(LIBOR) will hold its General Membership meeting on Tuesday, October 27th at the Melville Marriott of Long Island, 1350 Old Walt Whitman Road, Melville, New York. All Realtor® mem- bers who are present and in good standing may vote at this meeting. Polls open at 9:00 a.m. and close promptly at 2:00 p.m. Realtor® members can also vote in addi- tional locations including the Realtor Service Center in Jackson Heights, the Realtor Service Center in West Babylon, the Riverhead Service Center, and the Best Western Mill River Manor. The LIBOR Nominating Committee, chaired by LIBOR’s immediate Past President Mohsen Zandieh, met on Wednesday, September 2nd in West Babylon. At the meetings conclusion, the following report was given: President-elect, Liz English, Queens Vice President, Laura Copersino, Nassau Vice President, Charlotte Vanderwaag, Suffolk Vice President, Caroline Jemison, Treasurer, Moses Seuram and Secretary, Bettie Meinel. LIBOR members that would like to run for an office must submit a petition by Wednesday, October 7, 2009. All petitions must be delivered to the Board Office in West Babylon on that date no later than 5:00 p.m. Contact Lisa G. at ext. 350 for an application. Incoming LIBOR President, Kathy Engel is an Associate Broker with RE/MAX Shores in Oceanside. Ms. Engel has been in the real estate business for over 23 years. Kathy holds many Realtor® designations including: CRS, CRB, LTG, E-Pro and will be receiving her CIPS Designation at the NAR Conference in San Diego this year. She has served as a LIBOR Director for the past 17 years, as well as a NYSAR Director for the past 10 years; where she has chaired many Committees. Kaplan and Philip Weiden LIBOR is proud to report that Suffolk County Executive Steve Levy has signed IR 1545-2009 - the Co-op Housing Reform Bill into law on August 28th after the County Legislature passed the bill in early August. The law went into effect as soon as it was delivered to the New York State Secretary of State. Additionally IR 1763 has been introduced to amend the new law by clarifying the enforcement pro- visions. According to LIBOR President Buddy Hoosein, “This is fantastic news as it gives the law more strength.” This new Resolution is subject to two public hearings on September 9th at the Ways and Means Committee Meeting and September 17th, at the full public hearing. Thus the ear- liest it could be voted on by the full Legislature is at the October 13th meeting assuming that that the public hearing is closed on September 17th and the bill pass- es through the Ways and Means Committee. Buddy Hoosein added, “We are very opti- mistic that this will indeed happen.” The original bill, which was intro- duced at the request of Suffolk County Executive Steve Levy, requires that a Co-op Board accept or reject a potential buyer within 45 days and if they are denied — a written reason must be disclosed. REALTORS® have been pursu- ing similar legislation for many years at the state level. Both LIBOR’s Common Interest Ownership Committee and the Legislative Committee have been intimately involved in the process. Earlier this year — the LIBOR Board of Directors voted to additionally pursue this on a local level. Many people are already taking advantage of the benefits of paying and receiving bills electronically. All Realtors are encouraged to check there email inbox and check that they received a copy of their 2010 LIBOR Annual Dues Bill that was sent to you from the Long Island Board of Realtors on August 17, 2009. In previous years the Annual Dues Bill has always been mailed, but this will be the first year the LIBOR is only emailing the bill and not using the U.S. mail service. All LIBOR Dues Bills for 2010 are payable by September 30, 2009. As an incentive for members to pay their bill securely online, LIBOR has launched the 2nd Annual Online Bill Pay Contest. Any member that pays their bill online — on or before the due date, will automatically be entered into the contest that is offering cash prizes. Many businesses are moving toward e-billing and online bill pay- ment so they can offer their cus- tomers the convenience and securi- ty this service offers. It really is a time saver. The Multiple Listing Service of LongIsland, Inc. released the August 2009housing figures that reported a $385,000closed median home price for LongIsland, the highest reported sinceOctober 2008. The recently reported fig-ure is $10,000 higher than the $375,000closed median home price reported forLong Island in July of 2009 by MLSLI, butis still lower by 8.3% over August 2008.

