them were either damaged or destroyed. All the debris has
been removed from the beach and is now in the recovery phase. All boardwalk repair or
replacement requests are being forwarded to the ARB who will, along with Mr. Lameo, inspect
the boardwalks to make recommendations. Mr. Lameo stated that there were:
• 5 public boardwalks open,
• 18 private boardwalks being repaired,
• 6 boardwalks that are under review,
• 20 boardwalks that extend over 10 feet onto the active beach,
• 3 owners constructing without review and nonconforming
• All markers were washed away and each boardwalk owner is having to be identified
Homeowners will be notified how long they have to make the necessary repairs or modifications
to their boardwalk or if the boardwalk is a safety hazard and needs to be immediately addressed.

Mr. Lameo stated that of the 42 trash containers along the beach, 4 were able to be salvaged. TheTown has contracted for the containers to be replaced eight to ten at a time. He added that allvehicle accesses are passable and will be re-graded will rocks in the spring.
Ms. Tillerson stated that Town and Community Association staff did an outstanding job workingtogether pre and post hurricane.
XII. Mayor’s Report:
Mayor Lipuma stated the closing has taken place for the sale of Town Hall building and site to theCommunity Association. He added that the closing for the three million dollars loan had alsotaken place with proceeds from both will be used as part of the funding for the new MunicipalCenter.
XIII. Citizen Comments:

Mr. McGill stated the minutes are not be posted in a timely manner. He added that copies ofcontracts being considered are also not be posted and suggested that both be post on theTown’s website before the meeting.
Mr. McGill stated by Town Ordinance, the positions of Town Clerk, Treasurer, Attorney, and Judgeare appointed by Council. In his interpretation of Town Ordinance, the decision of the contractand appointment should be made by the incoming, not outgoing, Council and can be rejected bythe incoming Council. He also expressed his opinion that the Town Attorney is not required to bepresent at all Council meetings.
Mr. Rhoad responded by stating Town Ordinance does require the Town Attorney attendCouncil meeting. He stated the new Council has the prerogative to make the decision not toappoint the Attorney in January; the attorney serves at the will and pleasure of Council. It wasthe decision of this Council that it was in the best interest of the Town not to have a gap in legalservices.

Mrs. Kulick called attention to the “Meet the Candidates” night, sponsored by the CommunityAssociation, on November 14th, and indicated that she had not noted any notice of the event bythe Town. She also asked when the Town will send out the responses to questions not answeredat Council meetings and will the responses be released to the public.
XIV. Council Member Comments:
Mr. Wilson added to his earlier report on Johns Island Roads by calling attention to the fact thatunless one go by boat, all roads that take residents of Kiawah, Seabrook, and Wadmalaw to themainland are in unincorporated Johns Island or the City of Charleston and that is why the focushas been on these roads for many years and why the interest in the study for the bike path.

Mayor Lipuma showed a copy of the Town Notes which does superior summaries the mayoral and
Council candidates. It notices the “Meet the Candidates” night at the Sandcastle a 6:00pm.

Mr. Weaver motioned to adjourn the meeting at 3:44 pm. The motion was seconded by Mr. Wilson
and carried unanimously.

BACKGROUND:
The Town of Kiawah Island (TOKI) has financially supported a variety of Kiawah Conservancy programsand activities in recent years. Financial support has come from a number of different sources, includingthe Environmental Committee line item in the Conservation department. For the current fiscal year(2016-17), Town Council created a Kiawah Island Conservancy line item in the EnvironmentalDepartment budget, funded under the County Accommodation Tax fund. This line item contains$58,000 to support Kiawah Conservancy programs and activities. Funding proposals from the KiawahConservancy are first reviewed by the Town Environmental Committee. After this review, theEnvironmental Committee then makes a recommendation to the Town Council for funding approval.
ANALYSIS:
At the November 8 meeting of the Town Environmental Committee, Ms. Donna Windham from theKiawah Conservancy presented a total of 7 proposals for funding. The committee reviewed eachproposal and voted unanimously to recommend funding. Proposal titles and costs are listed below:

