Riding the momentum set by German Chancellor Angela

Merkel’s recent three-country African tour, the Managing Director of Germany’s official export credit agency and investment

guarantees, Euler Hermes Kreditversicherungs-AG (Euler Hermes) formalised a partnership with the African Trade Insurance Agency (ATI) today. The partnership between Euler Hermes, PricewaterhouseCoopers

AG WPG (PwC) and ATI is expected to strengthen trade ties between Africa and Germany.

Under the agreement, one of the key features will be risk sharing on joint transactions and an exchange of credit information on international buyers. This will help expand the trading on open terms between German and African companies as well as fill an existing information gap in the African credit market. African exporters can use this information to make more sound business decisions. And for German traders, both companies hope to facilitate increased flow of capital goods into African markets.

“International trade contributes considerably to the sustainable development of the global economy. Export credit agencies play a crucial role in strengthening economic recovery as a non-debt-creating source of growth. This partnership with ATI ultimately benefits African and German exporters. The improved cooperation with multinational African institutions is part of our strategy to intensify the engagement with Africa on multiple levels”, commented Managing Director Andreas Klasen.

The partnership stems from the current shift in Africa’s engagement with traditional economic and trade partners. This shift is reflected in Germany’s new policy on Africa, which envisions

partnerships of equals with Africa’ and increased trade ties. To signal Germany’s renewed commitment to Africa, policy makers noted that this is the first policy on Africa devised by several government departments working together including foreign, economics and environmental ministries.

“This agreement supports what ATI has been witnessing for the past decade - aid without trade is not sustainable. The statistics confirm this. Although trade with Africa accounts for just 1% of Germany’s total trade volumes this is equivalent to 15 times the volume of Germany’s bilateral aid to Africa,” notes ATI’s CEO George Otieno.

ATI provides trade credit insurance that protects exporters against non-

payment risks from their buyers. The organisation is aggressively marketing this product to exporters in countries across the continent. ATI is building a track record with exporters in countries such as the Democratic Republic of Congo, Kenya, Madagascar, Malawi, Tanzania, Uganda and Zambia. In 2010, ATI provided insurance to cover trades valued at over USD39m. For Kenyan exporters the relationship with Germany is important. Germany is the second largest export destination for Kenyan goods – mostly coffee and horticultural products. And for Germany, Kenya represents an important export destination. Kenya imports an estimated USD13bn annually of German oil and other goods.

By Peter MusaNew constitution at the Kenya National Chamber of Commerce and Industry will seal the loopholes of the business body once the members endorse it.The Kenya Private Sector Alliance has steering the process of the draft new chamber constitution, which has been sponsored by the United Nations

Development Programme (UNDP). One of the fundamental changes during elections is that a neutral body will be required to preside over the elections, thereby making it hard for partisan politics and rigging to take place. Once the members adopt the constitution, the elections could be held in November

this year. The chamber has been at the centre of an embroiled leadership infamy brought about by segmental leadership which has been gifted of lack of proper structures to guarantee rule of law. Wrangles have dominated the chamber since 2007 when chamber elections failed to meet the threshold of acceptance by all members, leading to court proceedings which only ended with a settlement out of court when two factions, one of Kiprono Kittony and another of David Githere entered into a truce. This gave birth to a progressive role to have the chamber administration and management streamlined. With the private sector and the United Nations Development Programme which has injected Sh5 million towards the chamber constitution reforms, the twilight is near, as the sitting national chairman Onditi told media recently. “The order which the court had given to have the Mbugua’s team expired. You cannot have a vacuum in a company as someone can come and claim the ownership of the assets due to that vacuum in place. So a special general meeting

was convened to discuss on how to allow continuity of the office. Though the mandate of the members, I was picked to oversee the reform process once more as this was the first priority of the consent which was entered into in December,” Onditi said. He explained that the draft constitution was ready and it was a matter of time before it was unveiled to the members at the grassroots. The members were asked to have their input out of which a law firm Anjarwalla and Khanna Advocates were charged with the responsibility of overseeing the harmonization of the document to suit a legal context. The draft constitution has spelt out the separated the powers of the chief executive officer and chairman of the chamber. It has also created a new post of a secretary general. While the chief executive officer will be presiding over the day to day running of the constitution, the secretary will be dealing with matters of governing council. The secretary will be in charge of record the proceedings of the chamber, and shall be the custodian of the corporate records. “I have been in the steering

