Categories3and4 (i) Must be a registered practitioner within the meaning of the Tamil NaduMedicalRegistrationAct,1914(TamilNaduActIVof1914)

(ii)MustholdthedegreeofM.B.B.SofanyUniversityrecognizedbyUniversityGrantsCommissionforthepurposeofitsgrantorthediplomainMedicineandSurgeryoftheGovernmentofTamilNadu.

(iii) (a)Must have served as House Surgeon or House Physician or ClinicalAssistantorAssistantSurgeonorMedicalOfficerinarecognizedHospitalinoroutofIndiaforaperiodofnotlessthantwelvemonths:Providedthatacandidatewho has undergone compulsoryHouse Surgeoncy as part of the

M.B.B.Sdegreecourseshallbeeligibleforappointment:

Provided further that a candidate who has served as House Physician orClinicalAssistantorAssistantSurgeonorMedicalOfficer inarecognizedHospital for a periodof not less thanninemonths shall be considered forappointment,butshallnotbeeligible forappointment to theserviceunlessbeforethedateofsuchappointment,hehascompletedtheremainingperiodof service tomakeup a total of twelvemonths; orUndergone a course ofpostgraduatestudyinoroutofIndiaforaperiodofnotlessthanninemonths;orObtainedtheDiplomaof theSchoolofTropicalMedicineandHygiene,Calcutta,afterundergoingacourseofstudyinthatschoolforaperiodofnotlessthansixmonths;or

(b)Served asDemonstrator in aMedicalCollege for a periodof not lessthantwelvemonths;and

(iv) In the case ofCategory 3, should have aDiploma inClinicalLaboratoryScienceChennaioranyotherspecialqualificationwhichmaybeconsideredequivalentbytheGovernmentfromtimetotime.

ClassII:Categories1and2 (a)Must possess a Sanitary Inspector’s Certificate granted by the Additional

DirectorofHealthServicesandFamilyPlanning,Chennai.astheChairman,Board of Examiners, constituted by Government in this behalf; or mustpossessaHealthInspector’sCertificateawardedbythePrincipal,MedicalCollege, Trivandrum or must possess a Sanitary Inspector’s certificateawardedbytheDirectorofPublicHealth,Bombay,and

(b)MustpossessphysicalfitnessforcamplifeandsatisfythephysicalstandardprescribedfortheHealthInspectors.

ClassIII: MustpossesstheGovernmentdiplomaforHealthVisitorsgrantedbytheBoardofExaminers,Chennai

ClassIV:Category1 (a)Must possess a Sanitary Inspector’s Certificate granted by the Additional

DirectorofHealthServicesandFamilyPlanning,ChennaiastheChairman,Board of Examiners, constituted by Government in this behalf; or mustpossessaHealthInspector’sCertificateawardedbythePrincipal,MedicalCollege, Trivandrum or must possess a Sanitary Inspector’s Certificateawarded by theDirector of PublicHealth, Bombay; or Sanitary InspectorCertificateawardedbytheGandhigramRuralInstitute;and

(b)MustpossessphysicalfitnessforcamplifeandsatisfythephysicalstandardprescribedforHealthInspectors.

Category2 MustpossessknowledgeinAutomobileEngineeringwithpracticalexperiencefornotlessthanthreeyears:

ProvidedthatpreferenceshallbegiventoLicentiatesinAutomobileEngineering.

ClassV:-

Category1 (a)AsuccessfultrainingforaperiodnotlessthanthreeyearsingeneralnursingofmenandwomenandforaperiodofnotlessthansixmonthsinMidwiferytraining in both cases to be undergone in an institution approved by theGovernmentunderrule37oftherulesmadeundersub-section(2)ofsection2oftheTamilNaduNursesandMidwivesAct,1926(TamilNaduActIIIof1926),withqualificationprescribedforregistrationasNurseandMaternityAssistantunderthesaidact;or

AforeigntrainingwhichisconsideredbytheAdditionalDirectorofHealthServices andFamilyPlanning,Chennai tobe equivalent or superior to theabovetrainingorpossessionofabasicdegreeinNursingfromaUniversityrecognizedbytheUniversityGrantsCommissionforthepurposeofitsgrant;and (b) Should have served as Nurse for not less than five years in aGovernmentHospitalorHospitalmaintainedbyaLocalBody.

