iT Scheme for seamless movement of tourist vehicles in India

Introduction: The nation has witnessed far reaching reforms after introduction of the national permit for goods vehicles. It is a general understanding that ease of movement across the states in public vehicles is a very important objective. This Ministry is in the pursuit of providing seamless movement to tourist passenger vehicles; therefore, to meet this end, a new set of rules is being launched in the form of proposed “All India Tourist Vehicles Authorization and Permit Rules, 2020”. This will replace the existing permit system, “All India Permit for Tourist Transport Operators Rules, 1993”. The scheme is under the finalization stage.

Features: (a) Any tourist vehicle operator may apply for an “All India Tourist Authorization /Permit” through electronic mode (website of Ministry of Road Transport & Highways, or that of State Transport Authorities).

(b)AlL such authorizations/permits shall be issued, after all relevant documents are submitted, as stipulated in the rules and due fees deposited towards such authorization/permit, within 30 days of submission of such applications, subject to all compliances being met by such an applicant. This would be a single point for all such applications, wherein an applicant residing in any part of the country can easily apply for such authorization/permits and all such applications have to be accepted or rejected within 30 days i.e., this is a time bound procedure.

(c) Authorization/Permit being granted shall be valid for a period of three months or its multiples thereof, not exceeding three years at a time. This will encourage small operators who have limited financial capacity and in areas where the tourism cycle is small.

(d) This scheme will enable consolidation of a central database and fees of all such authorization/permits, which might give a sense of tourist movements, scope of improvement, promotion of tourism and help increase revenues generated through such registrations.

Note: All existing permits shall continue to be in force during their validity. This is an additional system for granting the National Permit to tourist vehicles. The conditions prescribed in rule 82 to 85A of CMVR, 1989 shall not apply to permits granted under these rules.

2. Progress on scheme for implementation of “State-wise vehicle tracking platform for Safety & Enforcement as per AIS 140 Specifications”, in States / UTs under Nirbhaya Framework:

Ministry of Road Transport & Highways, Government of India had issued a notification on 28th November, 2016 and revised it subsequently, wherein Vehicle Location Tracking (VLT) Devices and Emergency Buttons were mandated to be fitted in all public service vehicles (all four wheeled or higher, passenger carrying vehicles) w.e.f. 1st January, 2019.

States/UTs were required to set up Command and Control Centers (Monitoring Centers), as per MoRTH’s notification and AIS-140, to provide interface to various stakeholders. Since very slow progress was achieved in setting up the Monitoring Centers in States, this Ministry decided to support States/UTs and issued the scheme guidelines on 15* January, 2020 for implementation of “Development, Customization, Deployment and Management of State-wise vehicle tracking platform for Safety & Enforcement as per AIS 140 Specifications in States / UTs under Nirbhaya Framework” with a total estimated cost of Rs. 463.90 Crore.

Proposals in this regard have been received from 26 States/UTs and implementation is under process.

3. Targets under Accessible India Campaign for Public Transport:

The Accessible India Campaign was launched by Hon’ ble Prime Minister for creating universal accessibility for persons with Disabilities in Built Environment, Transport, and Information & Communication Technology (ICT) ecosystem. The Campaign is based on the principles of the Social Model of Disability, which states that disability is caused by the way society is organized, and not based on the person’s limitations and impairments. Physical, social, structural and attitudinal barriers prevent people with Disabilities (Divyangjan) from participating equally in socio-cultural and economic activities.

Under this campaign, all the STUs have to achieve targets of Accessible India Campaign, as under:

. 25% of Government owned public transport vehicles should be made fully accessible by March 2019.

. All bus stops/ terminals/ ports should be made accessible.

. Facilities for speedy licensing and registration may be provided to differently abled persons.

In this regard, as per the latest data compiled by ASRTU in respect of 62 STUs by ASRTU, it was brought out that the total number of operational buses are 147029, the number of buses involved in intercity operations are 102689 and those in urban operations are 44340. The overall accessibility is found to be 34.38%, with wheel chair accessibility to be only 5.4%. The data in respect of accessibility of bus terminals and the bus stops have not been provided. Further, the details in respect of the accessibility features are required to be updated on the MIS portal of the Department of Empowerment of Persons with Disabilities (DoEPwD).

