We are just a few short weeks from what I know will be one of the finest conferences FALI hasever put together.

The quality of the speakers is without question, one that rivals national conferences. As wecelebrate our 20th Anniversary we will be recognizing many of our members who have beenwith FALI for five, ten, fifteen and twenty years. These are our milestone members who havestayed involved with FALI over the years, to assist in our mission of protecting and promotingour profession.

I’m honored to let you all know that the first president of FALI, Mr. Al Stone will be returning toFlorida to join us for this very special event. I hope all past Board members and Presidents willmake the trip to Tampa this year to be recognized for all that they have done with FALI for ourprofession.

This year we can add to our achievements with the help, and cooperation, of the Division ofLicensing. The DOL has agreed to remove any Class “A” licensees physical address from theDOL’s website upon receiving a written request. Many of our members who work from homehave wanted this for quite some time. I’m glad FALI was able to work with Grea Bevis and theDOL to achieve this. Another request from our members was the addition of two calibers forthose who have a Class G. The DOL has included in their 2013/14 bill the addition of the .40caliber and .45 ACP for those who wish to carry them.

The deadline for the group rate for the hotel rooms is fast approaching. If you want to savemoney, register before April 9th. In addition, the early bird registration period is also ending forthe conference and the rate will increase after April 11th so register now by phone, online atfall.org or via mail soon.See you at the conference.

As I write this the 2014 legislative session is off and running. There are many issues our legislators are going to have to deal with this session, fortunately, most of them don't have an impact on our profession. As I indicated in my last report we are fully behind the Department of Agriculture and Consumer Services bill for this session. In addition to the usual budget and clean-up language there is the allowance for the use of 40 and 45 caliber ammunition for those that hold the appropriate license.

I have looked at a number of bills that deal with privacy, open government, records and other issues that have potential impact on our profession. There are a few that have the potential to close some records but nothing of significance. The good news on the records front is that there is a bill that helps to define what is a public record and requires that agencies train employees on CH 119, the public records law. Hopefully this one will pass without opposition.

Otherwise I am looking forward to our conference in May. This will be the twentieth and it looks to be the best. Our president has promised a few surprises and there will be the usual great vendor presence. After the past few conferences, headed by Rory McMahon, I thought I had seen some of the best line-ups. This year I think he has managed to top his previous efforts yet again. I trust that I will see many of you there for some good food, great speakers, networking and maybe a good cigar and a cold beverage.

That is all from up here in Tallahassee. As always, if you have FALI business to discuss, particularly of a legislative nature, please give me a call or send me an email and if you find yourself up this way I'll meet you for a cup of coffee.

FALI Officer and Board Members Election Election time for the Florida Association of Licensed Investigators (FALI) is just around the corner. For the second time in as many years, none of the officer or board positions have any opposition. Ballots will soon be in the mail to all active and paid-up FALI members. Please complete the ballot and follow the instructions printed on the reverse side. Failure to follow the instructions will result in the ballot being disqualified. In order to ensure the secrecy of the ballots, please do not put your name or other identifying information on the ballot itself. Simply mark your ballots and then enclose it in the small envelope that we will also send you. Place the small envelope, inside the large, business sized envelope that is pre -addressed to the FALI Election Chair; and get it in the mail. All ballots must be received no later than 5 pm on Wednesday, April 30, 2014. Our annual business meeting and the elections will be held on Friday, May 2, 2014, at the 20th Annual FALI Southeastern Private Investigators Professional Development Conference in Tampa. If you haven’t already registered and/or made your hotel reservations, this would be a good time to get those out of the way—I know you will have a great time at the conference. On Thursday May 1, Brian Ingram will be presenting a special full-day pre-conference seminar* on: Electronic Evidence Exploitation.

Brian K Ingram is a recognized expert in his field and was named by PI Magazine as "the best Case Investigator in the country." He holds a Bachelors Degree from Sam Houston State University and was a police officer in several jurisdictions. Mr.

Ingram was also appointed Chief of Police and has conducted extensive criminal investigations during his career. He has been specializing in Internet Crimes and Investigations for many years and is widely recognized as the leading expert in this field.

