1. Request for a Technical Opinion

New French ministerial Order concerning the operati on of simple safety installations

Legal Basis Article 9(a) of the Regulation (EC) 881/2004 on the Establishment of a European Railway Agency as amended by Regulation (EC) No. 1335/2008 of 16 December 2008

Objective To assess the impact of a new French ministerial Order on activities of railway undertakings established in France and other Member States, in terms of requirements in Article 8(6) of Directive 2004/49/EC

Scope - Order of the Ministry of Ecology, Sustainable Development, Transport and Housing of 30 November 2010 concerning the operation of simple safety installations and modifying Order of 23 June 2003 concerning safety regulations applicable on the national railway network and Order of 28 April 2004 concerning the Regulation for safe use of the national railway network

On 22 April 2010 the European Commission received a complaint of the ▓▓▓▓▓▓▓▓ concerning the new practice of the delegated infrastructure manager (SNCF / GID) and related draft Order of the French ministry responsible for transport which defines simple safety installations and allows for transferring their operation from the infrastructure manager to railway undertakings. ▓▓▓▓▓▓▓▓ find that this additional task is not simple to be performed by train drivers and hinders access to the French national railway network. French authorities disagreed with the European Commission that draft Order was subject to notification according to Article 8(6) of Directive 2004/49/EC. Therefore the French Order was adopted and is only intended to be notified according to Article 8(4) of Directive 2004/49/EC. The task request to the Agency comprises an assessment of whether the new French Order may have negative impact on operations of the French and foreign railway undertakings as described in Article 8(6) of Directive 2004/49/EC. In particular, the Commission requests the Agency to answer the following questions:

1) Does the Order comply with the OPE TSIs, CCS TSIs and the Train Drivers Directive 2007/59/EC?

2) Are there any other concerns about compliance of this Order with EU legislation for railway safety and interoperability?

3) Doesthe Order constitute a means of arbitrary discrimination or a disguised restriction on rail transport operations between Member States?

4) Did French authorities follow the procedure in Article 8(6) of Directive 2004/49/EC? 5) Should the Order have been submitted to theCommission in draft according to

Article 8(7) of Directive 2004/49/EC? Key input documents

Having regard to Directive 2008/68/EC of the European Parliament and of the Council of 24 September 2008 on the Inland Transport of Dangerous Goods;

Having regard to Act No 97-135 of 13 February 1997 establishing the public company‘Réseau ferré de France’ with a view to the renewal of railway transport;

Having regard to Decree No 2003-194 of 7 March 2003 (amended) on the Use of the national rail network, in particular Article 3;

Having regard to Decree No 2006-1279 of 19 October 2006 on the Safety of railway traffic and the Interoperability of the railway system;

Having regard to the Order of 23 June 2003 (amended) on the Safety regulations applicable to the national rail network;

Having regard to the Order of 30 July 2003 (amended) on the Conditions of physical and professional fitness and on training, assessment of professional skills and qualification for the performance of safety duties on the national rail network;

Having regard to the Order of 28 April 2004 on the National rail network operation safety regulations;

Having regard to the Order of 29 May 2009 (amended) on the Land transport of dangerous goods, in particular Annex II,

Order:

Art. 1. – The safety installations necessary for access via the national rail network to refuelling facilities, freight terminals, marshalling yards, train formation facilities and storage sidings, maintenance and other technical facilities, and to any network or terminal system connected to the national rail network are operated by the SNCF, acting as delegated infrastructure manager on behalf of Réseauferré de France (RFF), or by the person party to the convention defined in the second paragraph of Article 1 of the above-mentioned Act of 13 February 1997, when the operation in question, in application of the applicable safety regulations, can only be carried out by a person qualified for the essential safety task of signalman.

This service is billed on the terms laid down in Article 3, second paragraph,of Section III of the above-mentioned Decree of 7 March 2003.

Art. 2. – The above-mentioned order of 28 April 2004 is amended as follows:

I. – In Article 1, the words ‘in Article 16 of the above-mentioned Decree of 30 March 2000’ are replaced by the words ‘in Article 3(2) of DecreeNo 2006-1279 of 19 October 2006 on the Safety of railway traffic and the interoperability of the railway system’.