As of this August, the MLS activityreport shows a year to date averageclosed sales price of $429,347 for LongIsland, which is 13.6% less than the yearto date average reported in August 2008.Although the price decline is in doubledigits, it still represents the lowest

decrease in average sale price this year.The highest annual average price compar-ison difference reported in recent monthswas 18% in April of this year when the yearto date home price went from $498,610 to$408,748. Since that time, the gap haslessened consistently each month.

Increased affordability is the result of thecontinued downward price adjustments.More affordable prices have resulted in sig-nificant increases in contracted sales. Overthe past few months, the Long Island realestate market seems to be regaining itsstrength in this area. In August 2009 therewere 3,025 contracted sales, representingan increase of 13% over August 2008. Therecent August figure also represents anincrease over July figures when the MLSreported 2,745 contracted sales for Long

Island. This reflects the trend across thecountry as the National Association ofRealtors reported under contract salesactivity has rising over the past six months.

Joseph E. Mottola, CEO of MLSLI said,“While contracted and closed medianprices remain lower than a year ago in allthree counties that make up the MLS ofLong Island, the month to month trendseems to indicate that the rates of declineare becoming less.‰ Mottola further notesthat, “If this trend continues the market willeventually hit a crossover point that will sig-nal a true stable market and perhaps thebeginning of inevitable price increases.” ‰

When Suffolk passedthis law — it eventually went on to becomestate law. We plan to pursue a similar Co-opbill in the Nassau County Legislature andthen in New York City. Since Suffolk Countypassed this bill it will create momentum forthis bill to possibly become law statewide.

According to Barbara Ford, LIBOR’sCommon Interest Ownership CommitteeChair, “Co-op discrimination is one of thebiggest challenges facing owners and REAL-TORS® when selling Co-ops. Co-op boardshave virtually unlimited power to do as theyplease. Co-op discrimination is known to bevery blatant and out in the open. In this dayand age that cannot be tolerated.”

We are supporting this legislation becausefor far too long Co-op boards have been ableto discriminate against people at will.Discrimination can occur because of manyfactors. The protected classes are: race, color,religion, national origin, sex, disability, famil-ial status creed, ancestry, marital status, sexu-al orientation, age, military status, presence ofchildren, pregnancy and gender identity.

It appears that based upon recentunder contract sales statistics, the realestate market is showing signs of recov-ery, which in part is due to many first-time buyers taking advan-tage of the $8,000 tax creditthat is available betweenJanuary 1, 2009 andNovember 30, 2009. Pleasebe aware that all sales haveto close before theDecember 1st deadline toqualify for the tax credit. Inorder to close before thedeadline, buyers need to beaware that they should be under contractby late September or early October totake advantage of this credit.

In addition to the tax credit available atthe federal level, the State recentlyannounced that the New York StateMortgage Credit Certificate (MCC) willenable first-time homebuyers to claim atax credit equal to 20 percent of theirannual mortgage interest costs, potential-ly saving the average homebuyer about$1,500 each year. When coupled withthe first-time buyer credit, the MMC willbring additional buyers back to the mar-ket and further boost the recovery of boththe state’s housing market and economy.

Currently, the most important factordriving home sales is affordability.

Market conditions are greatfor all buyers right now.There is a combination ofpositive market factors thatis fueling the marketplace.Historically low mortgageinterest rates, affordableprices, and tax incentivesare encouraging buyerswho’ve been waitingpatiently on the sidelines for

the best time to buy. But they need you tohelp them get to the closing table.

Now is the time for you to help thosebuyers get off the fence by providing themwith good advice and valuable information(like the programs noted above) that willhelp them make a decision to buy a home.It’s just as important to stay positive. Weknow that there is still uncertainty in theeconomy but help your buyers and sellersfocus on solutions, not the problems. Wemay not be able to change the market con-ditions, but you can influence the outcome.

