Automakers switch to new engine oil for more efficiency, better protectionEvery 2011 General Motors car rolls off the assembly line with the engine filled with a new generation of oil. Other automakers, such as Ford Motor Co. and the Chrysler Group, are also beginning the switch to new oil, known by its industry grading as GF-5 or SN, or, in GM's case, Dexos1. GM says using the wrong oil may cause engine damage that would void the powertrain warranty. The grade identifies oil that's designed to help engines run more efficiently and better protect them from wear. Those are key properties as automakers wring more horsepower out of smaller engines and make greater use of heat-producing turbochargers and superchargers. The protection properties of the new oil also have the potential environmental benefit of increasing the mileage interval between recommended oil changes.Tests make the differenceThe Dexos1 and GF-5 oils hit the market on Oct. 1. They replace the GF-4 standard from the International Lubricant Standardization and Approval Committee, which has members from GM, Ford, Chrysler and the Japan Automobile Manufacturers Association. The American Petroleum Institute uses the SN designation for the new oil.“GF-5 and Dexos1 oils have a more robust formulation that should give you better contributions to fuel economy, cleanliness and fuel emissions,” said Mark Ferner, manager of the lubricants technology group at Shell. The main difference between Dexos1, which is a GM-licensed brand, and GF-5 oils is testing, Ferner said. To be certified as GF-5, the oil needs to pass a variety of chemistry and engine tests set by the American Petroleum Institute. But GM's testing for Dexos1 uses some tests mandated by the ACEA, the European automobile manufacturers association, in place of the American Petroleum Institute tests. For example, Dexos1 oil has to pass Mercedes-Benz's sludge and fuel-economy tests and Opel's test for the ability to work under foaming conditions, known as aeration. GF-5-certified oils that do not undergo the same tests are subjected to the American Petroleum Institute's equivalent to be certified. GF-5 oil can be found in both conventional and synthetic formulations but Dexos1 can only be found as a synthetic, according to Shell, maker of the Pennzoil and Quaker State brands. In some cases, oil companies already have formulas that meet or exceed the Dexos1 and GF-5 specifications. For example, Shell's Pennzoil Platinum and Quaker State Ultimate Durability synthetics exceed both standards.Good for new and old carsDexos1 and GF-5 oils can be used in older cars. Owners still need to consult their owner's manual to choose oil with the recommended viscosity. Consumers will find some bottles of oil with both the Dexos1 and GF-5 certification, said Ferner of Shell. He added that consumers will not notice an immediate difference after changing to a Dexos1 or GF-5 oil. Instead, the benefits are oil that better protects and cleans the engine over time.But beware if you're tempted to use conventional oil in an engine that calls for the new specification. New Scam Targets C-stores in Tucson AreaTUCSON, Ariz. -- Convenience stores and fast-food restaurants are the targets of a new, elaborate scam that has worked on multiple businesses in the city and Pima County, sheriff's detectives told KOLD News 13. Detective Tom Peine said criminals have used the same story to rob seven businesses in the county and several more in Tucson. The victims include Circle K, Wendy's and Taco Bell. Peine said the crook calls the store at a late hour and identifies himself as upper management in the company, and tells the clerk that something bad happened at the store earlier in the day. "Somebody got hurt, fell, ate something bad and had to be medically treated," he explained. The person on the phone then tells the clerk to avoid a lawsuit, they must put money, and in some cases, food from the store in a bag and hand it to a cab driver waiting outside. "The cab driver, unbeknownst to him what's going on, takes the items and delivers them somewhere around town where the things are picked up curbside," Peine said. The scam is so elaborate that it keeps working, the report stated. Garry Singh, whose family owns an ampm convenience store in the area, said he understands how c-stores are getting tricked. "Some stores are owned privately and some are company owned. With company owned, it's more vulnerable to getting attacked because they don't know who is above them," he told KOLD News 13. Singh said his store's clerks are trained to always double check with management when any situation comes up. "We

never directly take money out of the store…We have insurance take care of that. So, if someone's asking for money over the phone, most likely it's not true," he said.