Categories3and4 (i)MusthavepassedIIIFormofarecognizedSecondarySchooland

(ii)Musthavepassed the examinationconductedby theGovernmentBoardofExaminers forCinemaOperatorProvided thatpreferenceshallbegiven tothosewhohaveexperiencefornotlessthanoneyearinRadioMechanism.

Category5 (i)Mustpossess trainingfornot less thanthreeyears inaGeneralHospitalofover 100 beds strength approved by the Chennai Nurses and MidwivesCouncil,andacertificateofhavingpassedtheexaminationheldattheendofthesaidcourseoftraining:

(ii)Mustpossessat leastonecertificate in section1-A,or1-B,or1-Cof theRegisterofNursesunder theTamilNaduNursesandMidwivesAct,1926(TamilNaduActIIIof1926)and

(iii)Mustpossess training fornot less thanoneyear inPublicHealthNursingInstitutionrecognizedbytheGovernmentandacertificateofhavingpassedtheexaminationheldattheendofthesaidcourseoftraining.

EXPLANATION:- (1) “A recognized Hospital” shall mean a hospital recognized by the IndiaMedicalCouncil.

(2)“recognizedsecondaryschool”shallmeanasecondaryschoolmaintainedbyoropenedwiththesanctionoftheGovernmentofTamilNaduandforwhichrecognitionhasbeenaccordedundertheTamilNaduEducationalRules.

7.Training:- In respect of persons appointed to categories 1 and 2 of Class 1without diploma inMaternityandChildHealth,theymayberequiredtoundergotheabovetrainingwithinaperiodof3yearsfromthedateofappointment.Theperiodofsuchtrainingshallbetreatedasduty.Ifaprobationerfailstoacquire the prescribed qualification, she shall not be deemed to have completed the probationsatisfactorilyandshallnotbeentitledtoappointmentasfullmemberortofurtherincrementsinthetimescaleofpayapplicableuntilandunlessshehaspassedtheprescribedexamination.Butsuchineligibilityfor increments shall not operate to postpone future increments after she has passed the prescribed

examination.Ifaprobationerdoesnotpasstheprescribedexaminationwithintheperiodof3yearsfromthe date of her appointment, she shall be discharged from the service. She shall not engage in privatepractice.

8.Probation:-Everypersonappointedtoaclassorcategory(exceptClassIIandpersonappointedbyrecruitmentby transfer toCategory–1ofClass IV shall from thedateonwhich the jointsdutybeonprobationforatotalperiodoftwoyearsondutywithinacontinuousperiodofthreeyears:

9.ReservationofAppointment:-TheruleofreservationsinGeneralrule22oftheGeneralRulesfortheTamilNaduStateandSubordinateServicesshallapplytoappointmentbydirectrecruitment.

10.Applicability ofGeneralRules:- TheGeneral rules for theTamilNaduMunicipal ServiceshallapplytothePublicHealthStaffundertheMunicipalitiesgovernedbytheseRegulations.

THETAMILNADUMUNICIPAL(NONCENTRALISEDREGULAR)PUBLICHEALTHESTABLISHMENT

REGULATIONS,1976.

1.ShortTitleAndCommencement:-

a)TheseregulationsmaybecalledtheTamilNaduMunicipal(NonCentralised_Regular)PublicHealthEstablishmentregulations,1976.

b)Theseregulationsshallbedeemedtohavecomeintoforceonthe30thAugust1976.

2.Definitions:-

Intheseregulations,unlessthereisanythingrepugnantinthesubjectorcontext.

(1)AppointedtotheEstablishment

Apersonissaidtobe“appointedtotheestablishment”inaccordancewiththeseregulationsorinaccordancewiththeregulationsapplicableatthetime,asthecasemaybe,ifhedischargesforthefirsttimethedutiesofapostborneontheestablishmentorcommencestheprobation.