4. Motor Vehicle Aggregator Guidelines-2020

In pursuance of provisions under Section 36 of the Motor Vehicles (Amendment) Act, 2019 and section 93 of Motor Vehicles Act, 1988, this Ministry has issued the Motor Vehicle Aggregator Guidelines, 2020 on 27% November, 2020.

These guidelines provide the definition of Aggregator and eligibility conditions for grant of licence to them; validity, renewal and suspension of aggregator licence, cancellation of license;enable ease of doing business, customer safety and driver welfare.

These are customer friendly and protect the interests of commuters, endeavour to enhance safety of customers, especially of women and the girl child, and provide for dedicated call centres for grievance redressal. These guidelines are driver friendly and ensure Road safety and safe driving. A framework is provided for sharing of revenue between drivers and aggregators. The guidelines encourage technology-based solutions for the sharing of rides/vehicles by commercial/private vehicles, thus promoting better utilization of existing assets and ensuring reduction of vehicular pollution and congestion on roads.

Vehicle Scrapping Policy (Phasing out of older unfit and polluting vehicles)

This Ministry has formulated a draft policy for scrapping of old unfit vehicles. The objective behind the scrapping policy is to phase out older, unfit vehicles and replace them with safe, fuel efficient, environment- friendly, new- generation vehicles. Commercial vehicles cause higher levels of pollution due to higher mileage covered by them. Therefore, efforts are focused more on these vehicles .The Voluntary Vehicle Scrapping Policy is driven through a combination of incentives and disincentives.

Salient features of the draft policy are:

Raising the registration fee for renewal, after completion of 15 years

Higher Fee for issue of Fitness Certificate, and fitness testing for vehicle above 15 years

Restrictions by states on the entry of old vehicles in City Limits

Higher Road Tax by States on vehicles older than 15 years

Waiver in registration fee and reduced road tax by states for vehicles purchased against scrapping certificates by scrapping old vehicles in an environment friendly and scientific manner

Vehicle fitness to be undertaken through automated fitness centres from a notified date

Deregistration of vehicles from VAHAN for vehicles older than 15 years (commercial vehicles) and 20 years(personal vehicles) found unfit through automated fitness testing centres

Necessary regulatory changes to be effected to create a process of establishing authorized scrapping centers by states.

More Scrapping facilities to be created, as per guidelines to be issued by MoRTH for scrapping old vehicles in an environment friendly and scientific manner

Sufficient numbers of Automated Fitness certification centres to be created by States under Govt./PPP mode

6. Scheme for Cashless Treatment of Motor Vehicle Accident Victims:

e After enactment of Motor Vehicle (Amendment) Act, 2019, Section 162 of the Motor Vehicle Act, 1988 empowers the Central Government to make a scheme for cashless treatment of road accident victims.

e Section 164B of the Motor Vehicle Act, 1988 empowers the Central Government to establish a fund named “Motor Vehicle Accident Fund”, which shall be used for: -

(a) Treatment of persons injured in road accident in accordance with Section 162.

(b) Compensation to representative of a person who died or person who is grievously hurt in a Hit & Run Accident.

(c) Compensation to such persons, as may be prescribed by the Central Government.

e Constitution of Motor Vehicle Accident Fund: - The fund will comprise of three accounts, namely: -

(a) Account for Insured Vehicles-To provide cashless treatment to accident victims in case accident concerns insured vehicles.

(b) Account for Uninsured vehicles/Hit and Run Accident- To provide cashless treatment to accident victims in case accident concerns uninsured vehicles, or it is a hit & run accident

(c) Hit and Run Compensation Fund- To give compensation to victims of road accidents as per section 163.

a) Scheme for Cashless Treatment: - This scheme provides for Cashless Treatment to all road accident victims till stabilization.

b) It is mandatory for all hospitals to admit road accident victims immediately and provide treatment.

c) Transportation cost i.e., bringing the victim to the hospital, or shifting to another hospital, in case required, is also covered.

d) Maximum amount of treatment covered is Rs. 1,50,000 per accident per person.