The Long Island Board and theMultiple Listing Service moved into theircurrent Headquarters in March of 1983.The 18,000 sq. ft. building was about 10years old at the time and we made modi-fications so we could fit our offices; aPrint Shop and a large Director/ClassMeeting Room. We originally occupiedtwo of the three floors.

Through the next 26 years,we made many internal alter-ations including occupyingall three floors and reallocat-ing space to meet the increas-ing needs for services andstaff. In the process, weobtained the adjacent build-ing which became theService Center and incorporated ourEducation/Conference Meeting roomsand Computer Training Center there.

However, we never significantly upgrad-ed the main building’s exterior. We patchedinstead of redoing. It finally became evi-dent that we could do it no longer. We hadongoing roof leaks; leaks through the build-ing’s frame and the windows themselves.Adding to this was the wind infiltration.

The project eventually evolved into roofreplacement; rebuilding elements of theparapet; increased insulation; energy effi-cient HVAC replacements; redoing thestucco exterior; removing the existing win-dows and frames and installing new framesand upgraded glass. At all steps, the ener-gy efficiency/cost benefits were consideredto arrive at well reasoned compromises.

The building is owned by an MLSLIsubsidiary “Cove Industries” (Cove).Cove is the landlord and rents the space toLIBOR and MLSLI and charges fair mar-ket rents based on the percentage of occu-pancy...56% MLSLI and 44% LIBOR.

Cove has a small Board of Directors whichbid out the Construction Management andarchitectural and engineering require-ments. They awarded the bid for these ser-vices to the H2M Corp in Melville. H2M,as part of their engagement, bid out thevarious components of the project.

The work has started and the initialphase, a new roof, is under-way. The staff relocated outof the building because wecould not run the air condi-tioning and ventilation dur-ing the process. Followingelements of our DisasterPlanning scenario, some staffoperated from the adjacentService Center; some from

the Woodbury Center and some fromhome via their home computers. Our TechServices group prepared the “world”technically to make all this work withphones, data lines and home networks.

For the balance of the work, staff willoperate from the building no matter whatthe noise, wind and rain conditions mightbe. Departments will be relocated as thework proceeds in their areas. Think of itas a “wave” as the renovation work movesaround the building starting on the westfaçade. If you call and hear a racket in thebackground, it’s just business as usual forus. If you visit, prepare for dust and noise!

We hope to be done by year end. Projectcost is approximately 1.2 million dollarsand will be covered in the Board and MLSbudgets from 2010 thru 2016. Theapproximate cost to members is between$6.00 and $7.00 per year for that period.The end result will be an updated buildingwith improved operating efficiencies, amore contemporary look and an image inkeeping with the value of all Realtors.

It is hard to believe my year as Presidentof the Long Island Chapter of the Women’sCouncil of Realtors is coming to an end.Since this will be my last opportunity towrite an article for the Realtor Paper, I’dlike to thank and recognize those whomade 2009 such a successful year.

We started with a sell out crowd to hearMr. Joseph Mottola, CEO LIBOR/MLS,talk about Industry Issues, Trends andChallenges as well as a power agentpanel spanning three counties with theirbest ideas about handling their currentmarket place. Several of our meetingsthis year were joint with other chapterswhich increased attendance and made itpossible to bring quality meetings andmore value to our membership.

In April we joined with three otherNassau County Chapters and filled theroom at the Westbury Manor with over 150attendees to hear the Honorable MaureenO’Connell talk about the CommissionEscrow Act processing through her office.At each meeting we networked with otherREALTORS® across Long Island andQueens. Our powerful Annual RoundtableEvent featuring 10 relevant presentationtopics offered by true experts in their fieldis scheduled for September 11th. It willalso be our Election Meeting.

During the past two months I havebeen on a whirl wind tour of every MLSzone meeting from Queens to MountSinai. Not only has it been a learningexperience for me, it was also an adven-ture. Like the Starship Enterprise, I trav-eled to places where no man has evergone before (only kidding). The latesttechnology can’t help when you’re trav-eling in Queens or to Sayville. That’sright, not even a GPS system has everbeen to some of these areas.

