    “Tech neck” (or “Text neck”) are new buzzwords on social and mainstream media about the postural pains of modern life. So patients now blame their worsening neck and back pain pain on phones, tablets and computers. This burgeoning awareness posture’s impact on health is a boon for DCs who congruently ad-dress these new chronic pain syndromes in communications, clini-cal approach and strategies for patient self-management. “Tech Neck” correlates to the bio-mechanics of another postural theme in the medias: “Sitting is the New Smoking”. The bio-mechanic stress of our typing and texting sitting society is something new, and it’s linked to worsening neck and back pain, earlier in life. And the current health consequences of heavy tech-nology use are just the tip of the iceberg. New research indicates the limitations of human structure and the functional demands of living on keyboards and screens will cause accumulating postural compensations and adaptions in young people who started using tech earlier in life, as well as for boomers getting older. From college students spending 8 to 10 hours a day on their phones1 to kids in middle and high school2 diagnosed with headaches, migraines, neck and upper back pain and even TMJ disorders, MRIs of these patients say they don’t show “the exact cause of the pain”3. While the explanation may be “It’s just pos-ture”, research shows significant consequences of early posture degeneration, including early mortality and onset of disease. A 2015 meta-analysis of 47 studies found prolonged sit-ting was associated with significant health consequences. In ad-dition to cardiovascular issues, sitting 12 hours a day was associ-ated with a 91% increased risk of Type 2 diabetes and increaseed overall mortality risk of 24%.4 This is important to everyone, espe-cially boomers looking to stay active and age well.

    Postural Bio-Mechanics: Crossed Syndromes

    There’s more to “tech neck” and “Sitting is the New Smoking” than inactivity and forward head posture. These two modern posture problems have a common bio-mechanic link in the work of Vladi-mir Janda and the Prague school of rehab5. Janda first described in 1980 the “proximal and distal crossed syndromes,6 later refined to Upper Cross (the forward head and rolled in shoulder posture pattern of “tech-neck”) and Lower Cross syndrome (the folded kinetic chain at the root of the “Sitting is the News Smoking” syn-drome). Professor Janda was the inspiration of my efforts to com-municate about and strengthen posture. I once commented to him that American audiences would not understand his crossed model, the response was classic Janda: “This is truth. How you tell it is your problem”. Thus began my specialization in posture rehab.

    Crossed Syndromes: A Collapse of the Kinetic Box

    Using a phone with hands close together is a bio-mechanic per-fect storm for Janda’s syndromes. Muscles move bones - stand-ing or sitting, running or walking, and everything in between. And muscles work in pairs, each being opposed by another. So dys-functional muscles cause joints to work dysfunctionally, and dys-functional joints cause muscles to work dysfunctionally. The imbalance of balancing your head in front of the body overuses some muscles and underuses others. Over time, an overused muscle shortens and tightens while it’s partner length-ens and weakens - and the head drifts further forward in a gradu-ally worsening spiral. A key Janda insight is that the sensorimotor system func-