(2)ApprovedCandidate

“Approved Candidate” means a candidate whose name appears in the authoritative list ofcandidatesselectedforappointmenttoanycategory.

(3)ApprovedProbationer

“Approved Probationer” in a categorymeans amember of that categorywho has satisfactorilycompletedhisprobationandawaitsappointmentasafullmemberofsuchcategory.

(4)BackwardClasses:

“Backward Classes”means the Communitiesmentioned in Schedule I of Part I of the GeneralRulesfortheTamilNaduStateandSubordinateServices.

(5)DischargeofMemberofEstablishment:-

“Discharge of Member of Establishment” means member of establishment dispensing with hisservicesforwanttovacancy.

(6)Duty:-

Apersonissaidtobeondutyasamemberoftheestablishment:-

a)Whenhe isaperforming thedutiesofapostborneon theestablishmentor isundergoing theprobation.

b)whenheisonjoiningtime,or

c)Whenheisabsentfromdutyduringauthorisedholidaysoroncasualleavetakeninaccordancewith the instructions regulating such leave issued by the State Government, having been on dutyimmediatelybeforeandimmediatelyaftersuchabsence.

(7)ExecutiveAuthority:

“ExecutiveAuthority”meanstheMunicipalCommissionerandshallincludeaSpecialOfficeroftheMunicipalitywherethereisnoMunicipalCouncil.

(8)FullMember

“FullMember”meansamemberwhohasbeenappointedsubstantivelytoapermanentpostbomeontheestablishment.

(9)MemberoftheEstablishment:-

“MemberoftheEstablishment”meansapersonwhohasbeenappointedandwhohasnotretiredorresigned,beenremovedordismissed,orbeendischargedotherwisethanforwantofvacancy.Hemaybeaprobationer,anapprovedprobationer,orafullmemberoftheservice.

(10)MilitaryDuty:-

“Military”Dutymeans

i)dutyofanykind(includingacourseoftraining)involvingsubjectiontoNaval,MilitaryorAirForceLaw,or

ii)duty(includingacourseoftraining)withaliabilitytoserveoverseasorinanyoperationalareainNaval,MilitaryorAirForceUnityorformationorunderMilitaryMunitionsorstoresauthoritiesorinfactories,or

iii)Wholetimedutyin-

a) the civil pioneerForce, theChennaiCivilLabourUnits, or theChennaiLabourUnits forCeylon;or

b) theAirRaid precaution, or any other civil defence organisation specified by theCentralGovernment;or

c)anypostcreatedfor theefficientprosecutionof thewarof1939-1946,orassociatedwiththetrainingofwartechnicians,ifdutyinsuchpostisdeclaredbytheCentralGovernmenttobemilitaryduty.

Explanation:

NodutyshallbetreatedasMilitarydutyunlesseitherofthefollowingconditionsissatisfied,namely

i)Itmusthavebeenrenderedwiththeperiodcommencingonthe3rdSeptember1939andending

withthe21stNovember1948,providedthat,ifitcommencedonorafterthe2ndApril1946,itshallnotbereckonedasMilitaryduty:or

ii)itmusthavecommencedonanydateonorafterthe26thOctober1962.

(11)Municipality:-

“Municipality” shall mean and include every Municipality constituted under the Tamil NaduDistrictMunicipalitiesAct1920(TamilNaduActVof1920)

(12)Probationer:

“Probationer” in theestablishmentmeansamemberof theestablishmentwhohasnotcompletedhisprobation.

(13)Promotion:-

“Promotion”meanstheappointmentofamemberofanycategoryoftheestablishmenttoahighercategoryoftheestablishment.

(14)RecruitedDirect:-

ApersonissaidtoberecruiteddirectheisnotalreadyamemberoftheMunicipalEstablishment.

(15)Reversion:-

“Reversion”shallmeanthereversionofamemberofacategoryoftheestablishmenttoalowercategoryforwantofvacancy.

