8. COLLECTION. 11.FAILURETOMAKEPAYMENT. IfapurchaserfailseithertopayforortakeawayanylotBethunesatWebb'sshallwithoutfurthernoticetothepurchaser,atitsabsolutediscretionandwithoutprejudicetoanyotherrightsorremediesitmayhave,beentitledtoexerciseoneormoreofthefollowingrightsorremedies:

a.Toissueproceedingagainstthepurchaserfordamagesforbreachofcontract.

b.Torescindthesaleofthatoranyotherlotsoldtothepurchaseratthesameoranyotherauction.

c. To resell the lot by public or private sale. Any deficiency resulting from suchresale,aftergivingcredittothepurchaserforanypartpayment,togetherwithallcostsincurredinconnectionwiththelotshallbepaidtoBethunesatWebb'sbythepurchaser.Anysurplusovertheproceedsofsaleshallbelongtothesellerandinthisconditiontheexpression'proceedsofsale'shallhavethesamemeaninginrelationtoasalebyprivatetreatyasithasinrelationtoasalebyauction.

d.TostorethelotwhetheratBethunesatWebb'sownpremisesorelsewhereatthesoleexpenseofthepurchaserandtoreleasethelotonlyafterthepurchasepricehasbeenpaidinfullplustheaccruedcostofremoval,storage,andallothercostsconnectedtothelot.

e.Tochargeinterestonthepurchasepriceatarate2%aboveBethunesatWebb'sbankers'thencurrentrateforcommercialoverdraftfacilities,totheextentthatthepriceoranypartof itremainsunpaidformorethansevendaysfromthedateofthesale.

f.Toretainpossessionofthatoranyotherlotpurchasedbythepurchaseratthatoranyotherauctionandtoreleasethesameonlyafterpaymentofmoneydue.

g.ToapplytheproceedsofsaleofanylotthenorsubsequentlyduetothepurchasertowardssettlementofmoneyduetoBethunesatWebb'soritsvendor.BethunesatWebb'sshallbeentitledtoapossessorylienonanypropertyofthepurchaserforanypurposewhileanymoniesremainunpaidunderthiscontract.