Eventually, and when I did finallyarrive at my destinations, I was welcomedby very dedicated zone Chairpeople whoshared their concerns and were veryappreciative that I was there. They gaveme the opportunity to talk about howMLS can help with their concerns, theMLS position in the industry, and howour business effects the economy.

Every Realtor® on Long Island wasfaced with the same challenging issues atthe beginning of this year. In January wechanged our business plans, we adaptedto the current marketing conditions, andwe re-invented the way we did business.

Doing this enabled most of us to stay inbusiness.

Nassau, Suffolk, and Queens startedthe year off with 1,615 units in contractfor January, and for the next five (5)months we made steady gains. By theend of June we had 3,267 units in con-tract which represented a 102% increasefrom this January. How did we do this?We constantly reminded the consumerthat it was a great time to buy: we had thelowest interest rates in years, and we re-invented the phrase “aggressivelypriced”. We have an abundant amount ofinventory, but the major effect was thefirst time homebuyer $8,000 tax credit.

We are changing everyday in the greatworld we live in and people all around usare finding new ways to adapt. We are astrong and powerful group of Realtorswho can make a difference in people’slives and we have. Thank you for beingthe ultimate real estate professional!

Q. MLS has called and asked me tofax in a copy of a listing agree-

ment for a listing I recently input inStratus. Why do they request this?

A. Effective 7/11/05, you were nolonger required to send in copies

of listing agreements, price changes,extensions, etc. for your listings. Insteadwe have adopted a program in which theMLS Staff will call offices and request

offices to fax a copy of the signed listingagreement, extensions, etc. be faxed toMLS so the validity of theses can be veri-fied.

Failure to comply with any request forpaperwork within 24 hours will result inan automatic fine of $250. If paperworkis not provided, this offense will bereferred to the MLS ProceduresCommittee to determine the nature andamount of the penalty.

The MLS reports every month on theweb stats for MLSLI.com, but many peopleare not familiar with the terms used anddon’t really understand what the data reallymeans. Here is an overview of some of themore popular web stat terms used forreporting purposes. Indicated in the paren-thesis is the August 2009 web stat forwww.MLSLI.com.

Pageviews — (8.9 Million Page Viewsper Month) This tells you the amount ofviews your website pages are getting – inparticular, this allows you to see how yourwebsite fares over time. A view counts as aloading of a page. Still considered a veryimportant metric, but the increasing amountof flash/AJAX built websites, and theincrease in online video, means fewer pageviews are counted, even though the sameamount of content is being looked at.

Visits — (19,964 DAILY visits) A ‘visit’is the equivalent of when someone arrivesat your website and starts looking at pages.

Unique Visitors — (8,846 UniqueVisits per DAY) A unique visitor counts thenumber of distinct people that are visiting(making visits) to your website in a partic-ular time period, usually one day. A uniquevisitor can contain many visits, each con-taining many pageviews. This is still one ofthe best metrics to use for your website. Itis a great indicator of site popularity.

Average Time Spent — (14 Minutesper Session) This Average Time Spent(ATS) metric indicates the amount of time avisitor spends on your website and pages.It’s usually a good indicator of the qualityof your website (depending on the type ofwebsite). The longer the ATS, usually, thebetter.

Recently I have received a number ofcalls regarding the legal ramifications of aninvestigation of a Broker’s records pertain-ing to the employment status of his agents.The Department of Labor is in the processof checking the relationship between someBrokers and their agents in order to deter-mine whether the agents are independentcontractors or employees. Unfortunately,most Brokers are not careful enough inobserving the “Safe Harbor” guidelinesarticulated by the Federal and State gov-ernments. These guidelines are closelyscrutinized by the investigating authoritywhenever a question of agent status arises.

While Brokers need to follow theguidelines to prove the independent con-tractor status of their agents, they are alsorequired to supervise their agents and areheld liable for any of the agent’s wrong-ful acts. These duties often seem conflict-ing and sometimes create serious prob-lems for the brokers and agents.