If you missed him two years ago in Cocoa Beach, Dr. Henry C. Lee is one of the world’s foremost forensic scientists and will offer his insight on forensic science. Dr. Lee has been a prominent player in many of the most challenging and high-profile

cases over the past 40 years. Dr. Lee’s work has made him a landmark in modern-day forensic sciences. He has been a prominent player in many of the most challenging cases of the last 40 years. Dr. Lee has worked with law enforcement agencies in helping to solve more than 6000 cases. In recent years, his travels have taken him to England, Bosnia, China, Brunei, and other locations around the world. Dr. Lee’s testimony figured prominently in the O. J. Simpson trial, and in convictions of the "Woodchipper” murderer as well as hundreds of other murder cases. Dr. Lee has assisted local and state police in their investigations of other famous crimes, such as the murder of Jon Benet Ramsey in Boulder, Colorado, the 1993 suicide of White House Counsel Vincent Foster, and the reinvestigation of the Kennedy assassination. Dr. Lee is currently the Chief Emeritus for the Department of Public Safety, Division of Scientific Services and was the Commissioner of the Connecticut Department of Public Safety for over two years and served as that state’s Chief Criminalist from 1979 to 2000. Dr. Lee was the driving force in establishing a modern State Police Forensic Science Laboratory in Connecticut.

On Saturday, May 3, we will be joined by ROBERT E. O’NEILL, ESQ. will discuss Transition From Government/Public Sector to Private Sector Investigations.

Robert (“Bobby”) E. O’Neill joined the Freeh Group International Solutions, LLC (FGIS) as a Managing Director in July 2013. He is assigned to the office in Miami, Florida. Prior to joining FGIS, Mr. O’Neill served as the United States Attorney for the

Middle District of Florida. He was appointed by President Obama on October 5, 2010. Mr. O’Neill also previously served as the United States Attorney from 2007 to 2008 under then President Bush.

After developing some trial skills in the Manhattan District Attorney’s Office, Mr. O’Neill joined the United States Department of Justice. He became an Assistant United States Attorney in the United States Attorney’s Office in the Southern District of Florida. Bobby was assigned to the Miami Division. While in that office, he prosecuted all types of federal criminal cases, including arms export control act violations, violent crime, drug trafficking, money laundering and white collar crime. In addition to his trial responsibilities, he also held the following supervisory positions: Deputy Chief of the Major Drug Traffickers Section and Chief of the Financial Litigation Section.

Mr. O’Neill returned to his position as an Assistant United States Attorney in Tampa. However, within a year or so, he was again asked to serve another detail. This time, he was responsible for supervising the attorneys in the section who were prosecuting narcotics related criminal cases throughout the United States.

When Mr. O’Neill returned to the United States Attorney’s Office from his detail at the Department of Justice, he began concentrating on cases involving public corruption and complex fraud. In addition to handling his cases, he was offered and accepted a series of supervisory positions. Those positions included Chief, Special Prosecutions- Public Corruption Section; Chief, Criminal Division; Anti-Terrorism Coordinator; First Assistant United States Attorney; and ultimately, United States Attorney. Throughout that period of time, Bobby continued to prosecute cases personally as the lead and, except in one case, the only trial counsel for the United States.

When wise guys have a rat problem, they don’t call an exterminator — they dial defense lawyer Gerald McMahon. “No one does rats like I do,” McMahon boasted to The Post. “My specialty is cross-examining rats. I have good instincts.”

Last year was a banner year for the silver-maned 65-year-old — who has helped reputed Colombo associate Francis “B.F” Guerra beat double murder, extortion and assault charges in July, and won an acquittal on extortion charges for alleged Genovese capo Anthony Romanello in November.

“I’m pretty much dancing on the face of the Eastern District,” he said. To bust a rat, McMahon — who charges $800 an hour — said he uses a combination of street smarts and textbook psychology. The son of federal prosecutor Daniel F. McMahon — one of the attorneys who went after Jimmy Hoffa in 1957 — McMahon was an infantryman in Vietnam, drove a cab and was an actor in the Wisconsin troupe Theatre X, before becoming a lawyer. “Some nights when I was on stage, I could literally feel that if I raised an eyebrow, the audience would react,” he said, recalling his turn as Willy Loman in “Death of a Salesman.” “That’s what it’s like in the courtroom. They like a show.”

Carlton Joyce is a Partner at Bouhan Falligant, LLP practicing in the Firm's Litigation Practice Group, and has been

associated with the Firm since 1993. Mr. Joyce's litigation practice concentrates in the areas of aviation law, products liability, insurance defense, medical malpractice defense, and business litigation. He is admitted to practice in all federal and state courts in Georgia, the U. S. Supreme Court, and serves on the Federal Court Advisory Panel for the Southern District of Georgia. DENNIS ROOT is a renowned law enforcement trainer and nationally recognized expert who testifies in cases regarding use of force and personal safety. The George Zimmerman Experience, Preparing for High Profile Cases: Every case brings the witness before individuals that will

I am excited about being involved in launching NCISS’s new legislative program as we are moving into 2014. In short, Lobbyit, under the direction of Paul Kanitra, has taken the helm as NCISS’s lobbyist following the retirement of Larry Sabbath December 31. Larry has served NCISS well over the past decades. He has maneuvered us through the DPPA, the FCRA, many FTC rulings, the 2ND Amendment, and scores of untold battles involving social security numbers and data protection. We will miss him. He has done us proud.