(16)ScheduledCastes:-

“ScheduledCastes”meanstheCommunitiesmentionedandincludedfromtimetotimeinpartAofScheduleIIofPart1oftheGeneralRulesoftheTamilNaduStateandSubordinateServices.

Explanation:-

Nopersonwhoprofessesa religiondifferent fromHinduismshallbedeemed tobeamemberofascheduledcaste.

(17)ScheduledTribes:-

“ScheduledTribes”meansthecommunitiesmentionedandsuchothercommunitiesincludedfromtimetotimeinpartBofScheduleIIofpartIoftheGeneralRulesofTamilNaduStateandSubordinateServices.

(18)WarService:-

“WarService”means:-

a)ServiceofanykindinauditofformationliableforserviceoverseasorinanyoperationalareaorintheIndianNationalArmy(INA)

b)ServiceinIndiaunderMilitary,Munitionsorstoresauthoritiesorinfactorieswithaliabilitytoserveoverseasorinanyoperationalarea.

c)allotherserviceinvolvingsubjectiontoNaval,MilitaryorAirForceLaw:

d)aperiodoftrainingwithaMilitaryunitorformationinvolvingliabilitytoserveoverseasorinanyoperationalareas.

e) Valuable service rendered to the fighting forces in other ways, for example, by Way ofrecruiting.

f)ServiceinAirraidprecautionoranyothercivildefenceorganisationspecifiedinthisbehalfbytheCentralorStateGovernment:

and

I. any service connected with the prosecution of the war which a person was required toundertakebeacompetentauthorityundertheprovisionofanylawforthetimebeinginforce.

II.Serviceinanyofthefollowing:

i)Nationalwarfrontorganisation

ii)Camoflaugeorganisation

iii)Special–organisation for the production of war technicians, if duty in such post isdeclaredbytheCentralGovernmenttobe“militaryduty”

iv)Anypostassociatedwithtrainingofwartechnicians,ifdutyinsuchpostisdeclaredbytheCentralGovernmenttobemilitaryduty.

v)PostofSpecialconstableoncoastalpatrolduty.

vi)SurveyofIndia,iftheservicewastemporaryandinvolvedliabilityforserviceoverseas.

Theestablishmentshallconsistofthefollowingcategories:

burialandburninggroudwatchman,andallotherSanitaryWorkersincludingthoseemployedforAnti-Malaria,Anti-Filaria,guineawormandcompostschemes).

(2)PayandAllowances:

The posts shall carry the scales of Pay, Special pay and allowances asmay be prescribed byGovernmentfromtimetotime.

4.APPOINTMENT:

Appointment to the categories specified in column (1) of the table below shall be made by themethodsspecifiedinthecorrespondingentryincolumn(2)thereof:

EXPLANATION:-

Promotion to thepostsofdriver (lorryormotoror tractor),SanitarySupervisorandPublicHealthPeonshallbemadeinaccordancewithseniority,unlessthepromotionofamemberhasbeenwithheldasapenalty.

5.ReservationofAppointment:-

Theruleofreservationofappointmentsinrule22oftheGeneralrulesfortheTamilNaduStateandSubordinate Service shall apply to appointment by direct recruitment for the posts classified underregulation10assuperiorservice.

6.AppointmentofWomen

Womenaloneshallbeappointedtothepostsintheinstitutionspeciallyprovidedforthem.

7.ListofApprovedCandidates:-

Allfirstappointmentstotheestablishmentsshallbemadebytheappointingauthorityfromthelistofapproved candidates. Such list shall be prepared by the appointing authority in accordance with theprovisions made in the regulations. Where the candidates in such list are arranged in their order ofpreference,appointmentsshallbemadeinsuchorder.

8.AppointingAuthority:-

(1)SubjecttotheprovisionsofClause-(a)ofSub-Section(1)ofSection13oftheTamilNaduPublicHealthAct,1939(TamilNaduActIIIof1939)andtherulesmadethereunder,appointmenttothepostsshallbemadebytheExecutiveAuthorityoftheMunicipality.

