The petroleum purveyor net income $7.7 billion, compared to a profit of $6.9 billion during its 2011 first quarter!Chevron Reports One of Its Best Quarters EverChevron earned $6.5 billion for its latest quarter ending March 31, vs. a $6.2-billion profit during the company's 2011 fiscal first quarter. "It was one of the best quarters we ever had," said Patricia Yarrington, Chevron's vice president and CFO, adding that Chevron is leading the industry regarding oil margins. According to the company, Chevron earns a profit margin of nearly $39 per barrel of oil sold.

'Squeezed & Confused'Travel, tourism experts voice economic concerns over rising gasoline prices WASHINGTON -- The U.S. House Natural Resources Committee held an oversight hearing to examine the impact high gasoline prices have on job creation and economic growth in America's tourism and travel industry, which last year supported 14 million U.S. jobs."According to the Wall Street Journal, every dollar increase in gas prices means $2.6 billion a week must be diverted toward the gas pump and away from other spending. This decrease in consumer spending has significant impacts throughout our economy. With many families already running on tight budgets, the extra money spent on gasoline is more than enough to

force families to forgo summer vacations, spring break trips or other travel plans," said Natural Resources Committee Chairman Doc Hastings. "Beach towns, mountain gateway communities and various other tourist destinations rely heavily on spring and summer travelers for the majority of their yearly income. High gasoline prices can have a crippling effect on the travel and tourism industry as business costs increase and revenue decreases from the lack of tourists and visitors that can afford to make the trip." At the hearing, witnesses representing the travel industry recognized that as spring and summer travel season starts, many American families are already changing their travel plans and cutting back vacation and tourism.Overall, the U.S. travel and tourism industry generated $1.8 trillion in economic output last year. Some Americans are already changing their travel plans. Americans who plan to travel by car this summer, 54% said that an increase in the price of gasoline would affect their travel plans.Mark BrownAAA executive vice president of association and club services provided the committee with a consumer prospective on the impact of fuel prices on household budgets and travel plans. "Once again America's motorists are caught in a squeeze and confused as they try to understand what is happening at the gas pump," said Brown.Approximately 84% said they have already changed their driving habits or lifestyle in some way because of increased gasoline prices. Combining trips and errands was the most commonly reported cost-cutting tactic, with approximately 60% having already made this adjustment; 45% are dining out less and 34% are delaying major purchases.

Gas Prices Hurt Retailers; Too Pain at the pump especially hits independent owners hard, as the U.S. gas consumption drops to an 11-year low.ELMONT, N.Y. – The approximately 110,000 independent gasoline retailers are reeling from decreased demand, high prices and warehouse club competition, the Wall Street Journal reports. U.S. consumption of gasoline has declined to an 11-year low, 4.3% below this time last year. With demand decreasing, gasoline station owners are having tough times. “There have been times in the past month when I've been losing money for every gallon of gas I sell,” said Robert Fisher, co-owner of four Chevron convenience stores and gas station in Washington, Oregon and Arizona. “It's a very tough industry.” Sales of convenience store items and higher swipe fees contribute to the lowered profits. “The less traffic we have on the outside translates to the less traffic we have on the inside,” said Steve Cohen, owner of a Mobil gas station and convenience store. Candy, beer and other inside sales has slid around 25% from a year ago. “The volume is just slowly fading away.” The vast majority of U.S. gasoline stations are owned by individuals who purchase fuel from wholesale distributors. “I'm definitely hurting,” said Carl Betz. Gasoline sales at his Getty station are around 25% from 2011. “This is the worst business has ever been.” Grocery stores and warehouse clubs like Costco have cut into gasoline sales, too, by offering pump prices at a low amount. “Five years ago, [large chain outlets with gas pumps] were essentially nonexistent,” said Fisher. “Today they're all over the place.” Costco, Wal-Mart, Sam’s Club, BJ’s, supper markets, Big-Boxers, Hypermarkets plus can purchase wholesale gasoline on the open market while the independent gasoline retailer is a captive buyer under contract paying a much higher wholesale price and subsiding the above groups.

