    Engineering experts,scratching their heads over aproposal they consider pre-posterous,say it may be a sub-terfuge to accomplish atakeover.Experts in initiativewording see potential loopholesthat could accomplish suchan objective.

    It’s called “The Port of SanDiego Marine Freight Preser-vation and Bayfront Rede-velopment Initiative.” Thedisingenuousness of the namesuggests that humbuggerylurks. “The title is so mis-

    leading,”says Sharon Bernie-Cloward,president of the SanDiego Port Tenants Associa-tion.“This is about taking theTenth Avenue Marine Ter-minal over.”

    Ray Carpenter, presidentof National City’s R.E. Staite

    Engineering, snorts, “Thatarea is on dredged fill. Youwould have to penetrate thedredged soils 40 to 50 feet,and probably another 20 or30 feet to go down to SanDiego formational material.”His company has driven pilesfor foundations for the SanDiego Convention Center andnearby waterfront hotels.Henotes,“It is in an earthquakefault zone.Just the safety issuesalone are enough to stop the

    project.” So many columnswould be required that it wouldbe impossible to do port busi-ness, says Carpenter.

    He thinks it would cost abillion dollars just to put upthe deck. Any buildings ontop of the deck — footballstadium, sports arena, con-vention center expansion,hotel, shopping center —would be a huge add-on cost.A football stadium would beanother billion bucks.

    “It doesn’t make any sensefinancially,” says Carpenter.Once the people vote for it inprinciple, the promoters will

    say it is not cost-effective tobuild a deck after all.“They willsay they will build on the ter-minal [ground] level andadhere to the will of the peo-ple,” says Carpenter. “It is ahoax. A landgrab.”

    Steve Erie,political scienceprofessor at the University ofCalifornia, San Diego, whohas studied how initiativescan be worded misleadingly,thinks he has found the loop-

    when your pom-poms fly!” It continues:“After

    the sun sets,MCASD invites you to put on your

    boots, tease up your hair, and two-step over for

    some wild and naughty antics at Debbie’s Disco.”

    The invitation, which features a facsimile of

    the poster for the movie, goes on to warn that

    admission to the racy affair is limited to “ladies

    and gentlemen over 21.” The event is part of a

    bigger fund-raiser on the same night called

    Monte Carlo Does Dallas,billed as the museum’s

    “annual gala fundraiser.” Tickets start at $650.

    The Debbie portion is $50 for museum mem-

    bers, $75 for nonmembers. But those tapped-

    out La Jollans whose subprime mortgages have

    gone into default needn’t fret: according to the

    small print at the bottom of the invite, city law

    mandates that “no purchase is necessary to par-

    ticipate in the casino party,which is open to the

    general public.”According to the museum’s IRS

    filing for 2006, the latest available, the Monte

    Carlo event grossed $428,485 that year, netting

    $199,842; the salary of museum director Hugh

    Davies was $305,834.… Yet another highly paid

    administrator at UCSD has gotten a hefty raise.

    This time it’s engineering dean Frieder Seible,

    whose annual salary was boosted a whopping

    25 percent,or $65,200,to a total of $326,100.The

    university justified the increase by saying that Seible

    has just completed a “stellar five-year review”and

    helped raise “$240 million ($40 million more than

    originally planned) in UCSD’s recent $1 billion

    fund-raising campaign.”

    Extremism in the defense ofpolitics Just how ideologically polarized isSan Diego’s state legislative delegation? Pretty much,

    judging from a recently released

    scorecard of how legislators

    voted on a series of critical

    bills.But some are more abso-

    lute than others. According

    to the survey, conducted by

    Sacramento-based, nonpar-

    tisan Capitol Weekly — in

    which a perfect liberal score

    was 100 and a perfect con-

    servative score was zero — El Cajon’s Republi-

    can assemblyman Joel Anderson was tied with

    six of his GOP colleagues for most conserva-

    tive, all with zeroes. North County assembly-

    man Martin Garrick wasn’t far behind, with a

    looked like a raving liberal, with 15, and Chula

    Vista’s Shirley Horton was even further to the

    Was I pre-dooced?Urbandictionary.com

    defines “dooce” as “1. To befired from your job becauseof the contents of your weblog.2. To get fired from your jobbecause you post about yourjob on your weblog.”