    tions as a single system, and dysfunction of motion causes mo-tor learning that initially causes functional compensation, and over time structural adaptation in muscle, connective tissue and the nervous system. In other words, the body gets better at doing whatever you train it to do. Muscles weaken when specific muscle fibers atrophy from disuse when not recruited in their arc of motion. Neuroplas-tic nerves controlling those fibers become inhibited from disuse. And connective tis-sue and fascia molds to how you use your body. The re-sult is patterns of propriocep-tion and control from chronic muscle imbalance allow the kinetics normally supporting a body mass structure to col-lapse and lock in a folded po-sition. Visualize a card-board box. With the ends folded closed, it’s stable, and will support weight. However, open the ends and the box is floppy, buckling under a load. Upper crossed syndrome is the collapse of the Head-Torso kinetic box from forward head transla-tion and the imbalance of tight and short upper posterior cervical muscles unbalanced against deep anterior muscles. The simul-taneous structural adaptation is shortening of the anterior chest and shoulder stabilization muscles from structural adaptation and weakening of their antagonistic posterior torso and gleno-humeral stabilizers. The body masses (or PostureZones®) of Head-Torso fold and lock in that buckled geometry. Today’s texting Upper Crossed syndrome from chronic muscle imbalance locks the head forward of the torso with the shoulders rolled in, with an additional factor compounding the col-lapse of the kinetic box in: shortening of the coraco-brachialis. Texting while walking, sitting and (unfortunately) driving requires people to stabilize for precise placement of fingers when typing.     locking the proxi-mal upper extremity, often accomplished by shrugging shoulders up and anterior while stabilizing forearms to ribs. I believe this texting adaptation explains why pos-ture pictures increasingly show people with shoulders that are actually anterior to the front of the chest wall! Posture patterns are activity spe-cific. Internal humeral rotation to hold a phone shortens pectoral muscles. Plus many people lock the arm in flexion with shoulder roll-in, restricting gleno-humeral motion by over-recruiting an often neglect-ed deep stabilizer, the coraco-brachialis. Manipulation, muscle therapy and posture exercise can help this often missed tech-neck issue.

    Communication & Cueing

In addition, it fa-cilitates systematic cueing of rehab exercises (the StrongPosture® proto-cols) using focused atten-tion along three tracks to target Balance, Alignment and Motion.8 Janda’s Upper Crossed syndrome is de-scribed as dysfunction of Head-Torso biomechanics. (Lower Cross is Torso-Pelvis-Lower Extremity, and will be discussed in a future article.) And both can be benchmarked with a picture measuring the deviation of Head, Torso and Pelvis from gravity line center. Pictures show the problem and communicate changes over time. The PostureZone® app (free on iTunes) lets a patient’s spouse check his/her posture and allows pictures of friends to boost social awareness. Understanding is deepened when that framework is used to cue pos-ture rehab exercises.     Maintaining aCompliant Practice

    During a Natural Disaster

    With the recent wildfires in the North-west U.S. and the destruction left by hurricanes Harvey, Irma, and Maria, pro-viders are left wondering how to maintain a compliant office while facing the wrath of mother nature. Every office should have a contingency plan in the event of a natural disaster. Here are a few things you can do to stay safe and compliant in the face of ca-tastrophe.

    1. Data Backup: Document in detail the process for backing up the data in your office, including the third-party vendor that you use for data backup, where the data is stored, and the frequency at which your data is backed up. You should also include your process for confirming successful backups and the steps you take in the event a back-up has failed. Your third-party vendor should also have a process for protect-ing this data in the event of a disaster. Many vendors duplicate data in mul-tiple datacenters spread around the country. Request in writing how your information is protected. After that, one more critical step remains. We all as-sume the backup is restorable when the fact is you don’t know it is unless you have tested it. So, whether you handle your own backup process or outsource it, make sure you perform periodic restore functions to confirm your backups are functional and re-storable.

    4. Training and Testing. 1-2 times an-nually, during a team meeting, test your emergency plan. Determine what items were left out, what services can and cannot be provided if, for instance, you were without power. How would you access your patient information? Consider an on-site backup generator, even a small one that could at least run your computers or other critical equip-ment. How would you document a pa-tient visit and what are the policies for storing this information until power is restored? Who is responsible, and in what time frame, should this informa-tion be entered into your software sys-tem? Your team should feel confident and comfortable when it comes to run-ning your office during, and following, an emergency situation.

    5. Documentation. Create documenta-tion that outlines all the above, includ-ing your training and testing dates. Include the results from training and testing, and any modifications that were made as a result. Include names and contact information for third-party vendors responsible for information backup and your software. Include a list of all the systems in your office and in what order they should be restored. Some systems are more critical than others when it comes to running your practice.

    Some parts of the country are more sus-ceptible to natural disasters than others; prepare for them nevertheless. Several years ago, when Katrina hit the coast of Mississippi, many businesses were un-prepared when the capital city of Jackson and surrounding areas found themselves without power and gasoline. Although your

    business may not be located at ground zero, don’t assume that you won’t be affected.