II. – Article 2 is repealed.

III. – The provisions of the Annex ‘National rail network operation safety regulations’ are amended as follows:

1o The first paragraph of I-1 is replaced by the following provisions:

‘The national rail network operation safety regulations, supplementing the provisions laid down by the technical specifications for interoperability and by DecreeNo 2006-1279 of 19 October 2006 on the safety of railway traffic and the interoperability of the railway system, define the requirements intended to ensure the safety of users, personnel and third parties and the protection of the environment during the operation of the lines of the national rail network.’;

2o At the end of I-1, the following six paragraphs are inserted:

‘In the context of these regulations, ‘safety installations’ are understood to include:

– signalling systems, including their control and monitoring systems;

– points and crossings located on the main track and their control and monitoring systems;

– points and crossings located on service tracks, interlocked or protecting main tracks, and their control and monitoring systems;

– level crossing control and monitoring systems;

– interlocks and detectors necessary for traffic safety, including those relating to level crossings.’;

3o The paragraphs three to nine of I-2 are replaced by the following provisions:

‘– the provision of public transport services by rail.

The first category of duties is performed, according to the terms and procedures stipulated by Article 1 of Act No 97-135 of 13 February 1997 establishing the public company‘Réseauferré de France’ with a view to the renewal of railway transport, by the infrastructure manager or by the delegated infrastructure manager as defined in Article 9 of the Decree of 19 October 2006 cited previously or by the person party to the convention defined in the second paragraph of Article 1 of the above-mentioned Act. In the remainder of these regulations these entities are both referred to as the ‘infrastructure manager’ for the application of the provisions concerning them.

The second category of duties is performed by the railway undertakings as defined in Article 9 of the cited Decree of 19 October 2006.

Each operator ensures safety of operation corresponding to the elements of the railway system placed under its control (installations, rolling stock, procedures, personnel) in compliance with:

a) the regulations mentioned in Article 3 of the Decree of 19 October 2006 cited previously;

b) the national rail network operation documentation mentioned in Article 10 of the same Decree for the matters defined in the remainder of these regulations, by Réseauferré de France (hereinafter RFF);

c) requirements issued on delivery of the commercial operating licence for the system or subsystem used.

Each operator implements the requirements stipulated in the preceding four paragraphs in the context of the safety accreditation, certificate or statement mentioned in Chapter IV of Title II of the Decree of 19 October 2006 cited previously. It also determines the procedures it uses to inform:

– RFF of the safety risks that it considers arise from application of the national rail network operation documentation concerning the interfaces between operators and more generally the application of the other provisions of this documentation;

– the Etablissement public de sécuritéferroviaire (EPSF) of the safety risks that it considers arise from application of the texts mentioned in a)to c)above concerning the interfaces between operators and more generally the application of the other provisions of these texts.’;

4o In the last paragraph of I-3.2, the words ‘in application of I-2’ are deleted;

5o The second sentence of I-4.3 is repealed;

6o The first sentence of I-4.4 is replaced by the following provisions:

‘The communication conditions, the form and the content of messages exchanged in the context of traffic and train movement management and the traceability conditions are defined by a text drawn up by the infrastructure manager, when they have not already been set out in a technical specification for interoperability.’;

7o II-1.1 is replaced by the following provisions:

‘II-1.1. Maintenance of the rolling stock

The rolling stock is maintained in compliance with the requirements set out inTitle III of the Order of 1 July 2004 on the Requirements applicable to rolling stock running on the national rail network.’;

8o The last sentence of the third paragraph of II-1.2 is replaced by the following provisions:

‘The conditions for carrying out shunting operations are described by the operator in its operational directives and instructions, drawn up in accordance with Article 11 of the above-mentioned Decree of 19 October 2006, complying with the national rail network operation documentation published by RFF.’;

9o The fourth paragraph of II-1.2 is replaced by the following provisions:

‘To be able to run, a train must conform to all the technical, dimensional, speed, braking, communication and safety installation characteristics ensuring compatibility with operation on the lines, in accordance with the provisions in the infrastructure register and in the national rail network operation documentation published by RFF.’;

