a) UNC School of Government Training Module: Appeals of Staff Decision and Interpreting the Ordinance, by Adam Lovelady, Assistant Professor of Public Administration and Government

Review: o When it comes to appeals of decisions, there are several
steps to the process i. A formal decision. ii. Notice of decision. iii. Appeal is filed with the city clerk. iv. Specific procedures for appeal, including roles for the
staff and authority for the board. o For interpretations, remember:
i. Rely on the text, figure out what the governing board intended and enforce that.
ii. Look for definitions in the ordinance. iii. Consider the ordinance context, purpose and intent as
well as rules of construction. iv. Use the rules of thumb, construction of statutes are
equally applicable to construction of municipal ordinances.

INFORMATIONAL ITEMS:
a) Park Plans PARTF Grant Update
Town Administrator Mike Gordon shared information regarding the status and process of the PARTF Grant Application. He advised the Planning Board to be in attendance for the April 1, 2019 Town Council Meeting due the presentation of the Archer Lodge Park Draft Master Plan being presented by Susan Hatchell, Landscape Architect, PLLC.

Buffalo Road Project Update
Andy Thomas shared that the Sidewalk Agreement ID#8371 between NCDOT and the Town of Archer Lodge had been approved and signed. He added that NCDOT is waiting for the final approval from the NC State Historic Preservation Office for sidewalks at C.E. Barnes Store before starting the project.
c)
Non-Residential Guidelines Progress Update
Andy Thomas shared that the Planning Department staff are in the process of working on the Non-Residential Guidelines Draft. He noted that once the
draft guidelines are finalized the Planning Board members would receive an email of the draft copy, along with a calendar of details of the process of approvals and actions, to review before presenting at the Planning Board meeting.
d)
Bittle Creek Preliminary Plat Update
Andy Thomas asked that the Planning Board to consider meeting on April 17, 2019 to discuss the Bittle Creek Preliminary Plat, and possibly another Plat. He added that the Developer and NCDOT are working together regarding the requirement by NCDOT to have a turning lane.
Chairman Oglesby open the floor to consider having a Planning Board Meeting on April 17, 2019 to discuss the Bittle Creek Preliminary Plat and any other agenda items. No discussions followed.

NCDOT Bicycle and Pedestrian Plan - First Public Meeting with Cindy Camacho, AECOM Project Manager
Andy Thomas shared that the attendance was good at the Kick-Off Meeting and Workshop Session for the Steering Committee, that was held on January 31, 2019. He added that a Bicycle and Pedestrian Plan Online Survey was posted on the Town's Website and Social Media, asking for ideas from the public. Mr. Thomas noted that the Public/Steering Committee Meeting would soon be scheduled.
f)
Future Preliminary Plat - Vinson Park
Mr. James Lipscomb gave a brief overview of the plans for a future Preliminary Plat for Vinson Park. He shared that it will be a cul-de-sac located on Castleberry Road, with 20 lots and plans are to include private walking trails.

Tilghman (Tim) Lee Rezoning Request (ZMA20181107, SFR1 to NB) Update
Andy Thomas shared that the rezoning application for Mr. Tim Lee was approved to amend the Town of Archer Lodge Official Zoning Map by changing from SFR-1-Single Family Zoning District to NB-Neighborhood Business District, and to ratify Ordinance AL2019-02-1 to rezone SFR-1 to NB on a 2.13 acre tract (Tag# 16J03068K; Pin 178001-25-9864) by the Town Council, at the February 4, 2019 Town Council Meeting. He added that he had no further information.

PLANNING BOARD MEMBERS' REMARKS:
a) Terry Barnes shared that he liked the change in the Planning Board Meeting Agenda format by adding the Invocation and Pledge of Allegiance.
b)
Teresa Romano reiterated Mr. Barnes remarks regarding the change in the Agenda format. She added that it recognizes Veterans.
c)
Vice Chairman Purvis suggested the Planning Board ask permission from the Town Council to allow them to review the Town's Business Zoning Districts for the possibility of getting a further definition by adding different levels of Districts, and decreasing uses under each, in hopes of eliminating the chances of unwanted businesses coming to an area in the future. Discussion followed.
d)
Chairman Oglesby thanked Mike Gordon for attending the meeting as a liaison to the Town Council. He thanked everyone for their attendance.