N.J. Full-Service Heaven?New breed of Garden State retailers want self-service, hoping to bring down gas pricesTRENTON, N.J. -- Some New Jerseyans have been wondering whether it is time that they were allowed to pump their own gasoline, according to a Wall Street Journal report. Motorists pumping their own gasoline is illegal in New Jersey. It has been for 61 years. It is also illegal in Oregon, and in the New York town of Huntington, on Long Island, said the report.Yet the rhythms of full-service try the patience of the state's newest station owners, it said. Big oil is getting out of the pumping game, selling to people who forsake the repair shop for the convenience store and the high-volume pump island. The gasoline retailing lobby, once the force behind full-service, has split, the report said. Its association has given up praising the old filling station's homey virtues. Its least nostalgic members, meanwhile, are making the case for the "gas jockey's" demise.Bikram Gill and his partners have bought up 26 New Jersey stations. They don't fix cars; they sell cappuccino. Their burden is finding workers to push the buttons on their self-service pumps. "Any idiot can do it," Gill told the newspaper.If that category includes New Jersey drivers, Gill figures that self-service would let him cut prices by eight cents a gallon. But according to the Journal, New Jersey drivers do not necessarily want cheaper gasoline, which is cheap there already, it said.But New Jersey has the country's third-lowest gasoline tax, said the report, after Alaska and Wyoming. Prices are higher in the pump-your-own states next door.Gill said, "The consumer is thinking, 'I have low prices and I don't have to get out of my car. New Jersey is heaven!'."A BP station he owns, a 12-pumper, has a busy corner in Matawan, N.J., One afternoon, the report said; a line of cars awaited the attention of two attendants. Harish Sharma and Jagdeep Singh were working without banter for $9 an hour. Drivers phoned and texted. A few got out to use the ATM.In 1949, the year New Jersey banned them, America had 200 self-service gas stations; 13 other states had banned them, too. (Portsmouth, Va., banned attendants on roller skates.) The fear was that unprofessional pumpers would blow themselves up. "I wanted it guaranteed that the price will go down," Pam Fischer, a former state highway-safety director, told the paper. "If the price doesn't drop, what do I get? The chance to pump my own gas? I know how to do it. It stinks."The same words were said by the Oil Barons that gasoline prices will go down?

California's Proposition 23 Loss Could Burn Refiners In FutureHOUSTON -- While the refining industry spent millions trying to curb California's climate law via Proposition 23, it will spend much more trying to adapt to it, Dow Jones reported. California's climate law will force U.S. refiners to spend millions of dollars to update or replace equipment to meet the state's greenhouse gas emission targets, which are among the strictest in the country, according to those who operate on the West Coast. Valero Corp., Tesoro Corp. and others spent more than $9 million advocating the merits of Proposition 23, which would have suspended California's greenhouse gas emissions targets until unemployment in the state -- which has been around 12 percent since August 2009 -- dropped to 5.5 percent for at least a year. Californians voted 61 percent against the measure. The state is aiming to reduce greenhouse gas emissions to 1990 levels by 2020, according to the report. Valero, the largest independent U.S. refiner, reported third-quarter throughput of 272,000 barrels a day at its two California refineries, 11 percent of its total for the period. Meanwhile, Tesoro said it processed more than half of its third-quarter throughput of 474,000 barrels a day at its two California refineries, Dow Jones reported. Valero spent more than $5 million backing Proposition 23. Bill Klesse, chief executive of the San Antonio-based company, told investors last week that the company would "work around" the emissions targets if the proposition failed. But the CEO has also said the cost of meeting the clean air rules would force Valero to lay off some of the 1,600 people it employs at the two refineries and 83 retail outlets it owns and operates in the state. Market and industry analysts said the proposition's failure probably won't cause refiners to engage in massive layoffs or exit the market yet. But the defeat could further dampen profits in an already tough business environment and make the state a ripe target for foreign producers. Dominick Chirichella, a trading analyst with consultancy Energy Management Institute, said meeting the emission standards would potentially raise the cost of refining on the West Coast enough to make the region more open to refined product imports from Asia. "Imported oil would increase, and jobs would in essence be outsourced to refinery centers outside the U.S.," Chirichella told Dow Jones.