    In 2002, Heather B.Arm-strong,now a wife and motherin Salt Lake City, contributeda new word to the global lex-icon when her blog,dooce.com,was the reason for her jobtermination. (“Dooce”was acommon typo she made for“dude”when chatting online.)At the time she was living inLos Angeles, exploring a newlife free of the restrictions of

    the Mormon faith she’d leftbehind, dating actors, andworking as a Web designer. Inher blog, she chronicled herlife, which included talkingabout her job and cowork-ers. Her firing sparked anonline debate about bloggingsubjects, First Amendmentissues,privacy concerns,Inter-net tyranny and control, andsystematic censorship. Thedebate jumped from her blogto newsgroups and finally themedia. This occurred at atime when the political sec-tor was discussing whetherbloggers were journalists,withthe same protective rights asreporters.

    Another word for blogger is“escribitionist,”“a person whokeeps a diary or journal viaelectronic means,and in par-ticular,publishes their entrieson the world wide web,”according to Wikipedia.“Escribionist”was conceivedin June 1999 by Erin Venema,an “online diarist,”in an emailto a list of “web journalers.”

    Local escribitionist ChrisMorrow,a former spokesper-son for livejournal.com, onceone of the largest bloggingsites, says she was doocedbefore the word existed andhas faced stigma because ofher online presence.Her web-site, gigglecam.com, has beenvisually recording her marriedlife with her husband Martysince 1998. They were pio-neers of online reality pro-gramming.The website onceattracted hundreds of thou-sands of voyeuristic visitors,fans, enemies; there werewrite-ups in magazines andguest spots on radio and tele-vision talk shows. The web-cams followed them fromDallas to the Gaslamp Quar-ter to their loft in Little Italy,shut down only when mov-ing; otherwise, the cams run24/7, available online to any-one who wishes to view thecouple watching TV, playingwith their dogs, or enter-taining guests.

    “We’re not so unique any-more,”Morrow says.“Every-one has a cam up. But whenwe started, no one else wasdoing this sort of thing.”She

    concedes that catering topeople’s fascination with peek-ing into the private lives ofstrangers has its downside.There was the stalker.

    He started off as an Inter-net friend that she never metin real life. “He got weird,wanting my attention moreand more,”she says.“I clippedhim and then started to receiveletters from the Calvin andHobbes attorney. I publishedthe comic in my chronicles.The cease and desist lettersaid to take it down. I alsogot a letter from DiscoveryChannel. I had an agreementto display their cams in my

    chat room.This guy sent thema letter saying I was a porn siteand how appalled he was thatthe Discovery Channel wasassociated with porn.”

    The individual contactedher employer next. “I wasworking for a dot-com start-up, CU Shopper. This was in2000. The stalker sent themletters and said I was writingabout work in my Web jour-nal. I wasn’t. I was writingabout me.They called me onit, and I was let go.”

    She wasn’t going to stopblogging. It was a way of lifefor her. Not wanting to befired again, she told poten-

    tial employers up front whatshe did online. “I went totemp agencies,”she said,“andtold them I had an onlinejournal. They didn’t reactwell. They said, ‘We feeluncomfortable you do that.’ ”

    Cushopper.com, “a Cali-fornia-based provider of directand online shopping to creditunion members,” accordingto a 2000 press release, nolonger seems to exist. Thewebsite now lists references tomystery shopping providers.

    * * *“The Internet has changedin many social ways,” ChrisMorrow says.

    Today, a person can bedooced for any activity onthe Web, from posting con-tent, written or visual, onYouTube, MySpace, or Face-book, to podcasting, BBSposting,digital surfing,cyber-villaging, broadband pontif-icating, Web whistle-blow-ing, hypergossiping, orspeechifying in the dataslipstream.

