THEORY-PRACTICE HYPOTHESIS
“Law in practice” and “law in reality” are not synonyms. Neither theory nor practice can adequately capture and/or control “legal reality”. Theory and practice are at best both legitimate strategic approximations of (legal) reality – for different purposes.

LEGAL PRACTICE
Legal practitioners are attuned to being doers of rather thanthinkers about the law: they want to make things happen; they attempt to change reality and to utilise opportunities at their disposal to achieve particular objectives.
Activities in practice, however, are possible only within certain limits and subject to factual constraints. These limits are oftenimposed and the constraints determined by people who are not legal practitioners and by circumstances beyond legal practice itself. Structural limits, for example, are setby legislators and others in positions of authority, and factual constraints may result from socio-economic, culturaland political factors.