Federal Gas Tax Hike ProposedObama's commission recommends gradual 15-cent hike beginning in 2013WASHINGTON -- Senators Tom Carper (D-Del.) and George Voinovich (R-Ohio) are urging President Barack Obama's debt commission to consider raising the federal gasoline tax to pay for infrastructure projects, The Hill reported. have written a letter to the chairmen of the National Commission on Fiscal Responsibility & Reform advocating for a 25-cents-per-gallon increase. The commission has proposed a gradual 15-cent hike beginning in 2013."We suggest that the commission include an increase in the federal tax on gasoline and diesel as part of your report to the president," Carper and Voinovich wrote. "We suggest that the taxes be increased by one cent per month for 25 months--a total of 25 cents over a three-year period."

EPA to Delay Ethanol Decision  The EPA delayed until January a decision as to whether E15 is safe for 2001-06 cars and light trucks.WASHINGTON – The Environmental Protection Agency said that it would delay until January a decision as to whether a 15 percent ethanol blend (E15) is safe for 2001-06 cars and light trucks, Reuters reports.Last month, the EPA approved E15 for vehicles made since 2006. However, if it approves the blend for vehicles dating to 2001, the allowance would cover 60 percent of cars and trucks.The distinction is significant because many retailers have voiced opposition to E15, especially if it applies to only a small percentage of consumers. NACS is particularly concerned about the blend, as station owners could be held liable if consumers use E15 in non-approved engines.. Just last month, Oregon officials said they would now allow the blend to be dispensed in the state.Ethanol groups had urged the EPA to approve the higher blend in March 2009, though the EPA said it wanted to conduct a thorough review. Despite the EPA’s delay, they are still hopeful that the January announcement will be a favorable one for their industry."We are encouraged by EPA's commitment to accurate testing for 2001-2006 cars and pickup trucks, particularly given the failures are unrelated to the fuel being tested," said Bob Dinneen, president of the Renewable Fuels Association. "We believe the fuel testing to date clearly demonstrates the efficacy of E15 as a motor fuel for all light-duty vehicles.The American Petroleum Institute (API) said the EPA should extend its tests for an additional six months or more.Rushing to allow more ethanol before we know it is safe could be disastrous for consumers and could jeopardize the future of renewable fuels," said an API spokesperson.

Processing PCI Confusion As timelines for mandates are given more latitude, some retailers put off the inevitable task of becoming compliant, putting their business at risk. Many retailers are breathing a sigh of relief in regard to PCI, after this summer’s deadline for software compliance was relaxed after a request by the major oil companies, giving scrambling retailers a little more time to comply. But retailers be warned: chains that face a breach could still get hit with huge fines.  “Some operational problems developed as retailers hurried to install the latest software that met the Triple Data Encryption Standard (TDES), at the last minute,” said Trinette Huber, manager of information privacy and security for Sinclair Oil Corp.’s PCI program for the company’s 2,600 dealer-operated sites across 21 states.Skimming ConcernsThe dangers of a breach are fresh in the minds of many retailers after reports this summer that thieves attached skimmers to gas pumps at more than 30 service stations of various brands in and around Denver. “Skimming is a big worry, mainly because we’re seeing more and more of it. Visa is saying protection needs to be put in place, but there is no mandate,” Huber noted.  Retailers can be skimmed even if they update their encrypted pin pads. If thieves can’t get to the numbers, they’ll make fraudulent cards. Retailers are concerned because they’re not sure what such a breach would cost them and there is not a lot of discussion about it, Huber noted. Visa does not consider skimming a breach in the sense that it’s not PCI related because it’s a skimmer problem. Huber recommends that to prevent skimming at the store level, operators should change their locks and add some physical changes, such as better lighting and video cameras to deter would-be thieves—all in all, an inexpensive fix.