    2. Emergency Plan: Every business owner should have a written emergen-cy plan in place and review it with their staff at least annually. Your plan should include what to do and where to go in the event of a fire or tornado. Set out procedures to follow if you must evac-uate due to a disaster. It should include plans for how and when you will decide to re-open for business following an emergency, how you will communicate with your employees and patients be-fore and after an emergency, and how you will let your employees know when and how to report to work. In the military, the term “JUMP BAG” has been used in the past, meaning if you had to get out of your office in an emergency, what would you grab or already have in your jump bag that might help you get back to normal as soon as possible?

    3. Conducting Business After a Di-saster: Define the process for running your business after a disaster situa-tion. Recently, we received calls from several of our clinics that had opened their doors even though they were still without power following Hurricane Irma. What are your policies and pro-cedures for maintaining critical busi-ness functions if you were to be open without power? How do you document the services provided? How would you collect payments? Are additional secu-rity measures needed? Depending on the disaster, your ability to open your practice and the services you provide could vary.

    The short answer is “Yes.” If you pos-sessed the ability to earn a doctor of chiropractic degree, you can learn the ru-diments of clinical acupuncture and get a solid training in dry needling in fairly short order. Whether you call it acupuncture or dry needling, inserting filiform needles into trigger points and acupuncture points is the same skill set. Dry needling, like acupuncture, is a natural adjunct to chiro-practic care, and jurisdictions across US and around the globe are incorporating dry needling into scopes of practice for both chiropractors and physical therapists. The Virginia Board of Medicine has stated that dry needling is within the scope of a chiropractor who can document clinical training as part of his or her doctor-al level education and/or attendance to a program sponsored by a CCE-accredited college of at least 12 hours. This is a very modest investment in time and resources, considering the benefits dry needling can offer your patients and your practice. I’ve taught acupuncture and dry needling theory and techniques to thou-sands of chiropractors and other health-care providers for the last 30 years. At this point, I think I could probably teach a stone. OK, maybe not a stone… but I know what a chiropractor needs to know to perform safe and effective needling. And I know how to teach these techniques ef-fectively and efficiently. I’ve seen hundreds of doctors practice these techniques on one another and almost every one gets it right the first time. By keeping in touch with many of these doctors over the years, I know that these short focused programs equip mo-tivated practitioners to provide safe and highly effective needling treatments, and that their practices, their patients, and they themselves reap the benefits. Will you be the best acupuncture or dry needle provider right out of the gate? Not likely. However, you will know enough to help a lot of patients with a lot of prob-lems, and avoid hurting any of them. My experience is that doctors who continue to use needling regularly, end up as good as the next guy–maybe even better–within a few years. A great deal of thought and ex-perience are behind the architecture of to-day’s focus programs that take advantage of modern learning technologies where they work the best, both online and in live-classroom learning environments.

    One example of this integrated learning approach is with needle technique. Where one might think it is impossible to learn needling from a video, in fact, video dem-onstrations offer some distinct advantages over live in-classroom demonstrations. Ev-eryone gets a close-up front-row seat, and the videos can be revisited online multiple times to reinforce learning over time. Once a student has been introduced to the tech-nique, they can join an in-person intensive to review and practice those techniques. This combination yields a high level of skill and confidence. Focused acupuncture and dry needling programs by well-established, reputable organizations can deliver solid, clinically effective education in much less time and for much less money then has ever before been possible. It is not that dif-ficult to learn, yields powerful results, and adds an effective tool to healthcare provid-ers’ treatment options.     Forty chiropractic offices across the state collected 2,719 pounds of school supplies this summer as part of the Unified VCA’s inaugural drive to help enable more stu-dents to focus on learning. “Through no fault of their own, too many students don’t have the materials they need to take full advantage of learning opportunities and their potential” explained Dr. Carly Swift, UVCA Public Relations Committee Chair. “This initiative was designed to help students and their parents achieve their hopes and dreams through a healthy mind in a healthy body.” The office collecting the highest weight in school supplies of any in Virginia was Bowers Family Chiropractic in Fredericksburg, run by Dr. Jeff Bowers.     UVCA Attorneys Review Recent Va. Supreme Court Ruling & Erie Insurance