Additionally, it provides an open air space forcommunity gatherings and programs that are free and open to the public.Enhancing our natural habitat is a basic core value of the Town of Kiawah Island. Weare grateful for the support the Demonstration Garden has been given since itsinception through grants from the Town of Kiawah Island.
Statement and Objective: The Demonstration Garden has continued to meet itsplanned objectives as an educational tool supporting island-wide habitatimprovement efforts, Each year, sections of the garden must be updated with newand different plants. Additionally, paths must be reshaped and topped with materialfor walking and yearly reconditioning of the garden must be completed to enhancethe soil and therefore the effectiveness of the project.
Description of Proposed Project:New plantings, topsoil, pathway material and mulch will be added to the garden. Anindependent contractor will perform some or most of the projected work with thehelp and review of Conservancy staff and the Kiawah Island Golf Resort landscapingdepartment. Project will be completed by November 2016.
Target Audience: Open to the public. Outreach and educational programs arescheduled monthly except for August and December.
Expected Outcomes: The Demonstration Garden will continue to be in its pristinestate to welcome property owners and visitors and display a landscape thatsupports habitat improvement for Kiawah’s wildlife. In meeting the ComprehensivePlan, this project directly impacts the three goals set in the plan approvedSeptember 2015.

Introduction to project: The new smartphone app “Naturally Kiawah Pathways” has
been one of the most popular projects the Conservancy has undertaken. Residents
and guests are finding the app useful in touring the island, plus also informative and
educational. Our goal was to give the viewer an ‘oh that’s interesting” or ‘wow, I
never knew that about the island” experience. Thanks to the support of the Town of
Kiawah Island, six tours are available for free use to property owners and visitors,
with a seventh tour being released later in 2016. A companion brochure was
produced to explain how the app works (see attached) and also provide information
about the island, including a map and safety guidelines. The Conservancy is asking
for funds to reprint the brochure due to the high demand for it by residents and
guests.
Statement and Objective: The brochure will provide an educational tool to
supplement the ‘Naturally Kiawah Pathways” app. This project meets the goals and
objectives of the Town of Kiawah Island’s Comprehensive plan approved September
2015 (Maintaining and Expanding Public Education and Outreach Programs).
Description of Proposed Project: See above
Target Audience: Will be available to residents and visitors.
Expected Outcomes: The brochure will make the app easier to use and understand,
while also providing some important information regarding Kiawah’s ecology and
history, along with additional guidelines regarding safety and protecting wildlife.

about Kiawah’s natural environment in an afternoon.

conducted October 27, 2016. In cooperation with the KICA ‘Our World” lecture
series, this annual collaborative project will explore the world of Alligators. Guest
speakers, music and readings will be presented along with the premier production
ofa Documentary of Kiawah’s Alligators. This project meets all the goals outlined in
the Comprehensive plan adopted in September of 2015.
Statement and Objective: To educate our general population of the beast that lives
among us. Not to promote fear, but rather an understanding of why we need to
present caution and respect for these animals.
Description of Proposed Project: The annual Symposium will begin at 3pm with a
reception to meet speakers and give the audience a chance to mingle before the
lecture series begins. AL 4pm — presenters, including the Town of Kiawah Island
biologist(s), will present an outline of past and future research of this species. All
island related staff will be part of this education and informational session (KICA,
KIGR, Town of Kiawah Island). Off-island speakers include Dr. Thomas Rainwater,
Clemson University and Rudy Mancke, University of South Carolina and PBS
naturalist program host. The afternoon will conclude with the premier of the
Documentary film —Kiawah’s Alligators.
Target Audience: Open to public.
Expected Outcomes: Film will be uploaded for all island entities to use as a resource
and tool in their respective media sources. The Town of Kiawah Island will be given
credit from the podium, in the program and on the presenting screens for their
grant to this program. This symposium and documentary release meet the goals
and objectives of the Town of Kiawah Island’s Comprehensive plan approved
September 2015 (Maintaining and Expanding Public Education and Outreach
Programs].