  • hole. In one section, the pro-posal talks of “flexibility forconsideration of a wide arrayof development options”andlater, more ominously, says,“grade level acreage need notbe used exclusively for theexisting marine-related indus-trial activities.” In football,that’s called encroachment.

    “This is the money shot,”says Erie. “This gives themleeway to rezone and reusethe existing terminal-facili-ties space. It is a sneakerclause — what we call a killerclause.”

    Adds Erie, “This is a conjob.”The promoters say theywill only use air rights abovethe port and it will cost the tax-payers nothing.“But this givesthem $2 billion worth of devel-opment rights for nothing.”

    “Once you use the groundlevel for other purposes, youdisplace the businesses downthere doing maritime workand create congestion prob-lems,”says Irene McCormack,port spokesperson.She is waryof the same loopholes thatbother Erie and Carpenter.

    Jim Mills, former presi-dent pro tem of the Califor-nia Senate, notes that whilethere have been similar facil-ities built over rail yards, therehas been nothing like this con-structed over a working port.He notes that near the port areyards of the Burlington North-ern Santa Fe Railway, as wellas trolley yards.But if the pro-moters went to either,“Theywould say,‘Sure,let’s talk aboutit.Let’s talk about price,’ ”saysMills. By building over portland, there would be no suchdiscussion. They would tryto walk away with it for free.When he was in the stateassembly in the 1960s, Millscoauthored the bill that cre-

    ated the port.From then to thepresent,“The first priority isthe handling of maritimetrade,” he says.

    Mills also notes that if theinitiative passes, the port’sboard must within 60 daysenter into an exclusive nego-tiating agreement with a pri-vate developer to work outthe details of the new plan.The San Diego–based pro-moters, developers RichardChase and Frank Gallagher,have been working on this fora year and a half.“No [other]firm could analyze the possi-bilities and problems in 60days,” says Mills. Chase andGallagher would not only bein the driver’s seat, they wouldbe sitting there alone.

    While Chase and Gallagherclaim that the air rights couldbe used for all kinds of struc-tures, it is clear that a Charg-ers stadium is what’s on theestablishment’s mind. Gal-lagher, for example, claimsthat if a football stadiumand/or sports arena wouldoccupy the space above theport, the City could use theQualcomm and Sports Arenaspaces for residential and com-mercial purposes, and —shazam! — the tax revenuecould pay off the pensiondeficit and keep the Charg-ers in San Diego to boot.

    Mark Fabiani, Chargerslawyer/mouthpiece, says theteam remains “exclusivelyfocused”on two possible ChulaVista locations, but if “theTenth Avenue site does becomepotentially viable, the Charg-ers would of course considerthe site.” Just about everyknowledgeable person in thecounty knows that Chula Vistaain’t gonna happen. But theChargers are in great shape:they pay extremely low rentat Qualcomm.They complainthat the Q doesn’t produce

    enough revenue,but the team’snet profit is excellent becausecosts are so low. The Charg-ers can afford to wait. “Fouryears ago we evaluated thecost of building a deck,” saysFabiani, but a key port offi-cial said not to bother, and“we have done no cost esti-mates of a deck since.”

    Padres majority ownerJohn Moores— who has beenout of town for some time —once cast a covetous eye atthe terminal, but Gallaghersays he hasn’t even talked toMoores and doesn’t intendto do so.Bernie-Cloward saysshe learned from a close asso-ciate of Moores that he thinksit’s a dubious idea.

    Gallagher says the project’scritics are “people who knowso little.” He says it will takemuch less than a billion dol-lars to build the deck. “Wehired the number-one engi-neering firm in the world.”The adjacent Hilton San DiegoBayfront hotel on the site ofthe former Campbell Ship-yards, subsidized by the port,is on the same kind of land ashis proposed deck.He insiststhat any use of the groundfloor would be for “trafficvehicles that will come in atthe lower level.” He says heapproached the BurlingtonNorthern:“You might as welltry to get an audience withthe Pope. The railroad is notgiving up one cubic inch of airrights.” Arguments againstthe project — such as that theNavy might depart in a huff —are “laughable, ludicrous.”