    MEMORANDUM TO: Unified VCA MembersFROM: David B. Dolberg, PresidentDATE: October 16, 2017RE: Recent VA Supreme Court Ruling and Erie Insurance A recent ruling by the Virginia Supreme Court related to a Virginia DC’s personal injury case and Erie Insurance has led to questions about the Assignment of Benefits (“AOB”)/Lien forms and protocols developed for and provided to Unified VCA members. The Unified VCA attorneys – specialists in this area -- have completed their review of this ruling on behalf of our members. The Assignment of Benefits “AOB”/Lien forms and proto-cols developed for and provided to Unified VCA members continue to be a wise approach to accepting assignment in the vast majority of cases. If you are utilizing the UVCA-provided materials and in-structions without deviation, do not stop. This Supreme Court case represents an atypical scenario. The ruling is limited to liability cases in which the patient does not have an attorney and negotiates a settlement on his or her own with no Court involvement. In the afore-mentioned case:• A UVCA member doctor forwarded an AOB form to the liability

    insurance carrier representing the person who hit the patient.• However, despite the AOB on record, the insurance carrier

    paid the patient the entire settlement directly.• Our member chiropractor took the liability carrier to court in an

    attempt to force the carrier to pay the doctor. The doctor won in General District Court so the carrier appealed to the Circuit Court (a Court of Record) where the carrier lost again.

    • After the carrier lost in both those courts, it appealed the case directly to the Virginia State Supreme Court, bypassing the Virginia State Court Appeals.

    • In an unfortunate and unexpected move, the Virginia Supreme Court overturned the previous rulings. The Virginia Supreme Court cited a precedent from several decades ago stating that in this particular instance, because of no attorney or court in-volvement, the patient had no “ownership right” to any money from the liability carrier, consistent with Virginia state law.

    A settlement out of court with no attorney is more like a payoff/exchange in return for the patient (plaintiff) signing off and releasing the insurer and the insured of any future liability.• The Virginia Supreme Court ruled that the AOB is good and

    enforceable against money that is due to the patient.• In this case, the Court said this money was not legally due to

    the patient, so the patient had no “ownership” of the settlement money.

    An AOB/Lien is against someone’s property -- and money is property.• If the accident case had gone to court and a judge ruled that

    a certain amount of money was due to the patient, the AOB would be in effect and enforceable.

    • If a patient hires an attorney and signs away his/her rights to the money received as part of the attorney contract: An AOB/lien works in that scenario once there is a settlement or a court ruling because that is money that the patient is due according to the contract with the attorney.

    • A settlement without an attorney is an option, not a require-ment. This subtle difference is what made all the difference

    in this case. It is an option that is sometimes chosen by the uninformed patient because it is a less expensive path for the insurance carrier because they don’t have to deal with an attorney and a quicker way for the patient to receive his/her settlement money. Again, legal representation is common but not required in any way, so the court views that money as not due to the patient as a “settlement”. Therefore, the AOB is not applicable in this very limited case.

    We can argue the merits of the decision, which many have deemed “lousy.” However, after researching the case, our attorneys echo and cite the same explanation that the Virginia Su-preme Court provided. So how can we establish office policy to appropriately safeguard receipt of payment for our services?1. Continue to use the AOB/Lien EXACTLY as directed on the

    UVCA’s website. It will provide the protection that is intended for:

    - Payment from your patient’s auto insurance policy (Medpay). - Payment via an attorney that your patient has hired, whether that money comes from Medpay, a liability case, or both. (Dollar amount will vary.)2. Recognize that you are not protected via the AOB/Lien from

    a liability insurance carrier’s settlement with a patient without an attorney. You would be covered if the patient represents himself AND there is a court ruling, something that rarely hap-pens. However, practically speaking, it is very unlikely that a patient will go to court on his own.