Winter Haven FL Three men have been arrested and charged with the illegal transportation of fuel in a case the Polk County Sheriff's Office reports might involve stolen diesel fuel.The arrests followed the appearance by several Sheriff's Office detectives and deputies at the Chevron gasoline station at 1200 Third St., S.W. (U.S. Highway 17 South) in Winter Haven on Monday morning.At approximately 10 a.m., according to a Sheriff's Office report, deputies received a call from the Winter Haven Police Department and a request to help officers at the Chevron station, which is in the city limits.City police had received an anonymous call about a suspicious red truck at the Chevron station and what appeared to be three men perhaps stealing fuel from an underground storage tank, according to the Sheriff's Office. When deputies arrived at the station, they found the red truck with a box trailer attached to the back of it and large containers holding diesel fuel inside the trailer.The men had just finished unloading the fuel from the containers in the trailer into the underground storage tank at the Chevron station, the Sheriff's Office reported.

According to the felony traffic citations, the suspects were identified as Ezekiel Johnson, 38, of 2000 16th Court, N.W., Apt. 12, Winter Haven; Perralyn Small, 60, of 224 Lincoln Court, Auburndale; and Myron Williford, 47, of 213 Lincoln Court, Auburndale.Each of the suspects was charged with unlawful conveyance of fuel, a third-degree felony, and booked Monday night into the Polk County Jail in Bartow.

Jurors Decide SunMart's Pumps Were RiggedHOUSTON -- A Harris County jury handed down a $30 million verdict against the Houston-based owner of SunMart convenience stores. The chain was accused of cheating customers by giving them less fuel than they paid for, according to a report by The Houston Chronicle. Attorney General Greg Abbott said the gas pumps at 86 Texas stations owned by parent company Petroleum Wholesale were illegally set to deliver less than a full gallon of gasoline. "The jury's verdict reflects a significant and well-deserved rebuke to SunMart's fraudulent pump calibration scheme," Abbott told the newspaper. Petroleum Wholesale officials denied bilking customers, said they will appeal the decision. "We believe the jury disregarded tolerances, long recognized by law, and held us to a standard of perfection that neither we, nor anyone in the retail fuel industry, can attain," said Stuart Lapp, general counsel for Petroleum Wholesale. The verdict ended an eight-week trial that originated in July 2008 when Texas Department of Agriculture inspectors launched Operation Spotlight, which tested more than 1,700 pumps at the Texas SunMart stores. Officials said 985 of the pumps were set to dispense less than a full gallon of gas. State officials also accused the company of sending workers to recalibrate the pumps before state examiners could reach the SunMart locations, the report stated. Petroleum Wholesale was charged with violating the Texas Deceptive Trade Practices Act. Jurors were given 48 boxes of fuel receipts, covering more than 5,700,000 gallons of gasoline and more than 727,000 fraudulent sales transactions. The jury found Petroleum Wholesale liable for almost $19 million in restitution, more than $8 million in civil penalties and almost $3 million in fees to the state, officials said in the newspaper report.

Fill ’er up at Walgreens—is this the first step?Drug store chain to jump on electric-car recharging stations in HoustonDEERFIELD, Ill. -- Walgreens is among the retailers looking to get in on the ground floor of electric vehicle recharging stations, planning to install eVgo high-powered rapid charging stations at 18 locations in Houston beginning in February 2011.Walgreens is participating in the nation's first privately funded and comprehensive electric vehicle-support system, where NRG Energy will install the rapid charging stations for electric vehicles. Walgreens is the largest retailer participating in this program; others include Best Buy, H-E-B and Spec's Wine, Spirits & Finer Foods.The charging locations, which will also include some public parking facilities and work

places, will make up NRG's eVgo network to help ensure anyone with an electric vehicle has a place to charge up within 25 miles of the Houston city center."Our neighborhood stores will be a great and convenient location for customers to recharge electric vehicles," said Walgreens director of energy and sustainability Menno Enters. "This is another way we are providing our customers with an environmentally sustainable shopping experience, and it sets us apart as a retailer who is moving clean and green energy alternatives forward."