(2)AnappealshalllietotheDirectorofMunicipalAdministration,ChennaiagainstallordersoftheExecutiveAuthorityinrespectofappointments.

(3)“TheGovernmentmayfromtimetotimeissueanyorder,clarificationorguidelineforselectionofcandidatesbytheAppointmentCommittee.Insuchcases,theAppointmentCommitteeshallfollowsuchorders,clarificationorguidelinesissuedbytheGovernment.

9.(a)QualificationsastoAge:-

No person shall be appointed to the posts specified in column (1) of the table below, if he hascompletedorwillcompleteonthefirstdayofJulyoftheyearinwhichtheselectionforappointmentismade,theyearofagespecifiedinthecorrespondingentryincolumn(2)thereof.

Providedthattheagelimitspecifiedincolumn(2)shallnotapplytotheappointmentbytransferorpromotionofapersonintheestablishmentoftheLocalAuthorityorofanyotherlocalauthority.

ProvidedfurtherthatapersontobeappointedtothepostofAyah(MaternityandChildHealth)andsanitaryworkershouldhavecompleted30and18yearsofagerespectivelyonthefirstdayofJulyoftheyearinwhichtheSelectionforappointmentismade.

Provided that in the case of Scheduled castes and Scheduled Tribes the maximum age limit forappointmentinthePublicHealthEstablishmentoflocalbodyinrespectofpostsmentionedinitems3,4,61014and16ofthetableis31years:ProvidedalsothatpersonswhoaredemobilizedfromtheArmy.NavyofAirForceandwhohavenotcompleted45yearsofageincaseofsuchdemolishedpersonsnotbelongingtoScheduledCastes,ScheduledTribesorbackwardclasses,and50yearsofageinthecaseofdemobilisedpersonsofScheduledCastesScheduledTribesandbackwardclassesshallbeeligibleforappointment.

10.ClassificationofService:-

(a)ServiceinthepostsshallbetreatedassuperiororinferiorinaccordancewiththedefinitionsofsuperiorandinferiorservicegivenintheFundamentalRulesapplicabletoGovernmentServants,unlessotherwisedirectedbytheGovernmentinaparticularcaseorcases.

(b)ServiceinthepostofBlacksmithandCarpentershallbetreatedassuperiorservicewitheffectfrom11-5-53forthepurposeofcontributiontotheProvidentFundandforleaverules.

11.Probation

1)Everypersonappointedtoapostinsuperiorserviceshall,fromthedateonwhichhejoinsduty,beonprobationforatotalperiodof2yearsofdutywithinacontinuousperiodof3years.

2)Everypersonappointedtoapostininferiorserviceshallfromthedateonwhichhejoinsduty,beonaprobationforaperiodofoneyearofdutywithinacontinuousperiodof3years.

12.DateofcommencementofProbationofpersonsAppointedorPromotedTemporarily

If apersonwho is appointedorpromoted temporarilyunderRegulation25of theseRegulations issubsequently appointed thereto in accordancewith these regulations, it shall beopen to the appointingauthoritytoallowsuchpersontocommencehisprobationfromthedateofsuchappointmentorpromotionor from an earlier date, such date not being earlier to the date of his first Temporary appointment orpromotionunderregulation25,astheappointingauthoritymayinhisdiscretiondecide.

13.DutyinHigherPosttocountforProbationinLowerposts:-

Aprobationerinanycategoryshallbeeligibletocounttowardshisprobationhisdutyperformedonregularappointmenttoahighercategoryoftheestablishment,ifany.

Nothingcontainedinthisregulationshallbeconstruedasauthorisingthepromotionofaprobationerincontraventionoftheseregulations.

14.DutyonTemporaryPromotionToCountForProbationinLowerPosts:-

AProbationerinanycategoryoftheestablishmentwhoispromotedtemporarilyundertheprovisionsofregulation25oftheseregulationstoahighercategoryshallbeentitledtocounttowardshisprobation,ifany,inthelowercategory,theperiodofdutyperformedbyhiminthehighercategoryduringwhichhewouldhaveheldthepostinthelowercategorybutforhistemporaryappointment.