    Gallagher says the TenthAvenue Marine Terminalbrings in a very small amountof cargo; the National CityMarine Terminal does theheavy lifting.But McCormacksays that Tenth Avenue is crit-ical because it brings in goodsthat don’t fit into containers,

    and the big West Coast portsspecialize in containers.Andthe tonnage at Tenth andNational City are about equal,she says. Gallagher saysNational City handles muchmore tonnage. Employmentis not that different: NationalCity has 995 employees andTenth Avenue 822,accordingto Gallagher’s numbers.

    Gallagher and Chase aremanaging members of thegroup that’s promoting theproject,“and we are definitelyraising capital from others,”Gallagher says.“But the firstthing is to get the initiativepassed,” and then talk withthose who have an interest inthe project, such as residentsof Barrio Logan.You can betthat local groups promotingsports corporate welfare willbe solicited.

    Sums up Erie,“This $2 bil-lion gift in such a short timeframe is a perversion of the ini-tiative process. It is a scam.San Diego has never met adeveloper it doesn’t like.” ■

    The San Diego branch ofthe Automobile Associationof America declined to returna call for comment on theincident or their bloggingpolicy.

    Ellen B.,who lives in Hill-crest,says she has been dooced“three times for my writing.”The most recent was from adowntown architectural firm;she is limited to what she canreveal because she signed anagreement upon her termi-nation.She asked that her fullname not be used.“I was blog-ging about work,about someof the people there who Icouldn’t stand. No one knewabout it until my blog wasmentioned in a newspaperarticle. Immediately, the nextday, I was told to go on a two-week leave of absence.WhileI was gone, there were meet-ings about what to do aboutme.”

    When she returned, shewas called into a meeting.“They had printed out myentire blog. There were threeboxes full of sheets.They hadhighlighted parts where Italked about coworkers andthe office.”

    Although she used nick-names, they were known byher colleagues,and some werenot happy about what shehad to say.

    “I signed a separationagreement that I would nolonger blog about the com-pany or anyone there,” Ellensays, “and they also pickedselected entries and asked meto delete them. I did. At thetime I was worried — wouldthey give me good recom-mendations, would I ever beable to get another job in thearchitecture business?

    “When you are beingdooced,you feel guilty — didI do something wrong? DidI really hurt someone’sfeelings?”

    She adds,“I believe I wasfired out of fear I might stirup controversy.”

    Her first doocing experi-ence was in 2000 when sheworked at one of San Diego’sAppleOne temp agency offices.The company was monitor-ing and recording keystrokeson employee computers. “Iwasn’t blogging then.I had anemail list. I would tell myfriends about my weekend,share jokes. The thing was,every woman in the officewas doing the same thing,even the woman who got mefired, my manager. It waswhen I criticized the way she

    did things that I was told Iwas being let go for misusinga company computer on com-pany time.”

    Her second dooce was alsoat a temp agency, “the nextjob,at Volt,”she says.“A friendtold me not to use the com-puters and email,so I switchedto a blog. I wrote about theIT guy. He said he was aller-gic to something, I forget, soI wrote he was allergic to sex.One of the employees, a for-mer friend, was reading myblog. She showed it to the ITguy.”

    Word made its way aroundthe office about the onlinediary. Ellen was laid off fromher job; she was told it was dueto a financial crunch and“nationwide layoffs, but Iknew it was about my blog.”

    * * *Anonymous blogrings arepopular places for like-mindedpeople around the world towrite about their jobs.A com-pilation of blogs can be foundat anonworkblogs.blogspot.com.It lists Web journals frompolice officers, nurses, fire-fighters, waitresses, and edu-cators on every continent.“The Report Card” is writ-ten by a teacher who chron-icles the administrativemishaps at his school,assign-ing code names such as BlondeBloke, Pompous Ponce, andTalkie,whose mouth gets herfired. “CAD Monkey in theCubicle Jungle,”the blog of anarchitect who “sold out” tobecome a corporate lackey,left the blog July 26, 2006,saying,“I’m done, guys.”The

    next post is dated May 25,2008, titled, “The Bitch IsBack.”