FDA's Dire Graphic Warnings on Cigarette PacksWASHINGTON, D.C. -- Within two years, convenience store retailers and other retailers of cigarettes will be faced with selling a product whose packaging will prominently feature gruesome pictures of emaciated cancer patients, dead bodies, and sick babies (presumably due to mothers who smoke during pregnancy).By October 2012, all cigarette packs in the United States will show such graphic images and contain stern warnings about the dangers of smoking, the Food and Drug Administration announced this week. Other possible pictures proposed by the FDA include women blowing smoke in children's faces, diseased lungs, a cancer-riddled mouth and a smoker puffing through a tracheotomy hole in his neck, according to FDA Commissioner Margaret Hamburg. The images will cover half the space on packaging and will also be shown on all cigarette ads, along with bold statements such as "Smoking Will Kill You.""Today, FDA takes a crucial step toward reducing the tremendous toll of illness and death caused by tobacco use by proposing to dramatically change how cigarette packages and advertising look in this country. When the rule takes effect, the health consequences of smoking will be obvious every time someone picks up a pack of cigarettes," said Hamburg said in a prepared statement. "This is a concrete example of how FDA's new responsibilities for tobacco product regulation can benefit the public's health." The plan is a result of the 2009 federal law that gave the FDA the authority to regulate tobacco products, including marketing and labeling guidelines, ban certain products and limit nicotine.Over the last decade, countries as varied as Canada, Australia, Chile, Brazil, Iran and Singapore, among others, have

adopted graphic warnings on tobacco products. Some are downright disturbing: in Brazil, cigarette packages come with pictures of dead babies and a gangrened foot with blackened toes, according to HealthDay.com. In the U.S., the current text-only warnings on packages have changed little since 1984, said HealthDay.com.

SWIPE FEE REFORM IN COURTTCF National Bank, based in Minnesota, filed a lawsuit challenging the constitutionality of debit card regulations in the Durbin amendment to the Wall Street Reform law. The bank argued that the requirement that fees be “reasonable and proportional” to the cost of the transaction violates the Takings clause in the Fifth Amendment and that the law only applies to banks with at least $10 billion in assets violates the Equal Protection clause of the 14th Amendment.In his response to the lawsuit, Senator Richard Durbin (D-IL) said his amendment passed with broad bipartisan support in Congress and that he is confident the courts will find his provisions constitutional.

FinCEN Announces Launch of FinCEN Updates E-mail Subscription News ServiceThe Financial Crimes Enforcement Network (FinCEN) today announced the launch of FinCEN Updates – a new, free e-mail subscription management service designed to keep the financial industry, the media and the public informed of news, rulemakings, advisories and other developments at FinCEN. This new secure e-mail subscription management service permits users to customize their updates, which enables them to receive e-mails related to the topics to which they have subscribed.

FinCEN Updates allows users to choose their subscription preferences. Subscription items include advisories, guidance, news releases, rulings, enforcement actions, and current career opportunities at FinCEN. Users can add or delete subscription items themselves, and have the option to password protects their accounts for increased security. Users can opt to have FinCEN Updates sent immediately, daily, weekly, or monthly to their e-mail accounts or directly to a wireless device.FinCEN selected the GovDelivery® E-Mail Subscription Management service to monitor designated website content and to send an e-mail to alert subscribers when there is new information posted on FinCEN’s public websites. The Cost of Non InvolvementOne of the worst possible assumptions you can make, assuming that you have interests in issues before the legislature, is that someone else is effectively representing your issues to legislators. A close corollary to this is the assumption that it's all right for you to not get involved with the legislative process because those who have opposing views probably aren't involved either. Add either or both of these assumptions to a lack of understanding of how legislators make decisions and you have one good recipe for legislative disaster. Legislators understand involvement above most other concepts. The people they see or hear from most often have the greatest impact; be one of them, and success may be yours; slack off and you're likely to fail. Legislators need and appreciate lobbyists for what they can do, but legislators and lobbyists know that lobbyists (as well as legislators!) have their limitations. You cannot expect legislators to know all the facts on all the issues. Even good lobbyists take a back seat to informed industry members when it comes to presenting convincing arguments to legislators, lawmakers simply must hear from the industry members the people in the trenches. Those who have opinions on issues continually barrage legislators. If your opponents are among them and you aren't, you lose. Remember the best way to lobby the legislature is through grass roots. It is very important that all members get to know their legislators. Call these elected officials on the phone, and especially invite them to your place of business. It is very important that you know those in the district where you vote as well as those in the district where your business is located.