NEW YORK – A piece in Fortune earlier highlights the curious case for rising U.S. gasoline prices: While the U.S. “is enjoying an energy boom,” producing more crude oil than at least one OPEC country, the price of gasoline is $4 or more per gallon, even as demand hits historic lows.“[M]ore drilling is happening now, and prices are still going up,” writes Leah McGrath Goodman. The reason? “Wall Street has changed the formula for pricing gasoline.” Until last year, gasoline prices were directly linked to the price of U.S. crude oil, which was set daily in Cushing, Oklahoma, the largest oil-storage hub in the United States. However, today, U.S. gas prices are tracked to the price of Brent crude, a type of oil found in the North Sea. And Brent crude trades at roughly $20 more per barrel than U.S. oil.Therefore, even while more drilling is taking place on U.S. soil, the price benchmark has resisted a decrease, as it is linked to more expensive oil. “This is an unprecedented shift,” writes McGrath Goodman. “Since the dawn of the modern-day oil markets in downtown Manhattan in the 1980s, U.S. gasoline prices have followed the domestic oil price. In the past year, U.S. oil prices have repeatedly traded in the double-digits below the Brent price. That is money Wall Street cannot afford to walk away from.”Wall Street traders and major oil companies, therefore, seek the highest price for oil, and “just because an oil company drills inside U.S. borders doesn’t mean it has to sell to a U.S. buyer,” McGrath Goodman notes. Overseas buyers, she said, offer greater profit, which is winning over patriotism.As more North American pipelines emerge, this will lead to greater exports, which may lower global prices in the long term, though lead to “more of our North American petroleum products. lost to competition from abroad” in the short term.“America will have to fight to keep oil on its shores instead of seeing it shipped to another country by paying dearly for that privilege,” McGrath Goodman concludes. “Energy independence may be within our reach. But it comes at a price.”

Pressure is on Commodity Futures Trading Commission to reduce speculationU.S. Senator Dick Durbin of Illinois announced that many of his colleagues have come to the realization that oil futures speculation is intrinsically linked to rising gasoline prices. When he chaired a Senate Appropriations Subcommittee hearing (3/21) he cited a February report produced by Goldman Sachs that said speculation alone accounts for 56 cents per gallon and may at times go higher. A Wall Street Journal analysis says 63 cents of every gallon is due to speculation.Durbin questioned Gary Gensler, Chairman of the U.S. Commodity Futures Trading Commission (CFTC), about the effects market speculators have on the price of gasoline. In his responses Gensler acknowledged that speculation does indeed impact retail gasoline prices but beyond "watching oil markets regularly" he expressed little interest in taking any corrective actions or upsetting any apple carts.

Domestic Fuels Act IntroducedBill aims to make it easier for retailers to offer customers different kinds of fuel.The Domestic Fuels Act of 2012 (S.2264) was introduced in the U.S. Senate yesterday, March 29. The legislation would help retailers offer new fuels with a lower cost of entry, a lower liability risk and to limit other regulatory factors that impact the amount of renewable fuels that can be sold through existing motor fuel retail outlets, DL Online reported.U.S. Senators Amy Klobuchar (D-MN), John Hoeven (R-ND), Roy Blunt (R-MO) and Mike Crapo (R-ID) introduced the bipartisan legislation. The legislation’s goal is to produce more energy, increase competition, promote alternative fuels, provide more consumer choice and lower the cost of fuels at the pump. The Domestic Fuels Act would also help make it easier to market all fuels in order to give consumers more fuel choices.The bill looks to do the following:• Allow all fuels—traditional and renewable—to be stored and dispensed with common equipment.• To require the EPA to develop streamlined criteria, so underground tanks can be used to dispense gasoline, diesel, ethanol or some combination of fuels, rather than requiring the use of separate tanks.• Provide liability protection for retailers that meet these streamlined EPA standards, allowing them to sell multiple types of fuel with fewer restrictions.• Establish a new way for retailers to ensure their equipment is safe and legally recognized in order to reduce the cost of entry.NACS is behind the legislation and has been working with a coalition including the American Fuel & Petrochemical Manufacturers and many industry associations to develop the legislation.The coalition noted that importantly, the bill would “protect innocent parties from certain liabilities associated with misfueling when consumers are informed about fuels that are approved for only certain engines; and it will establish that an entity who complies with today’s laws and regulations cannot be held retroactively liable even if those laws and regulations change tomorrow.” In support of the bill, nine trade associations sent letters to key Members of Congress in both the House and Senate