It does little to fight restrictive legislation in Florida without simultaneously joining forces with an association that can represent you in Washington D.C. That association is NCISS. We have learned that addressing laws impacting our businesses is often facilitated through relationships we establish with our elected representatives. This is exactly what happened when we were in the throes of dealing with FCRA language requiring us to get permission to investigate an individual in a workplace investigation. Thanks to the relationship TALI member Bill Asher had with Texas Congressman Pete Sessions, Sessions agreed to help us; the problem was addressed and was ultimately corrected. This is a great example of why it is essential to become acquainted with those who are elected to represent us so we can dialogue concerning regulation and laws that affect us, our clients, and the judicial system.

Lobbyit, with an office is just a couple of blocks from the Capitol, will have several

people that will be available to us to advocate on our behalf and help us sustain those vital relationships.

Heading up the firm as its president and founder is Paul Kanitra. Paul graduated from Texas Christian University in Fort Worth with a Bachelor’s in Political Science.

Second in command is Keith B. Nelson, an attorney and former prosecutor with considerable regulatory experience. Prior to his association with Lobbyit, he ran the Legislative Affairs offices for the US Department of Justice and the White House Office of National Drug Control Policy.

Nile Elam, Director of Congressional Affairs, worked with Governor Romney’s Presidential Campaign and Arizona Congress member Paul Gozar. Nile also graduated from Texas Christian University.

December 1 found NCISS transitioning smoothly with both Larry and Lobbyit on board for one month. We added additional services in January, and then will be adopting Lobbyit’s full blown program effective April 1, 2014. There will be many positive developments as we

Wayne Taylor is a licensed senior private investigator and managing partner of EKS Security Services, LLC providing customized intelligence and counterintelligence investigative services for clientele throughout the state of Florida. He joined EKS Security Services after retiring from a 20-year career as a senior Human Intelligence Officer and Counterintelligence Special Agent for the United States Army. During his career as a Special Agent, he conducted national security crime investigations, to include espionage and terrorism investigations. Between deployments in support of the Global War on Terror, Wayne served as an advisor to multiple Joint Terrorism Task Forces throughout the Midwest regarding exploitable weaknesses of terrorist organizations.

Throughout his career, he worked in progressive positions of leadership, including deputy chief of the Offensive Counterintelligence Office at United States Central Command, Director of the Department of Defense (DoD) Advanced Source Operations Course (ASOC) for the Human Intelligence Training Joint Center of Excellence, Senior Human Intelligence Officer, Counterintelligence Officer/Agent as a few of his key assignments. During his tenure as the Director of ASOC, Wayne also served as a platform and field instructor teaching human intelligence and counterintelligence methodology and tradecraft, as well as surveillance and counter surveillance operations to DoD Students. As a result of his various experience and roles within the DoD, he remains an active consultant regarding intelligence activities.

Wayne is a former associate professor at Henley-Putnam University, and has been a guest speaker at the University of South Florida, the Pat Tillman Foundation, and ASIS Tampa Bay Chapter’s workshop on providing a “Competitive Advantage”. He is a contributing author of Terrorism and Homeland Security: Perspectives, Thoughts, and Opinions and the author of the Dark Arts of Business: Elicitation, introducing the subtle art of information collection in a simple and no-nonsense text. traverse through 2014 including an online advocacy hub and legislative tracking for all 50 states to develop a broad, national advocacy presence across the country.

The advocacy hub tracking state legislation is particularly important for those states, unlike Florida, where no strong legislative monitoring program exists. Although Lobbyit will not be serving as the lobbyist for state interests, they will certainly assist representatives from NCISS member state associations in developing their own grass roots advocacy program and be a resource for all of the state associations.

Besides representing private investigators, NCISS has a strong security side with a second legislation committee headed up by Past President Maria Landry. Attention CLASS “A” AGENCY OWNERS: WOULD YOU LIKE TO HAVE YOUR PHYSICAL ADDRESS REMOVED FROM THE DOL WEB SITE ?