    “The bad news is that inmany cases, there is no legalmeans of redress if you’vebeen fired for blogging,”statesthe Electronic Frontier Foun-dation on its page, “How toBlog Safely.”“While your rightto free speech is protected bythe First Amendment, thisprotection does not shieldyou from the consequences ofwhat you say. The FirstAmendment protects speechfrom being censored by thegovernment; it does not reg-ulate what private parties(such as most employers) do.In states with ‘at will’employ-ment laws like California,employers can fire you at anytime, for any reason.And nostate has laws that specificallyprotect bloggers from dis-crimination, on the job orotherwise.”

    The foundation suggestsusing services such as Near-lyFreeSpeech.net and Tor soft-ware (torproject.org) that willhelp with anonymity by mask-ing IP addresses and keepinga blog off Google and othersearch engines. Some sites,like livejournal.com, offer usersblogs that can be locked frompublic view, readable only topermitted friends.

    Michelle, a hiring man-ager at Kearny Mesa’sAppleOne, said the companyhad no written policy aboutthe do’s and don’ts of employeeblogging.“There was nothingin our training seminars thatcovered that,” she said, “andwe’ve never been told to ask

    potential hires if they blog ornot.”At Volt Services, a man-ager named David said,“Thatis left to individual companiesand their policies.”

    Chris Morrow still tellsemployers that she blogs; shesays she will not write aboutthe workplace. Ellen B. nowknows not to blog about peo-ple at a job or use identifyingnicknames or code words,but she feels that as long as shedoes not blog on companytime, she has the right to freeexpression.

    “I can stand on a streetcorner and shout about howmuch I think my boss is stupidor how my manager doesthings wrong,and that’s okay,”she says. “I have the right todo this. So if I write about itonline,what’s the difference?I still have the same right. Ifyou are posting private busi-ness information, I wouldthink you’re crossing a line,but if you’re posting aboutyour life, it’s your life, nottheirs.”

    Robert Cox, founder andpresident of Media BloggersAssociation, told USA Todayin 2006 that he encouragesall bloggers,whether at home,work, or the political arena,to fight back and protect theright of free speech againstany action that is taken to“merely silence critics.”

    When asked what she feelsabout her legacy, HeatherArmstrong emails the patentanswer she has told everyonesince 2002:“Never write aboutwork on the Internet unlessyour boss knows and sanctionsthe fact.” ■

That is, thepeople who are going to TJare not “suicidal.” They areseeking a peaceful, digni-fied, certain way out ifchronic or terminal illnessesmake their suffering un-bearable. They know thatoften at the end of life peo-ple lose control; decisionscontrary to their wishes aremade by others, and theymay be forced to live whenthey’ve lost their person-hood and dignity and theywould rather die. They donot want to shoot them-selves or jump off a build-ing. They should be entitledto be in their own homes,

    Mr. Alice, Sir:I’ve never seen you or anybody else for that matter take on this situation. Maybe the answer istoo obvious, but I don’t understand how. I like frequenting upscale bars and mingling with thewomen who are there. I have pretty good success and meet quite a few eligible dates that way. Butone thing really bothers me. It seems that about half the time, maybe more, when I meet thewoman the second time, she’s not anything like what I thought she was when I met her. Shedoesn’t look as good, she’s not as funny, engaging, whatever. It’s happened so often, I’mwondering what’s going on. This isn’t the usual kind of question you answer, but maybe you cancome up with something. It really has me bothered.

    Jeez, where have you been, Anon? Oh, yeah, that’s right. Upscale bars. Any of your highfalutintootsies ever drop the term “beer goggles” within earshot? It’s pretty well known. Smash Mouthhas a song about it. Bart Simpson even bought a pair of beer goggles in a gift shop and turnedone of his dreadful aunts into Angelina Jolie. It’s a phenomenon that everybody knows is true;but recently scientists felt it was necessary to prove it with grants and statistics and lab rats andjournal articles. The work was done in England and Scotland. So, Anon, we can definitively sayyou’re suffering from a chronic case of beer goggles. There’s no cure, limited treatment.