There are twenty common law tests foremployment, including but not limited tosuch things as how, when and where towork, mandates as to training by the firm,integration of the worker’s services intothe company’s business operations, thepersonal nature of the services suppliedby the worker, the hours worked, thenature of compensation and how deter-mined, the ownership of the “tools of thetrade” and the right of the company

owner to otherwise exercise dominionand control over the workers. IRSGuidelines provide that the IRS will notchallenge independent contractor statuswhen the associate is a licensed realestate agent, has income solely basedupon production and not hours worked, isdescribed and presented as an indepen-dent contractor for all purposes, pays hisown income taxes and performs servicespursuant to a written contract. Theseguidelines have also been adopted by theState of New York.

The written contract should be signedat least every 15 months!

Failure to meet all these Safe HarborGuidelines could result in the Broker’sand Agent’s liability for certain tax pay-ments and penalties!

Unfortunately, the Department ofLabor does not believe itself bound bytax laws and could determine a brokerand agent are, in fact, employer andemployee, despite meeting most of theguidelines, if the DOL believes theBroker to have that degree of control overthe agent that the agent is not deemed tobe acting independently, particularly ifthere is no recently signed IndependentContractor’s Agreement!

An additional problem also arises if theDepartment of State determines theBroker is not properly supervising hisagents, but that is a tale for another day!

The New York State Department ofState Division of Licensing Servicesrecently notified all real estate licenseesvia mail and e-mail that it will begin issu-ing photo identification cards in the nearfuture.

The cards, which will be generated by theDepartment of Motor Vehicles, will beissued to licensees when their renewal ororiginal licenses are approved.Additionally, the cards will be issued fol-lowing change of association, change ofbranch address or change of broker address.

The Division of Licensing has requestedthat as soon as possible all licensees down-load and complete a DMV consent form,which allows the division to utilize thelicensee’s driver’s license or non-driver ID

photo. It is important to note that the nameon file with DMV must match the name onfile with the Division of LicensingServices for a photo card to be generated.According to DOS, brokers will not beable to perform many online transactionsin eAccessNY if the broker and his or heraffiliated licensees have not provided theDivision of Licensing with a DMV identi-fication number.

Licensees who have not yet activatedtheir eAccessNY accounts are requested todo so as part of this process.

DOS to Begin Issuing Photo ID Cards

ARTICLE I - NAME SECTION 3. OFFICIAL PUBLICATION

The Official notification publication of theBoard shall be the Long IslandREALTORS� websitenewspaper. Saidwebsite may be used for the purpose ofproviding official notice to members of theBoard on an issue or in connection withany provision in these Bylaws requiringnotice to be given to Board members.

ARTICLE X - DUES, FEES ANDFINANCE

SECTION 4. NON-PAYMENT OF DUESAND/OR MISCELLANEOUS OBLIGATIONS

If dues, miscellaneous financial obliga-tions or fines due to LIBOR are not paidwithin thirty (30) days after any billing date,a letter shall be sent on the 31st day,Certified, (return receipt requested) to themember shall be notified stating that as ofthat date he/she is suspended from mem-bership for non-payment of dues and/ormiscellaneous financial obligations. Theletter notification will also state that themember can reinstate his/her member-ship by the payment of the arrears in fullplus a reinstatement fee in accordancewith Section 5 of this Bylaw.Each such bill for dues, fines and/or mis-cellaneous obligations shall contain anotice to the effect that failure to pay suchbill within thirty (30) days will result inremoval from membership.

ARTICLE XI - OFFICERS AND DIRECTORSSECTION 4. BOARD OF DIRECTORS

The governing body of LIBOR shall be aBoard of Directors composed of the fol-lowing:

a) Twenty-four (24) Directors, the majorityof which shall be DR's, Partners orCorporate Officers, eight (8) from each ofthe three territorial Divisions of LIBOR.

b) All duly elected Chapter Presidentsand one designated representative ofeach Chapter. The chapter shall elect theirrepresentative who shall be a member ofthat chapter.