FALI members who are owners of a home-based private investigation business, have long been concerned by the requirement that all A agency owners must list their physical address on the DOL web site.

The DOL policy of posting a physical address on the web site, has been a concern for small business owners, most of whom work out of their private residences. Larger private investigator businesses maintain an office and their physical well being is not affected by posting their home address.

Members of the FALI board of directors, as well as FALI president Tim O'Rourke, have lobbied DOL officials to remove the physical address and replace it with a mailing address. We now have some good news to report. DOL Director Grea Bevis has agreed to remove any A license holder's home address, upon written request.

If you are someone who is concerned about their safety and who would rather your clients not know where you live, then write to the following address and specifically request that they remove your physical address from the DOL license verification web site. Be sure to list your name, mailing address, the name of your business and your A license number, and a contact telephone number in case the DOL needs to contact you.

**Lucky Sevens!**

I was updating the Division of Licensing stats column on page 19 of this issue of the FALI Forum Newsletter and I got excited. Not the fact that most of the number of licensees dropped a little, but because the number of class C licenses is 7,777 as of 2/28/14.

Sure Las Vegas triple sevens can be good luck, but what do four 7’s mean for us in Florida? Probably nothing—except to point out that all license’s did drop in numbers except for class CC interns! Yes, Agency’s, Manager’s and Class G Firearm Licenses all took a dip. But not interns! I don’t think it’s a take over (laughing out loud), but it does tell me that more people are seeking to work in our profession.

I haven’t done any due diligence to consider if it’s the boomer generation retiring or just people changing careers, but it’s still interesting to me. But how lucky can anyone be without education?

Well folks, look no further except to the weekend of May 1-3, 2014. I could shake the dice, pull the slot machine lever, take a risky bet someplace else or just register online for the 20th Annual FALI Conference and win! And there is even an official Poker Tournament Saturday evening if you do gamble!

I won’t be taking any chances on missing out with my lucky 777’s or 7,777’s. I will be cashing in my chips, dice or whatever fun comes my way in May! It’s just a way to keep my own licenses in the system so I am not one to drop out in the next statistics the bureau issues next quarter!

The Florida Association of Licensed Investigators (FALI), as part of our service to our membership, has updated three business forms routinely utilized by Florida private investigative agencies and they are now available, exclusively to FALI members, on the FALI web site. Members can now download any of the forms, free of charge, from the Resources (Agency PI Business Forms) section of the FALI web site, www.fali.org.

The forms include a new contract/service agreement between a client and a private investigative agency; a subcontractors agreement and confidentiality and non-disclosure agreement; and a contract between a private investigative agency and an investigator employee.

As FALI continues to expand their services to our members, President O'Rourke reminds all members that "FALI is your association--we are here to assist you in every way possible. We feel that by arranging for these three new forms, we have probably saved each private investigate agency at least $300 and possibly as much as $1,000." That's money in the FALI members pockets."

We are seeking articles for our next issue of the FALI Forum – from Private Investigators and support staff with experience in the following areas; arson, asset checks, civil investigations, criminal defense, due diligence, fraud, information brokers, missing persons, product liability, skip trace, surveillance, workers compensation or any topic that may be of interest to your colleagues. We publish an electronic edition of the FALI Forum every other month (bi-monthly) and we publish printed editions twice a year that are mailed to our vendor friends, licensed investigative agencies and schools involved with private investigative educat ion. Please follow the editorial guidelines for FALI Forum submissions. These guidelines are designed to help you, the writer, understand what we accept and don’t accept for inclusion in our article database. Our GOAL is to provide a professional publication designed to convey the latest news of interest to FALI members and private investigators. Editor reserves the right to refuse publication of any submission at any time.

Editorial Guidelines for Submitting To the FALI Forum

a. MUST BE AN ORIGINAL ARTICLE THAT YOU WROTE. If you are submitting the article, lease submit the article as the original author, i.e. meaning that you wrote 100% of the copy. We accept reprints with express author authorization. b. MUST BE INFORMATIVE and share your unique expertise. Includes tips, strategies, techniques, case-studies, analysis, opinions and commentary in your article. Please make notable quotes separating facts and opinions as to not confuse the reader. We do not accept articles that contain more than 5lines of quoted or sourced material. c. MUST BE TIGHTLY WRITTEN articles; 750 to 1,500 words for feature articles; shorter articles of 350-750 words are great for “filler space” and Editor loves these types of submissions; and 120-300 words for news, press releases, etc. d.