    You’re on the slow end of the curve, so we’d better catch you up. “Beer goggles” is thepopular term for what happens to your judgment when you’ve had a drink or two. Specifically,people look more attractive. Things look brighter and breezier. Bad jokes are funnier. Butmostly, people look more attractive.

    The Brit brain studiers got half their subjects a little tipsy, while the rest remained untipsy.Then they showed photos of random faces to both groups. Consistently, the drinkers rated thepeople in the photos as more alluring than did the sober group. This applied to both sexes —both men and women in the photos were rated as tastier by both male and female subjects. Soyou see, the dolly who looks dreamy after a mojito or two can turn into a little dog-o tomorrow.

    And in a related bit of breaking news, scientists have proved that men make bad judgmentswhile watching girls in bikinis. Really. This was studied by serious professors with tenure andeverything. Seems guys get impatient and make snap decisions when surrounded by near-nakedbabes. And for how many decades has the auto industry draped bikinied lovelies across fendersat car shows? Another bit of science proving the well-known and obvious. And I hope thisinformation enriches your already full life.

    Heymatt:Why are there so many people with the surnames Green, Brown, White, and Black but no onewith the surnames Yellow, Purple, Orange, or Red?

    And why is there only one family named Alice? Don’t have an answer for that one, but I canenlighten you about why you don’t live next door to Howard and Edna Purple. If we hop inthe wayback machine and set the dial for, oh, England in the year 1000 A.D., we find that peopleare beginning to adopt biblical given names, like John, Paul, Matthew, etc. Pretty soon, well,within a few centuries, in certain places, there were an awful lot of Johns and Pauls. As the populationgrew, confusion reigned. Candygrams meant for one John ended up going to some other John.Pizza delivery was chaos. So people started referring to some outstanding characteristic of theparticular John they were talking about. “I borrowed this rake from John. Can you return it,please? John the brown-skinned man who lives near the piggery. John the brown. John Brown.Got it?” Or John the carpenter. John Carpenter. John the son of Robert. John Robertson. Inaddition to colors (of skin, hair, eyes), people were identified by where they lived (Hill, or Greenif you lived near the village green), their stature (Short), and a ton of other identifiers.

    In fact, there are surnames derived from red (probably hair color) — Reed, Reid, andRussell. (Remember that much of this is going on during the time of Middle English.) Blountis what you might have dubbed a blonde. Some common surnames come from foreign languages.Vaughn is Welsh for red. Lloyd is Welsh for gray. Alice isn’t Welsh for anything, I don’t think.

    nlike some nattering nabobs of negativismin the local press, I thought our San DiegoState Aztecs played with skill and enterprise

    against those beasts from upstate San Luis Obispo.Hell, if the game ended one play earlier, San Diegowould have won!

    But, I’m not here to speak about Saturdaynight or, for that matter, the preceding 39 years ofSDSU Division I football. Who cares about that?Do you care who won the Paraguayan War? Ofcourse not. Besides, that’s not the point. Mypurpose is to preview next week’s contest and layout the Six Keys to Victory. If you’ll kindly stepover here…

    Sometime this week, the San Diego StateAztecs football team will board a jet aircraft and flyto the heartland of America. Once there, they willtransfer to ground transportation bound for NotreDame Stadium, thence to changing rooms, thenceonto the gridiron to confront the athletic industrialcomplex known as Notre Dame/NBC.

    NBC will televise the game over free TVbeginning at 12:30 PST. That’s this Saturday, people.

    So, how are we going to win? What are the SixKeys to Victory? Unfortunately, we can’t takecrowd noise into account. Notre Dame Stadiumholds 80,232 screaming, rabid, I-will-die-for-youfans. Saturday will mark Notre Dame’s 200thconsecutive home-game sellout.

    So what. The Aztecs just played before 26,851of their screaming, deliriously excited fans atQualcomm Stadium.
