    Overview

    Under the Tourism (Northern Ireland) Order 1992 anyone providing or oering to provide tourist accommodation

    as a business (i.e. overnight sleeping accommodation or tourists provided by way o a trade or business) mustpossess a valid certifcate issued by the Northern Ireland Tourist Board in respect o the premises.

    There are fve statutory categories o tourist establishment:

    Hotels

    Guesthouses

    BedandBreakfastestablishments

    Self-cateringestablishments

    Hostels

    Minimum standards apply to each o category and businesses must ulfl the appropriate requirements in orderto operate legally. Details are available on NITBs corporate website: www.nitb.com

    Role in tourism

    At least once a year all tourist establishments are inspected by NITB inspectors to ensure that the requirements

    appropriate to its category are met. NITB has the authority to revoke the certifcate o businesses which ail tomeet requirements.

    Overview

    How to apply or Planning Permission

    Businesses are required to provide detailed inormation in support o each proposal, depending on its nature.

    The more complex the proposal, the more detailed the inormation required.

    Follow the steps below to fnd out how to about apply or planning permission.

    Step 1

    ContactthePlanningService(contactdetailsbelow).Telltheplanningstaffwhatiswantedandaskfor

    their advice.

    Step 2

    Iftheplanningofcerthinksitisnecessarytoapplyforplanningpermission,askforanapplicationpack.The planning ofcer will advise how many copies o the orm need to be returned and how much the

    application ee will be. The ull suite o planning application orms is available on the Planning Servicewebsite. Forms can be downloaded, completed and then posted to a divisional planning ofce.

    Step 3

    Decidewhattypeofapplicationisrequired.Inmanycasesthiswillbeafullapplicationbutthereare circumstances where an outline application is appropriate - or example, to test the principle

    o development on the site.

    Step 4 SendthecompletedapplicationformstotheDivisionalPlanningOfce(allofcecontactdetailscanbe

    ound on www.planningni.gov.uk/key_contacts), together with the correct ee. Each orm must beaccompanied by plans o the site and drawings o the proposed work.

    Overview

    The Package Travel Regulations 1992 apply to businesses that oer a package o services or sale at an inclusive

    price, covering a period o at least 24 hours or including overnight accommodation and at least two o theollowing services:

    - Transport

    - Accommodation

    - Other tourist services (not ancillary to transport or accommodation) accounting or a signifcant

    proportion o the package, such as a tour guide.

    In the United Kingdom, anyone who oers or sale (other than occasionally) package holidays must complywith the Package Travel Regulations 1992. These set out travel organisers responsibilities to their customers,

    and remedies available to them should there be a breach o the regulations.

    Role in tourism

    The regulations provide consumers with statutory legal rights against tour operators by making clear to

    operators that they have legal responsibilities to their customers. The regulations also enable dissatisfedholidaymakers to pursue their case with a single supplier, the travel organiser, instead o with individual

    suppliers such as airlines or hoteliers.

    Overview

    The Equality Commission or Northern Ireland is an independent public body established under the Northern

    Ireland Act 1998. The Commission has a remit to work towards the elimination o discrimination and thepromotion o equality o opportunity on the grounds o age, disability, gender, race, religious belie/political

    opinion and sexual orientation. It also has responsibilities in respect o the statutory equality duty on publicauthorities to promote equality o opportunity and good relations.

    Role in tourism

    All private sector employers with more than 10 ull-time employees (working more than 16 hours per week)

    are required to register with the Equality Commission. Specifed public sector employers are automaticallydeemed to be registered.

    The Fair Employment and Treatment (Northern Ireland) Order 1998 (FETO) makes it unlawul to discriminate

    against someone on the ground o religious belie or political opinion. This includes a persons supposedreligious belie or political opinion and the absence o any, or any particular, religious belie or political opinion.

    The role o Invest NI is to grow the economy by helping new and existing businesses to compete internationally

    o Invest NI is currently providing developmental support to the NI tourism industry via severalinitiatives, particularly in relation to marketing.

    Visa Programme

    o To help the NI tourism industry beneft rom the development o new air access routes into

    Northern Ireland by Air Route Development (NI) Ltd and other international marketingopportunities being targeted by NITB and TIL, Invest NI has developed a programme o support to

    help tourism businesses develop strategic and tactical marketing plans. A marketing programmeaimed at accommodation providers - VISA - was delivered in 2006 and 2007 and was very well

    received. A third and fnal programme is scheduled to commence in winter 2008.

    Role in tourism

    A number o the above programmes, notably Passport to Export and the Visa Programme are designed toassist those currently involved in, or thinking o becoming involved in Northern Irelands tourism industry.