MilitaryDutyCountsforProbation:-

Probationerinanypostwhohasbeenormaybedeputedformilitarydutyshallbeentitledtocounttowardstheperiodofprobationinsuchposttheperiodspentonmilitaryduty.

15.CompletionofProbationandDrawalofArrearsofIncrements:

AssoonasaprobationerinanycategoryoftheestablishmenthascompletedhisperiodofprobationprescribedintheRegulations,ortheextendedperiodofprobationreferredtoinregulation16,asthecasemaybe,theappointingauthorityshallconsiderhissuitabilityforfullmembershiptothecategory.Iftheappointingauthorityissatisfiedthattheprobationerissuitableforfullmembership,heshallpassanorderdeclaringhimtobeanapprovedprobationer.

Any delay in passing orders of completion of probation shall not monetarily affect the approvedprobationer, andarrearsof increments shall be allowed from thedateof completionofprobationas amatterofcoursesubjecttothefollowingconditions,namely:

(1)thattheprobationwouldhavebeendeclaredtohavebeensatisfactorilycompletedfromthedateorderedevenifthequestionofdeclarationofprobationhadbeentakenupearlier.

(2)thatthedeclarationofsatisfactorycompletionofprobationwasdelayedbyfactorswhichwouldnotinanycasechangethedateofsuchcompletion.

(3)Thatthepersonwhoseprobationisdeclaredtohavebeensatisfactorilycompletedwasqualified

asonthedateordered.

(4)Thatthedeclarationofsatisfactorycompletionofprobationwasnottheresultofanyrelaxationoftheregulations.

Inallthecasescomingunderitems(1)to(4)above,ordersissueddeclaringtheprobationorrelaxingtheregulationsshallincludeaspecificprovisioninregardtodrawalofarrearsofincrements.

16.ExtensionofProbation:

Iftheappointingauthorityisoftheopinionthattheprobationershouldcontinuetobeonprobationinordertoenablehimtodecideuponhissuitabilityforfullmembership,theappointingauthoritymayextendhisperiodofprobationforaperiodnotexceedingoneyear.

17.TerminationofProbation:

If,onthecompletionoftheperiodofprobationortheextendedperiodofprobation,asthecasemaybeiftheappointingauthorityissatisfiedthattheprobationerisnotsuitableforfullmembership,heshallpassanorderterminatinghisprobationaftergivingtheprobationerareasonableopportunityofshowingcauseagainsttheproposedterminationofprobation.

18.AutomaticCompletionofProbation:

Aprobationerinanycategoryoftheestablishmentshallbedeemedtohavecompletedhisprobationautomatically unless,within a periodof 6months calculated from thedate onwhichhe completed theperiodofprobation,ortheextendedperiodofprobation,asthecasemaybe:

(i)acommunicationaskinghimtoshowcausewhyhisprobationshouldnotbeterminatedisservedonhim,or

(ii)disciplinaryproceedingsareinitiatedagainsthimforcorruptionorotherseriousmisconductandheisspecificallyinformedinwritingthat thequestionofconsideringthesuitabilityoffullmembershipwillbetakenuponlyafterthecompletionofthedisciplinaryproceedings.

19.AppealAgainstTerminationofProbation:

A probationer whose probation has been terminated shall be entitled to appeal to the Director ofMunicipalAdministration.Suchappealshallbepreferredwithinaperiodof2monthsfromthedateonwhichtheorderofterminationofprobationiscommunicatedtohim:

Provided that the appellete authoritymay, in his discretion, extend the aforesaid period beyond 2months.

20.RightofProbationersandApprovedProbationerstoReappointment:

A vacancy in any category shall not be filled by the appointment of a person who has not yetcommenced his probation in such category, when an approved probationer or probationer therein isavailableforsuchappointment.

21.DischargeorReversionandReappointmentofProbationersandApprovedProbationers:

Probationersandapprovedprobationersshallberevertedordischargedforwantofvacancyin thefollowingorder:

First–Theprobationersintheordersofjuniority.

Second–Theapprovedprobationersintheorderofjuniority.