10o The antepenultimate paragraph of II-1.2 is replaced by the following provisions:

‘The operator specifies the conditions under which a train not satisfying one or more of the required running conditions can be run in compliance with the national railway system operation documentation published by RFF.’;

11o The second paragraph of II-1.3 is replaced by the following provisions:

‘The driver must know the characteristics of the line on which he/she is travelling. In the absence of such knowledge, for example in the case where the train has to take a diversion which is covered by the alternative route sheet mentioned in Article 6 of the above-mentioned Decree of 19 October 2006, a procedure drawn up by the railway undertaking describes the conditions under which the driver can drive the train on this line in compliance with the national railway system operation documentation published by RFF.’;

12o The last paragraph of II-1.4 is repealed;

13o The last two paragraphs of II-1.5 are replaced by the following provisions:

‘The conditions of introduction of this measure for cases of failure of onboard automatic systems or of communication systems during train operation are defined by the operator in compliance with the national railway system operation documentation published by RFF. The infrastructure manager can apply special assistance rules on certain parts of the network when specific passenger evacuation conditions are stipulated by emergency plans.’;

14o The last paragraph of II-2.2.3 is replaced by the following provisions:

‘Points that are safety installations in the meaning of these regulations must be operated by personnel qualified for the post of signalman, except in the cases defined in II-2.2.4 below.’;

15o A sub-section, II-2.2.4, drafted as follows is inserted after II-2.2.3:

‘II-2.2.4. Operation of simple safety installations

Simple safety installations can be operated in nominal operating mode by personnel, other than signalmen, nominated and qualified for the purpose.

Subject to the provisions defined below, the following safety installations are considered to be simple safety installations:

a) points and crossings (points, locks, cleats) located on service tracks, interlocked or protecting main tracks, and their control and monitoring systems;

b) points and crossings controlled from the trackside located on main tracks and their operating systems;

c) any other safety installation (points or crossings, signals, level crossings, etc.) used only for train reception or departure, vehicle stabling or exit from stabling, shunting or service to interlocked terminal systems or establishments; when it allows access to main tracks, such a system must not control more than four interlocked points located on a main track junction.

However, no computer-controlled interlocked system can be considered to be a simple safety installation.

The local operation directives mentioned in Article 10 of the cited Decree of 19 October 2006 define for each site the simple safety installations, their operation and their utilisation constraints.

A local operation directive defining as a simple safety installation:

– an installation as defined in b)hereinabove, operation of which involves more than six individual locks,

– or an installation as defined in c)hereinabove,

can only be published on condition that the EPSF has not considered, within a period of two months following its transmittal by registered mail with acknowledgement of receipt, that the safety installation concerned raises particular risks regarding for example the conditions of operation and its environment. If the latter is the case, the safety installation concerned is not considered to be simple.’;

16o A sub-section, III-2.5, drafted as follows is inserted after III-2.4:

‘III-2.5. Dangerous goods

On the national rail network lines concerned, movements are scheduled to avoid passing between trains consisting of more than nine wagons carrying dangerous goods and oncoming scheduled passenger trains in railway tunnels more than 1000 metres long. Wagons carrying solid fertilizers and empty wagons that have carried dangerous goods and contain only gas and non-drainable residues are not counted for the application of this provision.

The conditions for implementation of the provisions of directive 2008/68/EC of the European Parliament and of the Council of 24 September 2008 on the inland transport of dangerous goods concerning rail transport and of the provisions of Annex II of the order of 29 May 2009 (amended) on the land transport of dangerous goods are defined, in particular according to the seriousness of incidents, in the national railway system operation documentation published by RFF and in compliance with the provisions of the order of 12 August 2008, in application of Article 13 of DecreeNo 2006-1279 of 19 October 2006, on emergency response and safety plans on the national rail network.’

Art. 3. − I. – Article 1 of the Annex to document IN 1683 ‘Shunting’, cited in its version dated 1 September 2005 appended to the above-mentioned Order of 23 June 2003, is repealed.

In all the documents appended to the order of 23 June 2003 cited above, the words ‘safety installation(s)’ have the same meaning as that given in I.1 of the Annex to the above-mentioned order of 28 April 2004.