    The bottom line is this:• If the patient is only offering the liability insurer as a third party

    method of payment and there is no Continued on page 15

    attorney or Court involved, you are not protected by the AOB! If the pa-

    tient has an attorney or the patient actually takes the carrier to court (something that is very rare) you are covered by the AOB.

    • If you have a properly executed AOB and are going through the patient’s Medpay, you are protected.

    • The normal procedure is for you to bill the patient’s health insurance if you are a participating provider with their health insurance carrier, regardless of the cause of injury. However, if the only place for payment is the at-fault party’s insurance, your best option is to require payment at the time of service. We would also recommend you make this part of your insur-ance policy that the patient signs.

    • Certainly you can and should forward the patient’s claim to the liability carrier at the end of care so that patient can negotiate a settlement and try and recoup their expenses, but you have no protection for seeing that money so these patients should be treated as cash patients and pay for all your services on the date of services provided.

    If you take on a personal Injury case, you need to be aware of both the solid ground and risks of choosing to “accept as-signment” (choosing to defer upfront-payment and wait to be paid by an attorney or a third party). While the ruling on this particular doctor’s case was not what was hoped, it did provide a valuable lesson that we hope will help other doctors avoid learning it the hard – and expensive -- way.

    UVCA Increases Outreach toVirginia Media

    Thanks to the UVCA’s new Group Membership in the Founda-tion for Chiropractic Progress, the association now has ac-cess to a far more extensive list of Virginia media outlets than it previously had. Additionally, thanks to the Foundation’s timely, professionally written news releases, the UVCA is incorporating Foundation releases with its own to significantly increase Chiro-practic’s presence in Virginia Media. In the last couple of weeks alone, the UVCA has dis-tributed news releases on how Seniors’ Use of Opioids Under-scores Need for Drug-Free Chiropractic Care, National Prescrip-tion Drug Take-Back Day, and 2017 Awards Recipients, among others. It has already resulted in a request from one paper for a DC to contribute wellness material on a regular basis.

    The Unified VCA Announces 2017 Awards Recipients

    During the Unified Virginia Chiropractic Association’s (Unified VCA or UVCA) Fall Convention and Annual Meeting, Septem-ber 15-17 at the Sheraton Oceanfront Virginia Beach, the UVCA presented the following leadership awards.

    Raymond S. Solano, DC, CCSPJohn Stoke Award

    The John Stoke Award recognizes DCs who have published or produced something for lay consumption. Dr. Solano from Falls Church, Virginia has reached millions with his pro-chiropractic message through TV, Radio, and Print. He has been one of FOX 5’s Health contributors for five years and done well over 100 health segments on health related topics including backpack safety, find-ing the right pair of running shoes, and safety in the snow. He has made appearances on NBC 4, ABC 7, and News Channel 8 in DC, discussing the latest trends in physical health and sports medicine. He has been featured as an expert in The Washington Post, Washingto-nian Magazine, ESPN 980, and 106.7 The Fan. Local businesses, schools, and athletic teams have engaged Dr. Solano to present health talks on a range of topics including workplace ergo-nomics, injury prevention, and wellness.

    Phillip Connolly, DC, DACANDistrict Director of the Year

    Dr. Connolly has worked hard to increase the sense of community in Northern Virginia. He owns and runs Spine Care of Alexandria and has practiced in Northern Virginia since 1991. He is a graduate of NYCC and has a diplomate in neurology. On his web site, Dr. Connolly men-tions that “chiropractic healing is all about well-ness and communicative care.” This excellence in communications and commitment to strength-ening the profession is inherent in everything he does as district director of UVCA district 2-East. He spearheaded his district’s participation in this year’s inaugural UVCA School Supplies Drive. He has worked with organizations like the Virginia Spine Institute, Anabolic Laborato-ries, Insight Imaging and Brainspan to put to-gether meaningful district meetings.