Item: Consider a preliminary plat for Bittle Creek a 14-lot subdivision on the western right-of-way
of Buffalo Road adjacent to the Pace Farm. There are 4 lots that are existing but being reconfigured
and 10 new lots.

Engineer: Donald A. Adams-Adams and Hodge Engineering, PC, Clayton, NC
James Lipscomb and Donnie Hodges met with the Planning Board’s Technical Review
Committee (TRC) on Wednesday, March 6th. Those in attendance included Planning Board
members John Ogelsby, Fire Chief Phillip Driver, Andy Thomas, Jr. and Bob Clark. Comments
were also available from NCDOT. Today, April 10th, the developers and their engineer updated
the TRC Committee on revisions (dated 4/9/19) to the Preliminary Plan to reflect input from
NCDOT and confirming the riparian buffer location.
Kensean Drive (a new public street) will be extended westward from its intersection with Buffalo
Road (opposite Hillsdale Drive) and terminate in a cul-de-sac turn around from which four

existing reconfigured lots with homes will have direct access to the street or be served from an
existing 30’ wide utility and private access easement. There is also a reserved area for possible
street stub towards the adjoining Pace Farm. No additional driveways will be allowed on
Buffalo Road from corner lots. The developer has discussed approval with NCDOT and turn
lanes are not being required. An additional 15 feet of right-of-way will be dedicated along
Buffalo Rd. for future widening or turn lanes, if needed.
Lots 1 and 2 are proposed to have off-site septic fields due to poor soils. All the lots will be
reviewed and approved by Johnston County Environmental Health.
The utilities, stormwater and sedimentation and erosion control will be approved by Johnston
County Public Utilities.
A reduced pdf copy of the plat is attached. It includes revisions made per TRC and agency
comments received to date (attached).

Item: Consider a preliminary plat for Vinson Park a 20-lot subdivision on the western right-of-way
of Castleberry Road adjacent to the Town Park property and southwest of Mayfield subdivision
Developer: James H. Lipscomb, Clayton, NC
Property Owner: Willie G. May, 3205 Castleberry Road, Clayton, NC
Engineer: Donald A. Adams-Adams and Hodge Engineering, PC, Clayton, NC
James Lipscomb, Paul Parker and Donnie Hodges met with the Planning Board’s Technical
Review Committee (TRC) on Wednesday, April 10th. Those in attendance included Planning
Board member Bob Davis, Town Administrator Mike Gordon, Andy Thomas, Jr. and Bob
Clark. Andy Thomas, Jr. had already met with Marcus A. Lee representing NCDOT.
Vinson Park Drive (a public street) will be extended that will have a future right-of-way reserved
for a street stub to the southern property line of an existing farm. No additional driveways will be
allowed on Castleberry Road. NCDOT has stated that turn lanes will be not required. Their only
concern was maintaining proper sight distance. The block length for Vinson Park Drive less than
the 1500 ft. allowance but exceeds by 170 ft. +/- the 1,000 ft. the cul-de-sac length standard.

However, because of the proposed stub for potential future right-of-way would shorten that
length to approximately. Favorable approval would be granting a waiver this standard.
There is an existing pond and its’ 50 ft. riparian buffer on the northern portion of the property.
This area is to be left in common open space and will be maintained by the Homeowner’s
Association as common open space. The developer has also offered an easement between the
pond and Castleberry Road for a possible future public trail or side-path. The developer will
construct a 10 ft. wide asphalt walking path in a public easement near the street entrance to the
Town’s future park for maintenance by the Homeowners Association.
Articles creating a Homeowner’s Association shall be submitted prior to the final plat
recordation.