There were a handful of recent news events suggesting increasing supply availability in triggering the change in market sentiment that led to the selling, including potential buyers of two refineries in Pennsylvania that were slated for permanent closure. This news in particular drove down gasoline prices in open market trading that had been boosted sharply by fear of a tight supply-demand dynamic during the summer months in the heavily populated Northeast.The board of directors for Delta Air Lines has given the green light to management to acquire the Trainer refinery near Philadelphia, which is currently closed. ConocoPhillips closed the refinery in September 2011, the facility that can process up to 185,000 barrels per day (bpd) of crude oil. Delta is looking to cut its jet fuel bill, with the company reportedly to work with J.P. Morgan to finance operations at the facility.Sunoco, Inc. said it would delay the planned closure of its 330,000 bpd Philadelphia refinery from July to August after entering into exclusive discussions with The Carlyle Group, a global alternative asset manager, regarding a potential joint venture. There is no guarantee that a deal will be reached, and Sunoco said it would idle processing units in August one is not consummated. “We are working actively with Sunoco and other stakeholders to explore ways to keep this vital facility operating. The facility has been operating at a significant loss for some time, and we are exploring every avenue to create a viable plan,” said Rodney S. Cohen, managing director of The Carlyle Group.Sunoco’s 178,000 bpd Marcus Hook refinery located just outside of Philadelphia was shut in December 2011 with no plans in restarting the facility.In addition to this news, was an earlier than expected start date for a reversed Seaway Pipeline. The pipeline will carry oil from Cushing, Oklahoma to Freeport, Texas, unlocking the important supply hub at Cushing which serves as the delivery location for the New York Mercantile Exchange light sweet crude futures contract.Rapid growth in both heavy tar sands from Canada and light shale oil from the Midcontinent have swelled supply at Cushing, which does not have pipeline takeaway capacity to the Gulf Coast. The Seaway Pipeline will provide an initial 150,000 bpd of takeaway capacity to the Gulf Coast as early as May. This pressured oil prices as traders repositioned on the news.TransCanada is fully committed to the construction of the 1,897-km (1,179-mile) Keystone XL Pipeline Project from Hardisty, Alberta to the United States it could possibly repeat 2008 decline in gasoline prices!

Another Payment Processor Hit by Hackers Unverified reports alleges a New York street gang with ties to Central America swiped more than 10 million credit and debit card transactions.McLean, VA – Global Payments, an Atlanta-based payment card-processing firm, suffered a credit and debit card breach affecting more than 10 million transaction records, USA Today reports. The processor issued a statement late last week confirming that it discovered the breach last month and reported it to industry officials and the FBI. Gartner banking security analyst Avivah Litan said reports point to a New York City street gang with Central American ties as taking control of "an administrative account that was not protected sufficiently." "I've spoken with folks in the card business that is seeing signs of this breach mushroom," Litan said. Security blogger Brian Krebs said thieves hacked into the Global Payments network between January 21 and February 25. MasterCard issued a statement advising its cardholders to contact the financial institution that issued their cards, while Visa said that no Visa systems were breached. The breach recalls the Heartland Payment Systems breach in 2008 and 2009, whereby 130 million payment card records were compromised. More recently, hackers stole payment card information from more than 100 million Sony PlayStation customers, while Zippos suffered the theft of account data for 24 million customers. "Any business that's capturing payment data is a target," said Mark Bower, analyst at Voltage Security. Retailers face stiff penalties for failing to comply with data breach disclosure laws. Currently, 46 states have enacted legislation that require merchants to notify customers whose card numbers are stolen. Many impose hefty fines if notifications are not made in a timely manner.

"Merchants are definitely on the hook for these state disclosures, because they are the ones who have the consumer relationship," said Ted Julian, of Co3, a Cambridge, Mass.-based company that helps retailers manage the repercussions of credit card theft.

Florida Targets Fruit-Flavored Tobacco Around 100 communities have adopted resolutions urging businesses to ban fruit- and liqueur-flavored tobacco products.ORLANDO, Fla. – Localities are asking businesses to stop selling fruit- and liqueur-flavored tobacco products because of the appeal of those products to children, the Orlando Sentinel reports. Around 100 communities have passed resolutions urging retailers to ban the flavored cigars, snuff and chew products. “Youth perceive these products as safe because of the candy flavor,” said Dr. Bonnie Sorensen, director of the Volusia County Health Department. Several cities, including Kissimmee, Lake Mary, Port Orange and St. Cloud, have adopted resolutions asking retailers to stop offering the products. While flavored cigars have been on the market for years, dozens of new flavors and tobacco products have recently been introduced, including flavored tobacco products and nicotine-laced toothpicks. The R.J. Reynolds Tobacco Co. manufacturers tobacco pellets and snuf, but does not market those products to children, said John Singleton, communications director of Reynolds American Inc. Singleton pointed out that the company works with middle schools around the country in smoking prevention. “We're aligned with the purpose of this effort,” he said. “We have a different way of going about it, though.” Resolutions carry little weight, given that it’s not a law and just a request. Jeff Baker, who owns Eustis convenience store, said retailers already follow the law in regard to not selling tobacco to minors. He said that parents should be more involved in monitoring their children’s purchases.