    Nelson Marquina, DC, PhDUSA Laser Biotech, Inc.Presidential Merit Award

    Dr. Marquina’s company, USA Laser Biotech, has been a Supporting Supplier Member for over 15 years. Dr. Marquina conducts seminars and research presentations in laser photother-apy and photobiology in North America, Asia and South America. Yet despite a challenging schedule, Dr. Marquina still finds time to support the UVCA far beyond his valued participation as a dues-paying member. He has conducted sem-inars and convention sessions for the UVCA on both laser therapy and Spanish in the chiroprac-tic office. He provides photographic coverage of the conventions. He and his wife and colleague, Dr. Sherron Marquina, provided their confer-ence facility to the association at no charge ear-lier this year for our rad tech program, saving

    us high meeting costs that we otherwise would have had to pass along to the students. His company regularly exhibits at UVCA conventions and sponsors extra convention functions.

    Carly S. Swift, DCPresidential Merit Award

    Dr. Swift is Chair of the UVCA Public Relations Committee and Director of UVCA’s District V-East. Even though she has only been in practice since 2013, she has volunteered many hours of her time to help chiropractic in Virginia since day 1. She at-tended her first UVCA strategy meeting when she had been in practice for barely a month. She coordinates the UVCA’s an-nual silent auctions, managed this year’s inaugural school sup-plies drive, masterminded Virginia Beach spine parades, and

    has put together numerous district meetings.

    Dr. N. Ray TuckChiropractor of the Year

    For nearly two decades, Dr. Tuck has been helping patients across the New River and Roanoke Valleys with chiropractic. During that time, he grew from a sole practice to now hav-ing nine clinics, led by twelve doctors and an even larger support team. Dr. Tuck’s leadership within health-care is clear. Dr. Tuck was just re-appointed by the Governor to serve as the chiropractic representative on the Virginia Board of Medi-cine and was elected that board’s Vice Presi-dent. He serves on the Board of Governors for the American Chiropractic Association and is a Board Member of the Virginia C-PAC. Dr. Tuck is a past president of the Virginia Chi-ropractic Association and received its Chiro-practor of the Year award in 2003. Dr. Tuck states, “I’m glad to have the acknowledgement that what I’m doing is of value of others to rise to the level of receiving this award.” He notes that “In today’s health-care system, most of the things I do are about how we can bring chiropractic to very key tables to improve healthcare with other practi-tioners. In today’s world, healthcare is about a team approach.” Chiropractor of the Year nominations are submitted to a committee comprised of the previous three recipients of this top Uni-fied VCA award. For this year, that committee consisted of Dr. Tom Wetzen, Dr. Will Sonak, and Dr. Joe Foley.

    Dr. David Dolberg, Unified VCA President, notes, “non-profit associations such as the Unified Virginia Chiropractic Association de-pend heavily on volunteerism to realize their mission. This year’s award recipients are per-fect examples of what a difference individuals can have on the health and strength of chiro-practic in Virginia – and beyond.”

    Dr. Doug Cox, Charlottesville, is healing with honey. A self-de-scribed “novice beekeeper,” he started his hives three years ago to produce honey to sell to the public. Proceeds from his “Hero Honey” program go to the Virginia chapter of the Wounded Warrior Project. He has also persuaded other lo-cal beekeepers to do-nate their honey to the cause.

    Dr. Bibhu Misra was a featured speaker at Inova Neuroscience and Spine Institute’s recent Comprehensive Practices for Pa-tients Requiring Spine Care conference in Northern Virginia. He spoke on “Spinal Health and Posture: Basic Pillars to Improving Health.” He was extremely well-received and took the opportu-nity to tell them that they ALL need to get their spines checked and that he would be glad to help. He shared that in April 2017 “their” American College of Physicians recommended spinal ma-nipulation as one of the first lines of treatment for LBP.