II. − The last item in 2.2 of Annex III to the above-mentioned Order of 30 July 2003 is replaced by the following provisions:

‘– use simple safety installations as defined by the provisions of the national rail network operation safety regulations appended to the above-mentioned order of 28 April 2004, and electrical disconnect devices, and react in the case of malfunction.’

Art. 4. – The local operation directives published by RFF before the entry into force of this order and qualifying safety installations as simple remain applicable when the installations concerned:

– correspond to those listed in a)to c)in II-2.2.4 of the Annex‘National rail network operation safety regulations’ to the above-mentioned order of 28 April 2004; and

– are not computer-controlled interlocked systems.

The local operation directives that do not comply with the provisions of the operation safety regulations cited hereinabove must be brought into compliance before 31 December 2011, without prejudice to the possibility for any person performing a railway activity to refer to the EPSF, before this date and by documented request, any directive the provisions of which appear to the person to raise safety risks. The EPSF can then require amendment or withdrawal of the directive, defining the time allowed.

Art. 5. – The Annex to the above-mentioned order of 23 June 2003 is replaced by the provisions in the Annex to this order.

Art. 6. − The director of transport services is given responsibility for the implementation of this order, which will be published in the Journal officielof the FrenchRepublic.

5.1.1. Order of 30 July 2003 on staff aptitude and training

Article 2

The safety functions to which the personnel may be assigned are as follows:

- guard: employee who, regardless of his other duties, is responsible in a train, both while moving and stopped, for certain safety-related tasks, in particular assistance to the driver;

- foreman shunter: employee who, regardless of his other duties, is responsible for controlling and carrying out shunting;

- operating staff: employee who, regardless of his other duties, is responsible for application of the service instructions; on restricted traffic lines, train operative in charge of applying the corresponding regulations;

5.1.2. Order of 28 April 2004 on operational safety regulations According to the Order of 28/04/2004, Annex II-1.5 train guards may be involved in operations in two cases: in non-staffed stations in the absence or non-operation of the communication systems between IM staff and train driver, as well as when required in IM rules for certain parts of the network.

TITLE I

II-1.5. Train crew

Apart from the presence of the personnel assigned for commercial or technical purposes, in particular the person authorised to perform the conductor function, the presence of an authorised accompanying person is also necessary to assist the driver:

- in case of absence or non-operation of the on-board automatic controllers enabling stopping in case of driver failure;

- in case of absence or non-operation of the communication systems between the wayside personnel and the driver.

The conditions for setting up this measure, in case of malfunctioning of the on-board automatic controllers or communication systems during the journey, are defined by the infrastructure manager.

The infrastructure manager may require special accompaniment rules on certain parts of the network.

5.1.3. IN 1504 ‘Traffic Department’

IN 1504 concerns duties of operating staff, foreman shunter or train formation agent, beside duties of signaller in unmanned stations such as open line service points, the open line private sidings and the open line signalling centres other than those designated at stations.

5.1.4. IN 1683 ‘Shunting’ IN 1683 asks foreman shunters or other agents to verify and manipulate certain safety installations before shunting operations (Articles 304 and 305) which shall be put back to their initial position by foreman shunter (Article 308). Annex, Article 4 grants operating staff and other qualified designated staff with signaller functions in the unmanned stations, if there is no qualified employee on site. There is a note indicating that this task allocation takes into account the arrival of new RUs which staff can fulfil safety tasks previously performed by SNCF alone.

Article 304. Ententes et vérifications préalables concernant l’itinéraire de la manoeuvre.

Avant de donner l’ordre de mise en mouvement, le chef de la manoeuvre doit :

2° prendre les mesures pour que l’itinéraire de la man.uvre soit tracé en temps utile :

- lorsque les appareils de voie sont man.uvrés par un poste, par entente avec l’aiguilleur,

- lorsque les appareils de voie sont man.uvrés à pied d’.uvre, en vérifiant ou en faisant vérifier, en temps utile, que ces appareils de voie sont correctement disposés, et que les aiguilles collent dans la position convenable.