Introduction to project: Three of the Conservancy’ conservation easements containtrails and/or boardwalks: Falcon Point Road marsh, Rhett’s Bluff freshwaterwetland and Marsh Island Park. Presently, old interpretive signs are on two of theseproperties and are less than current standards for the island (Rhett’s Bluff andMarsh Island Park). No interpretive signs exist at the Falcon Point property, whichcontains high marsh and salt shrub thicket habitats.
Statement and Objective: The Kiawah Conservancy will develop new interpretivesignage for these properties including identification markers and directionalinformation. The signs will be similar to the newly installed signs located at theMaritime Forest Reserve Trail (1.33 Conifer Lane) that the Town supported lastyear. These signs will provide important information regarding Kiawah’s naturalenvironment to our residents and visitors, and will indicate that the Town of KiawahIsland has given support.

Kiawah Island Utility, Inc. (Kiawah or the Company) filed an Application for Adjustment of Rates andCharges and Modifications to Certain Terms and Conditions for the Provision of Water and SewerService with the Public Service Commission of South Carolina (the Commission). The Application wasfiled pursuant to S.C. Code Ann. §58-5-240 and 10 S.C. Code Ann. Regs. 103-712.4.A and 103-512.4.A.The Applicant requests approval of the monthly water and sewer service charges set forth in the rateschedules attached to the Application as Exhibit A, and the Company also requests approval of any andall fees and charges in these schedules. Additionally, pursuant to 10 S.C. Code Ann. 103-703 and 103-503, Kiawah proposes to modify certain non-recurring charges to include creation of a service fee fornon-routine and non-emergency calls, creation of a charge for restoration of service after discontinuanceof service for the purpose of not receiving monthly statements, and increases in its charges to restoreservice after disconnection, delinquent notification fee, and return check.
As justification for the relief requested in its Application, Kiawah states that it has been over four yearssince rates were increased, and the increase was based on Company financial information that is nowmore than six years old. In addition to the other reasons listed on page four of five of the Application, theCompany states that it has made a substantial investment in the planning and construction of a secondwater supply line to St. John’s Water Company to provide redundancy in its water supply, to equalize thecurrent capacity of its water supply and to ensure reliability of service for its customers on Kiawah Island.

I. The Applicant is a corporation in good standing organized under the laws of
the State of South Carolina.
2. The Applicant is a public utility, as defined by S.C. Code Ann. §58-5-10(4),
providing water and sewer service to the public for compensation in certain areas of South
Carolina, specifically Kiawah Island.
3. The Applicant provides service pursuant to the rates approved by the
Commission in Order 20 12-98 in Docket No. 2011-317-WS.

REQUEST FOR RATE RELIEF AND APPROVAL OFRATE SCREDULE MODWICATIONS
5. Pursuant to S.C. Code Ann. §58-5-240 and 26 S.C. Code Ann. Regulations
R.. 103-712.4.A and 103-512.4.A, Applicant requests that the Commission approve the
monthly water and sewer service charges set forth in the rate schedules attached hereto and
irvorporated herein by this reference as Exhibit “A”. The Company also requests approval
oi any and all fees and charges contained in these schedules.
6. Pursuant to 26 S.C. Code Ann. Regulations R. 103-703 and R. 103-503, the
Applicant proposes to modify certain non-recurring charges to include creation of a service
fe for non-routine and non-emergency cafls, creation of a charge for restoration of service
a±er discontinuance of service for the purpose of not receiving monthly statements, and
increases hi its charges to restore service afler disconnection, delinquent notification fee, and
return cheek fee (as set forth in Exhibit “A”).

NEED AND JTJSTII’TCATION FOR RATE RELIEF
15. Applicant submits that rate relief is justified because rate relief was last
gxacited on February 8,2012, based on a 2010 test year. It has been over 4 years since rates
were increased, and the increase was based on company financial information that is now
more than six years old. The proposed rate increase is necessary for the company to provide
reasonable and adequate service to its customers, cover its expenses, be permitted an
ol{1Portunit to earn a reasonable return on its investment, and attract capital fur future
improvements. Among other things, the Applicant has made a substantial investment in the
pInning and construction of a second water supply line to St. John’s Water Company to
pr.ovide redundancy in its water supply, to equalize the current capaàity of its water supply
and to ensurwreliability of service for its customers on Kiawah Island. The rates proposed
are also necessary to allow the Applicant to comply with the standards and regulations set
by D1{EC and other environmental regulatory authorities. The proposed rates will preserve
the financial integrity ofApplicant, promote continued inveatment in and maintenance of its

a4! sewer services.
REQUEST FOR OPERATING MAJGIN TREATMENT
16. Applicant requests the Commission continue to set its rates according to the
operating margin method in this proceeding.

prays that the Commission approve the rates proposed and grant to Applicant such other and
futher relief as the Commission may deem just and proper.