c) All duly elected Presidents or designat-ed representative of the Long IslandCommercial Network, Appraisal Division,Multiple Listing Service of Long Island,Inc., Women's Council of REALTORS�,and the Long Island REALTORS� FederalCredit Union, providing they hold REAL-TOR� status in LIBOR.

d) All elected officers of LIBOR

e) The President may, subject to theapproval of the Board of Directors, appointLIBOR members who are sittingNYSAR/NAR Officers and/or NAR Directorsas LIBOR Directors for a term of one year.

f) Past Presidents and LIBOR members ofthe New York State Real Estate AdvisoryBoard not nominated or filling prescribedpositions can serve providing theyacknowledge their willingness to servebefore being appointed. They shall besubject to the same attendance require-ments and regulations as other Directors.

g) No MLS Officer with the exception ofthe President may sit on the LIBOR Boardof Directors. No LIBOR Officer with theexception of the President may sit on the

MLS Board of Directors.

Each Director shall have one vote at meet-ings of the Board of Directors.

SECTION 7. ELECTION OF OFFICERSAND DIRECTORS.

No later than 90 days before the AnnualMembership meeting, the President shallappoint a Nominating Committee consistingof REALTOR� members (one from eachChapter) and six alternates (two REALTOR�Members from each county) subject to theapproval of the Board of Directors.Alternates shall serve in the event a memberof the Committee has resigned or otherwiseis incapable of acting as a member of theNominating Committee. The alternate shallbe from the same county. The chairman ofthe Committee shall be the immediate pastpresident of the Board. A past presidentfrom the other two counties shall be includ-ed if possible.

The entire Nominating Committee shallselect one candidate for President Elect,Secretary and Treasurer. The VicePresident and the County Directors at largeshall be nominated by a majority of thosemembers of the Nominating Committeefrom the county which the Vice Presidentand Director is to be elected to serve. Thereport of the Nominating Committee shallbe published in on the official publicationwebsite of the Board in accordance withArticle I at least one month prior to the dateof the annual meeting.

ARTICLE XII - MEETINGSSECTION 3. ANNUAL MEMBERSHIPMEETING

c) Notice and the proposed agenda forthe Annual Membership meeting shall bepublished on in the official websitepubli-cation of the Board in accordance withArticle I at least one month preceding themeeting. If a special meeting, the noticeshall include a statement of the purpose ofthe meeting which shall constitute theagenda, and shall clearly indicate atwhose request the meeting was called.

ARTICLE XIII - COMMITTEESSECTION 5. QUORUM

A quorum of 3 one-third of the membersplus the chairperson shall be necessaryfor all committees to function.

ARTICLE XVI - AMENDMENTSSECTION 1.

a) These Bylaws may be amended by amajority vote of those REALTOR� mem-bers in good standing present at a sched-uled general membership meeting. Thefull text of such proposed amendment oramendments shall be published on in theofficial website publication of the Board inaccordance with Article I at least onemonth prior to the date of any annual orspecial meeting of the membership calledfor such purpose. No such amendment oramendments shall be altered, changed ormodified by the members at the meeting.

SECTION 2.

Notice of all meetings at which suchamendments are to be considered shallbe published on in the official websitepublication of the Board in accordancewith Article I at least one month prior to thetime of the meeting together with theagenda of such meeting.

Case #1-28: Disclosure ofExistence of Offers toProspective Purchasers

Seller S listed her home for sale withREALTOR® B. The property was pricedreasonably and REALTOR® B was confi-dent it would sell quickly. The listingagreement included the seller’s authoriza-tion for publication in the MLS andauthority to disclose the existence of offersto prospective purchasers.

Within days, REALTOR® B had shownthe property to several prospective pur-chasers and one of them, Buyer Z, wrote apurchase offer at close to the asking price.

REALTOR® B called Seller S to make anappointment to present the offer. Afterhanging up with Seller S, REALTOR® Breceived another call, this time from REAL-TOR® A. REALTOR® A explained that herepresented a buyer who was interested inmaking an offer on Seller S’s property.REALTOR® A explained that while hisbuyer-client was quite interested in the prop-erty, price was also a concern. He askedREALTOR® B if there were other offers onthe property, indicating that his buyer-clientwould likely make a higher offer if therewere competing offers on the table. REAL-TOR® B responded telling REALTOR® A,“That’s confidential information. Please tellyour client to make his best offer.”