S’il s’agit d’aiguilles talonnables, ces vérifications sont faites lorsque les aiguilles sont prises en pointe ; elles ne sont pas imposées lorsque ces aiguilles sont talonnées par la man.uvre et se disposent alors d’elles-mêmes (voir art. 305).

Une aiguille talonnable non renversable doit cependant être disposée convenablement à l’avance si la man.uvre qui la talonne ne doit pas la dégager entièrement.

Dispositions Complémentaires

1. L’entente réalisée avec l’aiguilleur est confirmée :

- lorsque l’itinéraire que doit emprunter la manoeuvre est commandé par un signal particulier à la voie, par l’ouverture de ce signal ou par la présentation d’un ordre de manoeuvre s’il s’agit d’un signal de manoeuvre installé à demeure ;

- en l’absence de ce signal, ou si le signal s’adresse à un groupe de voies convergentes, ainsi qu’en cas de man.uvre sur sémaphore fermé, par un moyen de liaison quelconque tel que radio, téléphone, signaux convenus.

2. La vérification du collage des aiguilles n’est pas imposée :

- s’il s’agit d’aiguilles dont la position n’est pas modifiée à l’occasion de l’exécution de la manoeuvre, lorsque le collage a été vérifié lors d’une manoeuvre précédente et que ces aiguilles n’ont pas été talonnées depuis ;

- s’il s’agit d’aiguilles dont la position est fixée par cadenas ou par serrure, dites aiguilles à position imposée (la vérification du collage incombe alors à l’agent qui fixe l’aiguille dans cette position).

Article 305. Appareils de voie manoeuvrés à pied d’œuvre*.

1. L’agent chargé de disposer dans une position déterminée une aiguille manœuvrée à pied d’oeuvre doit vérifier qu’elle colle dans cette position ; s’il n’en était pas ainsi, il devrait faire le signal d’arrêt.

2. Lorsqu’une aiguille talonnable a été talonnée par la manoeuvre précédente, sa position et son collage doivent être vérifiés avant d’engager une circulation prenant l’appareil en pointe.

3. Il est interdit de modifier la position d’un appareil de voie tant qu’un véhicule est engagé sur cet appareil.

Toutefois, s’il s’agit d’une aiguille talonnable non renversable sur laquelle une manœuvre s’est arrêtée inopinément après l’avoir talonnée, le chef de la manoeuvre doit disposer ou faire disposer cette aiguille pour assurer la continuité de la voie s’il vient à commander une man.uvre la prenant en pointe.

(*) Les dispositions applicables aux aiguilles man.uvrées à distance et non contrôlées sont indiquées dans l.IN1553 (CG S6A n° 1) « Utilisation des Installations de Sécurité » (extrait repris en annexe au présent texte) Article 308. Mesures à prendre à la fin de la manoeuvre.

1. A la fin de la manoeuvre, le chef de la manoeuvre prend ou fait prendre les mesures pour que les véhicules :

- n’engagent pas les voies principales et stationnent en deçà des taquets, dérailleurs, etc. ;

- dégagent les croisements des voies de service contiguës (compte tenu de la décompression des tampons après desserrage des freins à air) ;

- soient immobilisés.

Lorsque les croisements des voies de service restent exceptionnellement engagés par un véhicule ou une rame en stationnement, le chef de la man.uvre avise ou fait aviser les agents intéressés (aiguilleur, agents de la manoeuvre,...) et fait protéger les croisements par les signaux du poste ou par signaux d’arrêt à main.

2. Le chef de la manoeuvre fait par ailleurs remettre en place les appareils (aiguilles,...) ayant une position imposée et rétablir les dispositifs de sécurité (cadenas, serrures, taquets,...) dont la position a été modifiée au cours de cette man.uvre. Il opère de même, le cas échéant, à l’égard des installations de traction électrique.

ANNEXE AU RÈGLEMENT S 8 A EXTRAIT DE LA CONSIGNE GÉNÉRALE S 6 A n°1 (IN 1553) UTILISATION DES INSTALLATIONS DE SÉCURITÉ Article 4.