22.AppointmentoffullMembers:

The senior-most approved probationer in a category of the establishment shall, at the earliestopportunity, be appointed as full member in a substantive vacancy existing in such category. If thesubstantivevacancyexistsfromadatepriortothedateofcompletionofprobation,heshallbeappointedretrospectivelyasafullmemberfromsuchdate,providedthatnopersonshallbeappointedfromadatewhichisearliertothedateonwhichhecommencedprobation:

Providedthatwhereapersonwhoisonprobationorwhohascompletedhisperiodofprobationinapostisdeputedformilitaryduty,heshallbeconfirmedattheearliestopportunityassoonasasubstantivevacancyarisesinthepostwhileheisonmilitarydutyorafterhisreturnfromsuchduty,inpreferencetoallpersonswhosedateoffirstappointmentinthatpostotherthantheappointmentreferredtoinregulation25 is later than his, subject in the case of person on probation to the condition that he shall, after thecompletionofhismilitaryduty,undergoandsatisfactorilycompletesuchportion,ifany,oftheprescribedperiodofprobationasremainsaftercountingtheperiodofmilitaryduty.

23.MembersAbsentFromDuty:

Theabsenceofamemberoftheestablishmentfromdutywhetheronleaveandwhetherhislieninapostborneonthecategoryoftheestablishmentissuspendedornotshallnot,ifheisotherwisefit,renderhimineligibleinhisturn.

(a) for reappointment to substantive or officiating vacancy in the post in which he may be aprobationeroranapprovedprobationer:

(b)forpromotionfromlowertoahighercategoryintheestablishment,asthecasemaybe,inthesamemannerasifhehadnotbeenabsent.Heshallbeentitledtoalltheprivelagesinrespectofappointment,seniority,probationandappointmentasfullmemberwhichhewouldhaveenjoyedbutforhisabsence,subjecttohiscompletingsatisfactorilytheperiodofprobationonhisreturn.

24.Seniority:

Theseniorityofapersonappointedtoanycategoryshallbedeterminedwithreferencetohisrankinthelistofapprovedcandidates.

Providedthattheseniorityofapersonwhowasalreadyamemberoftheestablishmentonthedateofissueof these regulations shallbedeterminedwith reference to thedateofhis first appointment to theestablishment.

25.TemporaryAppointmentorPromotion:

(1)If,owingtoanemergencyorforadministrativereasons,it isnecessarytoappointorpromoteapersonotherwisethaninaccordancewiththeseregulations,theappointingauthoritymay,forreasonstobeclearlyrecordedinwriting,appointorpromotetemporarilyapersonwhomheconsiderssuitable;butthe person so appointed or promoted shall not be regarded as probationer in the post towhich he isappointedorpromoted,orbeenentitledtofutureappointment,andshallbereplacedassoonaspossiblebyacandidatequalifiedtoholdapostundertheseregulations.

Providedthattheappointmentmadeunderthisclauseshallnotexceedaperiodofoneyearatatime:

ProvidedfurtherthatthepriorapprovaloftheDirectorofMunicipalAdministrationshallbeobtainedwhentheperiodofappointmentexceedsoneyearforwhichpurposetheappointingauthorityconcernedshall promptly intimate the fact to theDirector ofMunicipalAdministration as soon as an unqualifiedcandidateisappointedtoapost.

(2)Where it is necessary to appoint amember of the establishment againstwhom an enquiry intoallegationofcorruptionormisconductispending,theappointingauthoritymayappointhimtemporarilypendingenquiryintothechargesagainsthim.Thepersonsoappointedorpromotedtemporarilyshallnotberegardedasprobationerinthatcategory,andheshallbepaidhissubstantivepayortheminimuminthetimescaleofpayapplicabletothepost,whicheverishigher.

26.GrantofLeave:

TheExecutiveAuthorityshallbetheauthoritycompetenttograntleave.

27.Retirement:

No member of the establishment other than a person belonging to the inferior services shall beretainedinserviceafterhehasattainedtheageof58years.Amemberbelongingtotheinferiorserviceshallnotberetainedinserviceafterhehasattainedtheageof60years.