Taken aback by REALTOR® B’s com-ments, REALTOR® A shared them withhis buyer-client, who chose not to make anoffer and instead pursued other properties.

Buyer Z’s offer was accepted by Seller Slater that evening and, sometime later, thetransaction closed.

Several months afterward, Seller S andREALTOR® A met at a social event.REALTOR® A related his conversationwith REALTOR® B. Seller S askedREALTOR® A if he thought that REAL-TOR® A’s buyer-client would have madean offer on Seller S’s home absent REAL-TOR® B’s refusal to disclose whetherthere were other offers pending. REAL-TOR® A responded that it was impossi-ble to tell for certain, but his buyer-clienthad certainly not been favorablyimpressed by REALTOR® B’s responseto a seemingly routine question.

Seller S subsequently filed an ethics com-plaint against REALTOR® B alleging vio-lation of Article 1 as interpreted by Standardof Practice 1 — 15. He noted that he hadclearly authorized REALTOR® B to dis-close to buyers and cooperating brokers theexistence of pending offers and that REAL-TOR® B’s arbitrary refusal to share infor-mation he was authorized to share couldhave been the reason, or part of the reason,why REALTOR® A’s client had chosen not

to make an offer on Seller S’s home.REALTOR® B defended his actions

indicating that while he agreed that he hadan obligation to promote Seller S’s inter-ests, his obligation to REALTOR® A andto REALTOR® A’s buyer-client was sim-ply to be honest. He had not, in any fash-ion, misrepresented the availability ofSeller S’s property. Rather, he had simplytold REALTOR® A to encourage his clientto make hr best offer. “I’m not required toturn every sale into an auction, am I?” heasked rhetorically. “I feel that I treated allparties honestly and fairly,” he concluded.

The Hearing Panel did not agree withREALTOR® B’s reasoning, indicating thathe had violated Article 1 as interpreted byStandard of Practice 1 — 15. They notedthat Standard of Practice 1 — 15 requiresREALTORS®, if they have the seller’sapproval, to divulge the existence of offersto purchase on listed property in respo9nseto inquiries from either potential buyers orfrom cooperating brokers. REALTOR® Bhad not met that obligation and, conse-quently, the Hearing Panel concluded thatREALTOR® B had violated Article 1.

Case #6-4: Acceptance ofRebates from Contractors

REALTOR® A, who managed a 30-year-old apartment building for Client B,proposed a complete modernization planfor the building, obtained Client B’sapproval, and carried out the work.Shortly after completion of the work,Client B filed a complaint with the Boardof REALTORS® charging REALTOR® A

with unethical conduct for receivingrebates or “kickbacks” from the contrac-tors who did the work.

At the hearing, Client B presented writ-ten statements from the contractors to sub-stantiate his charges.

REALTOR® A defended himself by stat-ing that he had carried out all work involv-ing the preparations of specifications, solic-itations of bids, negotiations with the con-tractors, scheduling work and supervisingthe improvement program; that he had pre-sented all bids to the owner who had autho-rized acceptance of the most favorable bids;and that he and Client B had agreed on anappropriate fee for this service.

REALTOR® A also presented compara-tive data to show that Client B hadreceived good value for his money.

After all of the contracts were signed andthe work was under way, REALTOR® Afound that his fee was inadequate for thetime the work required; that he needed addi-tional compensation but didn’t want to addto his client’s costs; and that when heexplained his predicament to the contractorsand asked for moderate rebates, the agreed.

Questioning by panel members revealedthat the contractors felt that since theywere being asked for rebates by the manwould supervise their work, they felt thatthey had no choice but to agree.

The Hearing Panel concluded thatREALTOR® A was in violation of Article6 of the Code of Ethics and that if he hadmiscalculated his fee with Client B, hisonly legitimate recourse would have beento renegotiate this fee with Client B.