Conformément au vocabulaire utilisé dans les textes réglementaires :

- l’appellation "poste" s’applique à toute installation quelle que soit par ailleurs sa désignation administrative, comportant la manoeuvre de signaux et, éventuellement, d’appareils de voie ;

- l’appellation "aiguilleur" s’applique à tout agent, quels que soient son grade et ses autres fonctions (agent-circulation, chef de service, garde, ...) chargé de la manoeuvre de signaux ou d’appareils de voie ;

- l’appellation "agent-circulation" s’applique à l’agent-circulation dont dépend le poste ; pour les postes de voies de service, cet agent peut être le chef de service.

D’autre part :

dans les établissements P.L.2, à défaut d’agent qualifié sur place, la fonction d’aiguilleur est remplie par l’agent de desserte (1), ou par un agent qualifié désigné; celle d’agent circulation est remplie par l’agent-circulation de la gare dont dépend l’établissement P.L., ou par un agent qualifié désigné.

5.4.7 Operation of safety installations

When Réseau Ferré de France supplies services that involve manoeuvring safety installations on certain sites, such services will be invoiced on the basis of an estimate produced by RFF and countersigned by the railway undertaking.

The rates charged are calculated on the basis of work units obtained from the information systems of Réseau Ferré de France or those polled and recognised by Réseau Ferré de France. The value of these work units is established by applying the scales in force as specified in § 6.3 below and is used to work out the amounts to be invoiced to the applicant…

10.5 Operation of facilities by the railway undertaking

The railway undertaking may have cause to operate some facilities itself (points, level crossings or other), in accordance with the rules stipulated in local operating instructions.

It shall take full responsibility for such operations, except when the facilities are used by the personnel of the railway undertaking in downgraded mode, in which case they will be acting under the authority and auspices of a movements operative of the SGTC.

4.5 Information provided by the RU

4.5.1 Local organisation of operations

Train preparations at the origin of the train path and the operations conducted at halts in transit and on arrival at the terminus of the train path may require the RU to perform a number of operational functions (including operating safety equipment) using its own resources. In cases where the corresponding details have not been provided in the train path request, the RU will inform the DCF of its requirements in relation to the use of the national rail network as regards shunting, reversing and stabling its rolling stock.

In some heavily trafficked stations, service standards have been established and are included in the reference documents. RFF may allow the RU to exceed these standards.

Le droit d'accès aux infrastructures du réseau ferré national gérées par Réseau ferré de France ou par le titulaire d'un contrat de partenariat conclu en application des articles 1er-1 et 1er-2 de la loi du 13 février 1997 susvisée est régi par les dispositions suivantes :

I. - Le droit d'accès au réseau ferré national comprend pour toute entreprise ferroviaire mentionnée à l'article 2 le droit aux prestations minimales suivantes : le traitement de ses demandes de capacités d'infrastructure, le droit d'utiliser les capacités qui lui sont attribuées, l'utilisation des branchements et aiguilles du réseau, la signalisation, la régulation, la gestion des circulations, la communication et la fourniture d'informations concernant la circulation des trains ainsi que toute autre information nécessaire à la mise en oeuvre ou à l'exploitation du service pour lequel les capacités lui ont été attribuées.

Le droit d'accès au réseau ferré comporte également le droit d'accès aux équipements suivants : les installations de traction électrique, y compris les installations de transport et de distribution de l'électricité de traction, les infrastructures d'approvisionnement en combustible, les gares de voyageurs comprenant leurs bâtiments et les autres infrastructures, les terminaux de marchandises, les gares de triage, les gares de formation, les gares de remisage, les centres d'entretien et les autres infrastructures techniques.

Réseau ferré de France et la Société nationale des chemins de fer français sont chargés, chacun en ce qui le concerne, de satisfaire sans discrimination toute demande portant sur les prestations énumérées au I.

II. - Toute entreprise ferroviaire mentionnée à l'article 2 peut demander à bénéficier des prestations complémentaires suivantes : la fourniture du courant de traction, le préchauffage des voitures, la fourniture du combustible, les services de manoeuvre et tous les autres services fournis aux installations dont l'accès est prévu au I, des contrats sur mesure pour le contrôle du transport de marchandises dangereuses ou l'assistance à la circulation de convois spéciaux.