28.Re-EmploymentofPensioners:

Notwithstanding anything to the contrary in these regulations, the State Government shall have thepowertore-employanypersonwhohasretiredfromtheservice.There-employmentofsuchpersonshallnot be regarded as a first appointment to the establishment, nor shall it confer on him the status of amemberoftheestablishment.

29.MaintenanceofServiceBook:

(a) A service book shall be maintained in such form and manner as may be laid down by theGovernmentforeverymemberoftheestablishmentwhoisentitledtosubscribetotheGeneralProvidedFund,maintainedbytheMunicipality.

(b) The appointing authority shall be responsible for the correct and upto-datemaintenance of theService book, andhe shall record an annual certificate of verification in the service book as early aspossibleafterthecloseoftheyear.

30.AlterationoftheDateofBirth:

(1)ThedateofbirthofthememberoftheestablishmentalreadyenteredintheServiceBookshallnotbe altered except with the previous sanction or under the direction of the Director of MunicipalAdministration.

(2)Anapplicationforalterationofdateofbirthshallbeentertainedifitismadewithin5yearsafterthememberhas entered the service.Anyapplication receivedafter5years entry into service shall besummarilyrejected.

(3) An application received for the alteration of date of birth shall be forwarded to the RevenuedepartmentfornecessaryenquiryandreportbyanofficeroftheRevenuedepartmentnotbelowtherankofDeputyCollectorof theDistrict.On receiptof the report, theDirectorofMunicipalAdministrationshalldecidewhetherthealterationofdateofbirthmaybepermittedortheapplicationmayberejected.TheordersoftheDirectorofMunicipalAdministrationshallbefinal.

(4)Theprocedurelaiddowninclause(3)shallbefollowedinallcaseswherealterationofdateofbirthisproposedsuomotobytheappointingauthorityonthebasisofmedicalopinionintheabsenceofanyotherauthoritativerecords.

31.AppointmentinPlaceofMembersDismissed,Removed,CompulsorilyRetiredorReduced

Where a personhas beendismissed, removed, compulsorily, retiredor substantively reduced fromany category, no vacancy caused thereby arising substantively in such category shall be substantivelyfilled to the prejudice of such person until the expiry of a period of one year from the date of suchdismissal, removal, compulsory retirement or reduction or until the appeal, if any preferred by himagainstsuchdismissal,removal,compulsoryretirementorreductionisdecided,whicheverislater.

32.ConsequencesofResignation:

Amemberoftheestablishmentshall,ifheresignshisappointment,forfeitsallhispreviousservice.The re-appointment of such persons shall be treated in the same way as first appointment to theestablishmentbydirect recruitment and the regulationsgoverning suchappointment shall apply, andonsuchreappointment,heshallnotbeentitledtocountanyportionofhispreviousserviceforanybenefitorconcessionadmissibleunderanyruleororderorregulation.

33.ApplicationofRulesApplicabletoGovernmentServants:

(a)Inmattersinrespectofwhichnoprovisionhasbeenmadeintheseregulations,everymemberoftheserviceshallbegovernedbytheprovisionsoftherulesapplicabletogovernmentservantsofsimilarstatusandstanding.

(b)IfdoubtordifficultyarisesintheapplicationoftheseregulationstothemembersofthePublic-Healthestablishment,thenthemattermaybereferredtoGovernment,andthedecisionoftheGovernmentshallbefinal.

34.PowertoRelaxRegulations:

Notwithstanding anything contained in these regulations, theStateGovernment shall havepower todealwiththecaseofanypersonwhohasservedintheMunicipalEstablishmentoranycandidateorclassofcandidatesforappointmenttotheMunicipalEstablishmentinsuchmannerasmayappeartothemtobejustandequitable.

Providedthatwhereanysuchregulationisapplicableinthecaseofanypersonorclassorpersons,thecaseshallnotbedealtwithinanymannerlessfavourabletohimorthemthanthatprovidedbythatregulation.