“Cash Mobs” Hit Up Small Businesses From San Diego to Buffalo; groups of organized do-gooders are descending upon small businesses, buying merchandise in cash and celebrating their pro-small, local businesses mission.MCLEAN, VA – “Cash mobs,” a much-welcomed relief from the criminal rash of “flash robs,” has come on to the retail scene to help out local merchants. USA Today wrote last week that these organized groups of do-gooders are hitting up small businesses to buy merchandise in cash, which for some retailers is a generous boost to their bottom line during tight economic times.These flash-mob-type shopping sprees have taken place in dozens of cities from San Diego to Buffalo, notes the newspaper, and are organized on social media platforms such as Facebook and Twitter. So far farmers markets, toy stores and hardware stores have been on the cash-mob hit list. During a spree, mobsters typically spend $10 to $20 in cash. Cash-mob organizers notified John Reburn three days in advance that his Appalachia Press business, a letterpress and silk-screening shop in Roanoke, Va., would be “hit” by a mob of more than 100 people. During the shopping spree, his store rang up 54 sales in less than an hour. “We did the equivalent of a Christmas shopping day in 45 minutes,” he told the newspaper. After the spree, the group convened at a local barbecue joint for drinks.“There are months when you just wonder if you can continue and if (printing) just has to be a hobby and not your career,” added Reburn. “But this little cash mob was just so joyful. Even though it was just one night, it does make you feel appreciated.”

Despite Reform, C-store Debit and Credit Card Fees Continue to RiseNATIONAL REPORT -- Few retailers have yet to benefit from the recent regulatory changes aimed at reducing debit card fees, according to a new study of Internet retailers released just as convenience store operators revealed their debit and credit card expenses rose a whopping 23 percent last year.Hidden Fees Lead to Higher Pump PricesWASHINGTON, D.C. -- The price at the pump is getting higher every day, and a new study finds there is more than meets the eye.

NACS, the Association for Convenience and Fuels Retailing, has uncovered that motorists are paying six to 10 cents a gallon in hidden bank fees every time they gas up. In addition, swipe fees increase along with the price of gas, even though banks are not doing anything extra to process the transaction.Card fees have been an ongoing problem for convenience store operators, ranking as the largest operating expense after labor. Convenience stores paid more than $11 billion in card fees last year, a jump of almost 25 percent and an amount almost 90 percent greater than their profits, according to the trade association."These fees have come to be a tremendous burden on convenience stores, most of which are run by small business people," said Lyle Beckwith, senior vice president of government relations for NACS. "In many cases, the banks are profiting more from the sale of gas than our members."As gas prices reached $4 a gallon in some markets, the banks' cut of the swipe fees ticked up to seven cents when motorists paid with a debit card and 10 cents when motorists used a credit card, according to NACS.The study also found that gas prices increased 80 percent between 2004 and 2011, while card fees rose 180 percent.

Many people think oil companies, who drill, extract, ship, and sell crude oil are the ones making billions of dollars. That's true. They do all the exploration, development, and hard work to bring the oil above ground. However, there are other players who don't even do any work and get paid on every gallon you buy.Banks earn billions in swipe fees every year, just for purchases you make at the gas pump. The gas station isn't making much, nor is the convenience store, so besides the oil companies, who's getting their hands in the pie?First- the government. We all know that all we're sure about is death and taxes. The government taxes everything- they don't do any extraction, processing, etc, they just take a tax. So who else does nothing and takes from the pockets of motorists and gas stations? Banks.