CHARGES FOR SERVICE DISCONT]NJANCE, RECONNECTIONI AND OTHER MISCELLANEOUD SERVICE CHARGES
1, When a customer requests discontinuance of service for the purpose of not receiving amonthly statement, the Company shall charge the equivalent of three months of baalefacilities charges for both water and sewer service and require payment of such chargeswhen for any reason service is restored to that particular customer.
2r Reimbursement of costs to make repairs to services or meters caused by others will becharged at actual cost as allowed per PSC Regulations 103-726 and R 103.733.5.
3L Whenever service is disconnected for violation of rules and regulations, nonpayment ofbills or fraudulent use of service, the Company will charge a $70.00 fee to restore service.
4. A service fee of $25.00 shall be charged by the Company for non-routine, non-emergency service perforiried for the customer on the customer’s side of the meter.
5 Delinquent Notification Fee - A fee of $20.00 shall be charged each customer to whomthe Company mails a notice of discontinuance of service as required by the Commissionrules prior to service being discontinued. This fee assesses a portion of the clerical andmailing costs of such notice to the customer creating the cost.
Customer rnitiãtion Fee - A one-time fee of $25.00 will be charged to each new accountto defray costs of initiating service.
Return Check Fee When a check is returned from the bank for Non-Sufficient Funds,a fee equal to the maximum amount permitted by S.C. Code Ann. Section 34-11-70 willbe charged.
Safe Dunking Water Fee If the South Carolina Department of Eealth andEnvironmental Control charges the Company an assessment based on customer units
I served by the Company, the Company may bill its customers for the applicable unit costof that assessment. The charge shall be identified on a separate billed item, identified asthe SDW fee and included in the total of the service billing.

PURCHASED WATER ADJUSTMENT
Kia’ah lsland Utility, Inc. (“Company”) purchases its potable water from the St. John’s WaterCompany (“St. John’s), which in turn purchases the water from the Commissioners of PublicWorks of the City of Charleston (“CPW”). Whenever CPW increases the price of water soldto St. John’s, the increase in price is passed through to the Company pursuant to the waterpurchase agreement between the Company and St. Jobn’s.
The water purchase agreement also provides, as part of the purchased water price, apro-rata share of St. John’s annual operation and maintenance costs to be charged tothe Company. Therefore, the Company’s revenue requirement for purchased water ismade up of the water unit price per thousand gallons and the operation and maintenancecosts charged by St. John’s.
Accoding1y, whenever there is a price adjustment for the purchase of potable water toKiawah Island Utility, Inc. by the St. John’s Water Company, the following billing adjustmentshall ,e made by the Company to its customer rates:
1. Billing Adjuslment
In the event that St. John’s adjusts (whether an increase or decrease) the unit priceper 1,000 gallons and/or the operation and maintenance charges related to thepurchase of potable water, the following billing adjustment practice would apply:
(a) If the unit price is adjusted the cost change per 1,000 gallons would be passedthrough to the customers as an adjustment in like amotint to the consumptioncharge on their water bilL
Example: The unit price of purchased water is increased by two centsper 1,000 gallons. The consumption charge on thecustomer’s bill would reflect a two cent per 1,000 gallonincrease.
(b) If the pro-rata operation and maintenance charge is adjusted tire cost changeper 1,000 gallons (based on the most recent 12 months ofpotable water billed)would be passed through to the customers as an adjustment to the consumptioncharge on their water bill.
Example: The annual operalion and maintenance charge is increasedby $18,000 and the most recent 12 months of potable waterbilled is 900,000 thousand gallons. The consumptioncharge on the customer’s bill would reflect a two cent per1,000 gallon increase.
2. NotificationAny special billing adjustment shall not be billed until the following conditions are met:
(a) The Company shall furnish the South Carolina Public Service Commission

The Town understands that in making the decision to grant or to not grant KIU the ability to increase water and/or sewerrates, that PSC has a duty to balance the service needs of Kiawah residents with the financial needs of the utility.