committee, and members are demanding this document. I am lucky that members have appointed me to be at the chamber. There is need for chamber reforms as we are soon getting on to form the EAC chamber which has to be guided by good leadership principals,” Onditi said. Besides, the draft removes the role of managing an election from the chamber members to an independent body which is legally mandated to conduct elections such as the Law Society of Kenya or the Independent Electoral Boundary Commission. “This is meant to eliminate partisanship and irregularity,” Onditi said. The constitution has empowered the county

chambers which will act as the management centres on all the affairs affecting the members, at the county level. The role of the chamber at the county will be to promote, coordinate and protect commercial and industrial interest of the members at the county level and shall be comprised of a county governing council, which will manage the affairs of the chamber at the county. It will compromise of county chairman, vice-chairman, secretary, woman, youth and persons with disabilities’ representatives. The constitution says that 10 members will be picked from 47 counties to participate in the elections of the national chairman.

Chinese companies are scouring Africa for resources to fuel a red-hot economy back home, but Beijing is interested in more than just what’s underground.In Kenya — which has few natural resources — the Chinese are building a massive highway and truck factory, and jockeying to construct a new port.

Kenyans say it’s all part of a broader Chinese strategy that is winning friends, opening markets and causing unease.The highest profile project is the Thika Road superhighway. Three Chinese companies are building a 31-mile road from the Kenyan capital of Nairobi to the city of Thika. In some sections, it’s 16 lanes across.

Peter Ngau, who teaches urban planning at the University of Nairobi, says East Africa has never seen anything like it.“There’s no comparison,” he says. “It’s a showpiece of the government.”Ngau says the highway will increase business and help expand the Kenyan economy. The road will help link

Kenya to Ethiopia, a major regional economy with about 80 million people. Apartment buildings are already sprouting along the sides of the highway.It’s also expected to ease some of Nairobi’s crippling traffic. It takes Ngau two hours to drive down the road to class each morning. When the highway is finished, he expects it will take him less than 40 minutes to get to work.One reason much of Africa remains poor is a lack of basic infrastructure. Kenyans hope this new superhighway will cut travel time and boost trade.“I think Chinese are trying to buy favor,” he says. “One of the biggest challenges in African countries has been poor infrastructure. African people are happy with them, because the roads are better with the Chinese.”Chinese roads are not only building good will — they’re also helping Chinese businesses penetrate the continent.“China is seeing Kenya as a gateway to the East Africa community,” says Joseph

Kieyah, an economist with the Kenya Institute for Public Research and Analysis, a government think tank.Kieyah says East Africa’s economy is about $75 billion. And, along with the economies of other countries on the continent, it’s growing. The International Monetary Fund estimates that seven of the world’s fastest-growing economies over the next five years will be in Africa.China already does booming trade with Kenya. Between 2005 and 2009, Chinese exports here more than tripled to $860 million. They include furniture, textiles and machinery.Most of the Chinese products are genuine, but others are fake. Some end up in a storeroom in downtown Nairobi run by Kenya’s anti-counterfeit agency. There are fake Yamaha electric guitars, fake Peavey drum sets and boxes of fake Staedtler pencils stacked nearly to the ceiling.“The fakes from China are so rampant in Kenya,” says Caspar Oluoch, an agency inspector. “Right now, if you walk through the streets of Nairobi, you will find so many fakes there.”As business ties between the two countries have grown,

Chinese counterfeits have followed. Kenyan businesses estimate they lose more than half a billion dollars annually to fakes — mostly Chinese. A.G.N. Kamau, the chairman of the anti-counterfeit agency, says he’s written to the Chinese Embassy twice about the problem.Some businesses say Chinese companies get special treatment because China is so powerful. Steve Smith, the recently retired managing director of Eveready East Africa, says the Kenyan government gave a Chinese company a waiver several years ago. The waiver allowed the company to import batteries without paying a mandatory 35 percent duty.Smith says he eventually persuaded the government to reverse the decision, but not before the Chinese company had taken a chunk of his market share.Like their products, the Chinese themselves are a growing presence in Kenya and much of Africa, and that’s having an impact on the country’s signature resource: wildlife. Every few months, police at Kenya’s Jomo Kenyatta International Airport seize smuggled shipments of elephant ivory.
