    LEASE DEED

    This LEASE DEED is made on________day of ___________2010

    BETWEEN

    Mr._____________________s/o Mr___________________,r/o_____________________(hereinafter

    reffered to as the LESSOR which expression shall include his heir,successors,legal representatives and

    assignees of the ONE PART).

    AND

    Mr.___________________s/o Mr _____________________,r/o ____________________( hereinafter

    reffered to as the LESSEE which expression shall include his heir,successors,legal representatives and

    assignees of the OTHER PART).

    WHEREAS the LESSOR is lawful and absolute owner and landlord of all that piece and parcel of the

    property bearing Flat no. __________________________________________________________

    AND WHEREAS the LESSOR has agreed to give on rent the above mentioned Apartment consisting of 2

    Bedrooms , 1 Living/Dining room , 2 Bathrooms, Kitchen and Scooter garage along with assets and

    fixtures listed in the annexure herein attached to LESSEE on monthly rent of Rs 20,000/-(twenty

    thousand only) for a period of 11 months extendable to further 11 months on following terms and

    conditions.

    AND WHEREAS the parties are now desirous of reducing the terms of lease into writing.

    NOW THIS DEED OF LEASE WITNESSETH AND THE PARTIES MUTUALLY CONSENT WITH EACH OTHER AS

    UNDER

    1. That the LESSOR hereby agrees to grant lease and permission to the LESSEE to use the subjectproperty therein for his residence ans that of his family on and from _______________(date),

    and LESSEE herein had agreed to take subject property on lease basis with effect from the same

    date. The period of lease is for 11 months from _____________(date) to ___________(date).

    2. That in consideration of LESSOR granting lease to the LESSEE, the LESSEE shall pay the LESSOR amonthly rent of Rs 20,000/-(twenty thousand only) payable in advance by ________day of

    respective month of the English calender.

    3. That the rent mentioned above includes payments for the following services and facilities:

    4. That the LESSEE shall furnish to the LESSOR interest free security deposit ofRs__________()which will be paid by the LESSEE to the LESSOR at the time of taking physical

    possession of the property, to be held by the LESSOR and which shall be reffered at time of

    vacating the premise, by the LESSEE or on termination of his lease and vacant and peaceful

    possession handed over by the LESSEE to the LESSOR.

    5. That the Lessor may at his sole discretion extend the period of land agreement for another 11months with or without increase in rent after ___________(date )

    6. That the LESSEE shall use the said premise as a resedential accomodation for the exclusive useof Mr. ____________and his family and shall not do or suffer to be done anything therein which

    likely to be a nuisance or annoyance to other residants or to prejudice the rights of LESSOR as

    the Owner of the said premises.

    7. That the LESSEE shall not sublet, assign or part with the possession of whole or part of thedemised premises in any case.

    8. That the LESSEE shall pay all the charges for electricity and water consumed and telephoneusage by him in said premises direct to the authorities.

    9. That the LESEE shall be liable to undertake all day to day repair of the electricity, sanitary andwater supply.

    10.That the LESSEE shall not during the period of the lease deed make any structural alterations inthe said premises without the prior wrtten consent of LESSOR, but shall be at liberty to install air

    conditioner and domestic electric appliances and other conviences reasonbly requried by him

    and which remain the property of the LESSEE and shall be removed by him on vacating of the

    premises.

    11.That the LESSEE will keep and maintain the LESSORs fixtures and fitting and effects in the saidpremises in good order and conditions and upon the termination of the lease the LESSEE will

    leave the same as provided by the LESSOR to the LESSEE at the time of handing over the

    possession of the said premises (reasonable wear and tear accepted ).

    12.That the LESSOR is fully empowered, authorised and able to make this deed of this lease and willhold LESSEE free and harmless of any demands, encumbrances, claims, actionsor proceedings by

    other in respect of the quiet possession of the premises and the LESSOR further states that it

    will ensure to LESSEE peaceful and uninterupted use and enjoyment of the premises during the

    term of the lease.

    13.That the LESSOR shall be responsible for the payments of any taxes or levies imposed by thegovernment of India or Governmental authorities and that all law and rules , regulations of such

    authorities will fully be complied by the LESSOR.

    14.That the LESSEE shall have an option of terminating the lease agreement by giving _____________months notice. However this option can be exercised only after expiry of

    _____months, alternatively after payments of ________months minium rent. On doing so the

    LESSOR shall return to the LESSEE all unadjusted payments made to him in form of advance rent

    or security deposits.

    15.That all the belonging to the said premises shall be handed over to LESSEE at the time of signingof lease agreement which the LESSEE shall return to LESSOR on expiry or temination of lease

    agreement.

    16.That the lessor shall not be responsible of any theft, loss,damage or distruction of any propertyof the LESSEE in the said premises and not for any bodily injury to any person living in said

    premises during the occupancy of leased premises from any cause whatsoever.

    17.That the LESSOR and the LESSORs authorised representatives shall have full liberty to inspectthe leased premises at a reasonable hour by giving ___________hour notice.

    18.That notwidstanding anything hereinabove contained, it is agreed by and between the partieshereto that in the event of default of any conditions hereinabove reffered to,the LESSOR shall

    be entiled to revoke the lease granted after giving the LESSEE __________month/s written

    notice to remedy the breach complained of. On expiry of the said period , the LESSOR shall be

    entiled to and shall always have power to terminate the said lease at his absolute discretion

    without subjecting himself to any liability on that account and in such an event, the LESSEE shall

    surrender the premises and deliver the possession to LESSOR.

    19.That in case the LESSEE does not vacate the premission the expiry of the lease period, theLESSEE shall pay a daily charge of Rs____________extra as penalty to the LESSOR till date of

    vacation of said premises. This penalty shall br without prejudice to the right of the LESSOR to

    take steps to retain back the possession of the said premises.

    20.That at the time of handing over the vacant and peaceful possession of the premises by theLESSEE to the LESSOR . the LESSOR has to refund the security deposit after justified deductions

    (including any pending electrical, phone, water bills)

    21.That the original lease deed is excecuted on appropriate stamp paper which shall be retained bythe LESSORwhile a copy thereof shall be retained by the LESSEE.

    The original lease deed is excecuted on stamp paper of Rs. 407/- which shall be retained by the

    LESSOR while copy thereof on stamp paper of Rs 2/- shall be retained by LESSEE.

    22.That the rights of parties shall be governed under provisions of Transfer of Property Act and notunder provisions of Delhi Rent Control Act as rent of property is beyond statutary limit.