Toute entreprise ferroviaire mentionnée à l'article 2 peut également demander à bénéficier de prestations connexes comprenant l'accès au réseau de télécommunications, la fourniture d'informations complémentaires et le contrôle technique du matériel roulant.

Dès lors que Réseau ferré de France et la Société nationale des chemins de fer français fournissent une de ces prestations complémentaires ou connexes, ils doivent la fournir sans discrimination à toute entreprise qui en fait la demande.

III. - L'accès par le réseau aux prestations minimales mentionnées au premier alinéa du I donne lieu au versement de redevances d'infrastructure dans les conditions prévues par le décret n° 97-446 du 5 mai 1997 susvisé.

L'accès par le réseau aux équipements de service mentionnés au second alinéa du I donne lieu au versement d'une rémunération égale au coût directement imputable à l'exploitation du service considéré.

La fourniture des prestations complémentaires ou connexes mentionnées au II donne lieu au versement d'une rémunération qui est égale au coût du service lorsque celui-ci est rendu par un fournisseur en situation de monopole.

Les modalités d'application du présent article sont définies, en tant que de besoin, par arrêté conjoint des ministres chargés des transports, de l'économie et du budget.

Réseau ferré de France élabore un document de référence du réseau ferré national qui contient l'ensemble des informations nécessaires à l'exercice des droits d'accès au réseau ferré national mentionnés au titre Ier. Le document de référence du réseau ferré national intègre les documents de référence élaborés par les titulaires d'une convention de délégation de service public dans les conditions prévues à l'article 20 du décret n° 2006-1534 du 6 décembre 2006, ainsi que les informations fournies par les titulaires d'un contrat de partenariat dans les conditions prévues à l'article 14 du décret susmentionné.

Le document de référence comprend notamment :

a) Une présentation de la consistance et des caractéristiques de l'infrastructure mise à la disposition des entreprises ferroviaires et des conditions d'accès à celle-ci ;

b) Une présentation des prestations mentionnées à l'article 3 ;

c) Les règles de répartition des capacités d'infrastructure, celles-ci précisant, en tant que de besoin, pour chaque section élémentaire, les capacités offertes respectivement aux services publics de transport de voyageurs et aux services de transport de marchandises ; pour les lignes sur lesquelles la disponibilité des sillons est limitée, les tableaux d'affectation fixant par type de services et par tranche horaire le nombre de sillons susceptibles d'être attribués lors du prochain horaire de service ainsi que les intervalles nécessaires à la maintenance et aux travaux ; pour les lignes déclarées saturées, les règles de priorité applicables ;

d) Les délais et modalités de présentation et d'instruction des demandes d'attribution des capacités ;

e) Les principes de tarification et le projet de tarification de l'infrastructure ferroviaire mentionné à l'article 9 du décret n° 97-446 du 5 mai 1997 susvisé, en précisant les règles d'imputation comptable, par nature, des diverses charges prises en compte pour l'établissement des redevances, les hypothèses d'évolution de fréquentation du réseau et des charges de Réseau ferré de France par rapport, d'une part, aux coûts constatés dans sa comptabilité et, d'autre part, à l'évolution constatée du coût des unités d'œuvre des travaux de renouvellement. Ces hypothèses tiennent compte des objectifs de productivité fixés dans le cadre de la convention conclue en application de l'article 14 du décret n° 97-444 du 5 mai 1997 susvisé ;

f) Les conditions dans lesquelles les entreprises qui utilisent le réseau ferré national mettent en oeuvre la réglementation relative à l'utilisation de l'infrastructure.

Réseau ferré de France soumet le projet de document de référence du réseau à l'avis du ministre chargé des transports, aux entreprises ferroviaires utilisant le réseau ferré national et aux organisations nationales représentatives des usagers des transports ferroviaires. Les avis sont réputés favorables s'ils ne sont pas intervenus dans les deux mois suivant la transmission du projet.

Réseau ferré de France arrête le document de référence du réseau et le rend public, par tout moyen approprié, au plus tard quatre mois avant la date limite pour l'introduction des demandes de sillons.

Le document de référence du réseau est mis à jour dans les mêmes formes. Les mises à jour effectuées sur ce document entrent en vigueur après que Réseau ferré de France les a rendues publiques par tout moyen approprié.