Shell, BP, ConocoPhillips Settle 'Hot Fuel' Class ActionOthers in class-action lawsuit soldier on KANSAS CITY, Mo. -- Three major oil companies--BP, Shell and ConocoPhillips--have reached a binding settlement agreement with class-action attorneys who sued more than 100 refiners, convenience store operators and truckstop marketers for failing to temperature-correct fuel sales to 60 degrees Fahrenheit.The lawsuits, filed five years ago on behalf of consumers in 28 states, Chief Judge Kathryn H. Vratil, sitting in a Kansas City, Mo., federal court, disclosed the settlement in a two-sentence announcement, but gave no details of the deal. Since the three companies market mainly through wholesaler-owned stations, the burden of complying with the settlement terms is expected to fall largely on marketers."I can verify that a preliminary settlement has been reached in the temperature correction cases around the country," Kayla Macke, a spokesperson for Shell said, "The settlement agreement is designed to fully resolve the cases against the parties to the settlement." There is no word of settlements involving other refiners or retailers in the case so far. The class-action trial is currently scheduled to start on May 7. Retailers involved in the litigation include The Pantry, Circle K Stores, Pilot Travel Centers, QuikTrip and RaceTrac Petroleum.The plaintiffs want retailers to install temperature-compensation equipment that would ensure that fuel is sold at or near a temperature of 60 degrees, but U.S. regulators have yet to approve such equipment for retail use. The deal that Shell, BP and Conoco have struck must still be approved by the court and members of the class represented in the cases, noted Macke. "The terms and provisions of the agreement will be made public through the court process for the approval of the settlement." Speculation is that the three majors will pay a lump cash sum in damages will make further concessions, perhaps requiring retailers to display decals on dispensers warning about the energy content of their fuel. The basic allegation is that marketers should have offered temperature compensation at the pump when they couldn't legally do it. This case has never been about consumers, but about a group of lawyers trying to get a fat settlement down the line," Dan Gilligan, president of the Petroleum Marketers Association of America (PMAA), told CSP Daily News.What's Behind the 'Hot Fuel' Settlements?Details point to strategy motivating "sudden rush" to settle Given their diminishing claims, marketers are puzzled as to why Shell, BP and ConocoPhillips, along with Casey's General Stores Inc. would suddenly settle out of court. It could be that they have done the math and decided that it's cheaper to settle than stay in, given that they do not run their own retail operations are more, said Dan Gilligan, president of the Petroleum Marketers Association of America (PMAA). Gas stations lobby for immunity from E15The EPA is getting ever closer to approving E15 for use in 2001 and newer vehicles. In the last few days, several lobby groups have convinced politicians to make sure that gasoline stations don't have liability and are somewhat immune from

responsibility over their customers improperly filling their vehicles.What's that mean? If you accidentally fill up with E15 in your older vehicle because the sign is too small or you aren't keen enough to see what you're pumping, you can't hold the gas stations liable for that small sign or warning.It's another sign that the renewable fuel industry continues to lobby on their own behalf instead of doing what motorists desire, which according to a recent poll is doing anything but adding more ethanol to gasoline.In a recent poll, 77.5% of respondents indicated they don't want any more ethanol in their gasoline. On the flip side, just 13.9% said they wanted more ethanol in their gasoline. The remaining 8.6% were not sure what they wanted.After it a deal with the EPA was announced, the AFPM released a statement saying the EPA was being responsible in regards to E15. Their statement said, "Unfortunately, today's EPA announcement represents yet another in the agency's unwise, premature and irresponsible series of actions in its rush to force E15 to the marketplace. EPA's hasty attempts to speed introduction of E15 before necessary testing is complete could endanger the safety of American consumers, threatening their vehicles and gasoline-powered equipment with possibly severe damage. This action is more about political science than real science because it is designed to protect the ethanol industry rather than the American people."This decision is particularly troubling, since recent information released by the Coordinating Research Council shows failures when using E15 in vehicles approved by EPA. With a lawsuit by AFPM and other organizations on this critical issue about to be heard, there is no reason for EPA to have rushed to judgment and acted so recklessly."The Domestic Fuels Act of 2012, a bipartisan bill introduced March 30 in both houses of Congress, includes a provision that would make it illegal for a retailer to be held responsible for damages that could occur as a result of misfueling by consumers, so long as the retailer has complied with the U.S. EPA’s misfueling regulations. The proposed legislation would protect retailers against potential liability should consumers use E15 in small engines, vehicles produced earlier than model year 2001, or in any other nonapproved engine and would also prevent retailers from being held liable if the consumer’s use of a fuel voids the vehicle/small engine warranty (according to Ethanol Producer Magazine)Why do we continue to push ethanol when it continues to put upward pressure on corn and thus food prices? Why do we use ethanol if it achieves less energy, and thus lower fuel economy than 100% conventional gasoline?Let your congressmen and women know you aren't happy. Not only are motorists losing the ability to hold stations responsible for E15 problems, but we may be getting forced to fill with E15 in the near future.
